RESEARCH THESIS ABSTRACT

Title : Enhancement of Halal Food Legal Infrastructure

Halal business is not solely confined to Muslim community. Lately, Halal food,

cosmetics, pharmaceuticals and Islamic financing services have gained much attention

globally. Businesses around the world are developing this market. At present, there

is a growing global market for Halal food which is estimated to be RM 560 billion

(US$ 150 billion) per annum. In 2010, it was estimated that the value of Halal

products market amounted to USD2.1 trillion. It makes The Halal market is growing

fast in the world. There are many exhibition, forum and conference to educate people

and to disseminate information on Halal such as exhibition of World Food Market,

International Halal Showcase. Population of Muslim in the world is expected to reach

2 billion and this number will increase by 30 % out of the whole world population by

2025. The amount is expected to steadily increase following the growing number of

the Muslim population worldwide. The issue is whether or not the current legal

infrastructures particularly in Malaysia are effective in supporting Halal industry.

Currently, there is a lot of abuses recently relating to Halal in term of logo, especially

when it comes to food and products. The questions are whether or not Muslims’ rights

are fully protected under Halal Statutes and what are the rights conferred by law if

they are not complying to the regulation? For example, a question on the origins of

food or products ingredients and whether or not they comply with an Islamic

requirement, and if it does not, what is the best mechanism to overcome this issue in

order to protect the consumer. This research is conducted to address the consumer

issues arising from the practical aspect of Halal by studying and analysing the existing

law and Halal framework in Malaysia. In addition, this research seeks to highlight the

importance of enhancing the effectiveness of the current Halal industries legal

framework to achieve that objective. The methodology used is by referring to the

related laws, guidelines and policies from Malaysia and other jurisdictions. Other than

that, this research will provide some recommendations to enhance the effectiveness of

the legal infrastructures for Halal industries in order to enable the word Halal

becoming a marketing tool in winning the hearts of consumers as a symbol of healthy,

quality, clean and safe products in accordance with shari’ah requirements.
