AN ACT relating to public health; requiring or encouraging certain licensed or certified professionals to receive [evidence-based] suicide prevention and awareness training in order to renew a license [;] or certificate; and providing other matters properly relating thereto.

Legislative Counsel’s Digest:

Existing law requires psychiatrists, physicians, advanced practice registered nurses, 1

psychologists, clinical professional counselors, marriage and family therapists , [and] social 2

workers , alcohol and drug abuse counselors, problem gambling counselors and other 3

persons licensed or certified to practice in various related fields to complete certain 4

continuing education as a condition to the renewal of their licenses [.] or certificates. (NRS 5

630.253, 632.343, 633.471, 641.220, 641A.260, 641B.280 [) This], 641C.450, 641C.500) 6

Sections 1, 2, 3, 4, 5, 5.3 and 5.7 of this bill [requires] require certain of those professionals 7

to receive [at least 2 hours of] instruction on [evidence-based] suicide prevention and 8

awareness as a condition to the renewal of their licenses [.] or certificates beginning on July 9

1, 2016. Those requirements, however, are temporary and are eliminated or expire by 10

limitation on June 30, 2026. 11

Sections 1, 1.5 and 2 of this bill require the professional licensing boards for certain 12

physicians and advanced practice registered nurses to encourage their licensees to 13

receive certain training concerning suicide prevention, detection and intervention as 14

part of their continuing education. 15

Sections 1 and 2 revise provisions concerning compliance with continuing education 16

by physicians to require that they submit evidence of such compliance. 17

Sections 1, 1.5, 2, 3, 4, 5, 5.3 and 5.7 require certain professional licensing boards to 18

establish their continuing education requirements by regulation. 19

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

Section 1. NRS 630.253 is hereby amended to read as follows: 1

(a) Renewal of a license as a physician assistant; or 1

(b) Biennial registration of the holder of a license to practice medicine, 2

¬ require each holder to [comply] submit evidence of compliance with the 3

requirements for continuing education as set forth in regulations adopted by the 4

Board. 5

2. These requirements: 6

(a) May provide for the completion of one or more courses of instruction 7

relating to risk management in the performance of medical services. 8

(b) Must provide for the completion of a course of instruction, within 2 years 9

after initial licensure, relating to the medical consequences of an act of terrorism 10

that involves the use of a weapon of mass destruction. The course must provide at 11

least 4 hours of instruction that includes instruction in the following subjects: 12

(1) An overview of acts of terrorism and weapons of mass destruction; 13

(2) Personal protective equipment required for acts of terrorism; 14

(3) Common symptoms and methods of treatment associated with exposure 15

to, or injuries caused by, chemical, biological, radioactive and nuclear agents; 16

(4) Syndromic surveillance and reporting procedures for acts of terrorism 17

that involve biological agents; and 18

(5) An overview of the information available on, and the use of, the Health 19

Alert Network. 20

(c) Must provide for the completion by a holder of a license to practice 21

medicine who is a psychiatrist of a course of instruction that provides at least 2 22

hours of instruction on [evidence-based]clinically-based suicide prevention and 23

awareness. 24

¬ The Board may thereafter determine whether to include in a program of 25

continuing education additional courses of instruction relating to the medical 26

consequences of an act of terrorism that involves the use of a weapon of mass 27

destruction. 28

3. The Board shall encourage each holder of a license who treats or cares for 29

persons who are more than 60 years of age to receive, as a portion of their 30

continuing education, education in geriatrics and gerontology, including such topics 31

as: 32

(a) The skills and knowledge that the licensee needs to address aging issues; 33

(b) Approaches to providing health care to older persons, including both 34

didactic and clinical approaches; 35

(c) The biological, behavioral, social and emotional aspects of the aging 36

process; and 37

(d) The importance of maintenance of function and independence for older 38

persons. 39

4. The Board shall encourage each holder of a license to practice medicine to 40

receive, as a portion of his or her continuing education, training concerning 41

methods for educating patients about how to effectively manage medications, 42

including, without limitation, the ability of the patient to request to have the 43

symptom or purpose for which a drug is prescribed included on the label attached to 44

the container of the drug. 45

5. The Board shall encourage each holder of a license to practice medicine,

46

other than a psychiatrist, to receive as a portion of his or her continuing

47

education training concerning suicide, including, without limitation, such topics

48

as:

49

(a) The skills and knowledge that the licensee needs to detect behaviors that

50

may lead to suicide, including, without limitation, post-traumatic stress disorder;

51

(b) Approaches to engaging other professionals in suicide intervention; and

(c) The detection of suicidal thoughts and ideations and the prevention of

suicide.

6. A holder of a license to practice medicine may substitute not more than 2 3

hours of continuing education credits in the detection of suicidal thoughts and

4

ideations, and the intervention and prevention of suicide, pain management or

5

addiction care for the purposes of satisfying an equivalent requirement for 6

continuing education in ethics. 7

[6.] 7. As used in this section: 8

(a) “Act of terrorism” has the meaning ascribed to it in NRS 202.4415. 9

(b) “Biological agent” has the meaning ascribed to it in NRS 202.442. 10

(c) “Chemical agent” has the meaning ascribed to it in NRS 202.4425. 11

(d) “Radioactive agent” has the meaning ascribed to it in NRS 202.4437. 12

(e) “Weapon of mass destruction” has the meaning ascribed to it in NRS 13

202.4445. 14

Sec. 1.3. NRS 630.253 is hereby amended to read as follows: 15

630.253 1. The Board shall, as a prerequisite for the: 16

(a) Renewal of a license as a physician assistant; or 17

(b) Biennial registration of the holder of a license to practice medicine, 18

(e) “Weapon of mass destruction” has the meaning ascribed to it in NRS 25

Sec. 1.5. NRS 632.343 is hereby amended to read as follows: 27

632.343 1. The Board shall not renew any license issued under this chapter 28

until the licensee has submitted proof satisfactory to the Board of completion, 29

during the 2-year period before renewal of the license, of 30 hours in a program of 30

continuing education approved by the Board [.] in accordance with regulations

31

adopted by the Board. The licensee is exempt from this provision for the first

32

biennial period after graduation from: 33

(a) An accredited school of professional nursing; 34

(b) An accredited school of practical nursing; 35

(c) An approved school of professional nursing in the process of obtaining 36

accreditation; or 37

(d) An approved school of practical nursing in the process of obtaining 38

accreditation. 39

2. The Board shall review all courses offered to nurses for the completion of 40

the requirement set forth in subsection 1. The Board may approve nursing and other 41

courses which are directly related to the practice of nursing as well as others which 42

bear a reasonable relationship to current developments in the field of nursing or any 43

special area of practice in which a licensee engages. These may include academic 44

studies, workshops, extension studies, home study and other courses. 45

3. The program of continuing education required by subsection 1 must 46

include a course of instruction, to be completed within 2 years after initial 47

licensure, relating to the medical consequences of an act of terrorism that involves 48

the use of a weapon of mass destruction. The course must provide at least 4 hours 49

of instruction that includes instruction in the following subjects: 50

(a) An overview of acts of terrorism and weapons of mass destruction; 51

(c) Common symptoms and methods of treatment associated with exposure to, 1

or injuries caused by, chemical, biological, radioactive and nuclear agents; 2

(d) Syndromic surveillance and reporting procedures for acts of terrorism that 3

involve biological agents; and 4

(e) An overview of the information available on, and the use of, the Health 5

Alert Network. 6

¬ The Board may thereafter determine whether to include in a program of 7

continuing education additional courses of instruction relating to the medical 8

consequences of an act of terrorism that involves the use of a weapon of mass 9

destruction. 10

4. The Board shall encourage each licensee who treats or cares for persons 11

who are more than 60 years of age to receive, as a portion of their continuing 12

education, education in geriatrics and gerontology, including such topics as: 13

(a) The skills and knowledge that the licensee needs to address aging issues; 14

(b) Approaches to providing health care to older persons, including both 15

didactic and clinical approaches; 16

(c) The biological, behavioral, social and emotional aspects of the aging 17

process; and 18

(d) The importance of maintenance of function and independence for older 19

persons. 20

5. The Board shall encourage each person licensed as an advanced practice

21

registered nurse to receive as a portion of his or her continuing education at least

22

2 hours of instruction on clinically-based suicide prevention and awareness.

23

6. As used in this section: 24

(a) “Act of terrorism” has the meaning ascribed to it in NRS 202.4415. 25

(b) “Biological agent” has the meaning ascribed to it in NRS 202.442. 26

(c) “Chemical agent” has the meaning ascribed to it in NRS 202.4425. 27

(d) “Radioactive agent” has the meaning ascribed to it in NRS 202.4437. 28

(e) “Weapon of mass destruction” has the meaning ascribed to it in NRS 29

202.4445. 30

Sec. 2. NRS 633.471 is hereby amended to read as follows: 31

633.471 1. Except as otherwise provided in subsection [6] 8 and NRS 32

633.491, every holder of a license issued under this chapter, except a temporary or 33

a special license, may renew the license on or before January 1 of each calendar 34

year after its issuance by: 35

(a) Applying for renewal on forms provided by the Board; 36

(b) Paying the annual license renewal fee specified in this chapter; 37

(c) Submitting a list of all actions filed or claims submitted to arbitration or 38

mediation for malpractice or negligence against the holder during the previous year; 39

(d) Submitting [an affidavit] evidence to the Board that in the year preceding 40

the application for renewal the holder has attended courses or programs of 41

continuing education approved by the Board in accordance with regulations

42

adopted by the Board totaling a number of hours established by the Board which

43

must not be less than 35 hours nor more than that set in the requirements for 44

continuing medical education of the American Osteopathic Association; and 45

(e) Submitting all information required to complete the renewal. 46

2. The Secretary of the Board shall notify each licensee of the requirements 47

for renewal not less than 30 days before the date of renewal. 48

3. The Board shall request submission of verified evidence of completion of 49

the required number of hours of continuing medical education annually from no 50

fewer than one-third of the applicants for renewal of a license to practice 51

osteopathic medicine or a license to practice as a physician assistant. Upon a 52

medicine or a license to practice as a physician assistant shall submit verified 1

evidence satisfactory to the Board that in the year preceding the application for 2

renewal the applicant attended courses or programs of continuing medical 3

education approved by the Board totaling the number of hours established by the 4

Board. 5

4. The Board shall encourage each holder of a license to practice osteopathic 6

medicine to receive, as a portion of his or her continuing education, training 7

concerning methods for educating patients about how to effectively manage 8

medications, including, without limitation, the ability of the patient to request to 9

have the symptom or purpose for which a drug is prescribed included on the label 10

attached to the container of the drug. 11

5. The Board shall require, as part of the continuing education requirements 12

approved by the Board, the biennial completion by a holder of a license to practice 13

osteopathic medicine of [at] : 14

(a) At least 2 hours of continuing education credits in ethics, pain management 15

or addiction care [.] ; and 16

(b) If the holder of a license to practice osteopathic medicine is a 17

psychiatrist, at least 2 hours of continuing education credits on [evidence-based]

18

clinically-based suicide prevention and awareness.

19

6. The Board shall encourage each holder of a license to practice

20

osteopathic medicine, other than a psychiatrist, to receive as a portion of his or

21

her continuing education training concerning suicide, including, without

22

limitation, such topics as:

23

(a) The skills and knowledge that the licensee needs to detect behaviors that

24

may lead to suicide, including, without limitation, post-traumatic stress disorder;

25

(b) Approaches to engaging other professionals in suicide intervention; and

26

(c) The detection of suicidal thoughts and ideations and the prevention of

27

suicide.

28

7. A holder of a license to practice osteopathic medicine may substitute not

29

more than 2 hours of continuing education credits in the detection of suicidal

30

thoughts and ideations, and the intervention and prevention of suicide for the

31

purposes of satisfying an equivalent requirement for continuing education in

32

ethics.

33

8. Members of the Armed Forces of the United States and the United States 34

Public Health Service are exempt from payment of the annual license renewal fee 35

during their active duty status. 36

Sec. 2.5. NRS 633.471 is hereby amended to read as follows: 37

633.471 1. Except as otherwise provided in subsection 8 and NRS 633.491, 38

every holder of a license issued under this chapter, except a temporary or a special 39

license, may renew the license on or before January 1 of each calendar year after its 40

issuance by: 41

(a) Applying for renewal on forms provided by the Board; 42

(b) Paying the annual license renewal fee specified in this chapter; 43

(c) Submitting a list of all actions filed or claims submitted to arbitration or 44

mediation for malpractice or negligence against the holder during the previous year; 45

(d) Submitting evidence to the Board that in the year preceding the application 46

for renewal the holder has attended courses or programs of continuing education 47

approved by the Board in accordance with regulations adopted by the Board 48

totaling a number of hours established by the Board which must not be less than 35 49

hours nor more than that set in the requirements for continuing medical education 50

may lead to suicide, including, without limitation, post-traumatic stress disorder; 31

(b) Approaches to engaging other professionals in suicide intervention; and 32

(c) The detection of suicidal thoughts and ideations and the prevention of 33

suicide. 34

7. A holder of a license to practice osteopathic medicine may substitute not 35

more than 2 hours of continuing education credits in the detection of suicidal 36

thoughts and ideations, and the intervention and prevention of suicide for the 37

purposes of satisfying an equivalent requirement for continuing education in ethics. 38

8. Members of the Armed Forces of the United States and the United States 39

Public Health Service are exempt from payment of the annual license renewal fee 40

during their active duty status. 41

Sec. 3. NRS 641.220 is hereby amended to read as follows: 42

641.220 1. To renew a license or certificate issued pursuant to this chapter, 43

each person must, on or before the first day of January of each odd-numbered year: 44

(a) Apply to the Board for renewal; 45

(b) Pay the biennial fee for the renewal of a license or certificate; 46

(c) Submit evidence to the Board of completion of the requirements for 47

continuing education[;] as set forth in regulations adopted by the Board; and 48

(d) Submit all information required to complete the renewal. 49

2. Upon renewing his or her license, a psychologist shall declare his or her 50

areas of competence, as determined in accordance with NRS 641.112. 51

3. The Board shall, as a prerequisite for the renewal of a license or certificate, 52

adopted by the Board [.], which must include, without limitation, a requirement 1

that the holder of a license receive at least 2 hours of instruction on evidence-2

based suicide prevention and awareness. 3

Sec. 3.5. NRS 641.220 is hereby amended to read as follows: 4

641.220 1. To renew a license or certificate issued pursuant to this chapter, 5

each person must, on or before the first day of January of each odd-numbered year: 6

(a) Apply to the Board for renewal; 7

(b) Pay the biennial fee for the renewal of a license or certificate; 8

(c) Submit evidence to the Board of completion of the requirements for 9

continuing education as set forth in regulations adopted by the Board; and 10

(d) Submit all information required to complete the renewal. 11

2. Upon renewing his or her license, a psychologist shall declare his or her 12

areas of competence, as determined in accordance with NRS 641.112. 13

Sec. 4. NRS 641A.260 is hereby amended to read as follows: 19

641A.260 1. To renew a license issued pursuant to this chapter, each person 20

must, on or before the date of expiration of the current license: 21

(a) Apply to the Board for renewal; 22

(b) Pay the fee for renewal set by the Board; 23

(c) Submit evidence to the Board of completion of the requirements for 24

continuing education[;] as set forth in regulations adopted by the Board; and 25

(d) Submit all information required to complete the renewal. 26

2. The Board shall, as a prerequisite for the renewal of a license, require each 27

holder to comply with the requirements for continuing education adopted by the 28

Board [.] , which must include, without limitation, a requirement that the holder 29

receive at least 2 hours of instruction on evidence-based suicide prevention and 30

awareness. 31

Sec. 4.5. NRS 641A.260 is hereby amended to read as follows: 32

641A.260 1. To renew a license issued pursuant to this chapter, each person 33

must, on or before the date of expiration of the current license: 34

(a) Apply to the Board for renewal; 35

(b) Pay the fee for renewal set by the Board; 36

(c) Submit evidence to the Board of completion of the requirements for 37

continuing education as set forth in regulations adopted by the Board; and 38

(d) Submit all information required to complete the renewal. 39

2. The Board shall, as a prerequisite for the renewal of a license, require each 40

holder to comply with the requirements for continuing education adopted by the 41

(c) Submitting evidence to the Board of completion of the required continuing 50

education[;] as set forth in regulations adopted by the Board; and 51

receive at least 2 hours of instruction on evidence-based suicide prevention and 17

Sec. 5.3. NRS 641C.450 is hereby amended to read as follows: 19

641C.450 Except as otherwise provided in NRS 641C.320, 641C.440 and 20

641C.530, a person may renew his or her license or certificate by submitting to the 21

Board: 22

1. An application for the renewal of the license or certificate; 23

2. The fee for the renewal of a license or certificate prescribed in NRS 24

641C.470; 25

3. Evidence of completion of the continuing education required by the Board 26

[;] , which must include, without limitation, a requirement that the applicant

27

receive at least 1 hour of instruction on evidence-based suicide prevention and

28

awareness for each year of the term of the applicant’s licensure or certification;

29

4. If the applicant is a certified intern, the name of the licensed or certified 30

counselor who supervises the applicant; and 31

5. All information required to complete the renewal. 32

Sec. 5.7. NRS 641C.500 is hereby amended to read as follows: 33

641C.500 1. The Board may, by regulation, provide for the certification of a 34

person as a detoxification technician. 35

2. Any regulation adopted pursuant to subsection 1 must be consistent with 36

the provisions of chapter 622A of NRS and must include, without limitation, 37

provisions relating to: 38

(a) The requirements for submitting an application for a certificate, including, 39

without limitation, the submission of a complete set of fingerprints pursuant to NRS 40

641C.260; 41

(b) The scope of practice for a person who is issued a certificate; 42

(c) The conduct of any investigation or hearing relating to an application for a 43

certificate; 44

(d) The examination of an applicant for a certificate or a waiver of examination 45

for an applicant; 46

(e) The requirements for issuing a certificate or provisional certificate; 47

(f) The duration, expiration, renewal, restoration, suspension, revocation and 48

reinstatement of a certificate; 49

(g) The grounds for refusing the issuance, renewal, restoration or reinstatement 50

of a certificate; 51

(h) Requirements for the completion of continuing education which must

52

include, without limitation, a requirement that the applicant receive at least 1

hour of instruction on evidence-based suicide prevention and awareness for each

year of the term of the applicant’s certification;

2

(i) The conduct of any disciplinary or other administrative proceeding relating

3

to a person who is issued a certificate; 4

[(i)] (j) The filing of a complaint against a person who is issued a certificate; 5

[(j)] (k) The issuance of a subpoena for the attendance of witnesses and the 6

production of books, papers and records; 7

[(k)] (l) The payment of fees for: 8

(1) Witnesses, mileage and attendance at a hearing or deposition; and 9

(2) The issuance, renewal, restoration or reinstatement of a certificate; 10

[(l)] (m) The imposition of a penalty for a violation of any provision of the 11

regulations; and 12

[(m)] (n) The confidentiality of any record or other information maintained by 13

the Board relating to an applicant or the holder of a certificate. 14

3. A person shall not engage in any activity for which the Board requires a 15

certificate as a detoxification technician pursuant to this section unless the person is 16

the holder of such a certificate. 17

4. In addition to the provisions of subsection 2, a regulation adopted pursuant 18

to this section must include provisions that are substantially similar to the 19

requirements set forth in NRS 641C.280 and 641C.710. Any provision included in 20

a regulation pursuant to this subsection remains effective until the provisions of 21

NRS 641C.280 and 641C.710 expire by limitation. 22

5. Except as otherwise provided in this section and NRS 641C.900, 641C.910 23

and 641C.950, the provisions of this chapter do not apply to the holder of a 24

certificate that is issued in accordance with a regulation adopted pursuant to this 25

section. 26

6. As used in this section, “detoxification technician” means a person who is 27

certified by the Board to provide screening for the safe withdrawal from alcohol 28

and other drugs. 29

Sec. 6. 1. This section and sections 1, 1.5, 2, 3, 4, 5, 5.3 and 5.7 of this act 30

[becomes] become effective on July 1, 2016. 31

2. Sections 5.3 and 5.7 of this act expire by limitation on June 30, 2026. 32

3. Sections 1.3, 2.5, 3.5, 4.5 and 5.1 of this act become effective on July 1, 33
