NOTICE INVITING TENDER

E-tenders for empanelment of agencies for hiring of Taxies are invited from

the reputed agencies in two bid system through “e” procurement solution, as per the

guidelines and terms & conditions given in tender document. Tender documents are

available online from 01.07.2016 at

https://esic.eproc.in

. The approximate value of

annual procurement is Rs. 10 Lakhs. Bidders have to deposit the Earnest Money

Deposit (EMD) of Rs. 20, 000/- in the form of Demand Draft drawn in favour of “ESIC

Fund A/c No.1” payable at Hyderabad.

The interested tenderers should upload their technical & financial bids along with

scanned copies of all relevant certificates, documents, etc., duly signed – on the e-tender

portal

1. Instructions for E-tendering

Vendor should get registered at https://esic.eproc.in

by paying Annual

Registration Charges of Rs. 2, 000/-(non-refundable) in the form of Demand Draft

from any scheduled Bank in favour of M/s.Uptron Powertronics Limited at

Ghaziabad.

Vendor also needs to submit Bid Processing Fee Charges of

Rs. 4, 500/- (non-refundable) in the form of Demand Draft from any scheduled

Bank, in favour of M/s.Uptron Powertronics Limited payable at Ghaziabad for

participating in the Tender.

Vendor need to submit the Demand Draft of Annual Registration charges

and Bid processing Fee at the below mentioned Registered Address for approval

of Registration and successful submission of Tender, failing which, the vendor will

not be able to participate in the e-tender. Along with the Demand Draft, Vendors

need to send a covering letter mentioned about the payment details, company

name, address, payment towards ESIC Registration Charges(Mention User ID)

and ESIC Bid processing Fees ( mention the tender ID and Tender title) at the

below mentioned address:

The vendor also needs to mention his company name, address, user ID,

payments towards, ESIC Registration charges ( at the back side of Demand Draft

Title ( at the back side of the Demand Draft of Rs. 4500/-).

Vendors also need to send the scanned copies of Demand Drafts at

2. Eligibility conditions for tenderer



The tenderer must have a Registered/Branch Office in Hyderabad



The bidder should be a well established taxi agency/firm having a fleet of

latest models of taxies/cars ( at least 10 cars with registration in the

bidder’s own name/associate without any legal encumbrances)



The bidder should have experience of at least three years for providing

such services in Government/PSUs/Autonomous Body.



The bidder should have not been blacklisted by any Central/State

Government Agency in the past three years ( attach self certificates)



The bidder should have a regular office with a functional telephone for

round the clock booking of the requirements.



The bidder must be carrying a PAN number/Service Tax Registration No.

3. TERMS AND CONDITONS FOR TENDERER

1. The technical and financial bids can be uploaded up to 12.00 Noon on

26.07.2016 and any bid uploaded after the prescribed time shall not be

considered irrespective of rates. The technical bid will be opened on the same

date i.e., on 26.07.2016 at 3.30PM.

2. The bidder should carefully read, understand and seek clarifications if any

before uploading the bid. No claim whatsoever will be entertained for any

alleged ignorance thereof.

3. Earnest Money Deposit (EMD) of Rs. 20, 000/- (Rupees twenty thousand only)

should be sent to General Branch, ESI Corporation, Regional Office, 5-9-23,

Hill Fort Road, Adarshnagar, Hyderabad – 500063. The EMD shall be paid in

the form of Demand Draft/Banker Cheque from a Nationalized

Bank/Scheduled Commercial Bank in favour of ESIC Fund Account No. 1

payable at Hyderabad. Any bid/tender uploaded without requisite EMD shall

be deemed to be invalid and will be rejected.

4. The EMD should remain valid for a period of 45 days beyond the final tender

validity period.

5. EMD of bidder will be forfeited, if the bidder withdraws or amends its bid or

impairs or derogated from the bid in any respect within the period of validity

of its bid. Further, if the successful bidder fails to furnish the required

performance security within the specified period, its EMD will be forfeited.

6. EMD furnished by all unsuccessful bidders will be returned to them without

any interest whatsoever, after finalization of the contract. EMD of the

successful bidder(s) will be returned after receipt of the performance security

from him/them.

8. Performance Security should remain valid for a period of sixty days beyond

the beyond the date of completion of all contractual obligations of the supplier.

9. Performance Security will be refunded to supplier without any interest,

whatsoever, after it duly performs and completes the contract in all respects.

10.Performance Security will be forfeited if the firm fails to perform any of the

terms or conditions of the contract, besides it may also be black listed.

11.Copies of RC of all the vehicles registered in the name of the transport

company/firm.

12.The bidder should have the ownership of at least 10 vehicles. The bidders are

advised to read the instructions above and the terms and conditions herein

below carefully and submit confirmation of unconditional acceptance of the

terms & conditions without deviations. In case there are any deviations from

the terms & conditions of the tender they may be clearly indicated in the

technical bid for consideration.

13.The taxi/vehicle should not be more than 4 years old and must be having

good upholstery.

14.The Drivers should possess valid license/documents like road tax clearance,

pollution certificate etc., with respect to Taxi and himself. Liability of

maintenance of the vehicle will be of Agency. The Driver should wear neat

uniform, proficient in speaking in local language, well mannered, courteous

proven integrity, healthy personal habits and should carry a mobile with him.

15.No compromise shall be made by the ESIC towards punctuality, obedience,

promptness, alertness, behavior of the driver. In case of failure the ESIC

reserves the right to cancel the contract forfeiting the deposit without giving

any notice.

16.The ESIC will not be responsible for any wrong entry/wrong

parking/penalties/challans of the vehicle/driver.

17.The driver engaged should be broadly aware of the major routes of

Hyderabad/Secunderabad.

18.The vehicles on duty shall have to be kept in clean condition. The general

condition of the vehicle provided should be good. The seat should be

comfortable. The seats shall always be covered with neat and good quality

seat covers. No payment shall be made if the vehicle is found in dirty or

shabby conditions.

19.In case of any break down while on journey, alternative arrangement shall

have to be done by the contractor failing which the taxi will be hired from the

open market and the expenses incurred thereon shall be deducted from the

bills of the contractor.

20.At times, ESIC Regional Director may need additional number of

taxies/vehicles on specific days in connection with any conference/meeting.

The contractor should be responsible to arrange for additional demand of

taxies/vehicles by making necessary tie-ups at his end with other

taxies/vehicles operators and such additional vehicles should be supplied at

the contractual rates and conditions.

22.All compensation or other sums of money payable by the contractor to clients

under the terms of this contract may be deducted from the security deposit,

or from any sum that may be or may become due to the contractor on any

account whatsoever and in the event of the security deposit being reduced by

reasons of any such deductions, the contractor shall within 10 days of being

asked to do make good in cash or by cheque any sum which have been

deducted from his security deposit.

23.Tender containing any condition leading to unknown/indefinite liability, are

liable to be summarily rejected. If at all any rebate(s) is/are to be offered the

tenderer shall first quote his rates strictly on the terms and conditions

stipulated in tender document and then show separately rebate(s) offered

specifying the conditions for such rebate(s). Failure to follow this procedure

will render the tender liable to summarily rejection.

24.Canvassing in connection with tenders is strictly prohibited and the tenders

submitted by the contractors who resort to canvassing will be liable to

rejection.

25.Tenders for works shall remain open for acceptance for a period of 90 days

from the date of opening of tenders. If the tenderer withdraws his tender

before the expiry of the said period or makes any modifications in terms and

condition of the tender which are not acceptable to the ESIC, then the ESIC

without prejudice to any other right or remedy is at liberty to forfeit the

earnest money.

26.No advance will be granted in any case.

27.Deduction at sources such as TDS of Income Tax/Service Tax etc. shall be

recovered as applicable as per Government Rules.

28.The contractors should visit the site to ascertain the working conditions and

local authority regulations/restrictions if any and other information required

for the proper execution of the contract.

29.Estimated hiring charges for 12 moths are Rs. 10 lakhs. Contractor may

quote his own workable rate and need not take the estimated rate as base for

any purpose.

30.All expenses should be borne by the owner in case of breakdown of the

vehicle including immediate replacement of the vehicle.

31.All the charges towards repair/servicing, salary of the driver, all maintenance

charges, maintenance of up keep of the vehicles, all incidental charges for

maintenance of the vehicles etc., shall be borne by the taxi/vehicle owner.

32.The vehicle must be insured in all respects. All liabilities of any legal disputes,

accidents, etc., shall be borne /paid by the firm or taxi/vehicle owner.

33.Sub-letting of works is prohibited.

34.The tender is not transferable.

37.Tender bids shall be opened in the presence of tender committee and the

tenderer who wish as to be present at the time of opening of tender may

present himself/herself.

38.Towels/napkins, air-fresheners shall be replaced at regular intervals and new

set should be always be reserved for using the vehicle for any top

boss/visitors of the ESIC.

39.The tenderer should be prompt in payment of wages/salaries to the Driver

and must be complying with the provision of Minimum wages Act, ESIC and

EPFO.

4. Evaluation of Financial bid

The lowest bid will be finalized on the basis of lowest rate offered by

tenderers for category of items. The lowest rate for each item will be complied

and offered to all the technically qualified participants for their acceptance. The

acceptance of a tender will rest with the competent authority, who does not bind

himself to accept the lowest tender and reserves to himself the authority to reject

any or all of the tenders received, without assigning any reasons. All tenders in

which any of the prescribed conditions are not fulfilled, or are incomplete in any

respect are liable to be rejected.

5. Terms of payment

Payment will be released normally within 10 days (working days) after

receipt of complete bill. All statutory taxes such as; service tax will be

reimbursed on actual basis. Toll Tax & parking charges will also be reimbursable

on receipt of original slips. All taxes including sales tax, octroi, or any other

statutory obligation/tax on services, work contract tax, turn over tax etc., in

respect of this contract, as applicable, shall be payable by contractor. Service Tax

as applicable from time to time shall be paid by the ESIC. Actual parking/ toll

Charges/interstate/entry charges shall be reimbursed and the owner should

arrange necessary money available with the driver. The character antecedents of

driver to be deployed should be properly verified and recorded and get verified

with investigation or legal agencies. All payments shall be made by e-payment

process only.

6. Period of contract

(A)

In case of any delay in execution of the order beyond stipulated date and

time, including any extension permitted in writing, a penalty @ Rs.

200/-per complaint will be imposed.

(B)

Any misconduct/misbehavior on the part of Driver deployed by the Agency

will not be tolerated and concerned Driver will be replaced immediately by

the Agency.

(C)

The ESIC reserves the right to terminate the contract at any time by giving

one month written notice, on the ground of unsatisfactory services or

breach of any of the terms of the contract, and reserves the right to forfeit

the security retained towards performance guarantee.

8. Reporting of Taxi and Penalties

(A)

The empanelled Agency has to provide Taxi on telephonic intimation from

the authorized officer of ESIC Regional Office, Telangana. The taxies can

be requisitioned at any time of the day and night. The taxies should be

provided at the desired location within 30 minutes of telephone/written

intimation. In case the taxi is not made available at the appointed time

and desired location, the ESIC will make arrangement at its cost and risk

and the charges will be deducted from pending bills or by invoking the

Security Deposit or by raising claims.

(B)

The duty slips shall be signed by ESIC officers using the vehicle on the

same day/immediately after availing service. It will be the responsibility

of the Driver to get the duty slip filled up and signed by the officer using

the Car on completion of the journey. Any overwriting, cutting or erasing

of entries on duty slip will not be admitted.

(C)

ESIC stands indemnified of the consequences arising out of any accident or

mishap or violation of traffic rules by the Driver while performing ESIC

duty. ESIC also stands indemnified of any responsibilities that fall in the

domain of the empanelled Agency with respect to the hired vehicles,

drivers and statutory requirements with the State Transport Authority.

(D)

While performing the duty, if a vehicle is rendered out of order, Agency

shall send the replacement within 30 minutes failing which ESIC shall be

free to make alternate arrangements at the cost and risk of empanelled

agency.

9. Applicable law and jurisdiction

All disputes shall be governed by the Indian law both substantive and

procedural, for the time being in force and shall be subject to the exclusive

jurisdiction of Indian Courts at Hyderabad.

10.ESIC reserves the right to accept/reject any bid and to cancel the bidding process

at any time and reject all bids, at any time prior to placement of order, without

thereby incurring any liability.
