DOMESTIC – POLICY WORDING

In consideration of payment of premium, We agree to pay benefits in accordance with the Conditions, Definitions, Exclusions and Provisions contained herein.

The application in respect of this Policy, the enrolment form and/or any declaration by You shall form the basis of this contract and be deemed to be incorporated herein and shall constitute the entire contract.

In witness whereof, We have caused this Policy to be executed and to commence on the Effective Date as stated in the Certificate of Insurance provided that no insurance shall be in force unless the Certificate of Insurance attached hereto is signed by Our authorized representative.

SECTION 1 – DEFINITIONS

In this Policy, unless otherwise defined or the context otherwise requires:

Accident or Accidental means a sudden, unforeseen and fortuitous event .

Acts of Terrorism means any actual or threatened use of force or violence directed at or causing damage, injury, harm or disruption, or commission of an act dangerous to human life or property, against any individual, property or government, which the stated or unstated objective of pursuing economic, ethnic, nationalistic, political, racial or religious interests, whether such interests are declared or not.

Robberies or other criminal acts, primarily committed for personal gain and acts arising primarily from prior personal relationships between perpetrator(s) and victim(s) shall not be considered Act of Terrorism. Act of Terrorism shall also include any act, which is verified or recognized by the (relevant) government as an act of terrorism.

Benefit means the respective benefit, as stated in the Certificate of Insurance, payable by the Company under the terms and conditions of this Policy in respect of each event or loss covered by this Policy.

Bodily Injury means Accidental injury sustained by an Insured Person resulting solely, directly and independently of all other causes from an Accident and caused by external, violent and visible means.

Certificate of Insurance means the Policy Schedule and/or Certificate of Insurance, as applicable, which is incorporated and forms part of this Policy.

Child(ren) means the eligible and legal child(ren), including stepchild(ren) and/or legally adopted child(ren) of the Insured Person.

Common Carrier means:

i) Any bus, coach, ferry, hovercraft, hydrofoil, ship, taxi, train, tram, or underground train provided by a carrier

duly licensed for the regular transportation of fare- paying passengers which has fixed and established routes, or

ii) Any helicopter provided and operated by an airline which is duly licensed for the regular transportation of fare- paying passengers provided that such helicopter is operating only between established commercial airports and/or licensed commercial heliports, or iii) Any fixed-wing aircraft provided and operated by an airline

or air charter company which is duly licensed for the regular transportation of fare-paying passengers which has fixed and established routes.

Confined or Confinement means Confinement in a Hospital for at least a Day as a Resident In-Patient (other than for day surgery) upon the advice of and under the regular care and attendance of a Physician and for this purpose, Day shall mean a period for which the Hospital charges for room and board.

Civil Commotion means a disturbance, commotion or disorder created by civilians usually against a governing body or the policies thereof.

Critical Medical Condition means a medical condition suffered by the Insured Person as a result of Bodily Injury , which is determined to be life-threatening by the Physician treating the Insured Person.

Death means death occurring solely, directly and independently of all other causes, as a result of a Bodily Injury.

Dental Expenses means reasonable and necessary charges for emergency dental treatment due to Bodily Injury caused by an Accident, carried out by a Dentist, medically necessary to treat the Insured Person’s condition, including charges for medical supplies or services, not exceeding the usual level of charges for similar treatment, supplies or medical services in the locality where the expense is incurred and does not include charges that would not have been made if no insurance existed.

Dentist means a legally licensed dentist or dental surgeon duly registered and practicing within the scope of his license pursuant to the laws of the country in which such practice is maintained. Dentist shall not include the Insured Person or any of their relatives.

Destination means the place(s) where the Insured Person expects to travel on the Journey, as shown on the travel itinerary.

Effective Date means the effective date shown in the Certificate of Insurance.

Family Member means an Insured Person’s Spouse, parents, parents-in-law, grandparents, Child(ren), daughter-in-law, son-in- law, brothers or sisters, brother-in-law, sister-in-law, grandchild(ren), step-brother, step-sister, step-parents, aunt, uncle, niece, nephew, Guardian.

Financial Default means either the complete suspension of operation due to financial circumstances whether or not bankruptcy petition is filed; or partial suspension of operations following a filling of a bankruptcy petition.

Guardian means an individual who has legal guardianship over the Insured Person before he/she reaches the age of eighteen (18).

Hazardous Adventures such as but not limited to mountaineering, abseiling or rock climbing necessitating the use of ropes and other climbing equipment, bungee jumping, parachuting, hot air balloon, offshore activities rafting or canoeing involving white water rapids, jet skiing, flying or other aerial activities , underwater activities involving the use of any artificial breathing apparatus to a depth of more than 25 metres, pot-holing, racing (other than on foot), ski-jumping, ski- bob racing, skiing off trail, freestyle skiing including the use of bob sleighs, hang-gliding, professional sporting activities and of any kind, any organized sporting holiday competitions.

Home means the Insured Person’s usual place of residence in Malaysia.

PART 1 INTERPRETATION

Hospital means a legally constituted establishment operated pursuant to the laws of the country in which it is based, which holds a license as a hospital (if licensing is required in the state or government jurisdiction) and meets the following requirements:- (a) operates primarily for the reception, care and medicare

and treatment of sick, ailing or injured persons as in- patients;

(b) provides full-time nursing service by and under the supervision of a staff of Nurses;

(c) has a staff of one or more Physicians available at all times;

(d) maintains organized facilities for the medical diagnosis and treatment of such persons, and provides (where appropriate) facilities for major surgery within the confines of the establishment or in facilities controlled by the established; and

(e) is not primarily a clinic, nursing, rest or convalescent home or similar establishment and is other than a place for alcoholics or drug addicts.

And Hospital shall not include the following: -

(a) a mental institution; an institution confined primarily to the treatment of psychiatric disease including sub-normally;

the psychiatric department of a hospital.

(b) a place for the aged; a rest home; a place for drug addicts or alcoholics.

(c) a health hydro or nature cure clinic; a special unit of a hospital used primarily as a place for drug addicts or alcoholics, or nursing, convalescent, rehabilitation, extended-care facility or rest home.

Insured Person means:-

a) an eligible person who is named in the Certificate of Insurance and/or declaration and is accepted for insurance coverage by the Company.

b) whose premium has been paid.

c) a dependent Child(ren) if he/she is specifically named in the Certificate of Insurance and whose premium has been paid under the Family Plan.

Insured and Spouse Plan shall mean the Insured Person and one of his/her legal Spouse.

Family Plan shall mean:-

(a) the Insured Person and his/her accompanying Child(ren);

or

(b) the Insured Person, one of his/her Spouse and his/her accompanying Child(ren).

Journey means any trip undertaken by the Insured Person within the Period of Insurance for leisure purpose which is:

i) Within Malaysia (other than between West Malaysia and East Malaysia and vice versa); and

ii) Excluding daily commute to and from the Insured Person’s place of employment or work; and

iii) More than fifty (50) kilometres from the Insured Person’s Home

and shall start from the time of leaving the Insured Person’s Home and continue until return to the Insured Person’s Home.

Loss of Limb means total functional disablement or loss by complete and permanent physical severance of a hand at or above the wrist or a foot at or above the ankle.

Loss of Sight means the entire and permanent loss of all sight in any eye rendering the Insured Person absolutely blind in that eye and beyond remedy by surgical or other treatment.

Nurse means any qualified or trainee nurse or general nurse duly registered pursuant to the laws of the country in which the nurse is employed.

Medical Expenses means Usual, Reasonable and Customary Medical Expenses necessarily and reasonably incurred in the medical or surgical treatment of Bodily Injury covered by this Policy.

Period of Insurance means the period during which the coverage under this Policy is effective, as stated in the Certificate of Insurance.

Permanent Total Disablement means disablement caused other than by Loss of Limb or Loss of Sight, which has lasted for a continuous and uninterrupted period of at least twelve (12) consecutive months from the date of Accident and which will, in all probability, entirely prevent the Insured Person from engaging in gainful employment of any and every kind for the remainder of his life and from which there is no hope of improvement.

Pre-existing Condition(s) means any condition which the Insured Person has reasonable knowledge of, in the ninety (90) days prior to the effective date of this insurance. The Insured Person is considered to have reasonable knowledge of a pre-existing condition where the condition is one for which:-

(i) the Insured Person had received or is receiving medical treatment, diagnosis, consultation or prescribed drugs, or (ii) medical advice, diagnosis, care or treatment was

recommended by a Physician, or

(iii) clear and distinct symptoms are or were evident, or (iv) its existence would have been apparent to a reasonable

person in the circumstances.

Physician means a medical practitioner (other than Insured Person, a member of his/her immediate family or relatives) qualified by a medical degree and duly licensed and registered to practice Western medicine and who, in rendering treatment, is practicing within the scope of his/her licensing and training in the geographical area of practice.

Return Journey means a return trip made by the Insured Person from their Home to a Destination within Malaysia and back to their Home, and shall commence on the later of the following:

(i) 12.00 a.m. on the Effective Date of the Period of Insurance specified in the Certificate of Insurance;

(ii) the time the Insured Person leaves his Home to commence the trip;

and shall terminate on the earlier of the following:

(iii) 11.59 p.m. on the expiry date of the Period of Insurance specified in the Certificate of Insurance;

(iv) the time the Insured Person returns to his Home

Return Journey does not include daily commute to and from the Insured Person’s place of employment or work.

Resident In-patient means an Insured Person whose Confinement is as a resident bed patient and whose confinement is due to Bodily Injury and is covered by this Policy and not merely for any form of nursing, convalescence, rehabilitation, rest or extended-care.

Riot means the act of any person taking part together with others in any disturbance of the public peace (whether in connection with a strike or lock-out or not) or the action of any lawfully constituted governmental authority in suppressing or attempting to suppress any such disturbance or in minimizing the consequences of such disturbance.

Scheduled Departure Date means the date on which the Insured Person is scheduled to depart on a Journey as set out in his travel itinerary.

Serious Bodily Injury means Bodily Injury which causes the Insured Person to be Confined in a Hospital for more than five (5) consecutive days and certified in writing by a Physician.

Sickness means physical condition marked by a pathological deviation from the normal healthy state as verified by a Physician.

Specially Designated Nationals List means names of a person, entities, groups, corporate specified on a list who are subject to as trade or economic sanctions or other such similar laws or regulations of the United States of America, Australia, United Nations, European Union or United Kingdom.

Spouse means the legal spouse of the Insured Person. For the purpose of this Policy, a Common Law marriage is not considered a legal marriage except as provided under the Law Reform (Marriage

& Divorce) Act 1976.

Strike means the willful act of any striker or locked-out worker done in furtherance of a strike or in resistance to a lock-out; or the action of any lawfully constituted authority in preventing or attempting to prevent any such act in minimizing the consequences of any such act.

The Company means ACE Jerneh Insurance Berhad.

Travel Companion means a person named on the individual application and/or declaration as accompanying the Insured Person on the entire Journey.

Usual, Reasonable and Customary Medical Expenses means charges for treatment, supplies or medical services medically necessary to treat the Insured Person’s condition, does not exceed the usual level of charges for similar treatment, supplies or medical services in the locality where the expense is incurred and does not include charges that would not have been made if no insurance existed.

PART 2 ELIGIBILITY

(i) To be eligible for cover under this Policy,:-

(i) the Insured Person must be a Malaysian or Malaysian Permanent Resident or valid work permit holder or valid employment pass holder or valid dependent pass holder or valid long- term social visit pass holder or valid student pass holder of at least eighteen (18) years of age on the Effective Date.

(ii) the Spouse must be a Malaysian or Malaysian Permanent Resident or valid work permit holder or valid employment pass holder or valid dependent pass holder or valid long-term social visit pass holder or valid student pass holder, at least eighteen (18) years of age on the Effective Date; and

(iii) the Child(ren), must be:-

(a) a Malaysian or Malaysian Permanent Resident or valid dependent pass holder or valid student pass holder (b) at least thirty (30) days of age and not

more than eighteen(18) years (or twenty-three (23) years if studying full- time in a recognized tertiary institution) on the Effective Date (c) unmarried

(d) unemployed.

PART 3 SCOPE AND LIMITS OF COVER AND BENEFITS

SECTION 1- COMMENCEMENT OF COVERAGE

Coverage under Section 8 of Part 7 – Travel Cancellation, insurance is effective upon the issuance of the Certificate of Insurance and terminates on commencement of the planned Journey from the Insured Person’s Home.

For all other sections, insurance commences upon commencement of a Journey.

SECTION 2 - LIMITS OF COVERAGE

1. Any cover under this Policy in respect of an Insured Person shall terminate on the earliest of the following events:-

(i) Upon the expiry of any Period of Insurance;

(ii) Upon the Insured Person ceasing to satisfy any of the eligibility requirements set out herein (iii) Upon the death of the Insured Person.

(iv) Upon return to the Insured Person’s Home.

2. Termination of cover under this Policy in respect of the Insured Person shall automatically terminate cover for all other Insured Persons.

3. Unless otherwise provided in an appropriate endorsement, the Insured Persons shall only be covered:

(i) for the first thirty (30) consecutive days of any Journey, and the Company shall not be liable in respect of any loss occurring after 12.00 a.m on the thirty first (31st ) day after the commencement of any Journey, or the expiry of the Period of Insurance stated in the Certificate of Insurance, whichever is earlier.

SECTION 3 – POLICY EXTENSION

1. In the event that the Insured Person, as a ticket holding passenger on a scheduled Common Carrier, being prevented from completing the return leg of a Return Journey within the Period of Insurance, as a result of:

(a) the Insured Person’s Critical Medical Condition;

or

(b) the scheduled Common Carrier in which the Insured Person is traveling being unavoidably delayed due to strike or industrial actions, adverse weather conditions or mechanical breakdown/derangement of the Common Carrier or due to grounding of an aircraft as a result of mechanical or structural defect;

the Period of Insurance shall be automatically extended for up to a period of seven (7) days without additional premium.

2. In the event that the Insured Person is being prevented from completing the return leg of a Return Journey within the Period of Insurance, as a result of the Insured Person’s being Confined in a Hospital at the Destination within Malaysia at the expiry of the Policy whilst during the Insured Person’s Journey, the Period of Insurance shall be automatically extended for up to seven (7) days without additional premium.

PART 4 GENERAL EXCLUSIONS

This Policy does not cover, and the Company will not in any event be liable to pay any Benefits or indemnify the Insured Person in respect of, any loss which is, directly or indirectly, caused by, a consequence of, arises in connection with or is contributed to by any of the following:

1. Declared or undeclared war or any act of war, invasion, act of foreign enemy, hostilities, civil war, rebellion, revolution, insurrection, military or usurped power.

2. Loss, destruction or damage to any property whatsoever or any loss or expense whatsoever arising there from or any consequential loss directly or indirectly caused or contributed by or arising from ionizing radiations or contamination by radio-activity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel.

3. Any willful or intentional acts of the Insured Person whether sane or insane, self-inflicted injury, suicide pacts or agreements or any attempts thereat, provoked homicide or assault.

4. The Insured Person acting as a law enforcement officer, emergency medical or fire service personnel, civil defense personnel or military personnel of any country or international authority, whether full-time service or as a volunteer.

5. The Insured Person engaging in, practicing for or taking part in training in any speed contest, any professional competition or sports, and participating in Hazardous Adventure.

6. Any condition, which is or results from or is a complication of infection with Human Deficiency Syndrome (‘HIV’), any variance including Acquired Immune Deficiency Syndrome (‘AIDS’), and AIDS Related Complications (‘ARC’), or any opportunistic infections and/or malignant neoplasm (tumor) found in the presence of HIV, AIDS or ARC.

7. Any condition which is, results from or a complication of pregnancy, childbirth, miscarriage (except miscarriage due to Bodily Injury as direct result of an Accident as covered under Section 2) or abortion, -

8. The alcohol content in the blood and/or urine samples exceeding the limit permitted by law of the country in which the Bodily Injury occurred or drugs not prescribed by a Physician and not for treatment of drug addiction.

9. Illegal acts (or omissions) of the Insured Person or the Insured Person’s executors, administrators, legal heirs or personal representatives, loss resulting directly or directly from action taken by the Government Authorities including confiscation, seizure, destruction and restriction.

10. The Insured Person engaging in aviation, other than as a fare-paying passenger in, boarding and alighting from any fixed-wing aircraft provided and operated by a regularly scheduled airline or private unscheduled air chartered company which is duly licensed for the regular transportation of fare-paying passengers or in a helicopter provided and operated by an airline which is duly licensed for the regular transportation of fare-paying passengers, provided such helicopter is operated only between established commercial airports and/or licensed heliports.

11. Any loss or expenses which is, directly or indirectly, caused by, a consequence of, arises in connection with or is contributed to by the Insured Person undertaking any Journey against the advice of a Physician or for the purpose of seeking medical attention.

12. Any Pre-existing Conditions or congenital conditions 13. Any prohibition or breach of government regulation or any

failure by the Insured Person to take reasonable precautions to avoid a claim under this Policy following the warning of any intended strike, riot or civil commotion through or by general mass media.

14. The Insured Person not taking all reasonable efforts to safeguard his property or to avoid any injury or minimize any claim under the policy.

15. Any condition which is, results from or a complication of suicide or attempted suicide or intentional self-injury.

16. Illnesses or disorders of a psychological nature, Mental and nervous disorders, including but not limited to insanity.

17. whilst engaging in naval, military or air force service or operation or testing of any kind of conveyance or being employed as a manual worker or whilst engaging in offshore activities like diving, oil-rigging, mining or aerial photography or handling of explosive or loss of or damage to hired or leased equipment, .

18. Any condition which results from or is a complication of venereal disease.

19. Any loss or expenses which arises in connection with or is contributed by the Insured Person undertaking any Journey against the travel advice of the Ministry of Foreign Affair of Malaysia or the Ministry of Health of Malaysia , in relation to actual or threatened riot, strike or civil commotion, war or warlike situation, outbreak of disease or unsafe health conditions, or impending natural disasters, to the country or territory of the Insured Person’s Destination, unless the Journey had already commenced prior to the issuance of the travel advice.

20. Consequential loss or damage of any kind.

21. Any losses caused by terrorist attacks by nuclear, chemical and/or biological substances.

22. The Insured Person’s direct participation in terrorist acts.

23. Sickness, illness, diseases, or any bacterial infection other than bacterial infection that is the direct result of accidental cut or wound.

24. Any loss or expenses with respect to Cuba or a specially designated person, entity, group or company on the Specially Designated Nationals List or which if reimbursed or paid by the Company would result in the Company being in breach of trade or economic sanctions or other such similar laws or regulations.

PART 5 SPECIAL CONDITIONS

1. CANCELLATION

The Company will not refund the premium once the Certificate of Insurance or policy is issued.

2. AGE LIMIT ELIGIBILITY

The age eligibility for the Insured Person to qualify for cover under the Policy is thirty (30) days up to eighty (80) years of age on the Effective Date.

In the event that the Insured Person is below the age of eighteen (18), the Insured’s parent or Guardian shall enter into this contract of insurance with the Company for the benefit of the Insured Person.

PART 6 GENERAL CONDITIONS 1. PAYMENT BEFORE COVER WARRANTY

It is hereby agreed and declared that the total premium due must be paid and actually received in full by the Company (or the intermediary through whom this Policy was effected) on or before the Effective Date of the coverage under the Policy, Renewal Certificate or Cover Note.

In the event that the total premium due is not paid and actually received in full by the Company (or the intermediary through whom this Policy was effected) on or before the Effective Date referred to above, then the Policy, Renewal Certificate, Cover Note and Endorsement shall not attach and no benefits whatsoever shall be payable by the Company. Any payment received thereafter shall be of no effect whatsoever as cover never attached on the Policy, Renewal Certificate or Cover Note.

2. ENTIRE CONTRACT, CHANGES

This Policy, the Certificate of Insurance and any amendments or endorsements shall constitute the entire contract of insurance. No change to the terms and conditions of this Policy shall be valid unless approved in writing by an authorized representative of the Company and such approval shall be endorsed hereon or attached hereto. No broker or agent has the authority to amend or to waive any of the terms and conditions of this Policy.

3. CONDITIONS PRECEDENT TO LIABILITY

The liability of the Company for any Benefit under this Policy is conditional upon:

(a) the truth of the statements and information as provided to the Company by the Insured Persons;

and

(b) the due observance and fulfillment of the terms and conditions of this Policy insofar as they relate to anything to be done or complied with by the Insured Persons.

4. LEGAL ACTION

No action shall be brought to recover on this Policy prior to the expiration of sixty (60) days after written proof of claim has been filed in accordance with the provisions of this Policy.

5. MISREPRESENTATION

This Policy shall be voidable in the event of any misrepresentation, misdescription, non-disclosure or concealment of any circumstances by the Insured Persons which is material to or connected with:

(a) the Insured Persons' risk experience and claim history;

(b) the Insured Persons' insurance record, including previous refusals to grant insurance coverage.

6. FRAUD

If any claim under this Policy shall be, in any respect, fraudulent or if any fraudulent means or devices shall be used by any person to obtain a Benefit under this Policy, the Company shall have no liability in respect of such claim and the Company shall be entitled to terminate this Policy with immediate effect.

7. CLAIMS PROCEDURE

On the happening of any occurrence likely to give rise to a claim under this Policy, written notice shall be given to the Company’s Claims Department, Wisma ACE Jerneh, 38 Jalan Sultan Ismail, 50250 Kuala Lumpur, as soon as possible and, in any event, within thirty (30) days after the date of the occurrence. The Company will provide the Insured Person with forms for filing proof of claim.

Any documents or evidence required by the Company to verify the claim shall be provided by the Insured Person at his own expense. Any medical examination required by the Company to verify the claim will be at the Company’s expense. The Company has a right to reject any claims upon the failure of the Insured Person to provide the required documentation.

The Company shall, in the event of the death of an Insured Person, be entitled to have a post-mortem examination performed or shall have the right and opportunity to arrange an autopsy at its own expense where it is not prohibited by law.

8. PAYMENT OF BENEFITS

Payment of any benefit under this Policy is subject to the Definitions, Exclusions, and all other terms and conditions pertinent to the benefits.

Benefits payable under this Policy shall be paid to the Insured Person.

In the event of Insured Person death, the Benefits shall be paid to the nominated beneficiary or to the estate or in accordance with the law if there is no such nominated beneficiary.

9. INTERPRETATION

This Policy, including the application, certificate, endorsement, and amendments, if any shall be read together as one contract and any word or expression to which a specific meaning has been attached shall, unless the context otherwise requires, bear that specific meaning wherever it may appear.

10. TERMINATION FOR NON-PAYMENT OF PREMIUM This Policy shall be deemed to have been void from the intended Effective Date if the premium is not paid.

11. COMPANY’S RIGHT AFTER A CLAIM

The Company shall be allowed to conduct in the Insured Person’s name and on behalf of the Insured Person the defence or settlement of any legal action and take proceedings at the Company’s own benefit but in the Insured Person’s name to recover compensation from any third party in respect of anything covered by this Policy.

12. MULTIPLE POLICIES

The Insured Person can only be covered under one travel insurance policy underwritten by the Company for the same Journey.

13. COMPLIANCE WITH POLICY PROVISIONS

Failure to comply with any of the provisions contained in this Policy shall invalidate all claims hereunder.

14. CONTRIBUTION

In the event the Insured Person becomes entitled to a refund of or reimbursement of all or part of such expenses from any other source, or if there is in place any other insurance against the events covered under this Policy, the Company will only be liable for the excess of the amount recoverable from such other source or insurance.

15. JURISDICTION

All disputes relating to this Policy must be submitted to the exclusive jurisdiction of the courts in Malaysia.

16. NOTICE OF TRUST OR ASSIGNMENT AND THIRD PARTY RIGHTS

The Company shall not be bound or be affected by any notice of any trust, charge, lien, assignment or other dealing with or in relation to this Policy.

A person who is not a party to this Policy contract shall have no right to enforce any of its terms.

17. ARBITRATION

All differences arising out of this Policy shall be referred to the decision of an Arbitrator to be appointed in writing by the parties in difference or if they cannot agree upon a single Arbitrator to the decision of two Arbitrators, one to be appointed in writing by each of the parties within one calendar month after having been required in writing so to do by either of the parties or, in the case the Arbitrators do not agree, of an Umpire appointed in writing by the Arbitrators before entering upon the reference. The Umpire shall sit with the Arbitrators and preside at their meeting. The cost of the reference and of the award shall be at the discretion of the Arbitrator, Arbitrators and Umpire making the award. And it is hereby expressly stipulated and declared it shall be a condition precedent to any right of action or suit upon this Policy that the award by such Arbitrator, Arbitrators and Umpire of the amount of Benefit if disputed, shall be first obtained.

18. GOVERNING LAW

This Policy shall be governed by and interpreted in accordance with Malaysian law.

19. INTEREST

No amounts payable by the Company under this Policy shall carry interest unless provided by law.

20. CURRENCY

Premiums and benefits payable under this Policy shall be in Malaysian Ringgit.

21. CLERICAL ERROR

A clerical error by the Company shall not invalidate insurance otherwise validly in force, nor continue insurance otherwise not validly in force.

22. GEOGRAPHICAL AREAS Within West Malaysia or Within East Malaysia

PART 7 BENEFITS

SECTION 1 – PERSONAL ACCIDENT

If, during the Period of Insurance, whilst the Insured Person is on a Journey, the Insured Person sustains Bodily Injury which results in Death or Loss of Limb, Loss of Sight or Permanent Total Disablement within three hundred and sixty five (365) days from the date of the Accident, the Company will pay up to 100% of the relevant Benefit amount specified in the Certificate of Insurance subject to the terms and conditions of this Policy.

Benefit

1. Accidental Death

2. Permanent Total Disablement

3. Loss of one or more Limbs or Sight of one or both eyes Provisions

a) If the Insured Person is below the age of eighteen (18) years at the time of Bodily Injury the Benefits payable under 1 or 2 or 3 will be limited to the Benefit amount specified on the Certificate of Insurance.

b) The maximum amount of all benefits payable for one or more Bodily Injuries sustained by the Insured Person shall not exceed the Benefit amount specified on the Certificate of Insurance.

c) The Company will not pay for loss caused by or resulting from Sickness of any kind.

d) Subject to the limit of liability stated in the Certificate of Insurance for each Insured Person, the Company’s

maximum aggregate limit of liability per accident for all Insured Persons covered under this Policy shall not exceed RM15,000,000. In the event the aggregate amount of compensation payable in respect of such Insured Persons exceed this maximum aggregate limit, the Company’s liability for each Insured Person shall be proportionately reduced until the total benefits payable does not exceed the aggregate limit of liability.

Exposure and Disappearance

When, by reason of a Bodily Injury occurring during the Period of Insurance and whilst the Insured Person is on a Journey, the Insured Person is exposed to the elements and, as a result of such exposure suffer Death, such Death shall be covered hereunder subject to the definitions and all other terms and conditions of this Policy.

If the Insured Person’s body is not found within one (1) year of the disappearance, forced landing, stranding, wrecking, or sinking of a conveyance in which the Insured Person was an occupant, and a Court of Law has pronounced the Insured Person to be missing and legally presumed dead, the disappearance shall be considered to constitute a claim under this Policy. It is further agreed and understood that if at any time after payment has been made and the Insured Person is found to be living, any sums paid by the Company in settlement of the claim shall be refunded to the Company.

SECTION 2– MEDICAL EXPENSES

If, during the Period of Insurance, whilst the insured Person is on a Journey, the Insured Person incurs Medical Expenses as a direct result of Bodily Injury or Dental Expenses the Company will indemnify the Insured Person in respect of such expenses up to the relevant Benefit amount specified in the Certificate of Insurance subject to the terms and conditions of this Policy.

Covered Expenses

The Company will pay the Usual, Reasonable and Customary Medical Expenses:

a) for medical, hospital, surgical treatment necessarily incurred as a direct result of Bodily Injury sustained contracted by the Insured Person occurring during the Period of Insurance. The treatment must be given by a Physician.

b) for emergency dental treatment as a result of Bodily Injury to sound natural teeth occurring during the Period of Insurance. The treatment must be given by a Dentist.

Additional Conditions

1. For the avoidance of doubt, in the event the Insured Person becomes entitled to a refund of or reimbursement of all or part of such expenses from any other source, or if there is in place any other insurance against the events covered under this section, the Company will only be liable for the excess of the amount recoverable from such other source or insurance.

2. The Insured Person should seek necessary medical treatment at any registered clinic or Hospital within twenty- four (24) hours of the Accident causing the covered Bodily Injury. Follow-up treatment for the same covered Bodily Injury will be provided up to the last day of Period of Insurance.

Additional Exclusions

In addition to the General Exclusions, this Policy does not cover, and the Company will not in any event be liable in respect of any claim under this Medical Expenses section which is directly or indirectly, caused by, a consequence of, arises in connection with or contributed to by any of the following:

1. Any expenses incurred for prostheses, contact lenses, spectacles, hearing aids, medical equipment, dentures, or any dental work involving the use of precious metals.

2. Any expenses relating to any treatment not prescribed by a Physician

3. Any expenses incurred in relation to traditional treatment or treatment by a Chinese Physician.

4. Surgery or medical treatment which in the opinion of the Physician treating the Insured Person can be reasonably delayed until the Insured Person’s return to their Home.

5. The additional cost of single or private room at a Hospital

SECTION 3 – COMPASSIONATE VISIT

If, during the Period of Insurance, whilst the Insured Person is on a Journey, the Insured Person sustains Serious Bodily Injury or Death, the Company will pay the Compassionate Allowance expenses for travel (economy return train or air travel) and accommodation expenses up to the relevant Benefit amount specified in the Certificate of Insurance necessarily incurred for one (1) relative or friend who on written advice of a Physician (except in cases of death), are required to remain with the Insured Person or in the event of death, travel to the Insured Person’s place of death to arrange for the repatriation of the Insured Person’s body or remains.

SECTION 4 - CHILD GUARD

If, during the Period of Insurance, whilst the Insured Persons are on a Journey, the Insured Person is Confined in a Hospital at the Destination within Malaysia and there is no other adult to accompany the Insured Child(ren) on their journey home, the Company will indemnify the Insured Person for hotel accommodation and travel (economy return train or air travel) expenses necessarily incurred for one (1) relative or friend to fly to and accompany the Insured Person’s Child(ren) back to the Insured Person’s Home, up to the relevant Benefit amount specified in the Certificate of Insurance subject to the terms and conditions of this Policy.

SECTION 5 – DAILY HOSPITAL INCOME (Applicable to Sapphire Plan only)

If, during the Period of Insurance, whilst the Insured Person is on a Journey, the Insured Person is necessarily Confined in a Hospital at the Destination within Malaysia due to Bodily Injury, the Company will pay the Insured Person the Benefit specified in the Certificate of Insurance for every complete day up to maximum number of days specified in the Certificate of Insurance. No benefit will be payable for Hospital Confinement upon return to the Insured Person’s Home.

Provisions

a) Physician’s care and attendance

No benefit shall be paid for Hospital Confinement when the Insured Person is not under the regular care and attendance of a Physician

b) Benefits when Insured Person is over 65 years of age During the Insured Person’s Hospital Confinement, if the Insured Person is over age 65 but under age 80 on the date of commencement of such Confinement, the Basic Daily Benefit shall be limited to RM50 for each complete day up to maximum number of days specified in the Certificate of Insurance.

c) No Benefit will be payable if the Hospital Confinement is not covered under Section 2 – Medical Expenses.

SECTION 6 – EMERGENCY MEDICAL EVACUATION AND REPATRIATION

If, during the Period of Insurance, whilst the Insured Person is on a Journey, as a result of an Insured Person being in a Critical Medical Condition which requires medical evacuation and use of the services of ACE Assistance, the Company will indemnify ACE Assistance for all Medical Evacuation Expenses or Emergency Repatriation Services incurred on behalf of the Insured Person, subject to the terms and conditions of this Policy.

Conditions

1. ACE Assistance must be promptly informed of any potential claims for Medical Evacuation Expenses 2. The Insured Person shall not attempt to provide solutions

to problems encountered without involving ACE Assistance. Such action shall prejudice all claims for Medical Evacuation Expenses.

3. Repatriation will be organized by ACE Assistance by the most appropriate method as determined by ACE Assistance in its absolute discretion including, if necessary, the use of air services.

4. In the event that ACE Assistance are provided under this Policy to any person not insured under this Policy or situations not covered by this Policy at Insured Person’s request, the Insured Person hereby agree to pay ACE Assistance directly for all costs incurred for the said services.

5. In the event that ACE Assistance service are provided, the Company will have the right to recover from the Insured

Person the value of the refund relating to any air tickets or other tickets originally purchased for the Journey to the Hospital where appropriate medical care and facilities are available.. The Insured Person shall assist the Company in recovering any refunds from the carriers concerned.

The proceeds of such refund shall belong to the Company.

6. The Insured Person hereby agrees to pay ACE Assistance directly for any Medical Evacuation Expenses incurred by the Insured Person that is in excess of the relevant Benefit specified in the Certificate Schedule.

7. The Insured Person must comply in full with the decisions made by ACE Assistance. Failure to comply in full exempts ACE Assistance and the Company from any liability and all rights under this policy will cease immediately.

The Insured Person hereby agree to fully indemnify the Company in the event the Company is held liable to pay ACE Assistance for any of the services mentioned under clause 4 and/or 6 above and/or any other services not covered under this Policy.

Additional Definitions

Medical Evacuation Expenses means all expenses incurred in repatriating the Insured Person who is suffering from a Critical Medical Condition to the nearest Hospital where appropriate medical care and facilities are available or to the Insured Person’s Home including necessary expenses incurred for qualified medical staff to accompany the Insured Person (as deemed necessary by ACE Assistance in its absolute discretion), provided that such repatriation is:

a) Certified by a Physician to be medically necessary and b) Organized by ACE Assistance.

Emergency Repatriation Expenses means all funeral expenses incurred in the burial or cremation of the Insured Person outside of their Home, or the costs incurred for transporting the Insured Person’s body back to their Home.

Additional Exclusions

In addition to the General Exclusions, this Policy does not cover, and the Company will not in any event be liable in respect of any claim under this Emergency Medical Evacuation and Repatriation section which is directly or indirectly, caused by, a consequence of, arises in connection with or contributed to by any of the following:

1. Any expenses incurred for services provided by another party for which the Insured Person is not liable to pay, or any expenses already included in the cost of a scheduled trip.

2. Any expenses for a service not approved and arranged by ACE Assistance or its authorized representative.

3. Any treatment performed or ordered by a person who is not a Physician.

4. Any expenses incurred if the Insured Person is not suffering from a Critical Medical Condition or if the treatment can be reasonably delayed until the Insured Person returns to their Home.

5. Any expenses which are recoverable from any other insurance coverage that the Insured Person is entitled to.

6. Any such expenses that are incurred after thirty (30) days from the time of Accident or when the Sickness was first diagnosed. This exclusion does not apply when the first expense was incurred in the first 30 days from the date of Bodily Injury or Sickness.

7. Any expenses where there is no valid claim under Section 2 – Medical Expenses.

SECTION 7 – PERSONAL LIABILITY

If, during the Period of Insurance, whilst the Insured Person is on a Journey, the Insured Person incurs legal liability to a third party, the Company will indemnify the Insured Person in respect of each occurrence or a series of occurrences giving rise to such liability arising directly or indirectly from one (1) source or original cause, up to the Benefit amount as specified in the Certificate of Insurance subject to the terms and conditions of this Policy as a result of:

(i) Accidental Death or Bodily Injury to any third party; and (ii) Accidental Property Damage to property of third party.

The Company will also reimburse the Insured Person for:

a) All cost and expenses in respect of which a claim of damages for negligence under this Personal Liability Section is recoverable by a third party claimant from the Insured Person.

b) All cost and expenses in respect of which a claim of damages for negligence under this Personal Liability Section incurred with the Company’s written consent

Our liability under this cover for each claim shall not exceed the amount specified in the Certificate of Insurance for each of the Insured Person.

Additional Conditions

1. For the avoidance of doubt, in the event the Insured Person becomes entitled to a refund or reimbursement of all or part of such expenses from any other source, or if there is in place any other insurance against the events covered under this section, the Company will only be liable for the excess of the amount recoverable from such other source or insurance.

2. No admission, offer, promise, payment or indemnity shall be made without the Company’s written consent and the Company shall be entitled to take over and conduct in the Insured Person name the defence or settlement of any claim or to prosecute in the Insured Person name for the Company’s own benefit any claim for indemnity or damages or otherwise and shall have full discretion in the conduct of any proceedings and in the settlement of any claim and the Insured Person hereby agree to give all information and assistance as the Company may require.

Every letter, claim, writ, summons and process shall be forwarded to the Company upon receipt. Written notice shall also be given to the Company immediately upon the Insured Person receiving notice of any prosecution or inquest in connection with any circumstances which may give rise to liability under this coverage.

3. The Company may at any time pay to the Insured Person in connection with any claim or series of claims the limit of indemnity (after the deduction of any sum(s) already paid as compensation) or any lesser amount for which such claim(s) can be settled and upon such payment being made the Company shall relinquish the conduct and control of and be under no further liability in connection with such claim(s) except for the payment of costs and expenses recoverable or incurred prior to the date of such payment.

Additional Definitions

Property Damage means any physical damage to, destruction of, or loss of use of tangible property.

Additional Exclusions

In addition to the General Exclusions, this Policy does not cover, and the Company will not in any event be liable in respect of any claim under this Personal Liability section which is directly or indirectly, caused by, a consequence of, arises in connection with or contributed to by any of the following:

1. Harm and Property Damages to the property of or to any person who is the Insured Person’s relative or employee or deemed by law to be his employee.

2. In respect of death, disablement, bodily injury suffered by any person who is under a contract of service or training with the Insured Person when such bodily injury arises out of and in the course of his or her employment by the Insured Person.

3. In respect of death, disablement, bodily injury suffered by any member of the Insured Person’s family or any person with whom the Insured Person resides.

4. Property Damage to property which belongs to the Insured Person or held in trust by the Insured Person or is in his custody or control.

5. Damages relating to any liability assumed under contract.

6. Damages relating to the willful, malicious or unlawful act or omission on the part of the Insured Person.

7. The ownership, possession or use of vehicles, aircraft, watercraft, firearms or animals, or arising from the negligent supervision and vicarious liability for the acts of a minor in connection with the above.

8. Past or present business, trade or professional activities, including the rendering of or failure to render business, trade or professional services.

9. Any criminal proceedings taken against the Insured Person whether he is actually convicted or not.

10. The transmission of communicable disease by an Insured Person.

11. The possession or use of any controlled substance/drugs unless prescribed by a Physician.

12. Sexual molestation, corporal punishment, physical or mental abuse

13. Pollution which includes the alleged or potential introduction of substance which makes the environment impure or harmful.

14. The influence of intoxicants, riding or driving in races or rallies.

SECTION 8 –TRAVEL CANCELLATION

If during the Period of Insurance, the Insured Person incur expenses as a direct and necessary result of the Journey being cancelled due to the following reasons, the Company will pay up to the benefit amount as specified in the Certificate of Insurance for each loss of irrecoverable deposits or charges paid in advance or contracted to be paid:-

(i) the Insured Person dying or becoming ill or sustaining Bodily Injury rendering the Insured Person unfit to travel in the opinion of a Physician;

(ii) the death of the Insured Person’s Family Member or Travel Companion or Bodily Injury or Sickness of such person necessitating him to be Confined to a Hospital;

(iii) the Insured Person’s residence becoming uninhabitable following fire, storm, or flood occurring such that the Insured Person’s presence is required on the premises on the Scheduled Departure Date;

Whereby, in the context of cancellation of a Journey, for paragraphs (i) to (iii), the events mentioned occur within -seven (7) days before the Scheduled Departure Date, and must be accompanied with travel advice from relevant authority(s).

Additional Exclusions

In addition to the General Exclusions, this Policy does not cover, and the Company will not in any event be liable in respect of any claim under this Trip Cancellation section which is directly or indirectly, caused by, a consequence of, arises in connection with or contributed to by any of the following:

1. Changes in plans by the Insured Person or a Family Member or Travel Companion for any reason;

2. Financial circumstances of the Insured Person or a Family Member or Travel Companion;

3. Pre-existing medical condition of a Family Member or Travel Companion.

4. Any business, financial or contractual obligations of the Insured Person or a Family Member or Travel Companion;

5. Financial Default by the person, agency, airline or tour operator with whom the Insured Person made his travel arrangements;

6. Any loss that is covered by any other existing insurance scheme, government programme or which will be paid or refunded by a hotel, carrier or travel agent or any other provider of travel and/or accommodation.

7. Any government regulation or prohibition.

8. Carrier caused cancellation unless they are the result of matters stated under items 10 (iv) or (vi) above.

9. Travel arrangements cancelled by an airline, cruise line or tour operator unless the cancellation is the result of matters stated under items 10 (iv) and (vi) above.

10. An event or circumstance which occurs prior to the effective date as stated in the Certificate of Insurance.

11. Government regulation or act, delay or amendment of the booked itinerary, or failure in provision of any part of the booked Journey (including error, omission or default) by the provider of any service forming part of the booked Journey as well as of the agent or tour operator through whom the Journey was booked.

12. The Insured Person on whom the Journey is dependent on being involved in any unlawful act or criminal proceedings, unless the Insured Person’s attendance in

court in such criminal proceedings in a court of law is required under a subpoena.

13. The Insured Person’s failure to notify travel agent/tour operator or provider of transport or accommodation immediately upon finding it necessary to cancel the travel arrangements.

SECTION 9 – TRAVEL CURTAILMENT

If, during the Period of Insurance, the Insured Person is forced to curtail any part of a Journey, the Company will reimburse the Insured Person for the proportional return of irrecoverable prepaid costs of the planned trip as shown on the booking invoice, calculated at pro-rata basis for each complete day from the day of arrival back to the Insured Person’s Home necessarily and unavoidably incurred due to curtailment of planned trip due to:

a) The Insured Person suffering Serious Bodily Injury and upon obtaining medical advice during the Insured Person’s Journey. A medical certificate must be obtained from the Physician who is treating the Insured Person, advising the Insured Person to return to their Home due to the Serious Bodily Injury.

b) Unexpected death, Serious Bodily Injury of the Insured Person’s family members traveling with the Insured Person, or Travel Companion.

c) Unexpected death or Serious Bodily Injury of any of the Insured Person’s family members remaining in the Insured Person’s Home which requires Hospital Confinement for more than five (5) consecutive days.

d) Natural disasters which prevent the Insured Person from continuing their scheduled Journey.

e) The Insured Person’s residence becoming uninhabitable following fire, storm, or flood occurring such that the Insured Person’s presence is required on the premises

If the prepaid costs claimed are confined to air tickets, or Common Carrier’s tickets the reimbursement will only be on the unused sector of the travel tickets.

For Death of the Insured Person, proportional return of the irrecoverable prepaid cost shall be calculated from the date of occurrence to the expiry of the planned trip or policy cover whichever is earlier.

This coverage is effective only if the policy is purchased before the Insured Person become aware of any circumstances, which could lead to the disruption of the planned Journey.

Additional Definition

Curtailment means cutting short the Journey by early return to the Insured Person’s Home after arrival at the booked Destination as shown on the booking invoice or ticket.

Additional Exclusions

In addition to the General Exclusions, this Policy does not cover, and the Company will not in any event be liable in respect of any claim under this Trip Curtailment section which is directly or indirectly, caused by, a consequence of, arises in connection with or contributed to by any of the following:

1. Changes in plans by the Insured Person or a Family Member or Travel Companion for any reason;

2. Financial circumstances of the Insured Person or a Family Member or Travel Companion;

3. Any business, financial or contractual obligations of the Insured Person or a Family Member or Travel Companion;

4. Financial Default by the person, agency or tour operator with whom the Insured Person made his travel arrangements;

5. Any loss that is covered by any other existing insurance scheme, government programme or which will be paid or refunded by a hotel, carrier or travel agent or any other provider of travel and/or accommodation;

6. Government regulation or act, delay or amendment of the booked itinerary, or failure in provision of any part of the booked Journey (including error, omission, default) by the provider of any service forming part of the booked Journey as well as of the agent or tour operator through whom the Journey was booked;

7. The Insured Person on whom the Journey is dependent on being involved in any unlawful act or criminal proceedings, unless the Insured Person’s attendance in court in such criminal proceedings in a court of law is required under a subpoena;

8. The Insured Person’s failure to notify the travel agent or provider of transport or accommodation immediately after it is found necessary to cancel or curtail the travel arrangement;

9. Pre-existing medical condition of a Family Member or Travel Companion.

This Policy will only pay for any claim either under Section 8 or Section 9 but not both.

SECTION 10– TRAVEL DELAY

If, during the Period of Insurance, whilst the Insured Person is on a Journey, the departure of the scheduled aircraft, train, or sea vessel in which the Insured Person had arranged to travel is delayed for at least six (6) consecutive hours at any single Destination from the time specified in the itinerary supplied to the Insured Person due to strike or industrial action, adverse weather conditions or mechanical failure of the aircraft, train or ship, the Company will pay the Insured Person the relevant Benefit amount specified in the Certificate of Insurance for every full six (6) consecutive hours of delay (the delay being calculated from the departure time of the aircraft, train or sea vessel specified in the itinerary), up to the maximum Benefit amount specified in the Certificate of Insurance.

The delay must be verified in writing by the operator(s) of the Common Carrier or their handling agent(s) as well as the number of hours.

The coverage under this Section only applies to schedule Common Carriers, which the Insured Person had duly confirmed according to the scheduled Common Carrier rules and regulations. Any delay of chartered carrier is not covered.

Additional Exclusions

In addition to the General Exclusions, this Policy does not cover, and the Company will not in any event be liable in respect of any claim under this Travel Delay section which is directly or indirectly, caused by, a consequence of, arises in connection with or contributed to by any of the following:

1. Failure of the Insured Person to check in according to the itinerary supplied to him;

2. Strike or industrial action existing on the date the Insured Person applied for cover under this Policy;

3. Late arrival of the Insured Person at the airport, station or port after check-in or boarding time (except if the late arrival is due to strike or industrial action).

4. Compensation unless the Insured Person has obtained written confirmation from the airline, railway or shipping line or their handling agents showing the scheduled departure time and the actual departure time of the flight, journey or sailing.

5. Failure of public transport services arising from strike or industrial action which commenced or was announced before the departure from the Insured Person’s home

SECTION 11 – LOSS OR DAMAGE OF PERSONAL EFFECTS AND BAGGAGE

If, during the Period of Insurance, whilst the Insured Person is on a Journey, the Insured Person sustains loss of or damage to his Personal Property and Baggage, the Company will indemnify the Insured Person in respect of such loss up to the relevant Benefit amount stated in the Certificate of Insurance subject to the terms and conditions of this Policy.

Additional Conditions

(a) The Company will not pay more than the single article limit shown on the Certificate of Insurance for any one article or a pair or a set of articles..

(b) In respect of articles more than one year old, the Company may make payment subject to due allowance of wear and tear and depreciation or at its option reinstate or repair such articles.

(c) The loss or damage must be reported to the police or relevant authority having jurisdiction where the loss or

damage occurred within twenty-four (24) hours from the incident. Any claims for indemnity under this section must be accompanied by a copy of a police report or a report issued by the relevant authority evidencing such loss.

(d) For the avoidance of doubt, in the event the Insured Person becomes entitled to a refund or reimbursement of all or part of such expenses from any other source, or if there is in place any other insurance against the events covered under this section, the Company will only be liable for the excess of the amount recoverable from such other source or insurance.

Additional Definitions

Personal Property and Baggage means personal goods belonging to the Insured Person, which are taken by him on the Journey or acquired by him and carried on his person or hand-carried or check- in as accompanied baggage with the carrier during the Journey.

Portable Computer(s) means laptop, Notebook, Netbook, I Pad and hand-held computers.

Additional Exclusions

In addition to the General Exclusions, this Policy does not cover, and the Company will not in any event be liable in respect of any claim under this Loss of Personal Effects and Baggage section which is directly or indirectly, caused by, a consequence of, arises in connection with or contributed to by any of the following:

1. loss or damage of baggage caused by wear and tear, gradual deterioration, moths, vermin, inherent vice or damage sustained due to any process or while actually being worked upon or resulting therefrom.

2. loss or damage of baggage caused by mechanical or electrical breakdown or derangement or damage sustained due to any process initiated by an Insured Person to repair, clean or alter any baggage.

3. loss or damage of baggage resulting directly or directly from insurrection, rebellion, revolution, civil war, usurped power, or action taken by governmental authorities in hindering, combating or defending against such an occurrence, seizure or destruction under quarantine or customs regulations, confiscation by order of any government or public authority or risk of contraband or illegal transportation or trade.

4. loss or damage of property from confiscation or retention by customs or other officials or government authority.

5. loss or damage of property as a result of the Insured Person’s failure to take due and reasonable care and precautions to safe-guard and secure such property.

6. loss or damage of watches, Portable Computer(s) not carried as hand-carried baggage or kept under the Insured Person’s supervision.

PROPERTY NOT COVERED

The Company will not pay for damage due to or loss of:

(i) Animals, insects, rodents;

(ii) motor vehicles, aircraft, and other conveyances or equipment or parts pertaining to such conveyances;

(iii) artificial limbs, false teeth, hearing aids, any type of eyeglasses, contact lenses or corneal lenses;

(iv) tickets, except for administrative fees required to reissue tickets
