INVITATION TO BID -

BID #B-14-30

The Town of Brookline, acting through the Brookline Building Commission, the

Awarding Authority, invites sealed bids for Brookline Amos Lawrence and Pierce Schools –

Elevator Modernizations Bid #B-14-30, Brookline, MA in accordance with Contract Documents

prepared by CBI Consulting Inc., 250 Dorchester Avenue, Boston, MA 02127. The work of this

Contract includes elevator modernizations, including, but not limited to, the following:

Base Bid – All work at the Amos Lawrence Elementary School

Add Alternate #1 – All work at the Pierce Elementary School

All bids for this Project are subject to the provisions of Massachusetts General Laws

(Ter. Ed), including without limitation Mass. G.L. Chapter 149, Sections 44A through 44L

inclusive; and Chapter 149, Section 26 through 27D inclusive.

Filed Sub-Bids are required for the following trades:

Sealed bids for the General Contract on forms furnished by the Awarding Authority will

be received by the Awarding Authority at the offices of the Brookline Building Commission,

Brookline Town Hall - Third Floor, 333 Washington Street, Brookline, MA, 02445 until 2:00

p.m. local time on Tuesday, November 18, 2014. All General Bids will be publicly opened and

read aloud immediately thereafter.

Sealed Filed Sub-bids for the trades listed herein on forms furnished by the Awarding

Authority will be received by the Awarding Authority at the Brookline Building Commission,

Brookline Town Hall - Third Floor, 333 Washington Street, Brookline, MA, 02445 until 2:00

p.m. local time on Thursday, November 6, 2014. All Filed Sub-Bids will be publicly opened and

read aloud immediately thereafter.

Each General Bidder must be certified by the Department of Capital Asset Management

and Maintenance (DCAMM) for the category of work and dollar amount of this project and to be

considered must submit with his or her Bid, a DCAMM Certification and Update Statement

indicating additional work or contracts performed or executed after the certification date. The

category of work for this Project is General Building Construction. The estimated construction

cost of this Project is $580,000.00.

Each Filed Sub-Bidder must be certified by the Department of Capital Asset Management

and Maintenance (DCAMM) in the appropriate category of work and is eligible to submit bids

for public construction projects and to perform the work required. For a Filed Sub-Bid to be

considered eligible, a DCAMM Certificate of Eligibility in the category of work and an Update

Statement indicating additional work or contracts performed or executed after the certification

date must be submitted.

A pre-bid site inspection and meeting will be held on Tuesday, October 28, 2014 at 10:00

a.m. All Bidders are requested to meet at the Amos Lawrence School.

Each General Bidder and each Sub-Bidder may obtain complete sets of the Bidding

Documents, at the following time and location:

Plans and Specifications will be available to bidders after 2:00 PM local time, on

Wednesday October 22, 2014 at the Town of Brookline: Brookline Website:

Hard copies of the Bid Documents can be obtained with

a deposit of $150.00 per set. Copies of Addenda will be mailed or delivered electronically to

registered Bidders without charge.

The full amount of each deposit for Bidding Documents will be refunded to each Bidder

returning complete sets of Bidding Documents (including Addenda if issued) to the Building

Department office in good condition, within thirty (30) days after the date of General Bid

opening. Deposits for Bidding Documents will be forfeited to the Town of Brookline if they are

not returned within the specified time limit and in the good condition.

The Bidding Documents may also be examined at the following places during normal

business hours after issuance:

Each General Bid and each Filed Sub-Bid shall be accompanied by Bid Security equal to

five (5) percent of the total possible Bid amount, including all alternates in the form of a Bid

Bond, Certified Treasurer's or Cashier's Check issued by a responsible U.S. bank or Trust

Company, payable to the Town of Brookline. Each Bidder shall attach the required Bid Bond or

Check to their Bid Form.

The Bid Securities of all General Bidders, except those of the three lowest responsible

and eligible General Bidders, will be returned within five (5) days, Saturdays, Sundays, and legal

holidays excluded, after the opening of General Bids.

The Bid Securities of all Filed Sub-Bidders, except those of the Sub-Bidders named in

the General Bids of the three lowest responsible and eligible General Bidders, and those of the

three lowest responsible and eligible Sub-Bidders for each sub-trade, will be returned within five

(5) days, Saturdays, Sundays, and legal holidays excluded, after the opening of General Bids.

The Awarding Authority reserves the right to waive any informalities and to reject any or

all General Bids not deemed to be in the best interest of the Town. The Awarding Authority

reserves the right to reject any Filed Sub-Bid if it determines that such Sub-Bid does not

represent the Sub-Bid of a person competent to perform the Work as specified or that less than

three (3) such bids were received. (C.149, Sec.44E)

The successful General Bidder will be required to furnish a Performance Bond in the

amount of one hundred percent (100%) of the total bid, and a Labor and Materials Payment

Bond in the amount of one hundred percent (100%) of the total bid.

Attention is directed to the fact that no less than the minimum wages as set forth in

Document 00 32 00 PREVAILING WAGE RATES of the Contract Documents must be paid on

this Project and that no sales tax shall be included in their bids.

All bids shall remain in effect for sixty (60) days, Saturdays, Sundays and legal holidays

excluded, after the opening of General Bids.

The right is reserved by the Town of Brookline, Massachusetts through the Building

Commission to reject any or all bids, if it be in the public interest to do so.

1.02

BIDDING PROCEDURE

A.

Bids for the work are subject to the provisions of General Laws, Chapter 149,

Sections 44A-44L inclusive, as amended. Regulations governing the bidding

procedures as set forth in the above mentioned amended General Laws must be

followed.

B.

In the event of any inconsistencies between any of the provisions of these

Contract Documents and of the cited statute, anything herein to the contrary

notwithstanding, the provisions of the said statute shall control.

C.

No General Bid received by the Awarding Authority after the time respectively

established herein for the opening of General Bids will be considered, regardless

of the cause for the delay in the receipt of any such bid.

1.03

WITHDRAWAL OF BIDS

A.

Bids may be withdrawn prior to the time respectively established for the opening

of General Bids only on written request to the Awarding Authority.

1.04

INTERPRETATION OF CONTRACT DOCUMENTS

A.

No oral interpretation will be made to any bidder. All questions or requests for

interpretations must be made in writing to the Architect.

B.

Every interpretation made to a bidder will be in the form of an Addendum, to the

drawings and/or specifications, which will be made available to all persons to

whom Contract Documents have been issued.

C.

Failure of the Awarding Authority to send, or of any bidder to receive any such

addendum shall not relieve any bidder form obligation under his bid as submitted.

D.

All such addenda shall become a part of the Contract Documents.

1.05

EXAMINATION OF SITE AND CONTRACT DOCUMENTS

A.

Each bidder shall visit the site of the proposed work and fully acquaint himself

with conditions as they exist, and shall also thoroughly examine the Contract

Documents. Failure of any bidder to visit the site and acquaint himself with the

Contract Documents shall not relieve any bidder from any obligation with respect

to his bid.

B.

By submitting a bid, the bidder agrees that the Contract Documents are adequate

and that the required result can be produced. The successful bidder shall furnish

any and all labor, materials, insurance, permits and all other items needed to

produce the required result to the satisfaction of the Awarding Authority.

1.06

BID SECURITY

A.

The General Contractor's bid must be accompanied by bid security in the amount

of five percent (5%) of the bid.

B.

At the option of the bidder, the security may be bid bond, cash, certified,

treasurer's or cashier's check issued by a responsible bank or trust company. No

other type of bid security is acceptable.

Bid Bonds shall be issued by a Surety Company qualified to do business under the

laws of the Commonwealth of Massachusetts.

C.

Certified, Treasurer's or Cashier's check shall be made payable to the Town of

Brookline, Massachusetts.

D.

The bid security shall secure the execution of the Contract and the furnishing of a

Performance and Payment Bond by the successful General Bidder.

E.

Should any General Bidder to whom an award is made fail to enter into a contract

therefore within five (5) days, Saturdays, Sundays and Legal Holidays, excluded,

after notice of award has been mailed to him or fail within such time to furnish a

Performance Bond and also a Labor and Materials or Payment Bond as required,

the amount so received from such General Bidder through his Bid Bond, Cash,

Certified, Treasurer's or Cashier's check as bid deposit shall become the property

of the Town of Brookline, Massachusetts as liquidated damages; provided that,

the amount of the bid deposit which becomes the property of the Town of

Brookline, Massachusetts shall not in any event exceed the difference between his

bid price and the bid price of the next lowest responsible and eligible bidder; and

provided further that, in case of death, disability, bona fide clerical error or

mechanical error of a substantial nature, or other unforeseen circumstances

affecting the General Bidder, his deposit shall be returned to him.

1.07

BID FORM

A.

General Bids shall be submitted on the "FORM FOR GENERAL BID" enclosed.

Erasures or other changes must be explained or noted over the signature of the

bidder.

B.

Bid forms must be completely filled in. Bids which are incomplete, conditional,

or obscure, or which contain additions not called for will be rejected.

C.

General Bidders shall submit one (1) set of executed bid forms to the Awarding

Authority.

1.08

SUBMISSION OF BIDS AND BID SECURITIES

A.

Each bid submitted by a General Contractor shall be enclosed in a sealed

envelope which shall be placed with the bid security in an outer envelope. The

outer envelope shall be sealed and clearly marked as follows:

1.09

AWARD OF CONTRACT

A.

The Contract shall be awarded to the lowest responsible and eligible General

Bidder on the basis of competitive bids in accordance with the procedure set forth

in the provision of Section 44B-44L inclusive, as amended or inserted, by Chapter

149 of the General Laws of the Commonwealth of Massachusetts.

B.

If the bidder selected as the General Contractor fails to perform his agreement to

execute a contract in accordance with the terms of his General Bid, and furnish a

Performance Bond and also a Labor and Materials or Payment Bond, as stated in

his General Bid in accordance with Section 44F, an award shall be made to the

next lowest responsible and eligible bidder.

C.

The words "lowest responsible and eligible bidder" shall be the bidder whose

name is the lowest of those bidders possessing the skill, ability and integrity

necessary to the faithful performance of the work and who shall certify that he is

able to furnish labor that can work in harmony with all other elements of labor

employed, or to be employed, on the work. Essential information in regard to

such qualifications shall be submitted in such form as the Awarding Authority

may require.

D.

Action on the award will be taken within thirty (30) days, Saturdays, Sundays and

Legal Holidays excluded after the opening of the bids.

1.10

PRE-BID WALK-THRU

A.

Pre-bid walk-thru, meet on Tuesday October 28, 2014 at 10:00 AM at Amos

Lawrence School, Brookline, MA. Meet outside the front entrance.

1.11

CORI

A.

A CORI check will be required for all personnel working in the building or on

site. The CORI forms are included in the Contract Documents.

OTHER PROJECTS AT THE SITE(S)

A.

There are other construction projects that may be underway at the same time as

the work of this project. The awarded General Contractor, Filed Sub-Contractors

and all Subcontractors shall work in harmony with any and all other General

Contractors and Trades and shall not impede any other work being performed at

the Amos Lawrence or Pierce Elementary Schools by the Town of Brookline or

the Brookline School Department.

1.

At Lawrence School there is a project that is currently underway to add

classrooms in the rear of the building adjacent to Newell Road. It is

anticipated that this project will be complete in June, 2015, but it could

extend longer.

2.

At the Pierce School, it is anticipated that an electrical systems upgrade

project will run concurrently with the work of this project, during the

Summer, 2015. The scope of work includes, but is not limited to

replacement of the service and all of the Federal panelboards. Power is

expected to be available to the awarded Contractor(s) for this project at all

times, with the exception of one (1) 48-hour period (dates unknown) while

the service is changed over.

1.13

CONTRACT DOCUMENTS

A.

Each General Bidder and each Sub-Bidder may obtain complete sets of the

Bidding Documents, including Plans and Specifications will be available for

bidders after 2:00 PM local time, on Wednesday, October 22, 2014 at the Town of

EQUALITY

A.

Except where otherwise specifically provided to the contrary, the words "or

equal" are hereby inserted immediately following the name or description of each

article, assembly, system, or any component part thereof, in the Contract

Documents. It is the contractor's responsibility to provide all the research and

documentation that would prove a product or assembly is "equal". Failure to

provide research or documentation does not alleviate the contractor's

responsibility to meet the schedule.

1.15

TAX FREE NUMBER

A.

The Town of Brookline has a tax free number.

1.16

ARBITRATION AND MEDIATION

A.

The Town of Brookline does not use Arbitration. Any and all references to

arbitration are stricken from the contract.

B.

The Town of Brookline does not use Mediation. Any and all references to

mediation are stricken from the contract.

1.17

SCHEDULE

A.

All work shall be completed by

days from the Notice to Proceed.

1.18

LATE FEES

A.

If the work is not Substantially Complete by the dates noted in Section 1.15A, the

contractor shall be charged $500.00 per calendar day to pay for consulting and

testing fees to manage and arrange for the completion of the project. Late fees

will be deducted from the Contract via Change Order.

1.19

AWARD

A.

The Awarding Authority reserves the right to reject any or all bids, if it be in the

public interest to do so, and to act upon the bids and make its award in any lawful

manner.

1.20

MINIMUM WAGE SCHEDULE

A.

Bids shall be made on the basis of the Minimum Wage Schedule, as determined

by the Commissioner of Labor and Industries, pursuant to the provision of

Chapter 149, Section 26 to 27D inclusive, of the Massachusetts General Laws.

B.

All Bids shall be accompanied by the Bidder's Certification regarding payment of

1.21

CONFLICT OF INTEREST

A.

A bidder filing a proposal thereby certifies that the proposal is made in good faith,

without fraud, collusion, or connection of any kind with any other bidder for the

same work, and that the bidder is completing solely on its own behalf without

connection with, or obligation to, any undisclosed person or firm.

1.22

PROCEED ORDERS

A.

No bidder is to proceed without a proceed order as set out in the contract.

1.23

STAGING

A.

The General Contractor shall provide all the vertical access (which includes

staging, vertical lifts, etc.) and hoisting for all the work of the Contract over 8’-0”

above grade or finish floor. General Contractor will provide complete coverage

of all wall areas receiving work and shall provide full decks and complete access

for File Sub-Bidders, subcontractors, as well as the Architect.

1.24

CONSTRUCTION BARRICADES

A.

The General Contractor shall provide all barricades to enclose the work area to

prevent unauthorized access to the site.

1.

The barricades shall provide enough room for all construction activities to

be performed while separated from pedestrians and staff on site.

2.

Safety is the sole responsibility of the Contractor and any barricades

necessary to protect the work and the public shall be provided.

1.25

INSURANCE

A.

The contractor shall purchase and maintain, at his expense all insurance required

by the Contract. Documents and all insurance required by the applicable laws of

Massachusetts, including but not limited to, General Laws, Chapter 146, in

connection with all hoisting equipment.

B.

The Contractor shall purchase and maintain such insurance as will protect him

from claims under workmen’s compensation acts and from claims for damages

because of bodily injury, including death and all property damage including,

without limitation, damage to buildings and adjoining the site of construction

which might arise from and during operations under this contract, whether such

operations be by himself or by any subcontractor or anyone directly or indirectly

employed by either of them including:

The contractor shall provide insurance for the payment of compensation

and the furnishing of other benefits under Chapter 152 of the General

Laws (so-called Worker’s Compensation Act) to all persons to be

employed under this contract and discontinuance of such insurance as

aforesaid shall be deemed a material breach of this Contract and shall

operate as an immediate termination thereof. The contractor shall, without

limiting the generality of the foregoing, conform to the provisions of

Section 34A of Chapter 149 of the General Laws, which Section is

A.

The General Contractor shall gain access to the site via routes approved by the

Owner.

Information about Prevailing Wage Schedules for Awarding Authorities and Contractors

• This wage schedule applies only to the specific project referenced at the top of this page and uniquely identified by the “Wage Request Number” on all pages of this schedule.

• An Awarding Authority must request an updated wage schedule from the Department of Labor Standards (“DLS”) if it has not opened bids or selected a contractor within 90 days of the date of issuance of the wage schedule. For CM AT RISK projects (bid pursuant to G.L. c.149A), the earlier of: (a) the execution date of the GMP Amendment, or (b) the bid for the first construction scope of work must be within 90-days of the wage schedule issuance date.

• The wage schedule shall be incorporated in any advertisement or call for bids for the project as required by M.G.L. c. 149, § 27. The wage schedule shall be made a part of the contract awarded for the project. The wage schedule must be posted in a conspicuous place at the work site for the life of the project in accordance with M.G.L. c. 149 § 27. The wages listed on the wage schedule must be paid to employees performing construction work on the project whether they are employed by the prime contractor, a filed sub-bidder, or any sub-contractor.

• All apprentices working on the project are required to be registered with the Massachusetts Division of Apprentice Standards (DAS). Apprentice must keep his/her apprentice identification cardon his/her person during all work hours on the project. An apprentice registered with DAS may be paid the lower apprentice wage rate at the applicable step as provided on the prevailing wage schedule. If an apprentice rate is not listed on the prevailing wage schedule for the trade in which an apprentice is registered with the DAS, the apprentice must be paid the journeyworker's rate for the trade.

• The wage rates will remain in effect for the duration of the project, except in the case of multi-year public construction projects. For construction projects lasting longer than one year, awarding authorities must request an updated wage schedule. Awarding authorities are required to request these updates no later than two weeks before the anniversary of the date the contract was executed by the awarding authority and the general contractor. For multi-year CM AT RISK projects, awarding authority must request an annual update no later than two weeks before the anniversary date, determined as the earlier of: (a) the execution date of the GMP Amendment, or (b) the execution date of the first amendment to permit procurement of construction services. Contractors are required to obtain the wage schedules from awarding authorities, and to pay no less than these rates to covered workers. The annual update requirement is not applicable to 27F “rental of equipment” contracts. • Every contractor or subcontractor which performs construction work on the project is required to submit weekly payroll reports and a Statement of Compliance directly to the awarding authority by mail or email and keep them on file for three years. Each weekly payroll report must contain: the employee’s name, address, occupational classification, hours worked, and wages paid. Do not submit weekly payroll reports to DLS. A sample of a payroll reporting form may be obtained at

http://www.mass.gov/dols/pw.

• Contractors with questions about the wage rates or classifications included on the wage schedule have an affirmative obligation to inquire with DLS at (617) 626-6953.

• Employees not receiving the prevailing wage rate set forth on the wage schedule may report the violation to the Fair Labor Division of the office of the Attorney General at (617) 727-3465.

• Failure of a contractor or subcontractor to pay the prevailing wage rates listed on the wage schedule to all employees who perform construction work on the project is a violation of the law and subjects the contractor or subcontractor to civil and criminal penalties.
