“CHEAP RATES NO WAITS LOAN PROMOTION”
OFFICIAL RULES
1. Eligibility: The loan promotion is open to adults, aged 18 years or older as of September 6, 2014; and who live, work, worship or attend school in Minnehaha, Lincoln, Turner and McCook County in South Dakota. The loan promotion is subject to all applicable federal and state laws and regulations. By participating, applicants agree to abide by and be bound by these rules and accept the decision of Sioux Empire Federal Credit Union as final.
2. How the Promotion Works: The loan promotion applies to loans applied for, and granted in-person and online at www.siouxempirefcu.org between Saturday, September 6, 2014 at 12:00am and Sunday, September 7, 2014 at 11:59pm. The promotion will end when $3,000,000 in total loans is approved, the first 200 qualifying members have received loans, or until the deadline for application occurs on Sunday, September 7, 2014 at 11:59pm, whichever event occurs first. The promotional rate granted to qualifying applicants will be determined either by the order in which applicants submit their application or by a tiered scale of aggregate approved loan amounts, which is as follows:
• The first 50 qualifying members or $1,000,000, whichever is reached first, will receive a rate of 0.99% APR*
• The next 50 qualifying members or next $1,000,000, whichever is reached first, will receive a rate of 1.50% APR*
• The next 100 qualifying members or next $1,000,000, whichever is reached first, will receive a rate of 2.25% APR*
Upon completion of the promotional period, Sioux Empire Federal Credit Union will review all time stamped applications to determine which rate tier each applicant has earned. If the applicant has not contacted Sioux Emprie Federal Credit Union sooner, a Member Service Officer from Sioux Empire Federal Credit Union will then contact the applicant by phone no later than 7 calendar days after the application is received to notify the applicant of the rate in which they earned.
*Annual Percentage Rate.
3. How to Participate: To participate in the loan promotion, applicant must complete and submit a loan application in-person or online at www.siouxempirefcu.org starting on Saturday, September 6, 2014 at 12:00am through Sunday, September 7, 2014 at 11:59pm. In- person applications can only be made during normal Saturday business hours at the Credit Union’s Sycamore and Solberg locations on Saturday, September 6, 2014 from 9:00am – 12:00pm. All online and in-person applications will be time stamped to determine which promotional rate will be awarded.
For in-person applications, another person may stand in line on the entrant’s behalf, only if the person presents a signed application from the applicant or are going to be on the loan with the person they are applying for. For online applications, applications completed on the behalf of someone else may only be accepted if both party’s names are on the loan.
The likelihood of receiving the lowest available promotional rate will depend on the number of applicants and time the application is submitted.
Because the promotion will start before Sioux Empire Federal Credit Union’s branches are open on Saturday, applicants who submit their applications online will be able to apply earlier and may have an increased likelihood to receive a better rate.
4. Terms, Conditions, and Restrictions:
a. The loan promotion applies only to secured, consumer-purpose auto loans. Real estate-secured loans, open-end lines of credit, and business-purpose loans are excluded from the promotion. Typical security may include cars, trucks, motorcycles, boats, and
recreational vehicles.
b. Promotion applies to loans and refinances for vehicles 2004 and newer and terms up to 72 months.
c. Applicants must have a current Beacon credit score of at least 660 to qualify for a promotional rate. Applicants with a current credit score less than 660 may still be considered for approval. However, interest rates will be based on rates currently in effect for loan terms of the type applied for.
d. All loans are subject to credit approval and are based on credit criteria.
e. Offer not valid with other promotions or rewards, for example, Reward Points may not be used in conjunction with this promotion.
f. The maximum amount financed is limited to 100% NADA retail value of the collateral offered for security.
g. With the exception of the promotional rate, all other normal loan terms and conditions apply.
h. The loan promotion is restricted to new loans and refinances to the Credit Union and does not apply to loans already financed by Sioux Empire Federal Credit Union.
i. Preapprovals are only good for 14 days.
j. Rates, terms and conditions are subject to change without notice.
5. Additional Terms:
a. By participating, applicants agree to the Official Rules and that the decisions of Sioux Empire Federal Credit Union will be final in all respects.
b. Loan applications are issued on a first-come, first-served basis.
Applicants’ applications will be time stamped to establish their place in line. Applicants will be allowed to apply for their loan at whatever time they feel is appropriate during the promotional period. The Branches located at 3400 S. Sycamore Ave and 5010 S Solberg Ave will be open from 9:00am to 12:00pm on Saturday, September 6, 2014. The Credit Union is not responsible for any disputes regarding physical place in line at branch location.
c. Applicants agree to hold Sioux Empire Federal Credit Union harmless for any injury to persons or property.
d. Sioux Empire Federal Credit Union reserves the right to cancel, amend, and/or revoke this promotion at any time due to printing errors or other mistakes.
6. Tampering with promotion: The Promotion Entities including Sioux Empire Federal Credit Union, our partners and affiliates involved in the promotion, for the actions of entrants in connection with the Promotion, including entrants’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Promotion. Persons found tampering with or abusing any aspect of this Promotion, or whom Sioux Empire Federal Credit Union believes to be causing malfunction, error, disruption or damage may be disqualified. Additionally, any attempt to cheat the Promotion, as determined at the sole and absolute discretion of Sioux Empire Federal Credit Union, may result in immediate disqualification of the entrant, as well as other possible consequences, including disqualification from any and all existing and future Promotion. ANY ATTEMPT BY A PERSON TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE
OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SIOUX EMPIRE FEDERAL CREDIT UNION RESERVES THE RIGHT TO SEEK ALL LEGAL AND EQUITABLE REMEDIES FROM AND AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sioux Empire Federal Credit Union reserves the right, at its sole and absolute discretion, to disqualify any individual who is found to be, or suspected of, acting in violation of these Official Rules, or to be acting in
an unsportsmanlike, obscene, immoral or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person.
7. Suspension / Modification / Termination: In the event Sioux Empire Federal Credit Union is prevented from continuing with the Promotion by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Promotion by any party, or any federal state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sioux Empire Federal Credit Union’s control (each a “Force Majeure”
event or occurrence) Sioux Empire Federal Credit Union shall have the right to modify, suspend or terminate the Promotion. Sioux Empire Federal Credit Union additionally reserves the right, in its sole and absolute discretion: (1) to modify, suspend or terminate the Promotion should causes beyond Sioux Empire Federal Credit Union’s control
corrupt or interfere with the administration, integrity, operation, security or proper play of the Promotion; or (2) to disqualify any entrant found to be, or suspected of: (a) tampering with the entry process or the operation of the Promotion; (b) acting in violation of these Official Rules; or (c) acting in an un-sportsmanlike manner.
8. Waivers, Disclaimers and Releases: By participating in the Promotion, entrants agree to release, discharge and hold harmless the Promotion Entities from and against any and all claims, liability, costs, losses, damages or injuries of any kind arising out of or related to entrants’
participation in the Promotion (including, without limitation, losses, damages or injuries to entrant’s or any other person’s equipment or other property, or to their persons, related to participation in the Promotion).
Sioux Empire Federal Credit Union is not responsible if the participant is unable to gain access to their account due to technical errors such as
Internet service errors, user ID and/or password issues or frozen accounts.
Without limiting the generality of the foregoing, entrants agree that Promotion Entities: (A) maintain no control over the personnel,
equipment or operation of any person or entity furnishing online services in connection with the Promotion; and (B) will not be responsible or liable for any injury, damage, loss, expense, accident, delay, inconvenience or other irregularity that may be caused or contributed to: (1) by the wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of the Promotion Entities, and (2) by any cause, condition or event whatsoever beyond the control of the Promotion Entities. Entrants agree and that the Promotion Entities shall have no responsibility or liability for discontinued prizes; human error;
incorrect or inaccurate transcription of registration and/or account
information; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer
equipment, software, or Internet service provider utilized by Sioux Empire Federal Credit Union; interruption or inability to access the Website, or Sioux Empire Federal Credit Union or affiliated entities’ respective websites, or any online service via the Internet due to hardware or software compatibility problems; any damage to entrant’s (or any third person’s) computer and/or its contents related to or resulting from any part of the Promotion; any lost/delayed data transmissions, omissions, interruptions, viruses, bugs, defects; and/or any other errors or
malfunctions, even if caused by the negligence of the Promotion Entities.
Each entrant further agrees to indemnify and hold harmless Promotion Entities from and against any and all liability resulting or arising from the Promotion and to release all rights to bring any claim, action or
proceeding against Promotion Entities and hereby acknowledge that Promotion Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize. Sioux Empire Federal Credit Union is not responsible for the actions of entrants in connection with the
Promotion, including entrants’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the entrant.
9. Governing Law / Limitation of Liability: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sioux Empire Federal Credit Union or the Promotion Entities in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of South Dakota, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws.
10. BY ENTERING THE PROMOTION, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL
DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY RATE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT- OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR
SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANTS’
REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
