A I y-law to Set Fees for the Services performed by the Municip lity

WHEREAS the Corporation of the Town of South Bruce Peninsula wishes to enact a consolidated fee by-law in order to make standard fees regular, consistent and

administratively easier;

AN, W EREAS Section 391.1 of the Municipal Act, 2001 states that a municipality may pass by-laws imposing fees or charges on any class of persons for services or activities provided or done by or on behalf of it; for costs payable by it for services or activities provided or done by or on behalf of any other municipality or local board; and for the use of its property including property under its control.

F S UTH BRUCE 'ENINSULA ENACTS AS FOLLOWS:

1. THAT all fees outlined in Schedule "A" to this by-law are hereby in force and effect as of January e t, 2005 or such other date specified by any amending by-law.

2. It is intended that all provisions of this by-law shall be binding and effective. In the event that any particular provision or provisions or part of a provision is found to be void, violable or unenforceable for any reason whatever, then the particular provision or provisions or part of the provision shall be deemed severed from the remainder of this by-law and all other provisions shall remain in full force. 3. That this by-law supersedes any by-law or fee in any other by-law not consistent

with this by-law.

4. That non payment of the bi-monthly billing on the due date specified therein shall result in a penalty of 2 percent being added and thereafter a penalty of 2 percent will be added on the last day of each and every month the default continues. 5. This by-law shall be known as the "Category 3 Fee By-law, 2005".

6. This by-law shall come into full force and effect on January 1, 2005.

2. Alterations and repairs to existing residential

buildings; new accessory buildings $7.00 per $1,000 of estimated cost of construction plus an admin fee of S25.00

3. All other buildings(including industrial,

Change of Use Permits: Even though no construction is proposed, no person shall

change the use of a building or part of a building which would result in an increase in hazard as determined under the Building Code unless a permit has been issued by the Chief Building Official.

Partial Occupancy and Conditional Permits: Where approval has been received for the issuance of a Partial Occupancy or Conditional Permit, the fees shall be based on the type of construction and use as described above, and application shall be made and fees paid for the complete project.
