Board of Supervisors Meeting June 12, 2007 M I N U T E S CALL TO ORDER

The Solano County Board of Supervisors met on the 12th day of June, 2007 in regular session in the Chambers of the Board of Supervisors of the County of Solano in the Solano County Administrative Center, 675 Texas Street, Fairfield, California at 8:30 a.m. Present were Supervisors Silva, Spering, Vasquez, and Chair Reagan. Chair Reagan presided. Supervisor Kondylis arrived at 8:35 a.m. Also present were Michael D. Johnson, County Administrator and Dennis Bunting, County Counsel.

This meeting of the Solano County Board of Supervisors continued with the Salute to the Flag and a Moment of Silence.

2. Moved to adopt and presented Resolution No. 2007-133 recognizing June 15, 2007 as World Elder Abuse Awareness Day in Solano County. Directed staff to prepare a Press Release highlighting World Elder Abuse Awareness Day in Solano County and directed Chair Reagan to sign a letter in support for their application to Archstone Foundation for Phase 2 funding. PUBLIC COMMENT ON CONSENT CALENDAR

The Chair invited individuals of the public to make comments on items on the Consent Calendar. The following comments were received:

A. George Guynn, Jr., Suisun, expressed his concern with the hourly rate of pay for the class of Contract Employee - Professional and that the Potrero Hills Landfill should be relocated away from the Suisun Marsh area.

B. Lorraine McGee, Rio Vista, expressed her concern regarding the lack of proposals for recycling in Solano County and suggested that the tax on the tonnage of waste disposed at the landfill be increased to support recycling. Ms.

McGee requested a copy of the current Use Permit which governs the Potrero Hills Landfill.

C. David Isaac Tam, Northern California Recycling Association Board of Directors, expressed his concern regarding the Potrero Hills Landfill and the need for long term solutions for reducing waste, the need for recycling services, and the need to increase fees to provide for this service.

D. Dwight Acey, Citizens Against the Dump Expansion, noted that Highway 12 will continually be impacted by development along that roadway.

amending the Alphabetical Listing of Classes and Salaries to increase the hourly rate for the class of Contract Employee - Professional from the current rate of $11 to $100 per hour to a new rate of $11 to $145 per hour. (see Resolution Book)

7. Approved and authorized Chair Reagan to sign the Notice of Completion for work performed by Blackshear Construction of Benicia for the Office of Emergency Services and Facilities Operations Garage/Warehouse Project at 509 Delaware Street in Fairfield, CA. Authorized the Clerk of the Board to record the executed document.

7a. Ratified an emergency contract for $150,000 with Belfor USA Group, Inc. for the period of June 6, 2007 to September 30, 2007 to cleanup water damage in leased space located at 1745 Enterprise Drive and approved an Appropriation Transfer Request in the amount of $150,000 from General Fund contingencies to cover the cost of the contract.

8. Approved and authorized Chair Reagan to sign the following 17 contracts with new funds totaling up to $8,610,771 for the period of July 1, 2007 - June 30, 2010, for First 5 Solano-funded services:

1. Contract #2007-102, Solano County Health and Social Services "Early Periodic Screening Diagnosis and Treatment (EPDST)" in the amount of up to $300,000 for the period July 1, 2007-June 30, 2010, to provide mental health services to Medi-Cal eligible children ages 0-5. This funding represents a 5% match to a 95% federal- and state-funded

program for a total of up to $6 million in services over three years.

2. Contract #2007-101, Children’s Nurturing Project "Early Mental Health Collaboration". This is a two-year agreement in the amount of up to $100,000, for the period July 1, 2007-June 30, 2009, to develop an Early Childhood Mental Health (ECMH) Strategic Plan, make recommendations to the First 5 Solano Commission regarding deployment of ECMH funding, and to convene ECMH partners to collaborate on system change efforts and best practices.

3. Contract #2007-301, Benicia Police Department "Integrated Family Support Initiative". This is a three-year agreement in the amount of

up to $122,588, for the period July 1, 2007-June 30, 2010, to provide information & referral, case management, and home visiting services to at-risk families with children ages 0-5.

4. Contract #2007-302, Dixon Family Services "Integrated Family Support Initiative". This is a three-year agreement in the amount of up to $159,679, for the period July 1, 2007-June 30, 2010, to provide information & referral, case management, and home visiting services to at-risk families with children ages 0-5.

5. Contract #2007-303, Fairfield-Suisun Unified School District

"Integrated Family Support Initiative". This is a three-year agreement in the amount of up to $379,400, for the period July 1, 2007-June 30, 2010, to provide information & referral, case management, and home visiting services to at-risk families with children ages 0-5.

6. Contract #2007-304, Fighting Back Partnership "Integrated Family Support Initiative". This is a three-year agreement in the amount of up to $444,487, for the period July 1, 2007-June 30, 2010, to provide information & referral, case management, and home visiting services to at-risk families with children ages 0-5.

7. Contract #2007-305, Rio Vista CARE "Integrated Family Support Initiative". This is a three-year agreement in the amount of up to $179,295, for the period July 1, 2007-June 30, 2010, to provide information & referral, case management, and home visiting services to at-risk families with children ages 0-5.

8. Contract #2007-306, Vacaville Police Department "Integrated Family Support Initiative". This is a three-year agreement in the amount of up to $121,632, for the period July 1, 2007-June 30, 2010, to provide information & referral, case management, and home visiting services to at-risk families with children ages 0-5.

9. Contract #2007-307, California Hispanic Commission "Substance Abuse Specialist". This is a three-year agreement in the amount of up to $241,090, for the period July 1, 2007-June 30, 2010, to provide substance abuse specialist services as part of the Integrated Family Support

Initiative’s multi-disciplinary home-visiting team, for intensive services to high-risk families.

10. Contract #2007-308, Children’s Nurturing Project "Parenting Classes and Special Needs Group". This is a three-year agreement in the amount of up to $71,089, for the period July 1, 2007-June 30, 2010, to provide parenting classes to isolated families and convene a weekly support group for parents of children with special needs.

11. Contract #2007-309, Interfaith Council of Solano County "Homeless Shelter Services". This is a three-year agreement in the amount of up to $42,670, for the period July 1, 2007-June 30, 2010, to provide temporary housing/shelter to homeless families with children ages 0-5.

12. Contract #2007-310, Solano County Health and Social Services "Child Protective Services Worker & Public Health Nurse". This is a

three-year agreement in the amount of up to $463,635, for the period July 1, 2007-June 30, 2010, to provide a Child Protective Services Worker and Public Health Nurse services as part of the Integrated Family Support Initiative’s multi-disciplinary home-visiting team, for intensive services to high-risk families.

13. Contract #2007-311, Youth and Family Services "Substance Abuse Specialist Services". This is a three-year agreement in the amount of up to $210,181, fir the period July 1, 2007-June 30, 2010, to provide substance abuse specialist services as part of the Integrated Family Support Initiative’s multi-disciplinary home-visiting team, for intensive services to high-risk families.

14. Contract #2007-312, The Children’s Network of Solano County "Integrated Family Support Initiative (IFSI) Collaboration". This is a three-year agreement in the amount of up to $417,591, for the period July 1, 2007-June 30, 2010, to coordinate the IFSI multi-disciplinary case

conferencing team to develop a holistic family treatment plan, convene IFSI partners, share best practices, strengthen existing family support services, and connect service providers to research-based parenting programs. 15. Contract #2007-903, LaFrance Associates, LLC. "Evaluation Contractor". This is a three-year agreement in the amount of up to $533,570 for the period July 1, 2007-June 30, 2010, to evaluate First 5 Solano’s programs, initiatives and system-change efforts.

16. Contract #2007-504, The Children’s Network of Solano County "Child Care Professional Development". This is a three-year agreement in the amount of up to $398,726, for the period July 1, 2007-June 30, 2010, to increase the professional development and education levels of participating members of the child care workforce.

17. Contract #2007-601, Solano County Health and Social Services "Prenatal Services". This is a three-year agreement in the amount of up to $4,425, 138 for the period July 1, 2007-June 30, 2010, to provide prenatal services to pregnant teens, African American women and women at risk of substance abuse.

10. Approved the submission of the Renewal Grant Application for the Housing and Urban Development Department (HUD) 2008 Continuum of Care for Vacaville Social Services and Youth and Family Services Transitional Housing Projects; Caminar Permanent Housing Project; and the Homeless Assistance Centers. Authorized the Chair to sign any resulting revenue agreements.

11. Approved and authorized Chair Reagan to sign an amendment increasing by $6,056, for an amended total of $114,789 the contract ending June 30, 2007 under which the Children’s Network provides staff support to the Solano County Child Care Planning Council.

12. Took the following action for Master List of Contracts for the Department of Health and Social Services:

1. Approved the various revenue and expenditure contracts (H&SS Master List), effective July 1, 2007, with contract payment limits of $50,000 or higher, and delegated authority to the County Administrator to execute any amendments to these contracts in accordance with the Department’s approved FY2007/08 budget;

2. Adopted and authorized Chair Reagan to sign Resolution No. 2007-135 authorizing the Chair of the Board to sign Federal and State revenue contracts and Memoranda of Understanding (MOU), for incoming funds for FY2007/08;

3. Adopted and authorized Chair Reagan to sign Resolution No. 2007-136 authorizing the Health Officer to sign State Revenue Agreements and MOU for AIDS services;

4. Approved any amendments necessary to extend existing contracts through the execution of a successor contract necessary for critical services due to expire on June 30, 2007 and authorized the County Administrator to sign said amendment;

5. Authorized the Health and Social Services Director to amend contracts with contract psychiatrists, physicians, and dentists to grant hourly wage increases at the Director’s discretion coincident with increases approved for County staff, in an amount no greater than 15% of the hourly wage.

13. Approved the acceptance of First 5 Solano Children and Families

Commission funds for $4,425,988 for the period July 1, 2007 to June 30, 2010 under which Health & Social Services will continue the BabyFirst Solano project and provide prenatal services to pregnant and parenting African American women, teens, and women at risk for or using

substances, including alcohol, tobacco and other drugs during pregnancy. Authorized the County Administrator to sign the following eight

subcontracts totaling $2,584,493 for the period July 1, 2007 to June 30, 2010 to provide prenatal services to high-risk populations:

1. Partnership HealthPlan of California in the amount of $154,820 2. NorthBay Medical Center in the amount of $631,083

3. Everlasting Hope Ministries in the amount of $212,459 4. Youth & Family Services in the amount of $126,372

5. Planned Parenthood: Shasta-Diablo in the amount of $578,839 6. La Clinica-Great Beginnings in the amount of $596,420

7. Children’s Nurturing Project in the amount of $70,250

8. California Hispanic Commission in the amount of $214,250

14. Approved and authorized Chair Reagan to sign a Memorandum of Understanding (MOU) for the period July 1, 2007 through June 30, 2008, under which the County of Solano will receive a transfer of Federal

funds for $872,106 from the Solano County Office of Education for the provision of children’s mental health services under the State mandated AB 3632 Mental Health Program.

15. Accepted a $70,000 grant from the California Department of Health

Services (CDHS) for the time period March 1, 2007 through June 30, 2007 and authorized the purchase of a MIDI High Performance Liquid

Chromatography (HPLC) Analyzer for the Public Health Laboratory. Approved and authorized Chair Reagan to sign a $70,000 contract for the time period March 1, 2007 to June 30, 2007, from the CDHS, accepting the revenue to purchase the HPLC Analyzer. Approved an Appropriation Transfer Request for $70,000 and authorized the purchase of the fixed asset in the amount of $70,000.

16. Approved and authorized Chair Reagan to sign a contract amendment with Child Haven for $60,000 for a total contract amount of $735,000 for the term ending June 30, 2007, to provide mental health assessment and treatment to children ages birth to five years under Early Periodic Screening, Diagnosis and Treatment Plan (EPSDT).

17. Approved and authorized Chair Reagan to sign the following Probation Department’s Master List of contracts and amendments totaling $1,295,198 effective July 1, 2007 and authorized the Director of Probation to approve and execute any future contract amendments that remain within budgeted appropriations or are limited to minor modifications to scope of services and/or terms and conditions:

1. ISD Corporation in the amount of $75,193

2. California Forensic Medical Group in the amount of $890,505 3. Seneca Center for Families and Children (Family Preservation) in the amount of $132,000

4. Various Providers (SACPA - Prop 36) in the amount of $197,500

18. Approved and authorized the County Administrator to sign a amendment to a contract with Attorney’s Diversified Services in the amount of $108,000 to provide process service of court documents for the period of July 1, 2007 to December 31, 2008. This amendment coupled with the existing three-year contract amount of $225,000 results in a new contract total of $333,000.

19. Adopted and authorized Chair Reagan to sign Resolution No. 2007-137 approving a revised master agreement with Caltrans for Federal-aid projects (Agreement No. 04-5923R). Authorized the County Administrator to execute the agreement on behalf of Solano County. Authorized the

Director of Resource Management, functioning as the Director of

Transportation, to execute program supplements. (see Resolution Book)

20. Adopted and authorized Chair Reagan to sign Resolution No. 2007-138

approving Traffic Order 397 establishing a No Parking zone on Lynch Road. (see Resolution Book)

21. Approved and authorized Chair Reagan to sign a Notice of Completion for the FEMA Gates Canyon and Mix Canyon Roadway Repair Project

constructed by W.R. Forde Associates for a final cost of $391,653.

22. Approved and authorized the County Administrator to sign an Intercity Transit Funding Agreement for FY 2006/07 with the Solano Transportation Authority and the Cities of Benicia, Dixon, Fairfield, Rio Vista, Suisun City, Vacaville, and Vallejo.

24. Adopted and authorized Chair Reagan to sign Resolution No. 2007-140

vacating the action taken September 13, 2005 certifying the Final

Environmental Impact Report (FEIR) for the Potrero Hills Landfill (PHLF) phase 2 expansion project; vacating the action taken September 13, 2005 approving Revision #2 to Use Permit Application No. U-88-33 of Potrero Hills Landfill (Republic Services) for the expansion of the Potrero Hills Landfill from 320 acres to 580 acres and modifications of landfill

operations; and directing staff to take such further actions as necessary to comply with the Writ, including making the revisions to the FEIR as

prescribed by the Court, to (1) analyze and disclose corrected Reactive Organic Gas levels and any additional mitigation that may be required, (2) analyze and disclose the impacts of the Project on groundwater and wells due to the proposed well installation on the Northern portion of the Potrero Hills Landfill, and (3) analyze a reasonable range of project alternatives and provide a meaningful discussion of possible sites outside the Marsh area, both within and outside of Solano County, prior to the Board’s

reconsideration of the subject application. (The property is located at the south end of Potrero Hills Lane approximately 2 miles southeast of the City of Suisun within the Secondary Management area of the Suisun) Marsh in an "AL-160" zoning district.

25. Approved continuing the appointment of the following current 28 Directors of the Workforce Investment Board of Solano County for an additional two year term of office beginning on July 1, 2007 and expiring on June 30, 2009:

26. Approve Addendum No. 7 to the CWSUS Utility Services Agreement contract for $2,083 for plans and specifications for the District’s waterline extensions into the Terra Del Sol subdivision; authorize the General

Manager to enter into a reimbursement agreement with CD&G Enterprises, LLC for reimbursement of $2,083 for the plans and specifications for the District’s waterline extensions into the Terra Del Sol subdivision; and approve an Appropriations Transfer Request to increase contracted services and unanticipated revenues (4/5th vote required)

First Place for Youth for

Housing and Supportive Services

The Board of Supervisors received a report from staff outlining a program under which First Place for Youth would provide housing and supportive services during the period June 12, 2007 through June 30, 2008 to transition-age youths

emancipating from Child Welfare and Probation foster care.

At the conclusion of comments, the Board took the following action:

Moved to approve and authorized Chair Reagan to sign a contract with First Place for Youth for $872,834 to provide housing and supportive services to transition-age youths emancipating from foster care in Child Welfare Services and Probation for the period of June 12, 2007 through June 30, 2008.

Agenda Item No. 23

Solano Land Trust Agricultural Conservation Easement on the Kidwell Farm

The Board of Supervisors received a request to support the Solano Land Trust’s grant application to the California Department of Conservation’s California Farmland Conservancy Program (CFCP) to fund the purchase of an agricultural land conservation easement on the Kidwell Farm, in northeast Solano County, owned by the Denny E. Kidwell and the Ruby E. Kidwell Trust.

Supervisor Vasquez noted that he requested that this matter be placed on the agenda to assist the landowner in joining land together that was

previously divided to aide in production farming.

At the conclusion of discussion, the Board took the following action:

Moved to adopt and authorized Chair Reagan to sign Resolution No. 2007-139 supporting the Solano Land Trust’s grant application for funding the

purchase of an agricultural conservation easement on the Kidwell Farm, owned by the Denny E. Kidwell and the Ruby E. Kidwell Trust.

(Chair Reagan noted that he did not support the use of State Bond Funding to acquire conservation easements for properties not placed into Williamson Act, and in this case specifically, since it will probably be impacted by Highway 113 relocation.)

Supervisor Spering noted that he supported the agricultural conservation easement on the Kidwell Farm as the property was surrounded by agricultural easements previously approved by the Board but would not vote for any conservation easement in the future that was located along a transportation corridor.

This meeting of the Solano County Board of Supervisors recessed at 10:45 a.m. and reconvened at 10:55 a.m. All members were present. Chair Reagan

presided.

Agenda Item No. 30

Project Status Report for the Twin Campus Project

The Board of Supervisors received a presentation and project status report for the Twin Campus Project with improvements in Vallejo and Fairfield (formerly the South County Government Center Project) which included a project description, an update of the architectural program, site plans, floor plans, building elevations, estimated budget, schedule, and other information for the new Health and Social Services building in Vallejo and the Public Health Lab and Clinic in Fairfield.

It was noted that in order to maintain the overall budget and keep the project within the Health and Social Services reimbursement cap, the current design did not include the proposed expansion space for the new Health and Social

Services Building in Vallejo and the building size had been reduced to 58,000 square feet.

At the conclusion of discussion, the Board directed staff to return to the Board in the near future with information pertaining to building and operational

enhancements including installation of operable windows, installation of photovoltaic arrays, pedestrian circulation, bus route, and permeable paving.

Agenda Item No. 28

Update Report from State Legislative Advocate

The Board of Supervisors received an oral report from the County’s State

Legislative Advocate, Paul Yoder on the status of the current state budget and a summary of the Governor’s May Revise. Mr. Yoder noted two key issues were: 1) funding of the Mentally Ill Offender Crime Reduction Act (MIOCR) which helps fund probation initiatives that help divert adult offenders from further criminality; and 2) Williamson Act Subventions which are proposed to be eliminated. It was noted that in 2005, Solano County received $715,984 in subventions. Mr. Yoder noted that he felt there would be a significant downturn in state funding to the counties for the next five years and that counties were owed money from the state for services already provided to children.

This meeting of the Board of Supervisors recessed at 12:25 p.m. and

reconvened at 2:00 p.m. Present were Supervisors Silva, Spering, Vasquez and Chair Reagan. Supervisor Kondylis arrived at 2:10 p.m. Chair Reagan presided.

Agenda Item No. 29 Court Appointed Special

Advocates (CASA) of Solano County

The Board of Supervisors received a request for a second amendment to the Memorandum of Understanding (MOU) with Court Appointed Special Advocates (CASA) of Solano County in the amount of $129,000 for July 1, 2007 through June 30, 2008 for a third year of support toward the coordination and provision of volunteer services for CASA. The Board received an overview of fundraising activities hosted and to be hosted in the near future by CASA in an effort to become a stand alone non-profit agency. CASA representatives noted that they were also working to secure corporate sponsorships and applying for all possible grants and annual gifts.

At the conclusion of discussion, the Board took the following action:

Moved to approve and authorized Chair Reagan to sign a second amendment to the Memorandum of Understanding with Court Appointed Special Advocates (CASA) of Solano County for $129,000 for the period of July 1, 2007 through June 30, 2008 to coordinate and provide volunteer services.

Commissioner regarding the highlights of the Solano County Crop and Livestock Report for 2006.

32. Conduct a public hearing and consider adopting a resolution confirming delinquent accounts for unpaid monthly water service bills; Authorize the General Manager to proceed with processing and recording liens against delinquent property owners in the District.

Biosolids Program in Solano County

The Board of Supervisors received a report from staff providing an overview of the local biosolids land application program and requested the Board to provide direction to staff regarding the process to use in amending Chapter 25, the ordinance regulating land application of biosolids which is set to expire in

October. 2007 It was noted that Class B type biosolids (pathogens reduced, but not eliminated and rely upon site controls to protect public health and the

environment until the pathogens naturally die in the environment) was the type of biosolids currently land applied in Solano County onto farmland as a soil

amendment. Staff noted that after October 15, 2007, biosolids could continue to be applied in accordance with federal and state requirements. However, the County would lose the more protective standards in Chapter 25 and lose the local county program.

Moved to receive background information on the implementation of the biosolids program in Solano County and scheduled a public hearing for August 28, 2007 to discuss results of scientific research, receive public comment and hear

recommended changes to Solano County Code Chapter 25. MOTION: Barbara R. Kondylis. SECOND: Mike Reagan.

ITEMS FROM THE PUBLIC

Chair Reagan invited members of the public to make comments on subject matters within the jurisdiction of the Board. The following public comments were received:

A. Donald Tipton, unincorporated Vallejo, representing the Homeacres

Improvement Association, expressed his concern regarding the configuration of the Board Chambers, requested information not being provided, and that he felt more secure without the Sheriff deputies being present in the Board Chambers.

B. George Guynn, Jr., Suisun, made public comments regarding insensitivities by the County to the public and the costs of security at the Board of Supervisors' meetings.

BOARD MEMBER COMMENTS AND REPORTS ON MEETINGS

Chair Reagan invited Board members to make comments and reports on meetings. The following comments and reports were received.

A. Supervisor Vasquez requested that this meeting of the Solano County Board of Supervisors be adjourned in memory of Lorelei Floyd, Carl Sullivan and Mary Widger.

B. Supervisors Vasquez requested that Chair Reagan be authorized to sign a letter of support to the State of California on behalf of the City of Vacaville to keep Patrick Ghilotti monitored with the use of a GIS device.
