Until further notice, meetings of the Skokie Village Board will be held

electronically, with a majority of Village officials participating via remote access in order to comply with the State of Illinois Gubernatorial Disaster Proclamation. Members of the public who wish to comment as to an item on the published agenda or to comment during public comments must submit their statement or question in writing to the Village Manager’s Office and all properly submitted statements or questions will be presented and read during the relevant portion of the meeting. Written comments may be submitted by email to

THIS ORDINANCE MAY BE CITED AS VILLAGE ORDINANCE NUMBER

21-3-F-

AN ORDINANCE REDUCING THE TAX LEVY OF THE VILLAGE OF

SKOKIE FOR THE FISCAL YEAR BEGINNING MAY 1, 2020 AND

ENDING APRIL 30, 2021 IN THE AMOUNT OF $3,550,754.50

WHEREAS, the corporate authorities have caused to be filed with the Cook County

Clerk certified copies of Bond Ordinance 13-9-F-4008, Bond Ordinance 16-4-F-4225, Bond

2

Ordinance 18-3-F-4366, and Bond Ordinance 19-10-F-4493, each directing said Clerk to levy

3

and collect an annual tax for the purpose of paying the principal and interest on the Notes or

4

Bonds as authorized by these Ordinances; and

WHEREAS, the corporate authorities of the Village of Skokie have knowledge that an

7

additional sum of $3,550,754.50 will be available for the subject fiscal year to meet the

8

obligations of the Village of Skokie; and

9 10

WHEREAS, it is in the best interest of the Village of Skokie that the tax levy for said

11

fiscal year be abated to the extent of $3,550,754.50; and

12 13

NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Trustees of the

14

Village of Skokie, Cook County, Illinois:

Section 1: That the aforementioned Village Ordinances be and the same are hereby

17

amended to provide that the sums to be included in the tax levy for the tax year 2020 are

18

hereby reduced in accordance with the attached table, marked "Exhibit A", and hereby made

19

a part of this Ordinance. The amounts indicated in the column headed "Amount Levied" are

20

as originally specified in the aforementioned Ordinances. The amounts indicated in the

21

column headed "Amount Abated" reflect sums available to meet the obligations of the Village

22

of Skokie. The amounts indicated in the column headed "Net Tax Levy" reflect the sums to

23

be included in the 2020 tax levy for the payment of principal and interest on the debt provided

24

for in the aforementioned Ordinances.

Section 2: That all other provisions of Village Ordinance Numbers 13-9-F-4008,

16-4-27

F-4225, 18-3-F-4366, and 19-10-F-4493 shall remain in full force and effect.

Section 3: That a certified copy of this Ordinance shall be filed with the County Clerk

of Cook County, Illinois, on or before March 31, 2021.

Section 4: That this Ordinance shall be in full force and effect from and after its

passage, approval, and publication in pamphlet form as provided by law.

AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO ESTABLISH

AND OPERATE A CHILD DAY CARE NOT IN A RESIDENCE AT

4035 DEMPSTER STREET, SKOKIE, ILLINOIS

IN A B2 COMMERCIAL DISTRICT

WHEREAS, the owner of the following described real property:

LOTS 1, 2, 3 AND 4 IN BLOCK 2 OF A. A. LEWIS EVANSTON GOLF MANOR, BEING A SUBDIVISION

OF THE NORTH HALF OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF

3

SECTION 22, TOWNSHIP 41 NORTH, RANGE 13 EAST OF THE THIRD PRINCIPAL MERIDIAN,

4

ACCORDING TO THE PLAT THEREOF RECORDED JULY 9, 1926 AS DOCUMENT 9334468 IN COOK

5

COUNTY, ILLINOIS.

more commonly described as 4035 Dempster Street, Skokie, Illinois (hereinafter “Subject

8

Property”), petitioned the Village of Skokie for a special use permit to establish and operate

9

a child day care not in a residence in a B2 Commercial district; and

10

WHEREAS, this was previously the site of Mosaic Infant Center which had been

11

granted a special use permit, allowing it to operate at the Subject Property. The new child

12

care establishment, Little Muslims Childcare, intends to operate every day, 6:00 am to 6:00

13

pm, for up to 15 children. There will be a maximum of three (3) employees at any given time,

14

with food to be catered into the facility; and

15

WHEREAS, while no substantial renovations are planned, some replacement of the fire

16

protections systems are needed. The playground at Seneca Park, adjacent to the south, will

17

be utilized as needed; and

18

WHEREAS, the Skokie Plan Commission, at a public hearing duly held on January 21,

19

2021, for which proper legal notice had been achieved and no interested parties appeared, (a)

20

made the appropriate findings of fact as required under Section 118-6(f) of the Skokie Village

21

Code and (b) voted to recommend to the Mayor and Board of Trustees that the requested

22

special use permit be granted subject to the conditions contained in the Plan Commission

23

Report dated February 16, 2021; and

24

WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on

25

February 16, 2021, concurred in the aforesaid recommendations and findings of fact of the

26

Skokie Plan Commission;

27

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the

28

Village of Skokie, Cook County, Illinois:

Section 1: That the special use permit requested by the petitioner to establish and

operate a child day care not in a residence at the Subject Property, described above and

2

commonly known as 4035 Dempster Street, Skokie, Illinois, in a B2 Commercial district, be

3

and the same is hereby granted and approved subject to each of the conditions set forth

4

below:

5

1. The petitioner must operate and maintain the proposed use in substantial

6

conformance with the final Village approved Site Plan received December 7,

7

2020 and Floor Plan received December 7, 2020;

8

2. Prior to occupancy the petitioner must provide a signed agreement to use

9

Skokie Park District’s Seneca Park. A use agreement must remain in effect

10

during the duration of this ordinance;

11

3. All children must be dropped off and picked up by an adult, and vehicles used

12

must be parked on-site;

13

4. Children shall not be allowed to leave the day care without adult supervision;

14

5. Employees must park in parking lot and not in the adjacent residential

15

neighborhood;

16

6. All fencing, walls, sidewalks, driveways, curbs, wheel stops, parking areas,

17

signage, landscaping, structures, and any other facilities or infrastructure on

18

the Subject Property must be maintained in a good state of repair, and when

19

needed, be repaired or replaced in a timely manner;

20

7. All off-street parking spaces must be legibly striped and maintained;

21

8. All modifications to building elevations, signage, and landscaping shall be

22

subject to the review and approval of the Skokie Appearance Commission;

23

9. All signage must conform to the Skokie Village Code. Any sign on the Subject

24

Property that is in violation of that Code must be removed or modified to

25

conform with the Village Code prior to the issuance of an occupancy permit;

26

10. Vehicles must always be parked between, and not overlap, the striped lines of

27

designated parking spaces and must not block driveways, sidewalks, aisles, or

28

other points of access;

29

11. All private and public sidewalks must be maintained free of snow, ice, sleet, or

30

other objects that may impede travel;

31

12. Prior to the issuance of building permits, the petitioners must submit to the

32

Planning Division of the Community Development Department the name,

33

address, and telephone number of the company and contact person

34

responsible for site maintenance in compliance with the special use permit;

35

13. If work is to be performed on public property or if public property is utilized or

36

impacted during construction and/or development, the owner shall provide, or

37

shall cause the developer and/or contractor to provide, the Village of Skokie

38

with a certificate of insurance naming the Village of Skokie as additionally

39

insured for any and all claims related to any and all work. The owner shall

40

hold, and shall cause the developer and/or contractor to hold, the Village of

41

Skokie harmless and indemnify the Village for any and all claims for property

42

damage or personal injury related to work on or use of public property;

14. The petitioners shall comply with all Federal and State statutes, laws, rules

and regulations and all Village codes, ordinances, rules, and regulations;

2

15. Failure to abide by any and all terms of this Ordinance shall be cause for the

3

Village to initiate hearings to determine whether the subject Ordinance, as well

4

as any applicable business licenses, should be revised or revoked; and

5

16. The petitioners shall pay all costs related to any hearings conducted as a

6

result of non-compliance with any of the provisions of the enabling ordinance.

7

The costs shall include but not be limited to court reporter fees, attorney fees,

8

and staff time required researching and conducting said hearing.

9

Section 2: That a notice of the approval of this Ordinance incorporating the

10

conditions contained herein shall be executed by the owner of the property in writing and

11

duly recorded with the Cook County Clerk’s Office at the owner’s expense.

Section 3: That this Ordinance shall be in full force and effect from and after its

13

passage, approval and recordation as provided by law.
