RESOLVED: That upon the recommendation of Superintendent Daryl T. McLaughlin, the Board of Education hereby approves that the following SUNY Geneseo teacher certification candidate be allowed to complete his student teacher placement from August 30, 2022 to October 22, 2022 with Jim Byrnes.

McLaughlin to sign a Memorandum of Understanding with Genesee Community College (TRIO Upward Bound) for the 2022-2023 school year.

Q. Authorization - Agreement

RESOLVED: The Board of Education hereby authorizes Superintendent Daryl T.

McLaughlin, District Clerk Lisa Kowasz and Board of Education President Nathan Paddock to sign an agreement with the Rush-Henrietta Central School District to provide health and welfare services for approximately 1 child attending Norman

Howard School in the Rush-Henrietta Central School Distirct for the 2021-2022 school year.

R. Approve Overnight Stay

RESOLVED: The Board of Education hereby approves Superintendent Daryl T.

McLaughlin’s overnight stay to attend the New York State Council of School Superintendents 2022 Fall Leadership Summint September 18, 2022 through September 20, 2022.

SUBJECT: TRANSPORTATION PROGRAM

It is the intent of the Board of Education to comply with the letter and spirit of the New York State Education Law; with the regulations of the Department of Motor Vehicles and of the Department of Transportation and with the Commissioner of Education's regulations and decisions pertinent to student transportation, and these shall govern any questions not covered by specific declaration of policy herein.

The purposes of the transportation program are to transport students to and from school, to transport them for extracurricular activities, to transport them on field trips, and to transport those requiring special services.

The Board of Education recognizes and assumes the responsibility for all aspects of the transportation of children wherein the health and safety of students are involved, for the Board of Education has a legal obligation to safeguard the welfare of bus-riding children.

General Provision of Transportation to and From School for Students Attending District Schools

The District provides transportation to school from home and from school to home for District residents attending District schools within the following mileage limits listed below:

a) Grades UPK-3: distance from residence to school, 3/4th of a mile through fifteen (15) miles.

b) Grades 4-12: distance from residence to school, one (1) mile through fifteen (15) miles.

The District determines the bus routes and pick-up and drop-off points in accordance with the New York Education Law and applicable regulations of, and decisions of, the Commissioner of Education.

Those authorities do not require transportation curb to curb (directly to or from a student's home).

Special transportation services may, however, be required for certain students with disabilities depending upon their individual needs. The District is not required to provide transportation over privately maintained roads. Neither is it required to provide transportation over a public road if transportation over the road would involve an unreasonably hazardous condition.

The responsibility for administering the transportation program rests with the Business Administrator. The administration of the program will comply with all applicable laws, regulations, and policies established by federal, state, and local authorities. The Board of Education will review the routes on an annual basis.

Student Transportation Services

Student transportation requires special attention for the greatest benefit to accrue the School District from the dollars expended. It is important to set forth the major objectives that serve as a guide in the management of the student transportation program. These objectives include the following:

a) To furnish transportation to those students whose disability and condition or distance from the school make the service essential.

b) To provide safe transportation.

c) To operate the transportation program efficiently and economically.

d) To adapt transportation to the requirements of instructional program.

e) To maintain conditions on the buses that are conducive to the best interest of the students - including mental, moral, and physical considerations.

f) To promote a sympathetic public understanding of the entire transportation program - including safety, adequacy, efficiency, and standards of service.

g) To establish and review at least once a year the school bus scheduling and routing plans. A list of students riding each bus is required to be provided to the District by the bus contractor annually.

h) To review at least once a year the eligibility for transportation of students residing in the District.

i) Bus safety will be reviewed with all students on an annual basis.

SUBJECT: TRANSPORTATION OF STUDENTS

Requests for Transportation to and from Nonpublic Schools

The District provides transportation to and from school for students residing in the District but attending nonpublic schools within the same distance limitations as are listed for students attending District schools. The distance is measured from the student's residence to the nonpublic school. To be eligible for such transportation, in accordance with Education Law Section 3635[2], a written request for such transportation must be submitted to the Board of Education no later than April 1 preceding the beginning of the school year for which the transportation is requested; provided, however, that for those not residing in the District by April 1 but establishing residency in the District afterwards, requests shall be submitted within thirty (30) days of establishing residency within the District. However, no late request shall be denied where a reasonable explanation is provided for the delay.

In addition, transportation will be provided for students residing in the District but living beyond the mileage limitations under the following rules and limits. If the District provides transportation to a nonpublic school to student or students who do live within the mileage limitations above, a student or students living outside the mileage limitations but attending the same nonpublic school will be eligible for transportation between one or more centralized pick-up points and the nonpublic school. The District will designate one or more public schools as centralized picked-up points to transport the student or students between the nonpublic school and the centralized pick-up points. Transportation between the student's residence and the centralized picked-up point, however, is the responsibility of the student's parents and not the District. The District will provide transportation for students only between the centralized picked-up point and the nonpublic school. The cost of the District's providing transportation between centralized pick-up points and nonpublic schools will be an ordinary contingent expense.

Transportation to Nonpublic Schools on Holidays

The District will share its calendar and start and dismissal times with nonpublic schools before the start of the school year. The District is not required to provide transportation to nonpublic schools on days on which the District's schools are not in session.

Transportation for Nonpublic School Students with Disabilities who are Parentally Placed

For students with disabilities, ages 5 through 21, who are parentally placed in nonpublic schools outside their district of residency, if special education services are to be provided to a student at a site other than the nonpublic school, the school district of location is responsible for providing the special education services, including, as applicable, arranging and providing transportation necessary for the student to receive special education services.

The district of residence remains responsible to provide transportation to parentally placed nonpublic school students from the student's home to the nonpublic school.

Transportation of Students with Disabilities

Students with disabilities shall be provided with transportation to and from the programs and placements specified in their Individualized Education Programs (IEPs) in accordance with applicable federal and State laws. If required by a disabled student's IEP or by Section 504 of the federal Rehabilitation Act or the Americans with Disabilities Act, special transportation services shall be provided, including, when appropriate, curb-to-curb transportation.

Student Information

Upon written consent of the parent or person in parental relation, every school bus which is used to regularly transport students with disabilities will maintain the following information about each student with a disability being transported:

a) Student's name;

b) Nature of the student's disability;

c) Name of the student's parent, guardian or person in parental relation and one or more telephone numbers where that person can be reached in an emergency; and/or

d) Name and telephone number of any other person designated by such parent, guardian or person in parental relation who can be contacted in an emergency.

This information will be used solely for the purpose of contacting the student's parent, guardian, person in parental relation, or designee in the event of an emergency involving the student, will be kept in a manner which retains the privacy of the student, and will not be accessible to any person other than the driver or a teacher acting in a supervisory capacity. In the event that the driver or teacher is incapacitated, this information may be accessed by any emergency service provider.

This information will be updated as needed, but at least once each school year and will be destroyed if parental consent is revoked, the student no longer attends the school, or the disability no longer exists.

Fire Extinguishers

School buses manufactured on or after January 1, 1990 fueled with other than diesel fuel and used to transport three or more students who use wheelchairs or other assistive mobility devices or with a total capacity of more than eight passengers and used to transport these students will be equipped with an engine fire suppression system.

School buses manufactured on or after September 1, 2007 fueled with diesel fuel and used to transport three or more students who use wheelchairs or other assistive mobility devices or with a total capacity of more than eight passengers used to transport these students will be equipped with an engine fire suppression system.

School buses will also be equipped with at least one hand fire extinguisher in the event of an emergency.

Transportation of Homeless Students

Students identified as homeless or unaccompanied youth as determined by our registration process are entitled to comparable transportation services. If the homeless child or youth continues to live in the area served by the local educational agency in which the school of origin is located, the child's or youth's transportation to and from the school of origin shall be provided or arranged by the local educational agency in which the school of origin is located. The District's Homeless Liaison shall ensure that the parent or guardian of a homeless child or youth, and any unaccompanied youth, is fully informed of all transportation services, including transportation to the school of origin and shall assist in the appropriate transportation arrangements.

Transportation of Non-Resident Students

The District will not extend its bus routes outside of the District to pick up non-resident students except to the extent, if any, required for a homeless student as prescribed by State and/or federal law and regulation (such as McKinney-Vento Act).

Transportation to School Sponsored Events

When the District has provided transportation to students enrolled in the District to a school sponsored field trip, extracurricular activity or any other similar event, it will also provide transportation back to either the point of departure or to the appropriate school in the District unless a student’s parent or legal guardian has provided the District with written notice, consistent with District policy, authorizing an alternative form of return transportation for the student. In cases where intervening circumstances make transportation of a student back to the point of departure or to the appropriate

school in the District impractical, and the parent has not authorized alternative return transportation, a representative of the School District will remain with the student until the student's parent or legal guardian has been contacted and informed of the intervening circumstances and the student has been delivered to his or her parent or legal guardian.

Transportation between Before-and/or-After-School Child Care Locations and School

Transportation between before-and/or-after-school child care locations and school is available only to children attending grades universal pre-kindergarten through 8. Transportation is available to students based on the same 3/4 of a mile through fifteen (15) miles and one (1) mile through fifteen (15) miles limitations applicable to students in grades UPK through 8 for transportation to and from their homes and school, except that the mileage distances for any such student shall be measured from the before-and/or-after-school child care location to the school the child legally attends. Transportation is available only between "before-and/or-after-school child care locations" as defined in Education Law Section 3635 and the child's school. Transportation is not provided between a before-and/or-after-school child location and a child's home. Transportation is not provided to group activities or to other locations.

Transportation is provided only between school and before-and/or-after-school child care locations located within the District. Transportation is not provided to or from a before-and/or-after-school child care location if it is located outside the District (even if it would be within the mileage limitations above).

Pursuant to the Education Law, a "before-and/or-after-school child care location" means a place, other than the child's home, where care for less than twenty-four (24) hours per day is provided on a regular basis for a child who attends school within the District. To obtain transportation between a before- and/or-after-school child care location and school, a written request must be submitted to the Board of Education not later than April 1 preceding the beginning of the school year for which the transportation is being requested; provided, however, that if residency within the District does not exist on April 1, a written request must be submitted within thirty (30) days after establishing residency in the District. In accordance with Education Law Section 3635, the Board of Education retains the authority to decide not to provide any transportation between before-and/or-after-school child care locations and school, but if transportation is provided to any child to or from a before-and/or-after-school child care location, transportation must be provided equally to all children in like circumstances.

Other Transportation Requests

The District does not provide transportation to or from locations other than as specified in this Policy, including, but not limited to, that the District does not provide transportation to a doctor's or dentist's appointment, group activity, music lesson, or private athletic or club event of any kind, etc.
