For the latest developments around us, the recent approval on the proposed amendments in Real Estate Regulatory Bill is expected to be highly beneficial for the future home buyers. There are a number of measures by which the government aims to protect transparency and accountability in real estate transactions. In our cover story this month, we have listed down the most important points related to this Bill.

Thanks to another initiative at national level, we now officially have 21st June declared as

‘International Day of Yoga’. The Presidential Tower, heralded the grand celebration of Yoga, in support of an urban yoga studio, ‘SoulYogaCycle’ and an NGO called ‘Save a Mother’ and became host to YOGARAMBH 2015 – a celebration meant to take Yoga beyond the mat. It was a day long event and saw huge participation. A lot of enthusiasts indulged in the yoga sessions, Sufi performances and organic market.

The inside pages also have a glimpse of the events with which we were able to reach out to a larger populace. There is, of course, a showcase of the impressive progress of the project you have lovingly chosen for your cherished dream home. Each state will get a real estate regulator, which will settle disputes and impose compensation. Initially, the bill was applicable for residential real estate only. Now all residential and commercial projects will have to be compulsorily registered with the regulator so that buyers can have access to genuine projects. One or more 'Real Estate Regulatory Authority' in each State/Union Territory (UT) or one Authority for two or more States/UT will be established, by respective Governments to oversee real estate transactions. Now the developers and real estate agents, who are involved in a project in any way, cannot advertise or launch projects without prior registration of Real Estate Regulatory Authority.

A fast-track dispute resolution mechanism through adjudication and establishment of a Real Estate Appellate Tribunal will be established. There will be adjudicating officers to settle disputes and impose compensation and interest. On-going projects that have not received completion certificates will also be covered. It will be mandatory for brokers too, to get registered, failing which will lead to punishment for non-compliance.

3 Sale of property on the basis of super area (area in which a flat is spread plus common area such as lobby) will be prohibited. Developers will have to advertise carpet area, which is the area enclosed within the walls of a property, for sale.

They will also have to make a mandatory public disclosure of the details of registered projects like layout plan, plan of development works, land status, status of statutory approvals, details of promoters, project, and disclosure of proforma agreements, names and addresses of real estate agents, contractors, architects, structural engineers etc. Developers will submit clearances with the regulator. This will ensure transparency at all levels.

Very recently, proposals were made to make amendments in the Bill, so that home buyers are protected from real estate frauds, which got approval from the Union Cabinet chaired by Prime Minister Narendra Modi in April 2015.

Since 2009, efforts were being made for creating a regulatory mechanism for the real estate industry to ensure accountability and transparency. Finally, the Real Estate (Regulation and Development) Bill was introduced in Rajya Sabha in August 2013. This was a pioneering initiative to protect the interest of consumers, to

The bill outlines the duties of developers, including obligations regarding veracity of the advertisement for sale or prospectus, rectification of structural defects and refund of money in cases of default. Buyers can claim refund with interest and compensation if promoters fail to deliver projects on time. They have the right to procure stage-wise construction update and claim possession. If rules are violated, projects will be de-registered and penalties will be imposed on the developer. Noncompliance will attract fine up to 10 per cent of the project cost and misinformation, a fine of 5 per cent of the project cost.

To ensure projects are completed on time and developers are prevented from diverting money raised from buyers, promoters have to compulsorily deposit 50 per cent (or lesser percentage as notified by the authority) of the amounts realised for the real estate project from the buyer in a separate account in a scheduled bank within a period of fifteen days to cover the cost of construction.

7 Developers will need the consent of two-third buyers to alter plans, structural designs and specifications of the building/plot/apartment. While minor additions or alterations are allowed due to architectural and structural reasons, they will have the responsibility to rectify structural defects and refund money in cases of default.

8 Builders often demand part payment in cash, making many ordinary buyers party to corruption. The Bill will help curb undeclared "black money" in property markets that costs the government billions of rupees in lost taxable income.

SoulYogaCycle, an urban yoga studio; The Presidential Tower, Bangalore’s tallest 50-storey residential tower and Save A Mother, an NGO dedicated to better healthcare systems for the poor and reducing maternal mortality rates organized YOGARAMBH – A celebration beyond the mat, a day-long festival to celebrate INTERNATIONAL DAY OF YOGA on 21st June 2015.
