Invest Atlanta is soliciting responses to this Request for Qualifications (“RFQ”) for interested and qualified firms or individuals wishing to provide services for the rehabilitation of owner occupied homes in Vine City/English Avenue within the Westside TAD Neighborhoods and Vine City Trust Fund Target Area (Exhibit A).

BACKGROUND

Invest Atlanta was created by the virtue of the Development Authorities Law, activated by a resolution of the Council of the City and currently operates as a public body corporate, politically and instrumentality of the State of Georgia. Invest Atlanta was established to promote the revitalization and growth of the city and serves as the City’s redevelopment agency pursuant to the Redevelopment Powers Law for the purpose of implementing redevelopment initiatives within the City’s ten tax allocation districts

In 1989 the City of Atlanta, Fulton County, and the Georgia World Congress Center Authority established the Vine City Trust Fund. The fund was created to increase the supply of owner occupied housing, develop vacant lots, improve existing owner occupied structures, and encourage the conversion of single family rental properties into homeownership. Single family programs such as non-profit corporation bonds were issued to allow non-profits to construct as well as acquire land to help the Vine City neighborhood. Also a portion of the money was designated for mortgage loans, qualified rehab loans, and home improvement loans to help owner occupied housing.

In addition to single family housing, The Vine City Trust Fund was also created to aid in multi-family new construction and rehabilitation loans. The trust fund will offer capital for credit enhancement and provide financing for new construction of multi-family rental properties in the Vine City/English Avenue neighborhoods. The renovation of smaller multi-family rental properties will also benefit by being given below market rate loans. At least 20% of the tenants in all of these multi-family rental properties have to be low income families, in order for developers to receive the funds.

In 1998 the City of Atlanta, Fulton County, and the Atlanta School Board passed resolutions creating the Westside Tax Allocation District, establishing Invest Atlanta as the City’s Redevelopment Agent and, in the case of the County and School Board, consenting to the inclusion of their respective portions of all ad valorem tax increments created within the Westside TAD and the application of those tax increments to pay certain qualified redevelopment costs. As Redevelopment Agent, Invest Atlanta is responsible for promoting positive development within the Westside TAD and administering the TAD financing process.

The Westside TAD was created to capitalize on the 1996 Olympic legacy, Centennial Olympic Park, and facilitate the redevelopment of the long neglected western portion of downtown and the historic neighborhoods of Vine City and English Avenue. Objectives of the Westside TAD Redevelopment Plan include: capitalize on the opportunity to revitalize land surrounding Centennial Olympic Park; foster the development of connections between the Central Business District, Clark Atlanta University Center, the Georgia Tech Campus, and adjoining neighborhoods; develop infill projects to eliminate development gaps; remove blighted conditions and expand

2016 www.investatlanta.com redevelopment efforts to Vine City and English Avenue as well as the fragmented commercial/warehouse districts.

More specifically, the Westside TAD seeks to foster a livelier Downtown and ameliorate poverty in surrounding neighborhoods through two primary objectives.

 Nurturing a vibrant and connected Downtown by:

 Enhancing Downtown tourism and building an entertainment core  Retaining and creating jobs

 Supporting a vibrant office and retail core, including neighborhood retail for residents  Supporting new housing for a mix of incomes

 Linking assets via transport / pedestrian improvements  Reducing socio-economic distress in surrounding neighborhoods by:

 Providing community amenities for low-income residents  Reducing the high crime and poverty rates

 Reducing the high housing vacancy rate and redeveloping dilapidated housing stock In an effort to stimulate new economic activity in the English Avenue and Vine City neighborhoods specifically, Invest Atlanta worked with the community to establish an implementation plan for short, medium, and long-term actions. The Westside TAD Neighborhood Strategic Implementation Plan seeks to create a cohesive and sustainable community vision with a focus on building local human capital and job creation. Recommended actions are categorized into three phases: Stabilization, Predevelopment, and Execution. The plan identifies five priority areas (Martin Luther King Jr. Drive, Joseph E. Boone Boulevard, Northside Drive Entertainment District, North Avenue & Northside Drive, James P. Brawley Drive) in the neighborhoods to focus investments and establishes a decision-making tool for the evaluation of future projects in the community. Criteria included in the decision-making matrix includes:

 Possession of site control

 Utilization of vacant land

 Attraction of private investment

 Adequate zoning and entitlements

 Proximity to existing homeowners

 Condition of existing infrastructure

 Proximity to services, food, education, transit, open space and previous investments

 Job creation (construction and permanent)

 Attraction of innovation and growth services

 Utilization of intergovernmental partnerships

 Support of sustainability efforts (water management, urban gardening, parks and open space)

In 2013, pursuant to the resolution passed by Atlanta City Council in support of the construction of a new Atlanta Falcons Stadium at the northwest corner of Northside Drive and Martin Luther King, Jr. Boulevard, the City of Atlanta and Invest Atlanta engaged the community to develop a plan to guide future community funding efforts and ensure the surrounding neighborhoods of Vine City, English Avenue, and Castleberry Hill will benefit from the new stadium project. Resolution 13-R-1383 was adopted on December 2, 2013 by the Atlanta City Council. Recommendations of the Community Benefits Plan address the following areas:

Invest Atlanta (“Program Administrator and Co-Sponsor”) is seeking qualified General Contractor(s) (“GC” or “GC’s”) to provide renovation and repair services to homeowners participating in the Westside Roots Initiative program. Westside Roots Initiative (“WRI”) is targeted to lower income homeowners and is comprised of two programmatic elements: 1) comprehensive housing-stability related legal services; and 2) robust home repair services. The home repair component will provide comprehensive home repair services (ranging from $5,000 to $50,000). Final tasks and services to be provided by the selected GC’s will be developed in partnership with Program Providers and/or the Program Manager and may include the following elements:

1) emergency repair assistance; 2) energy efficiency improvements; 3) mold-asbestos remediation; and

4) deferred maintenance/home beautification improvements.

REQUEST FOR QUALIFICATIONS SUBMISSION

The Request for Qualifications may be obtained Thursday, May 5, 2016 online at www.investatlanta.com.

Friday, June 3, 2016 5:00 pm EST is the deadline to be approved for inclusion on the initial list of Pre-Qualified Entities. Entities submitting by this date will receive five bonus points in scoring. Please see page 10 of this RFP to see the Scoring Criteria. Interested entities may submit a response at any time thereafter, and upon approval will be added to the list, if funds are available. Prospective applicants are strongly encouraged to attend one of the RFQ Workshops on Thursday, May 12th, 1:00pm – 4:00pm, or Thursday, May 19th, 1:00pm – 4:00pm. The workshop

RESPONSE COMPONENTS

All qualifying Responses may be submitted by one of the following methods:

B. Responses may be submitted on compact disk or flash drive in portable document format (PDF); or

Response must specifically state your interest and any other specific information or statements called for in the enclosed Request for Qualifications, organized as outlined below. All materials should be submitted in Times New Roman, 11-point font.

1. Cover Letter (Not to exceed one page)

Please provide a description of client/community disputes or complaints that in the last three years you have faced and your efforts to address them.

A disclosure statement listing all potential conflicts of interest related to this project. This disclosure statement must be addressed specifically in your response, even if no conflict exists.

g.

An overview of the firm’s relationships with women owned business enterprises, minority business enterprises or small business enterprises. Please indicate if any proposing firm or joint venture partner is certified under any of these categories by the City of Atlanta.

The identified timeline for this project is expected to be 1 to 3 years with potential to extend beyond this timeframe for additional identified tasks to be determined following the completion of the project scope of work.

TERMS AND CONDITIONS

All responses and supporting materials as well as correspondence relating to this RFQ become property of Invest Atlanta when received. Any proprietary information contained in the response should be so indicated. However, a general indication that the entire contents, or a major portion, of the response is proprietary will not be honored.

A. All applicable Federal and State of Georgia laws, City and Fulton County ordinances, licenses and regulations of all agencies having jurisdiction shall apply to the Respondents throughout and incorporated herein.

B. Professionals requiring special licenses must be licensed in the State of Georgia, and shall be responsible for those portions of the work as may be required by law.

C. No response shall be accepted from, and no contract will be awarded to, any person, firm, or corporation that (i) is in arrears to Invest Atlanta or the City with respect to any debt, (ii) is in default with respect to any obligation to Invest Atlanta or the City, or (iii) is deemed irresponsible or unreliable by Invest Atlanta. If requested, the respondents shall be required to submit satisfactory evidence that they have the necessary financial resources to provide the proposed services.

D. Respondents shall provide the information and affidavits required for compliance with the requirements of E-Verify and SAVE (See Exhibit C).

i. E-Verify. Respondent must comply with the Illegal Immigration Reform and Enforcement Act, O.C.G.A. §13-10-90, et seq. All services physically performed within the State of Georgia must be accompanied by proof of your registration with the E-Verify Program, as well as verification of your continuing and future participation in the E-Verify program established by the United States Department of Homeland Security. A completed E-Verify Contractor Affidavit must be submitted to Invest Atlanta. To the extent there are subcontractors working on this contract, you are responsible for obtaining a fully signed and notarized subcontractor affidavit from those firms with whom you have entered into sub-contracts. In turn, should there be second tier subcontractors on this project, you must require the subcontractors to obtain E-Verify Affidavits from those second tier subcontractors.

ii. SAVE Affidavit. In addition to E-Verify, Invest Atlanta is required by the SAVE (Systematic Alien Verification for Entitlements) Program to verify the status of anyone who applies for a public benefit from Invest Atlanta. Benefits are defined by state statute, O.C.G.A. §50 36 1, by federal statute, 8 U.S.C. §1611 and 8 U.S.C. §1621, and by the Office of the Attorney General of Georgia. Contracts with Invest Atlanta are considered “public

2016 www.investatlanta.com benefits.” Beginning on January 1, 2012, any person obtaining a public benefit must show a secure and verifiable document, and complete the attached SAVE Affidavit. Acceptable documents have been identified by the Office of the Attorney General. Those lists may be found at: http://law.ga.gov

E. Professional Services Insurance Requirements Statutory Worker’s Compensation Insurance Comprehensive General Liability Insurance

a. $2,000,000 limit of liability per occurrence for bodily injury and property damage b. Professional Liability Insurance – Professional Liability Insurance Limit $1,000,000

per Occurrence / $2,000,000 per aggregate.

 Insurance company must be authorized to do business in the State of Georgia

 Dedicated Limits per Project site or Location (CG 25 03 or CG 25 04 or some other form)

 Additional insured shall be shown as: Invest Atlanta, and the City of Atlanta

 The cancellation provision should provide 30 days’ notice of cancellation.

 Insurance Company, except Worker’s Compensation carrier, must have an A.M. Best Rating of A-6 or higher. Certain Worker’s Comp funds may be acceptable by the approval of the Risk Management Division. European markets including those based in London and domestic surplus lines markets that operate on a non-admitted basis are exempt from this requirement provided that the contractor’s broker/agent can provide financial data to establish that a market is equal to or exceeds the financial strengths associated with the A.M. Best’s rating of A-6 or better. Insurance Company must be licensed to do business by the Georgia Department of Insurance.

 Certificates of Insurance, and any subsequent renewals, must reference specific bid/contract by project name and if applicable, project/bid number.

 The GC shall agree to provide complete certified copies of current insurance policies if requested to verify the compliance with these insurance requirements.

 All insurance coverage required to be provided by the Consultant will be primary over any insurance program carried by Invest Atlanta or the City.

 GC shall incorporate a copy of the insurance requirements as herein provided in each and every subcontract with each and every Subcontractor in any tier, and shall require each and every Subcontractor of any tier to comply with all such requirements. Consultant agrees that if for any reason Subcontractor fails to procure and maintain insurance as required, all such required insurance shall be procured and maintained by Consultant at Consultant’s expense.

 No GC or Subcontractor shall commence any work of any kind under this Contract until all insurance requirements contained in this Contract have been complied with and until evidence of such compliance satisfactory to Invest Atlanta as to form and content has been filed. The Accord Certificate of Insurance or a pre-approved substitute is the required form in all cases where reference is made to a Certificate of Insurance or an approved substitute.

 The GC shall agree to waive all rights of subrogation against Invest Atlanta, the City, their officers, officials, employees, and volunteers from losses arising from work performed by the GC for Invest Atlanta.

The GC shall make available, through its records or records of their Insurer, information regarding a specific claim. Any loss run information available from the contractor or their insurer will be made available to Invest Atlanta upon their request.

EVALUATION CRITERIA AND SCORING

Submittals will be judged based on the following evaluation criteria. Each item will be scored and weighted according to the factors indicated. Each submittal must respond to the requested information for each section. The Program Manager and Program Sponsor representatives shall determine qualifications, interest and availability by reviewing all written responses received that express an interest in performing the services and when deemed necessary by conducting formal interviews of selected applicants that are determined to be best qualified.

Overall Development Approach for Program Service Area – 35 Points

The approach should indicate an understanding of what is required to implement the Westside Roots Housing Stability Program as it relates to your specific Service Area(s) or Area(s) of Expertise. It should be a clear statement identifying the Service Area(s) of interest, as well as describing how the entity can assist in implementing the required services, including the reason for wanting to undertake this effort. This should not be viewed this as an “affordable housing” program. Rather it is the housing component of a broad-based neighborhood revitalization initiative designed to leverage funding resources to impact a significant number of homeowners. The narrative should clearly illustrate and indicate the following:

 Construction area specialty, if any

 An understanding of the residential construction area challenges

 Demonstrated understanding of challenges in redeveloping urban communities and a holistic approach to neighborhood revitalization

 How collaboration with the Project Manager and other stakeholders will be achieved

 Any other aspects of the submittal that are pertinent to Westside Roots’ overall goal of neighborhood stabilization and revitalization

This section should clearly indicate the capability of the entity to perform the work. It should include a description of the entity’s makeup, roles of team members, and entity’s experience. Applicants should include a summary of experience with the daily management and/or management oversight of the construction, renovation, and repair of homes. This section should also include background materials regarding the management team, experience and track record. A minimum of three (3) years of experience is required.

Responses will be evaluated based on the individuals that will be doing the work. Include: a. Firm Overview - Skills, capabilities, and experience of the entity and key individuals who

will be involved in this effort. It is important to provide information on the specific individuals and their roles:

 The name of the entity, date the entity was established, number of employees.

 The resumes of each team member that will be working on the project (please only those that will be working on the project).

 The general responsibilities of each team member.

 Experience with projects subject to Davis-Bacon Act (provide supporting documentation, if applicable).

b. Relevant Projects – Include a description of work currently in progress and/or completed in the last three years that is relevant to this RFQ. For any project identified, provide, at a minimum, the following information:

 Name, location, year of project

 Role of the entity in the development process

 Description of project, by type, size, relevant physical attributes similar to target project

 Price range of houses and target market served Financial Capacity – 25 Points

Each entity should submit information indicating its financial capacity and ability to deliver private financing.

a. Financial Statement

b. Please provide a current financial statement of the firm prepared by a Certified Public Accountant. The statement should show assets, liabilities, and net worth of the entity and should include information on all General Partners or principal shareholders.

c. If you are responding to this RFQ as a Renovation Contractor, General Contractor, or Builder please indicate current banking relationships as well as vendors that have extended credit to your business. If you are selected, please be prepared to provide information to the Program Manager that clearly identities that your business has the ability to acquire materials and pay sub-contractors in a manner sufficient to perform the required services.

Provide a fee structure limited to the amount of overhead and profit proposed for home renovation and repair services. Fee structure should outline your minimum total fee, maximum total fee, and fee percentages charged for overhead and profit, respectively.

Bonus - 5 Points

Entities submitting responses by the initial due date of Friday, June 3, 2016 by 5:00pm will receive five bonus points in scoring.

Invest Atlanta, Program Sponsors, and/or Program Manager will review all responses in accordance with the Evaluation Criteria outlined herein and make final selections. All submissions must conform to this RFQ. Invest Atlanta reserves the right to require interviews of the Respondents if it is determined to be in the best interest of the Program.

The submission will be evaluated based on organization, completeness, and sufficiency of information requested throughout the submission. The factors for award directly correspond to the RFQ requirements and they are listed below as prioritized by point value:

GENERAL CONTRACTOR SELECTION CRITERIA

Selection of a general contractor in the Westside Roots Initiative (“WRI” or “WRI Program”) is the responsibility of the homeowner with guidance from the Program Provider and/or Program Manager or designated staff. The selection of a general contractor in the WRI Program will follow the Program Manager’s procurement process, with bidding, awards and contract execution coordinated by the Program Manager. Rehabilitation work will be undertaken only through a written tri-party contract between the contractor, Program Manager, and the homeowner receiving the assistance.

The Program Manager will obtain a minimum of three (3) bids on the planned repairs, based on the preliminary work write-up prepared by the Program Manager or it’s designee in accordance with the guidelines provided for eligible repairs and prioritization. The bids are to be returned to the designated location on the specific due date. The Program Manager will record the total amount of the bid and the date and time the bid was received. The Program Manager will evaluate the bid documents to determine which bids are eligible. Bids are considered eligible when the following conditions are met:

1) The submitting contractor currently meets all program requirements and is not barred or suspended from participating in the WRI Program.

2) The contractor is not on probation as described in the following Section C.

3) The bid is received by the Program Manager or its designated agent prior to the bid submission deadline date and time stated in the bid documents.

4) The total amount of the bids are within 15% of the total cost listed on the initial work write-up prepared by the Program manager or its designee and does not exceed the maximum dollar limits of the program.

If none of the bids solicited are within 15% of the preliminary work write-up initially or by negotiation, the bid must be rejected and other bids must be obtained that are within the specified cost limits. Any bids received outside of the estimated range of housing rehabilitation will be rejected and the bidder will be notified in writing. Contracts will not be awarded until the Program Manager or its designee has completed its contractor certification and the contractor has met the requirements.

Contractors in the WRI Program will only be able to have one contract in progress at any time until they have successfully completed at least three (3) contracts. Successful completion of three contracts removes this restriction and the contractor may have more than one rehabilitation project at any given time.

When an acceptable, eligible bid has been secured and the general contractor is selected, the contractor is notified that they must furnish the Program Administrator or the implementing agency with a current Certificate of Insurance, a completed Contractor Information Form, and a statement concerning the non-use of lead-based paint. Information with be verified for accuracy and completeness of the forms submitted by the contractor. If all submitted documents are in order and the contractor is not on the list of parties debarred or suspended from participation in federal procurement or non-procurement programs or if the contractor is not suspended or debarred from participation in the City of Atlanta HOME Owner-Occupied Rehabilitation Program or the WRI Program, the Program Manager or its designee will proceed with the preparation of contract documents.

Participating general contractors must obtain all permits that are required to perform the authorized scope of work. The contractor must comply with all the regulations governing the issuance and inspections of any work permitted. Furthermore, all general contractors and subcontractors must possess trade or other professional licenses as may be required by the State of Georgia and the City

2016 www.investatlanta.com of Atlanta in order to perform such functions that are subject to licensing. Each contract between a contractor, Program Manager, and a homeowner shall contain language denying participation to contractors who fail to perform in a satisfactory manner.

Contractors proven to provide poor service or quality of workmanship and/or who exhibit behavior that is not professional in the opinion of the Program Manager or Program Administrator will be debarred or suspended from any future contracts with the WRI Program. Contractors will be informed of this decision in writing with the opportunity to appeal to the Program Manager or his/her designee. Contractors will be required to have criminal background checks

This section sets forth requirements and procedures with respect to contractor qualifications and construction contracts for housing rehabilitation assistance.

A.

CONTRACTOR – The term “Contractor” applies to the firm bidding on work or receiving an award. The firm must hold a current Georgia General Contractor license. Contracts for Major System Repairs may be awarded to business vendors whose services are appropriate for the work begin done (i.e., roofing contractor, plumber or licensed electrician) but who may not necessarily be licensed general contractors. These vendors must have current licensure applicable to their specialty.

B.

INSURANCE – Before commencing work, the contractor shall submit to the Program Manager a current certificate of insurance as evidence of the coverage required.

The contractor shall carry or require that there be carried Workers’ Compensation Insurance for all employees and those of subcontractor engaged in work at the site in accordance with Georgia State Workers’ Compensation Laws.

2.

The contractor shall carry during the life of the contract Property Damage Insurance in the amount of not less than $100,000 to protect the contractor and subcontractor from claims for property damage which might arise from operations under their contract.

The contractor shall carry or require that there be carried General Liability Insurance. The Program Manager and Program Administrator must be named as an additional insured under the general contractor’s protective coverage. General contractors or agents participating in the VCOR Program must furnish the Program Manager, written notice of any change and/or cancellation of the required coverage no less than thirty (30) days before any such change is effective. Coverage will be verified by the Program Administrator the Program Administrator before contract execution.

C.

FORM OF CONTRACT – The contract documents to be executed by the homeowner and the general contractor will be prepared by the Program Manager or its designee after a preconstruction conference. At this preconstruction conference, the

homeowner, Program Manager, and contractor will agree to work condition, use of facilities and other construction related matters. Such documents must be fully executed prior to beginning the rehabilitation work. These contract documents shall state a specific date for commencement of the work, a specific date for completion of work, and a copy of the work write-up. An executed copy of the contract shall be furnished to the homeowner, contractor, and to the Program Manager or its designee.

EXHIBIT C

CONTRACTOR AFFIDAVIT UNDER O.C.G.A §13-10-91(b)(1)

By executing this affidavit, the undersigned Contractor verifies its compliance with

O.C.G.A. §13-10-91, et seq. (the “Act”) and Chapter 300-10-1 of the Rules of Georgia

Department of Labor (the “Rules”), stating affirmatively that the individual, firm, or

corporation which is engaged in the physical performance of services on behalf of Invest

Atlanta: (1) has registered with; (2) is authorized to use; (3) is using; and (4) will continue

to use throughout the contract period a federal work authorization program commonly

known as E-Verify, or any subsequent replacement program, in accordance with the

applicability provisions and deadlines established in the Act and the Rules.

The undersigned contractor further agrees that, should it employ or contract with

any subcontractor(s) in connection with the physical performance of services pursuant to

the contract with Invest Atlanta of which this affidavit is a part, the undersigned contractor

will secure from such subcontractor(s) similar verification of compliance with the Act and

the Rules through the subcontractor’s execution of the subcontractor affidavit provided

below.

The undersigned contractor further agrees to provide a copy of each such affidavit

to Invest Atlanta at the time the subcontractor(s) is retained to perform such services and

to maintain copies of all such affidavits for no less than five (5) years from the date

provided to Invest Atlanta and otherwise maintain records of compliance with the Act and

the Rules as required.
