内容摘要

“土地是人类社会最重要的生产资料和生活资料”,这一认识恐怕到目前为 止不会遭到太多人的反对;而土地同时是十分稀缺的,必须有效利用,获得最大 化的效益,才能造福于人类社会,因此,人类展开了空间利用上的探索。空间使 用权在我国并非一个新名词,在《物权法》修订的过程中,许多学者曾就是否要 在《物权法》中单独设立空间使用权展开过热烈的讨论,其间争议甚烈,随着《物 权法》的颁布施行,相关讨论渐有偃旗息鼓之势。本文以呼吁学者及立法者对区 分所有建筑物立体空间使用权加以关注为目的而对其进行了探讨,除引言和结语 外,分为三章。 第一章首先对区分所有建筑物立体空间使用权所涉及的基本概念进行厘清, 阐述了区分所有建筑物的立体空间以及其现实使用情况,表明在现实生活中,人 类对这部分空间已经渐渐展开了越来越多的利用。接着文章简要介绍了空间使用 权的基本理论并在应有部分已经阐明的基础上说明了区分所有建筑物立体空间 使用权的构成及特点,从而进入文章的主题。 第二章是文章的重点。本章从分析区分所有建筑物立体空间使用形态入手, 阐明不同的使用形态会带来不同的影响。接着,文章重点分析了区分所有建筑物 立体空间使用权利冲突的类型,包括区分所有建筑物立体空间使用权的主体冲 突、区分所有建筑物立体空间使用权的客体冲突以及区分所有建筑物立体空间使 用权与其它权利之间的冲突。最后,在每节的末尾,都针对每项冲突提出了相应 的解决办法,表明这些冲突在得到解决的情况下,区分所有建筑物的立体空间能 够得到更充分的利用。 第三章是文章的收尾部分。本章主要阐明关于区分所有建筑物立体空间使用 权的立法构想。学理的分析最终还需要立法的确认。我国《物权法》用独特的形 式对空间权做出探索,然而却忽略了对区分所有建筑物立体空间使用权的规制。 只有法律制度的建立和不断完善才能更好地增进空间的利用,减少纠纷的发生, 推动我国空间权立法的发展。

ABSTRACT

ABSTRACT

Land is one of the most important means of production and subsistence of human society. And land is so exiguous that it must be used adequately. So people need to use the space. “The right to use the space” is not a new word in China. During the period of the constitution of Property Law of China, a lot of scholars had discussed the issue whether we should had independent right on space, on which they argued drastically. With the cease of the legislation constitution, the discussions have stopped gradually. The purpose of this article is to call on more scholars and legislators to pay attention to the system of the right to use space of the condominium building and to work on it thoroughly. Except the introduction and the conclusion, the article containts three chapters.

In the first chapter, the author analyses the basic conceptions about the right to use the space of the condominium building, and then expatiates on the space of the condominium building and the use of it, which indicates that the space of the condominium building is used increasing widespread. Then the author introduces the basic theories on the right of space and analyses the structure and characteristics of the right to use the space of the condominium building.

The second chapter is the most important part of the article. In this part, the author first describes different cases of the use of the space of the condominium building and its effects. Secondly, the author analyses different kinds of collisions on the use of the space of the condominium building, including the collisions on obliges, objects and collisions between the right to use the space of the condominium building and other rights. At last, in the finality of each subchapter, the author tries to put forward the approaches to solve each problem above. If all the problems were solved perfectly, the space of the condominium building will be used more adequately.

The third chapter is the last part of the article. In this part, the author gives some suggestions on the right to use the space of the condominium building. The ignorance of legislation should be changed in the process of the legislation of property law, and the main rules of space right should be built. In addition, other legislations should be done to improve the whole system. With the guidance of the law, the space could be exploited more efficiently.
