TO CERTAIN CLAIMS (SUBSTANTIVE)

Upon the objection (the “Objection”)

of the Reorganized Debtor seeking entry of

an order (this “Order”) reclassifying, disallowing and expunging, or reducing certain Disputed

Claims pursuant to section 502(b) of the Bankruptcy Code and Rule 3007 of the Bankruptcy Rules;

and it appearing that the Court has jurisdiction over this matter pursuant to 28 U.S.C. § 1334; and

it appearing that this proceeding is a core proceeding pursuant to 28 U.S.C. § 157; and it appearing

that venue of this proceeding is proper in this district pursuant to 28 U.S.C. §§ 1408 and 1409; and

adequate notice of the Objection and opportunity for response having been given; and it appearing

that no other notice need be given; and the Court having considered the Objection, the Robbins

Declaration, the Disputed Claims listed on Exhibits 1-4 attached hereto, and any responses

thereto; and the Court having determined that there exists just cause for the relief granted herein;

and upon the record herein; and after due deliberation and sufficient cause appearing therefor, it is

The Objection is sustained to the extent set forth herein.

The Reclassified Claims are hereby reclassified as set forth on Exhibit 1.

The No Liability Claims listed on Exhibit 2 are hereby disallowed and expunged in

their entirety.

The Multiple Debtor Claims identified on the attached Exhibit 3 under the column

titled “

Duplicate Claim to be Disallowed” are disallowed and expunged in their entirety.

5.

The Reduced Claims are hereby reduced as set forth on Exhibit 4.

6.

Claim No. 833, filed by Jeffrey Elwood Erdman, shall be deemed to be an allowed

priority claim under section 507(a)(4)(B) of the Bankruptcy Code against US Investigations

Services, LLC in the amount of $6,215.00, which claim shall be subject to the timing and payment

mechanisms set forth in the Plan.

7.

Prime Clerk, the Reorganized Debtor’s claims and noticing agent, shall update the

claims register to reflect the relief granted in this Order.

8.

The Reorganized Debtor’s right to file additional objections to the Disputed Claims

or any other proofs of claim that have been or may be filed against the Debtors are preserved.

Additionally, should one or more of the grounds of objection stated in the Objection be dismissed,

the Reorganized Debtor’s rights to object on other stated grounds or on any other grounds that the

Reorganized Debtor discovers during the pendency of this chapter 11 case are further preserved.

Each Disputed Claim and the objections by the Reorganized Debtor to such

shall only apply to the contested matter that involves such claimant and Disputed Claim and shall

not act to stay the applicability and/or finality of this Order with respect to the other contested

matters or Disputed Claims listed in the Objection or this Order.

10.

The terms and conditions of this Order shall be immediately effective and

enforceable, and the time to appeal this Order shall commence upon its entry. All time periods set

forth in this Order shall be calculated in accordance with Bankruptcy Rule 9006(a).

11.

The Court shall retain jurisdiction with respect to all matters related to or arising

from the Objection or the implementation of this Order.

The proof of claim asserts priority under section 507(a)(5) of the Bankruptcy Code and treatment as a secured claim for "services performed/lacking." The documentation attached to the claim does not appear to relate to the basis in the proof of claim. It includes receipts for prescriptions and other estimated medical expenses and asserts that these medical expenses would have been covered by USIS insurance but that the claimant had to pay for them without insurance. The claimant did not provide any documentation reflecting that the Debtor is obligated to pay for such expenses. The claim is not one for contributions to an employee benefit plan, nor did the claimant provide evidence that the alleged services were rendered within the 180 days prior to the Petition Date. Moreover, based on the Reorganized Debtor's review of the Debtors' books and records, the claimant is not entitled to a priority claim under section 507(a)(5) of the Bankruptcy Code. Furthermore, the claim is not entitled to secured status under the Bankruptcy Code or otherwise. Accordingly, the claim must be reclassified to a general unsecured claim.

The alleged benefits relate to the period of 6/2003 through 6/2013, which fall outside of the priority period under section 507(a)(5) of the Bankruptcy Code. Accordingly, the claim must be reclassified to a general unsecured claim.

claimant did not allege that she earned any wages, salaries, or commissions that were unpaid to her within 180 days of the Petition Date or establish any other basis for priority under the Bankruptcy Code. Based on the Reorganized Debtor's review of the Debtors' books and records and the claimant's supporting documentation, the claimant is not entitled to a priority claim under section 507(a) of the Bankruptcy Code. Accordingly, the claim must be reclassified to a general unsecured claim.

The documentation attached to the claim is a letter from the claimant explaining that the claimant paid for credit monitoring as a result of a personal information breach by the Debtor, resulting in an unsecured claim of $518.00. The claim also includes a letter from the Debtor stating that if the claimant failed to follow the instructions in the letter, the claimant would not receive any credit monitoring services. The claimant's letter also asserts that the Debtor did not match IRA contributions in the amount of $1,088.50, but does not include documentation substantiating that this amount is owed, nor does it include documentation substantiating that this amount is owed on a secured basis. Accordingly, this portion of the claim must be reclassified to a general unsecured claim. As set forth in the modified amount exhibit, the Reorganized Debtor also disputes the claimant's assertion that she did not receive an employer match for IRA contributions and seeks to reduce the proof of claim by $1,088.50. The claimant asserts that the entirety of the claim is entitled to priority status under section 507(a)(5) of the Bankruptcy Code. At a minimum, the portion of the claim relating to credit monitoring is not a claim for contributions to an employee benefit plan, nor does the claimant provide evidence that the applicable services were rendered within the 180 days prior to the Petition Date. Additionally, for the portion of the claim relating to IRA contributions, the claimant does not provide evidence that the applicable services were rendered within the 180 days prior to the Petition Date. Accordingly, the entirety of the claim must be reclassified to a general unsecured claim. Finally, no portion of the claim is for goods provided to the Debtors. Therefore, the claim is not entitled to administrative priority under section 503(b)(9) of the Bankruptcy Code. Even assuming the claimant intended to seek priority under another sub-section of section 507 of the Bankruptcy Code, on its face the claim does not satisfy the standard for priority under any section of 507 of the Bankruptcy Code. Accordingly, the Reorganized Debtor believes that the claim must be reclassified to a general unsecured claim.

Accordingly, the Reorganized Debtor has pro-rated the $10,500 claim over an 18 month period and believes that $7,795.89 of the claim should be reclassified to a general unsecured claim.
