Salary schedules of certified staff of the bargaining unit are subject to union-district negotiations.

8.9.6. Overtime Exempt Employees

Professional employees of the School District including administrative and certified employees are exempt from overtime provisions of the Fair Labor Standards Act. Non-exempt Employees

Non-exempt employees may be required to work overtime whenever it is deemed necessary by their supervisor. An employee shall not work overtime without the prior approval of their immediate supervisor and the Superintendent.

For those employees eligible to receive overtime compensation under the Fair Labor Standards Act, the following policy shall apply:

A. Subject to the limitations and exceptions set forth below, overtime at the rate of time and one-half will be earned by any employee who is required to work more than forty (40) hours during the work week.

B. All overtime must have prior approval of the superintendent or designee (s).

C. School employees required to seek and obtain prior approval for overtime are responsible for ensuring that their work week will not exceed forty (40) hours per work week.

D. Compensation for overtime shall be made by granting compensatory time off at a rate of one and one-half for each hour of overtime worked.

E. Compensatory time off shall be taken during the work week following the week in which it was earned unless the use of compensatory time off would unduly disrupt the operations of the district.

F. In the event the superintendent determines compensatory time off during the week following the week it is earned would be unduly disruptive to the operations of the district, such compensatory time off may be taken as soon as is reasonably possible thereafter. G. Compensatory time off shall not be accrued in excess of 240 hours.

H. An employee who has accrued compensatory time off as provided in this policy shall, upon termination of employment, be paid for the unused compensatory time off at a rate of compensation not less than:

1. The average regular rate received by such employee during the last three years of the employee's employment, or

2. The final regular rate received by such employees, whichever is higher.

I. Alternatively, the School District, in its discretion, may provide cash (the term "cash" should be interpreted as dollars added to the employees pay check) instead of compensatory time off or any overtime hours worked. The school district may freely substitute cash, in whole or part, for compensatory time off. Compensation for overtime to be paid in cash shall be paid at a rate of one and one-half times the employee's regular rate of pay. Payment for employees' overtime to be paid in cash shall be made on the regular pay day for the pay period encompassing the work week in which such overtime was earned.

J. The hours worked by an employee who, at his or her option, engages in part time, occasional or sporadic employment for the district in a different capacity than his or her primary employment, shall be excluded from the calculations of hours for which the employee is entitled to overtime compensation.

K. If an employee, solely at his option and with the approval of the Superintendent, agrees to substitute during the scheduled work hours for another employee who is employed in the same capacity, the hours worked as a substitute shall be excluded by the district in the calculation of hours for which the employee is entitled to overtime compensation.

L. This overtime compensation plan does not apply to executive, administrative, professional or licensed teacher employees or to volunteers.
