1. Eligibility: Tap. Order. Win. Sweepstakes (the “Sweepstakes”) is open only to legal residents of Indiana, Kentucky, Maine, Michigan, New York, Ohio, Pennsylvania and West Virginia, who are at least eighteen (18) years old and who have a Tims Rewards Account or who accept the terms and conditions for creation of an Account at the time of entry. Employees of Tim Hortons USA (“Sponsor”), Merkle Inc. (“Administrator”), their franchisees, and parent companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules. Sponsor’s and Administrator’s decisions are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Timing: The Sweepstakes begins on August 18, 2021 at 12:00 a.m. Eastern Time ("ET"), ends on September 14, 2021 at 11:59 p.m. ET (the "Promotion Period") and consist of three (3) weekly entry periods (each a “Weekly Entry Period”), as well as a grand prize entry period (“Grand Prize Entry Period”) that coincides with the Promotion Period, as set forth below.

The Grand Prize Entry Period is divided into three (3) prize pools, based on each entrant’s state of purchase (applicable for those entering through entry method 4(a)) and/or entrant’s state of residence (applicable for those entering through entry method 4(b)) (collectively, your “State”). Each will be referred to as a “Grand Prize Pool”, including the “Buffalo Bills Prize Pool”; the “Columbus Blue Jackets Prize Pool” and the “Detroit Red Wings Prize Pool”. The states representing each Grand Prize Pool consist of:

Administrator’s computer is the official time-keeping device for the Sweepstakes.

4. How to Enter: There are two (2) ways to enter: All entrants must be enrolled in the Tims Rewards by Tim Hortons^®program. It is free to join, but subject to its Terms and Conditions and Privacy Policy.

a. Download the Tim Hortons Mobile App, Create a Tims Rewards Account in the App or Online at timhortons.com and Make an Eligible Transaction: During the Promotion Period, download the Tim Hortons mobile app (“Mobile App”), to your mobile device, if you haven’t already done so. Once you have downloaded and opened the App, follow the instructions to

create or sign-in to your Tims Rewards account. Alternatively, you can visit the Tim Hortons website – timhortons.com and register for Tims Rewards online.

After you register or login to your Tims Rewards account, you must then make a purchase of

$0.51 or more USD, excluding applicable taxes, delivery fees and including any applicable Tims Rewards or other discounts (an “Eligible Transaction”) with a “Qualifying Scan”, as described below. You are limited to one (1) Qualifying Scan every 30 minutes.

The following methods are Qualifying Scans:

i. Scan of a digital Tims Rewards QR code in the Tim Hortons app: Log in to your Tims Rewards Account on the Tim Hortons App. Tap “Scan” on the App homescreen and ask the Team Member to scan QR Code before making your Eligible Transaction.

ii. Scan of a physical registered Tims Rewards card in-store: Scan physical registered Tims Rewards card in Restaurant before making an Eligible Transaction. Card must have been previously registered online or on the Tim Hortons app.

iii. Digital transaction in the Tim Hortons app or online (for in-store pick up or delivery): Log in to your Tims Rewards Account. Use the “Order” button and select “Pick Up” or “Delivery” as service mode. Follow the steps to place an Order for pick up or delivery. Must be an Eligible Transaction. Alternatively, you can go online to the website and place a mobile order.

For each Qualifying Scan, subject to the Limit stated below, from August 18, 2021 – September 7, 2021, you will receive one (1) Sweepstakes entry into the applicable Weekly Entry Period drawing. In addition, you will receive one (1) Sweepstakes entry into the drawing for the Grand Prize Pool (based on your State). If you enter on or after September 8, 2021, you will only receive one (1) Sweepstakes entry into the drawing for the Grand Prize Pool (based on your State).

b. Enter via the Microsite: During the Promotion Period, visit https://timhortons.promo.eprize.com/rewards/ “Website”) and follow the links and instructions to complete and submit the registration form by providing the valid email address associated with your Tims Rewards account. When you submit the Registration form, you must check the box indicating your consent to join the Tims Rewards program and acceptance of the program Terms and Conditions and the Promotion Official Rules. When you enroll in the Tims Rewards program through the Website from August 18, 2021 – September 7, 2021, you automatically will receive one (1) Sweepstakes entry into the applicable Weekly Entry Period drawing. In addition, you will receive one (1) Sweepstakes entry into the drawing for the Grand Prize Pool (based on your State). If you enter on or after September 8, 2021, you will only receive one (1) Sweepstakes entry into the drawing for the Grand Prize Pool (based on your State).

Limit: If you enter from August 18, 2021 – September 7, 2021, you may receive up to two (2) Sweepstakes entries into the applicable Weekly Entry Period drawing and up to two (2) Sweepstakes entries into the drawing for the Grand Prize Pool (based on your State) per day during the Promotion Period, regardless of method or combination of methods of entry. If you enter from September 8, 2021 – September 15, 2021, you may receive up to two (2) Sweepstakes entries into the drawing for the Grand Prize Pool (based on your State) per day during the Promotion Period, regardless of method or combination of methods of entry.

Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email

addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being an authorized account holder.

5. Drawings: Administrator is an independent judging organization whose decisions as to the administration and operation of the Sweepstakes and the selection Sweepstakes winners are final and binding in all matters related to the Sweepstakes. Administrator will randomly select the potential Sweepstakes winners, from all eligible entries received for each applicable Weekly Entry Period, on or around the date outlined in the table in Section 3. Non-winning Weekly Entry Period entries will not carry over to subsequent Weekly Entry Periods. Administrator will randomly select one (1) potential Sweepstakes Grand Prize Package winner on or around September 24, 2021 from all eligible entries received for each applicable Grand Prize Pool, based on the provided Eligible State (see Section 3 above) during the registration process, for a total of three (3) Grand Prize Package winners, as defined below. The potential winners will be notified by email, mail or phone. Each potential Grand Prize Package winner and each potential Weekly Entry Period 3 winner of the “6 Months of Free Timbits” prize will be required to sign and return a Declaration of Compliance, Liability Waiver and where not prohibited a Publicity Release ("Declaration") which must be received by Administrator within five (5) days of the date notice or attempted notice is sent, in order to claim his/her/their prize. Each potential winners of prizes valued under $600.00 may be required to provide their name, home mailing address (P.O. Boxes are not be permitted), and date of birth to confirm eligibility and for purposes of prize fulfillment within five (5) days of the date notice or attempted notice is sent, in order to claim his/her/their prize. If a potential winner of any prize cannot be contacted, fails to sign and return the Declaration or provide any other requested information within the required time period (if applicable), or the prize is returned as undeliverable, the potential winner forfeits his/her/their prize. Receiving a prize is contingent upon compliance with these Official Rules. In the event that a potential winner of a prize valued over $25.00 is disqualified for any reason or forfeits the prize, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the applicable prize will remain un-awarded. Unclaimed prizes valued at $25.00 or less will not be awarded.

Seating assignments to be determined by Sponsor, at Sponsor’s sole discretion, and subject to availability and change. Winner will not retain renewal rights for subsequent seasons. Transportation, accommodations, meals, gratuities and all other expenses not specified herein are solely winner’s responsibility. Coffee for a Year portion of prize is based upon the cost of 365 large hot brewed coffee beverages with a recommended price of $2.10. Winner will receive 1 $63.88 eGift card per month for 12 months. eGift card to be used on the Tim Hortons app or online. ARV: 4,766.50.

ONE (1) DETROIT RED WINGS GRAND PRIZE PACKAGE (awarded to one (1) resident or customer of Michigan)**: The winner will receive two (2) season tickets for the Detroit Red Wings 2021/2022 regular season home hockey games played in Detroit, Michigan, and Tim Hortons “Coffee for a Year”, awarded as

$766.50 worth of Tim Hortons eGift Cards. Game dates are subject to change. Seating assignments to be determined by Sponsor, at Sponsor’s sole discretion, and subject to availability and change. Winner will not retain renewal rights for subsequent seasons. Transportation, accommodations, meals, gratuities and all other expenses not specified herein are solely winner’s responsibility. Coffee for a Year portion of prize is based upon the cost of 365 large hot brewed coffee beverages with a recommended price of $2.10. Winner will receive 1 $63.88 eGift card per month for 12 months. eGift card to be used on the Tim Hortons app or online. ARV: $8,776.50.

ONE (1) COLUMBUS BLUE JACKETS GRAND PRIZE PACKAGE (awarded to one (1) resident or customer of Indiana, Kentucky, Ohio or West Virginia)**: The winner will receive two (2) season tickets for

the Columbus Blue Jackets 2021/2022 regular season home hockey games played in Columbus, Ohio, and Tim Hortons “Coffee for a Year”, awarded as $766.50 worth of Tim Hortons eGift Cards. Game dates are subject to change. Seating assignments to be determined by Sponsor, at Sponsor’s sole discretion, and subject to availability and change. Winner will not retain renewal rights for subsequent seasons.

Transportation, accommodations, meals, gratuities and all other expenses not specified herein are solely winner’s responsibility. Coffee for a Year portion of prize is based upon the cost of 365 large hot brewed coffee beverages with a recommended price of $2.10. Winner will receive 1 $63.88 eGift card per month for 12 months. eGift card to be used on the Tim Hortons app or online. ARV: $7,696.50.

**Winners will have an option to choose a cash substitute in lieu of the season ticket prize component. In lieu of claiming the two (2) season tickets to a professional football or hockey game, each Grand Prize Winner will have the option of receiving Five Thousand Dollars ($5,000 USD) (the “Cash Option”). If Grand Prize Winner elects to take the Cash Option, Grand Prize Winner will still receive the Free Coffee for a Year prize.

Odds of winning a Grand Prize Package depend on the number of eligible entries received during the Promotion Period for each Grand Prize Pool.

For Season Ticket Prizes: Buffalo Bills tickets are non-transferable. Columbus Blue Jackets and Detroit Red Wings tickets are digital and may be transferred within the applicable ticketing platform (for the Detroit Red Wings this is The Detroit District App, for the Columbus Blue Jackets it is transferable through email or Text or NHL App (CBJ). Ticketing app terms and conditions apply. Tickets cannot be sold. Tickets are subject to the terms and conditions on the reverse side of the ticket and all other restrictions disclosed by

each team on its respective website. The Buffalo Bills, Detroit Red Wings and Columbus Blue Jackets are not sponsors, promoters or administrators of this Sweepstakes.

For All Prizes: Terms and conditions of eGift Cards apply. Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Prizes will be fulfilled approximately 8-10 weeks after the conclusion of the Promotion Period. Limit: One (1) prize per entrant. Total ARV of all prizes: $30,126.40.

7. Release: Except where prohibited, by participating in the Sweepstakes, entrants agree to release and hold harmless Sponsor, its parent, Restaurant Brands International, Inc., Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.

8. Publicity: Except where prohibited, participation in the Sweepstakes constitutes each winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

9. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Sweepstakes, or any event or cause beyond Sponsor’s control (e.g. events such as natural calamities, national emergencies, wide spread illnesses, declarations of war, acts of God, acts of terrorism) interferes with any aspect of the Sweepstakes, including but not limited to fulfillment of the prize(s), as determined by Sponsor in its sole discretion. In such event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance and may modify the prizes offered herein. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if it is possible. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

11. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern

District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
