MIGA’s Business Medical Indemnity (BMI) insurance is for organisations that provide health care treatment, advice and services. BMI provides insurance protection for claims that may be made against the company.

Examples of organisations that may need BMI are medical practices or clinics, health care centres, radiology practices, pathology practices, locum services and day hospitals/surgeries. This list is not exhaustive – if your organisation is in the health care sector you may need BMI insurance!!!

MIGA can insure both the company and the doctors who work for it under an attractive group arrangement with a range of benefits and services. There are significant advantages in each having their insurance with the one insurer. Key benefits are that it minimises the risk of claims not being covered and you may save on premiums.

What is Business Medical Indemnity

(BMI) Insurance?

If you answer “yes” to any or all of the following – you may be taking a significant risk in providing health care services without BMI insurance.

Have you established a company for the purpose of providing health care advice, service or treatment?

Does the company employ or contract health care professionals, including doctors, other professional staff and support staff? Are your professional staff, including doctors insured by different insurers? Do you know the scope of their cover?

Does the company provide health care services via separate companies and/or locations?

Does the company employ administrative staff to support the doctors and other professionals in the practice?

Does the company engage locums and other temporary staff to work for it?

Does the company provide services to doctors and other health care professionals for a fee?

Does the company lease its facilities to other health care professionals?

Does the company own or lease machinery and/or medical equipment to provide the services (e.g. diagnostic equipment)? How do you know if you need

BMI Insurance?

The types of organisations that will need their own insurance include: – Corporate entities providing health care treatment, advice or

service that employ and/or contract a range of health care professionals in providing services

– Companies owned by doctors that employ staff (including doctors and allied health care professionals) and which provide a broad range of services (particularly those that provide services beyond each doctor’s area of medical practice)

– Companies that employ or are owned by a number of doctors who are insured with different insurers.

Complex business structures through which health care services are delivered are increasingly common and can often give rise to unexpected liabilities that are not always covered by individual medical indemnity insurance policies arranged by doctors.

Unfortunately, this can result in unintended gaps in medical indemnity insurance that are easily covered by BMI insurance.

What does BMI cover?

BMI provides cover for legal liability arising out of acts, errors or omissions relating to the provision of health care treatment, advice or service in the course of business. It includes cover for:

– Claims for compensation and the costs incurred in defending or investigating claims

– Expenses incurred in defending a prosecution or responding to inquests, inquiries, investigations or complaints arising from the provision of the health care services.

BMI insurance covers the liability of the company or practice entity, its subsidiaries and their employees including health care professionals such as nurses, technicians and the like (other than employed doctors*). Cover is also provided for vicarious liability for the acts of employees, including employed doctors and contractors, consultants and agents.

*An optional extension is available to cover employed doctors directly under the BMI insurance or alternatively doctors can maintain their own insurance and BMI will cover the company or practice over and above the individual doctors’ policies.

If the company employs doctors and they wish to maintain their own individual medical indemnity insurance cover, MIGA can offer a tailored group insurance arrangement for them that dovetails with the BMI insurance. The advantage of this is that each doctor can maintain their own insurance but they have access to more benefits, competitive premiums and broader cover via a group arrangement.

MIGA’s BMI insurance policy and our cover for individual doctors are complementary products; we can offer you either one or both.
