As a family-run law firm with more than 30 years of experience, Lynch Legal Associates has the ability to represent clients facing the simplest legal matters to more complex matters, sometimes requiring litigation. Regardless of the matter a client faces, the firm works toward finding solu-tions to help a client reach their goal while minimizing legal fees.

Senior partner James J. Lynch has practiced law since 1966 when he joined the Depart-ment of Justice in the Federal Bureau of Investigation. In 1970 he joined the firm of Frank and E. George Lawkins. In 1971 the firm became Lawkins & Lynch and in 1985 Mr. Lynch became a sole practitioner. Mr. Lynch has been awarded an “AV” rating by the Martindale-Hubbell Law Directory, the highest rating for an attorney who has practiced law for many years and who has demonstrated the highest levels of skill and integrity. In 2003 Mr. Lynch’s successful practice became Lynch Legal Associates, LLP when Kyle T. Lynch joined the firm.

Elder Law, Estate Planning

& Administration

Having a Will alone may not be sufficient estate planning. As real estate values rise and Congress and state government change estate tax and Medicaid eligibility laws, it is imperative that families prepare for their future and begin planning earlier than ever before. The attorneys at Lynch Legal Associates work with clients to prepare compre-hensive estate plans using insurance, life estates, trusts, credit shelter trusts and other techniques to help ensure Medicaid eligibility and minimize tax liability.

When a person dies with a Will, it is probated in Surrogate’s Court. When a person dies without a Will, the state’s intestate laws will distribute a person’s assets in accordance with a formula based on what the typical person may have done with their assets. The firm handles all facets of probate and estate administration, including preparation of State and Federal estate tax forms, protecting the interests of the fiduciaries, Surro-gate’s trial practice, and accounting submissions.

Real Estate

Just as the prices of real estate have risen in the region, so have the problems and potential for litigation when buying or selling real estate. It has never been more impor-tant to have an experienced real estate attorney help guide you through the process. The firm represents both residential and commercial real estate clients. The office prepares contracts and advises clients with regards to financial and structural issues of both commercial and residential transactions, including clearance of title exemptions, mortgage commitment contingencies, building department and zoning regulations, vari-ances, change of zoning, and requirements for closing of title.

Lynch Legal Associates also represents clients seeking approvals and variances before various municipal boards, including zoning boards of appeals, planning boards and com-missions, as well as with housing violations and issues addressed in municipal court.

Municipal Law

Lynch Legal Associates provides representation to municipalities and not-for-profit cor-porations. Its attorneys cover all aspects of board member representation in accordance with town, village, and general municipal law.

Civil Litigation

The firm handles matters of civil litigation including landlord/tenant disputes, evic-tions, and breach of contract issues. These services include preparation of pleadings, disclosure, investigation of the case and expert witnesses, settlement strategies, trial preparation, trial and post-trial procedural practice.

Criminal Litigation

Everyone make mistakes. Sometimes people’s mistakes result in criminal prosecutions. At times, someone may have been wrongly accused or the prosecution does not have enough evidence to convict. At other times, a client may admit they have made a mis-take and want to limit the damage to themselves and their loved-ones.

Matrimonial and Family Law

When a couple decides to end a marriage, a judge must issue a divorce decree. This requires one spouse filing for a divorce on the basis of grounds, including cruel and in-human treatment, adultery, imprisonment, abandonment, or constructive abandonment. The second means for obtaining a divorce is through the conversion of a separation agreement that has been in effect for at least one year. If a couple has not married, but needs to resolve issues such as paternity, child support, child custody, then these issues are handled in Family Court. This court also handles the prosecution of minors being tried as juveniles.

Lynch Legal Associates handles contested and uncontested divorce actions, child custody, separation agreements, pre-nuptial agreements, and offers alternative dispute resolutions to family law matters.

Personal Injury Law

Personal injury and medical malpractice actions are designed to compensate victims for intentional and negligent actions of others. There can also be significant awards to indi-viduals injured by products placed into the stream of commerce that are harmful when used as directed. The law seeks to compensate victims and their families for pain and suffering, lost earnings, loss of consortium, and at times, award punitive damages in the event of gross negligence.

James J. Lynch

James J. Lynch, partner, was born in Mineola, New York in 1941. Mr. Lynch graduated from St. John’s University with a BA in 1963. After graduating from St. John’s Law School with a JD in 1966, Mr. Lynch joined the United States Department of Justice in the Federal Bureau of Investigations from 1966 to 1970. In 1970, he entered private practice, joining the firm of Frank and E. George Lawkins. In 1971 the firm became Lawkins & Lynch, and in 1985 Mr. Lynch became a sole practitioner. Mr. Lynch later formed Lynch Legal Associates, LLP.

Kyle T. Lynch

Kyle T. Lynch, partner, was born in Glen Cove, New York. Mr. Lynch received a BA from Hartwick College in 1996 and an AASD from Johnson & Wales University in 1998. He received a JD from Hofstra University Law School 2003, when he formed Lynch Legal Associates with his father James J. Lynch.

Mr. Lynch is admitted to practice law in New York State, United States Tax Court, as well as the United States District Court’s Eastern and Southern Districts. He is a member of the American Bar Association, the New York State Bar Association, the Nassau County Bar Association, the Association of Trial Lawyers of America, the New York County Bar Association, and the New York Trial Lawyers Association. Mr. Lynch is listed in Who’s Who in American Law. He serves as a mediator in Hempstead District Court and is a member of the Volunteer Lawyers Project.

Daniel Cohn,associate, was born in New Hyde Park, New York. Mr. Cohn received a BA in political science from the University of Michigan in 1999 and a JD from Brooklyn Law School in 2005. After graduating, Mr. Cohn joined Lynch Legal Associates in 2005. Mr. Cohn is admitted to practice law in New York State as well as the State of New Jer-sey. He is a member of the ABA, NYS Bar Association, and the NY County Law Associa-tion.
