1 Introduction

1.1 In accordance with Regulation 31 of The Town and Country Planning (Local Development) (England) Regulations 2004, this statement describes the consultation that has been undertaken following the submission of the draft Statement of Community Involvement (SCI for short) to the Secretary of State. 1.2 In 2004 the Planning and Compulsory Purchase Act introduced a new planning

system for England. A key objective of the new system is to strengthen community involvement. The SCI sets out Newcastle City Council s policies and standards for engaging the community, stakeholders and other interested bodies in the

preparation and review of the Local Development Framework (LDF) and also in the consideration of planning applications. The principles and guidelines set out in the SCI will apply directly to plans and related documents prepared under the new Planning Act.

1.3 The purpose of this document is to demonstrate how the local planning authority has complied with the statutory requirements for consultation following the

submission of the SCI and to inform the independent Planning Inspector, who will be appointed to consider the soundness of the document, of any representations made since the submission.

1.4 The Inspector will consider all representations and produce a report which will be binding on the Council. The report will set out any changes that must be made to the document before it is adopted.

1.5 There have been three stages of consultation:

(1) Informal Pre Submission Consultation (under Regulation 25) (2) Formal Pre Submission Participation (under Regulation 26) (3) Formal Submission Stage Consultation (under Regulation 28)

1.6 An explanation of stages (1) and (2) including the responses received at each stage were given in the Statement of Consultation, which was published alongside the Submission Draft of the SCI.

2 Consultation on the Submission Draft of the SCI 2.1 Publication of Submission Draft of the SCI

2.1.1 In accordance with Regulation 28 of The Town and Country Planning (Local Development) (England) Regulations 2004, once the City Council had completed the formal pre submission consultation, the SCI was reviewed and amended in view of the comments received. The resulting Submission Draft of the SCI was submitted to the Secretary of State on 30 September 2005. As prescribed by the Regulations consultation was undertaken on the Submission Draft of the SCI from 30 September 2005 to 11 November 2005.

2.2 Availability of the Submission Draft of the SCI

2.2.1 Copies of the Submission Draft of the SCI, the Statement of Consultation on the earlier stages and a notice of Proposal Matters (see Appendix A) were available for

inspection free of charge for the six week consultation period as above in the following locations:

2.2.2 The Submission Draft of the SCI, the Statement of Consultation and the statement of Proposal Matters were also published on the Council s website at

www.newcastle.gov.uk/ldf, along with advice on where and when paper copies

were available for inspection or how to request a copy to be sent by post, free of charge

2.2.3 An advertisement was placed in the principal local morning newspaper The Journal on 30 September 2005 (see Appendix B) summarising the content of the document and stating where the document was available for inspection and the places and times at which it could be inspected, as above. A Consultation Response Form was made available with the other documents in all locations including the web site (see Appendix C).

2.3 Bodies consulted

2.3.1 The Council sent copies of the Submission Draft SCI , the Statement of

Consultation, the statement of Proposal Matters and details of the time and place where the documents were available for inspection, to the following bodies:

2.3.2 The Council informed the full list of those other than the above on the LDF

consultation database as per Appendix D to this document of the submission of the SCI and where to view or obtain copies. All those who had asked to be notified upon the submission of our SCI to the Secretary of State were so notified.

2.4 Form of consultation

2.4.1 Each of the consultation bodies specifically listed above were sent a covering letter (encouraging consideration of the document and inviting comments), copy of the Submission Draft of the SCI, the Statement of Consultation, a copy of the Proposals Matters and the Consultation Response Form. Consultees in Appendix D were generally sent only a notification letter or, where previously agreed, an email (see Appendix D for more details). All of the documentation clearly indicated the closing date by which comments should be made as the 11 November 2005.

2.5 Main issues arising from the consultation

2.5.1 The Council received 30 representations. 11 were objecting to the SCI or part of the SCI. None of the respondents wished to appear and present their case at a public examination, 14 wished to have their submission considered as a written representation and the remaining 16 have not indicated a preference.

2.5.2 The main issues raised are summarised in Appendix E. In the opinion of the City Council, nobody has raised fundamental objections to the Submission Draft SCI. The Council would be happy to accept many of the suggested changes. Appendix E gives a response from the Council to each comment individually, offering, where necessary, suggestions from the Council as to possible changes to the final SCI. Copies of the full representations received can be found in Appendix F, which is printed or made available electronically as a separate document or file.

2.5.3 The Council has made this Regulation 31 statement, including the representations received, available in the same locations as the Submission Draft of the SCI was available for inspection and have published the statement and the representations made on the LDF website.

The Submission Draft of the SCI is the second draft of our SCI. We consulted on an earlier version in August 2005 and have revised the document in the light of comments made. You can now make further comments, supporting or objecting to specific sections if you wish. In considering whether you wish to make representations on a SCI you may wish to consider the principles of community involvement which are set out in the document Community

Involvement in Planning: The Government s Objectives (available from www.odpm.gov.uk). If there are objections at this stage, an independent inspector will consider these and may hold a Public Examination early in 2006.

Reasons for Objection

Paragraph 3.10 of Planning Policy Statement PPS12 Local Development Frameworks states that there will be a presumption that the SCI is sound unless it is shown to be otherwise as a result of evidence considered at the examination. Method of Representation

In order to assess the soundness of the SCI and to ensure that it satisfies the statutory requirements for its preparation an independent Inspector will be appointed on behalf of the Secretary of State. If there are objections at this stage, the Inspector will consider these and will determine the most appropriate procedure. The inspector can deal with representations by exchange of letters but might decide to hold a Public Examination in Newcastle. This would be in early 2006.

- - Outlined English Nature s (EN) role as a statutory

consultee, and provided some generic advice about its aims and objectives for involvement in both the LDF and SEA process.

Also highlighted the following issues regarding consultation with statutory consultees, found in ODPM Circular 08/2005 Guidance on Changes to the Development Control System (24 August 2005) and suggested that these would be of great value to potential developers if included in the SCI: - Statutory bodies, such as EN, cannot make a substantive

response within the relevant timescale unless they receive all the information needed to provide an informed

response. This may require the planning authority to request further information from the applicant and thus result in a need to extend deadlines.

- Where separate legislation sets different time limits for responses, these supersede the requirement for statutory consultees to respond within 21 days of receipt of the consultation from the Planning Authority. This applies to applications likely to affect SSSIs where a time limit of 28 days is set.

- Recognition should be given to the value of

pre-submission consultation with statutory consultees before submission of an application. EN recommend that the SCI encourages developers to carry out pre-application

discussions with English Nature concerning any applications likely to affect directly or indirectly SSSIs, protected species or other issues identified in PPS9.

Comments regarding the consultation with statutory consultees on Development Control matters have been noted and passed to the Development Control Group. Suggestion regarding pre-application

consultation is also noted and the Council would welcome an

additional paragraph in Section 8 asking developers to consider early pre-submission discussions with statutory consultees on likely impacts on sensitive sites,

buildings or receptors. Use of CD-ROMs is shown in

Also, for development permitted under the GDPO, the Habitats Regulations set out provisions for consideration of such development where this is likely to affect the integrity of internationally important nature conservation features as designated in Special Protection Areas (SPA) and Special Areas of Conservation (SAC). These procedures are set out in Government Circular: Biodiversity and Geological

Conservation - statutory obligations and their impact within the planning system (ODPM 0612005, DEFRA 0 1/2005). EN also request to be informed of progress of the LDF would like to receive both paper and CD versions of all LDF consultations.

305 Mr Ian Alder - - Raised concerns over the ability of residents to participate in the planning process regarding telecommunications masts, suggesting there is too tight a limit on the reasons for objections to masts. Visual amenity is the main

objection, but health risk and now the 'perception of the fear of health issues' are also valid reasons. The SCI or a later 'more detailed' document should address this issue.

The SCI is not the vehicle to deal with such specific issues.

125 Jim Cousins MP - - Raised questions as to whether the public are being properly informed about the evolution of planning
