1. Chair's announcements 1,1 Interpretation

Interpretation was available in German, English and Italian and Danish. 1,2 Unused interpretation at shadows meetings

The Chair reminded the Coordinators that Members who requested interpretation and could not be present must notify the Secretariat as soon as possible in order to cancel unneeded interpretation. The Chair also underlined that shadows meetings should not be organised during Committee meetings.

1,3 Possible cancellation of EMPL meeting of 22 December 2015

Beslut:

The Coordinators decided to cancel the EMPL meeting scheduled for 22 December (2 half-days).

1,4 State-of-play on conflicts of interests with FEMM on different files Social/Female Entrepreneurship

The Coordinators

 noted that EMPL had been authorised to draw-up an own-initiative report on

"Social entrepreneurship and social innovation in combatting unemployment" (rapporteur Ms Lope Fontagné), that the FEMM Committee had requested permission to draw-up a similar own-initiative report on "External factors that represent hurdles to European female entrepreneurship, including social entrepreneurship" and that due to the overlap and the scope of the FEMM INI interfering with EMPL competences, the FEMM request had been blocked by EMPL in the CCC.

 agreed on the following position: FEMM should give up its own INI and become

opinion giving Committee to the EMPL INI, as appropriate under Rule 54 (enhanced cooperation) with FEMM having exclusive competence for the topic of "hurdles to European female entrepreneurship" (a special section on this topic could be taken on board in the EMPL report).

Women Domestic Workers and carers in the EU

The Coordinators noted that the Chairs of the two Committees agreed on the application of rule 54 to this report, with FEMM as lead Committee and EMPL as associated Committee. A joint letter signed by both chairs, with the details on the application of Rule 54 will be sent to the CCC.

The Coordinators noted that following EMPL’s contest of FEMM drafting the

implementation report on parental leave, which is the remit of EMPL, and since the two committees have not reached agreement, the CCC is preparing a recommendation for a solution for this issue.

1,5 Proposal to amend ESF increasing the possibility to pre-finance measures under YEI – advancing of deadline for amendments to Thursday 12 March noon

The Chair announced that with regard to the proposal "Youth Employment Initiative: increase of the initial pre-financing amount paid to operational programmes (2015/0026(COD))" the rapporteur, Ms Morin-Chartier, had suggested to advance the deadline for amendments to 12 March. Therefore, the date of the deadline for amendments would exceptionally be before the date of the discussion of the draft report in EMPL which is scheduled to take place on 24 March. The draft report of the rapporteur should be available on 5 March. The Chair will announce this new deadline for amendments at the EMPL Meeting on 5 March and the EMPL Secretariat will inform all Members by email.

3. EMPL public hearings in the second half of 2015 (ZP)

In view of the decision on the committee hearings to be held in the 2nd half of 2015 (July-December), committees are requested to submit requests for public hearings until 10 April 2015 at the latest.

Decision

 took note of the fact that

o the EMPL committee had only a limited number of meeting days in the

second half of 2015 (12 half-days after the summer recess, following cancellation of the 22 December meeting)

o hearings tend to occupy one half-day each

o the following shortlist for topics had been agreed on 24 September 2014 Re-shoring Europe - bringing jobs back to Europe (ECR)

Creating a competitive EU labour market for the 21 century: matching skills and qualifications with demand and job opportunities (ALDE) Social dumping in the aviation industry (GUE/NGL) - on the

understanding that the title might be broadened, subject to submission of a revised wording by GUE/NGL

Member States' active labour market policies - good practices with regard to the 3 parts of the Active Inclusion Strategy (adequate income, labour market activation, high-quality public services) (Greens/EFA)  took a decision of principle that a limited number of hearings be held in the second

half of 2015

 agreed that one or two topics for hearings should be selected at the next meeting  opened a deadline (17 March end of business) for possible new proposals.

4. EMPL delegations in the second half of 2015 (ZP)

In view of the decision on the committee delegations to be organised in the 2nd half of 2015 (July-December), committees are requested to submit requests for such visits until 10 April 2015 at the latest.

5. Social dimension of the EMU (PR/AC)

The papers for the meeting included an analytical note from President Juncker and a note prepared by the secretariat with EP conclusions on the Social Dimension of the EMU.

 Took note of footnote 1 on page 8 of the analytical note from President Juncker

which reads:

"The President of the European Commission has indicated his intention to draw on the input from the President of the European Parliament in his reflections during the preparation of the report."

 Held an exchange of views

 Agreed that the rapporteur, Ms Sander, and the shadow rapporteurs of the EMPL

opinion on the ECON INI "Review of the economic governance framework: stocktaking and challenges" should jointly assess the appropriateness of drawing up additional compromise amendments providing possible input for the 'Four Presidents' report'.

6. Aviation and road transport issues

The annex to this point includes: The reply of Commissioners Bulc and Thyssen

Decision

The Coordinators

 Took note of the reply from Commissioners Bulc and Thyssen on civil aviation.  Took note of the TRAN initiative.

 Agreed that, in line with the Coordinators' decision of 18 December 2014, an

exchange of views with social partners (including representatives of pilots and cabin crews) and the authors of the study on "Atypical employment in Aviation" should be held in the near future (before 28 May)

 Agreed that a meeting with the two Commissioners should be held after that

exchange of views

 Decided to take a final decision at their next meeting on the basis of a concrete

proposal.

7. Exchange of views on EMPL proposals to be made to the STOA panel (CO) The annex to this point includes:

 the STOA Chair letter sent to all Committee Chairs, requesting for proposals of projects

 annexes to the letter: projects overview 2009-2014; ongoing STOA projects; standard STOA proposal form

 proposals for STOA projects from Ms Jazłowiecka, Mr Pirinski and Mr Kósa.

8. UNCRPD Framework – joint report of LIBE, EMPL and PETI (MM) The annex to this point included: letter signed by 4 Members

Decision

The Coordinators

 Took note of the initiative of four MEPs (Ádám KÓSA, Helga STEVENS, Rosa

ESTARAS FERRAGUT and Soledad CABEZON RUIZ) who as representatives in the EU UNCRPD framework requested that a joint report of LIBE, EMPL, and PETI committees be drawn up in response to the CRPD Committee's recommendations.

 agreed to endorse the initiative.

9. Implementation of the European Progress Microfinance Facility - Modification of title and exchange of views with stakeholders (AC)

Decision

The Coordinators

 approved the proposal to request a modification of the title (new title:

"Implementation of the European Progress Microfinance Facility")

 decided that an exchange of views with stakeholders take place in EMPL committee

on 16 April, and that the invited speakers (without entitlement to claim expenses) represent:

o European Investment Fund and Commission; o Financial intermediaries (bank and non-bank); o Beneficiaries.

10. Exchange of views with stakeholders – Reducing inequalities with a special focus on child poverty (MM)

Decision

The Coordinators decided that an exchange of views with stakeholders take place during the first exchange of views in EMPL committee on 1 April. The invited speakers represent:

 Save the Children  Antipoverty network  Solidar

(The invitation of experts is made without entitlement to claim travel expenses.)

11. Use of translation reserve (ZP)

Decision

Coordinators authorised Jean Lambert to use 1 page from the reserve for the translation of the EMPL report on the 'Green Employment Initiative: Tapping into the job creation potential of the green economy'.

12. Motions for Resolution(Rule 133) - decisions on procedure (MM) Annexes: texts of the motions

12,1 B8-0175/2015 - Motion for a European Parliament resolution on establishing a European Platform to enhance cooperation in the prevention and deterrence of undeclared or falsely declared work by Dominique Martin, Mylène Troszczynski, Joëlle Mélin, Marie-Christine Arnautu, Mara Bizzotto, Georg Mayer, Florian Philippot, Franz Obermayr, Sylvie Goddyn, Marine Le Pen

Beslut: Not to follow up this motion for a resolution since the suggestions included in it are addressed in the amendments to the draft report on Establishment of a European Platform to enhance cooperation in the prevention and deterrence of undeclared work (rapp: Georgi Pirinski)

12,2 B8 0164/2015 - Motion for a European Parliament resolution on the minimum wage by Viktor Uspaskich

Beslut: Not to follow up the matter since the issue of minimum wages was already addressed in the European Parliament resolution of 25 February 2014 on the European Semester for economic policy coordination: Employment and Social Aspects in the Annual Growth Survey 2014 stressing the importance of exploring the possibility of reducing pressure on wages through minimum wage schemes according to national practices.

12,3 B8-0134/2015 - Motion for a European Parliament resolution on unfair social practices in the air transport sector in Europe by Marie-Christine Arnautu The Motion for Resolution can be found at annex to these notes.

Beslut: To wait for the aviation package foreseen in the Commission Work Programme 2015, and to draw up a report/opinion related to that aviation package taking into account the current motion for a resolution. (see also point on Aviation and road transport issues).

13. Petitions (MM)

13,1 Petition 2335/2013 by Dardan Haxhija (German) on instituting a minimum salary across the EU

Beslut: No action needed. The petition has been forwarded to EMPL for information only.

13,2 Petition 2382/2013 by Robert Duch (Polish), on treating seasonal workers in the same way as other workers

Decision

Mandate EMPL Chair to write back to PETI along the following lines:

Directive 2014/36/EU of the European Parliament and of the Council of 26 February 2014 on the conditions of entry and stay of third-country nationals for the purpose of employment as seasonal workers ( HYPERLINK "http://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX:32014L0036" http://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX:32014L0036) determines the conditions of entry and stay of third-country nationals for the purpose of employment as seasonal workers and defines the rights of seasonal workers.

According to Article 23 seasonal workers shall be entitled to equal treatment with nationals of the host Member State inter alia with regard to terms of employment, including the minimum working age, and working conditions, including pay and dismissal, working hours, leave and holidays, as well as health and safety requirements at the workplace as well as branches of social security, as defined in Article 3 of Regulation (EC) No 883/2004.

Member States shall provide for measures to prevent possible abuses and to sanction infringements of this Directive. Member States shall ensure that there are effective mechanisms through which seasonal workers may lodge complaints against their employers directly or through third parties. Every three years, and for the first time no later than 30 September 2019, the Commission shall submit a report to the European Parliament and to the Council on the application of this Directive in the Member States and shall propose any amendments necessary.

However, the deadline for the transposition of this directive is 30 September 2016. Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by that time.
