The Swedish Consumer Agency is a regulatory body which ensures that legislation, including the Swedish Product Safety Act and the Toy Safety Act, is followed. For this reason, it is the Consumer Agency’s responsibility to conduct tests on toys.

The project that formed the basis for this report was initiated in response to Swedish and European safety regulations (toy standards EN 71, part 2) which define the requirements that determine how flammable a toy may be.

The survey was conducted in co-operation with local consumer advisors in 25 districts. In all, 61 different kinds of costume, mask and soft filled doll were tested by the Swedish National Testing and Research Institute. 11 of the tested masks and 13 of the costumes did not fulfil the requirements of the Toy Safety Act. However, all of the soft filled dolls passed the tests.

Background

Costumes and masks are often used by children when playing at home, at day-care centres and parties. The Consumer Agency has received a number of complaints from consumers about costumes igniting when sparks produced by cap guns, etc. have come in contact with them. Also, Father Christmas and other masks have burst into flames when they have come in contact with candles.

According to the European regulations, masks, wigs and other head-wear must be made from non-flammable material. They must not cause a child’s hair to catch fire or cause injury to a child’s face. Costumes that are worn can be made from flammable materials, but the material they are made of should not burn so quickly that the child is unable to remove the item should it begin to burn. With regards to soft filled toys, the risk factor is not as great as it is with costumes and masks that they will cause personal injury should they catch fire. Therefore, the regulations state that it is acceptable that these products be made from materials that burn at a pre-determined rate. This means that if a soft filled toy ignites, then the person using this item should be able to freely remove themselves from the danger zone.

The flammability of costumes and soft filled toys can be reduced or eliminated by impregnating them with fire retardant chemicals. Some of these chemicals have,

however, proved to present a health risk in themselves and, as the risk of injury caused by the use of these chemicals is deemed to be greater than the risk of the toy igniting and causing burns on a child, they are not used.

The EN 71-2 standard defines regulations including requirements and test methods which determine the permissible burn rate of toys. The standard specifies the following points: Toys must not be made from highly flammable material such as celluloid or certain textiles which have a fluffy surface and which are known to burn in an explosive manner. EN 71-2 p.4.1.

Soft toys and dolls may burn slowly, at a rate of no more than 30 mm/s in accordance with the requirements and test methods specified in EN 71-2 p.4.5 and p.5.8.

Costumes may burn at a rate of no more than 30 mm/s. Should they burn at between 10 and 30 mm/s, then they should be affixed with a warning text that reads: “Warning! Must not come in contact with a naked flame.” Requirements and tests are applied in

accordance with EN 71-2 p 4.3 and 5.7.

Beards, masks, wigs and other head-wear must burn out within 2 seconds. If a toy burns and goes out within 2 seconds then a part of the toy must remain intact. Requirements and test methods are applied in accordance with EN 71-2 p 4.2 and 5.5 and 5.6.

The Toy Safety Act and the CE mark

Special safety requirements apply for toys in accordance with the Toy Safety Act, a government directive, and the guidelines defined by the Swedish Consumer Agency. The legislation for this is based on a direct translation of the EC Directives pertaining to the safety of toys (88/378/EEC). A toy may only be sold if it fulfils the demands made in law regarding safety, information and marking. If a toy is manufactured in full compliance with the European standard for toy safety, then it is also considered to have fulfilled the Toy Safety Act. However, should the manufacturer chose not to make the toy in

accordance with the legislation or in complete compliance with the standard, the toy must be type-approved by a third party (a so called Notified Body).

The Swedish Consumer Agency can, supported by the Product Safety Act, take action should a toy fail to fulfil the safety regulations, even if the toy lives up to the

requirements of the standard or if it has been type-approved. In this instance the requirements of the standard may have been set too low, or that an application of the standard or regulations has not been established.

If a toy is to fulfil the requirements of the Toy Safety Act, then it must carry the CE symbol. The manufacturer (or the importer/representative) has the right to use the CE symbol in a process commonly termed self certification. Through this action, the

relevant safety requirements.

Toys that do not carry the CE symbol may not be sold. It is also against the law to sell a CE marked product that does not fulfil the requirements of the act with regard to safety, information and marking.

As many consumers regard the CE symbol as a sign of quality, which indicates that a toy has been tested and declared safe, then it can be very misleading if it is displayed on a toy that fails to fulfil the requirements of the standard.

A retailer who breaks the law by selling toys that do not fulfil the requirements as stated in the standard can be tried in a court of law and fined or sent to prison for a maximum sentence of one year. This applies irrespective of whether the retailer acts intentionally or unintentionally. Responsibility for taking legal action resides with the Swedish Consumer Agency.

The Product Safety Act

If a product that is sold in the open market does not fulfil relevant safety legislation and does not comply with the demands as stated in the standard, then the person responsible for that toy should, in accordance with the Product Safety Act, take any actions necessary to increase safety. The seller can, for example, be ordered by the Market Court to cease sales of a particular toy. Non compliance will result in a fine being imposed. The seller can also be ordered to recall toys that have already been sold. Recalls can be made either from the retailer/toy store or from consumers. Information about recalls are usually published in newspapers to ensure that as many people as possible are aware that the item should be returned. The person responsible for the sale of the toy can also be ordered to include a warning text or other safety information with the product.

In reality, only a few cases are referred the Market Courts. Instead, the normal practice is that the person responsible for the toy voluntarily takes any actions necessary after discussions with the Consumer Agency.

Purchase

The Swedish Consumer Agency conducted the survey together with consumer advisors from 25 different districts. They visited shops in their home area and purchased

They also investigated the name of the importer of the toys. Both toyshops and department stores were visited.

The districts that took part in the survey were Borås, Gotland , Huddinge, Kungsbacka, Landskrona, Karlshamn, Kristinehamn

,

Luleå, Motala, Vänersborg, Västervik, Nybro, Nynäshamn, Nässjö, Skellefteå, Sundsvall, Smedjebacken, Sollefteå, Staffanstorp, Sundsvall, Trollhättan, Piteå, Ulricehamn, Uppsala, Västerås and Örebo.

The different districts were encoded according to the following:

Results

In all, 66 different items were purchased. Some of the consumer advisors bought the same kinds of costumes and dolls. Once the duplicate products had been removed, 61 items were left to be tested by the Swedish National Testing and Research Institute. Below is a breakdown of their findings.

Soft filled toys

23 soft toys were tested. All the toys fulfilled the safety requirements which stipulated that they should burn out in 2 seconds. The burn rate for one soft toy was, however, very close to the upper limit of the requirement.

Masks, wigs and other head-wear

20 masks were tested and of these, 11 failed to meet the requirements. They should have burnt out in 2 seconds, but 11 of the tested items carried on burning after this time. Se appendix 1.

Costumes with some form of hood

14 different costumes were tested. These often comprised a dress (which, according to the regulations, may burn at a rate of no more than 30 mm/s) and a portion that the child wears on their head. This head-wear should burn at a rate that corresponds to that of masks and should burn out in no more than 2 seconds (see below for evaluation). 4 costumes with head-wear fulfilled the requirements for the costume and the head-wear. 6 costumes fulfilled the demands made on costumes, but the accompanying masks or hats failed to pass the test. One further costume would have passed the costume test if it had been provided with a warning text which stated that it should not come in contact with a naked flame. However, the mask failed to fulfil the requirements. 3 costumes and the accompanying head–wear burned and did not fulfil the demands placed on costumes of this kind. See appendix 2.

Costumes without head-wear

4 costumes without head-wear were tested. Of these, 1 fulfilled the requirements for costumes. A further 2 would have passed the costume test had they been provided with a warning text which stated that they should not come in contact with a naked flame (they burned at a rate of 10 - 30 mm/s). The fourth costume failed to fulfil the requirements. See appendix 3.

Evaluation

The Swedish Testing and Research Institute has determined that all the tested head-wear including masks, rosettes, diadems, head-bands, etc. are included in the standard for masks and wigs, and has tested these in accordance with p. 4.2.1 or 4.2.2 of the EN 71-2

CE marking

49 out of 61 tested items displayed the CE symbol.

Conclusions

The market survey shows that many masks and other head-wear are flammable. Should a child that is wearing a mask or other flammable item of head-wear, come in contact with a naked flame, then there is an imminent risk of burn injury. It is not acceptable that children are exposed to such risks and the Consumer Agency has, therefore, decided that it demand that products that fail to fulfil the flammability requirements of the EN 71-2 standard are withdrawn from sale.

Fortunately, this survey showed that soft toys burned slowly and, thereby, fulfilled the requirements.

The Consumer Agency has informed the importers and retailers of the various products of the results of this market survey and asked them to take the necessary actions to rectify the problems that were identified, cease sales of these products or provide a warning text.

Results of the process

Masks

Combined costumes, costume and head-wear

Dnr 97/K 3183 Red Indian costume with feather shawl. Mikkelborg AB has stated that they do sell the Indian costume, but not the shawl. It appears that the retailer had

purchased a party of shawls at a bankruptcy auction and then marked the packaging with Mikkelborg AB’s name. It has not been possible to pursue the matter further. Kr 2 Dnr 97/K 3183 Spiderman costume. Mikkelborg AB, has questioned the results of this test and submitted the results of tests carried out by another accredited laboratory which show that the product fulfils the current regulations. With reference to the unclear wording of the standard’s flammability paragraphs, work has begun to review the wording of the standard. Therefore, the Consumer Agency will not take any actions at this time. Nä 1
