Notice of Public Hearing

The Council of the City of Powell River hereby gives notice that it will meet and hold a Public Hearing, May 6, 2021, at 6:30 pm, in Council Chambers of City Hall, 6910 Duncan Street, Powell River, B.C. to consider

proposed Bylaw 2655, 2019.

The intent of proposed Bylaw 2655, 2021 is to amend City of Powell River Zoning Bylaw 2100, 2006, by rezoning the subject property located at 7042 Cranberry Street as shown outlined in red on the map below from

“Institutional (NT)” to “Single and Two Family Residential (R2)”.

The purpose of this bylaw amendment is to accommodate a residence in the existing dwelling.

Copies of the proposed amendment bylaw and staff report may be requested through Planning Services, (604) 485-8655 or can be accessed at www.powellriver.ca. All written submissions may be sent via email to

planningservices@powellriver.ca or mailed to Planning Services at 6910 Duncan Street, Powell River, BC, V8A 1V4 and must be received no later than 2:00 pm on May 6th, 2021. At this time due to current Public Health Orders relating to COVID-19, Council meetings are closed to in-person attendance but will be video webcast and the link can be found on the City of Powell River’s website at https://powellriver.ca/pages/webcasts. Those wishing to speak at the Council meeting can use the phone-in option. Instructions on how to phone-in will be available on Council meeting agendas published the week of the meeting and will also be broadcast on the video webcast. In addition, those wishing to speak at the Council meeting may pre-register up until 2:00 pm on the same day as the Council meeting by calling or emailing Planning Services using the contact information provided above.

Dear Sir/Madam:

The City of Powell River is proposing to amend the City of Powell River’s Zoning Bylaw 2100, 2006, with regard to the zoning of a property located at 7042 Cranberry Street. The purpose of the bylaw amendments is to rezone the property from NT – Institutional to R2 – Single and Two Family Residential.

Please refer to the enclosed “Notice of Public Hearing” for the details regarding the proposed changes, as well as the date, time, and place of the Public Hearing.

As a result of recent updates and extensions to the Provincial Health Orders relating to COVID- 19, public hearings are now closed to in-person attendance at City Hall. Phone-in options for those wishing to engage with Council on this application will be available the week of the meeting on the City’s website. Any parties wishing to phone in may also pre-register through Planning Services. A webcast of meetings may be viewed at:

Recommendation:

Recommendation:

That following adjournment of this regular meeting, Council move in camera to discuss matters covered by the Community Charter under Sections 90(1):

(a) personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the municipality;

(c) labour relations or other employee relations;

(e) the acquisition, disposition or expropriation of land or improvements, if the council considers that disclosure could reasonably be expected to harm the interests of the municipality;

(i) the receipt of advice that is subject to solicitor-client privilege, including communications necessary for that purpose;

(j) information that is prohibited, or information that if it were presented in a document would be prohibited, from disclosure under section 21 of the Freedom of Information and Protection of Privacy Act; and

(n) the consideration of whether a council meeting should be closed under a provision of this subsection or subsection (2).

RECOMMENDATION:

That City of Powell River Zoning Bylaw 2100, 2006, Amendment Bylaw 2655, 2021, be read for a first and second time; and,

That City of Powell River Zoning Bylaw 2100, 2006, Amendment Bylaw 2655, 2021, proceed to Public Hearing and that staff be directed to schedule the Public Hearing and give notice in accordance with Section 466 of the Local Government Act.

ORIGIN/PURPOSE:

To consider an application to amend the zoning of a property located at 7042 Cranberry Street.

BACKGROUND:

The subject property is on Cranberry Street just east of Lindsay Park. The property is a hooked parcel with lands on either side of Cranberry Street. Attached to this report as Appendices A and B are a locator map and an orthographic image of the subject property. The portion of parcel on the waterside of the road is zoned NT (Institutions) as it housed a preschool and daycare operation for many years. This facility closed in March 2020 and the owner of the property would like to convert the existing building into a residence. To achieve this, they have applied to rezone the NT portion of the parcel to R2 (Single and Two Family Residential).

STRATEGIC PRIORITY:

Processing this type of development application is not specifically addressed in the City of Powell River Strategic Plan 2020-2022 but instead falls into the regular service provided by the City.

EXISTING POLICY:

Sustainable Official Community Plan (SOCP)

In the SOCP, the subject property has a land use designation of Suburban Residential. The intent of this designation is to accommodate residential uses, predominately in the form of single-family dwellings, in association with secondary suites, agricultural uses, home-based businesses, institutional uses, parks and green space, and utilities.

City of Powell River Zoning Bylaw 2100, 2006 (Zoning Bylaw)

The subject property is split-zoned with the upper portion zoned A1 (Small Lot Rural Residential Zone) and the lakeside portion zoned NT (Institutions).

ANALYSIS AND IMPACT:

The proposal would see these lands rezoned to R2. As this would be in keeping with the adjacent properties on the waterside of Cranberry Street, staff supports the application.

Attached to this report as Appendix C is draft City of Powell River Zoning Bylaw 2100, 2006, Amendment Bylaw 2655, 2021, for review.

FINANCIAL IMPACT:

Staff are not aware of any significant financial impact as a result of a zoning change to this property.

COMMUNICATIONS AND ENGAGEMENT:

All amendments to the Zoning Bylaw must undertake a public information process as prescribed by the Local Government Act. This includes concurrent advertisements in a local paper, placement of a development proposal sign on the subject property and a statutory Public Hearing.

OPTIONS:

1. That City of Powell River Zoning Bylaw 2100, 2006, Amendment Bylaw 2655, 2021, be read for a first and second time; and,

That City of Powell River Zoning Bylaw 2100, 2006, Amendment Bylaw 2655, 2021, proceed to Public Hearing and that staff be directed to schedule the Public Hearing and give notice in accordance with Section 466 of the Local Government Act; or,

2. That Council provides an alternate direction to staff; or, 3. That Council not endorse this application.

A Bylaw to amend City of Powell River Zoning Bylaw 2100, 2006

The Council of the City of Powell River, in an open meeting assembled, enacts as follows:

1. This bylaw may be cited as “City of Powell River Zoning Bylaw 2100, 2006, Amendment Bylaw 2655, 2021”.

2. “City of Powell River Zoning Bylaw 2100, 2006" is hereby amended by amending Schedule A to Zoning Bylaw 2100, 2006, being the Official Zoning Map, by rezoning a portion of the parcel legally described as LOT B DISTRICT LOT 4128 GROUP 1 NEW WESTMINSTER DISTRICT PLAN EPP47462 (PID 029-721-920) shown in bold on ‘Schedule 1’ attached hereto and forming a part of this bylaw, from NT (Institutions) to R2 (Single and Two Family Residential).

3. This bylaw shall come into full force and effect upon its adoption.
