President Making History

On July 1, 2012, Peter MacDougall became the 48th President of the College of Registered Nurses of Nova Scotia and the first male to ever hold this position since the organization was incorporated over a century ago. “I have aspired to be in this position since back in my student days,” says Peter. “However,” he chuckles, “leave it to me to be taking over the reins in the midst of a major transformation of our healthcare system. But that actually gives me even more incentive to work with Council, the College staff and all RNs and NPs in the province to help shape the future of our profession and health care in Nova Scotia.”

Born in North Sydney, Cape Breton, Peter graduated from the Victoria General Hospital School of Nursing in Halifax and since 1984 has practised and held numerous management positions in Cape Breton and Halifax. For the past seven years Peter has been employed at the QEII Health Sciences Centre (VG Site) as the Health Services Manager in palliative care and thoracic surgery.

Donna Denney, Executive Director of the College, is pleased to welcome Peter to the team. “Yes, Peter is making history as the first male RN to hold the position as president,” says Donna. “However, it is his passion and commitment to the nursing profession and his reputation for excellence that matters most.”

And that level of passion and commitment has been put to the test a number of times in Peter’s first few weeks ‘on the job’. He has been interviewed a couple of times with some very positive media coverage and recently represented the College at a meeting with Premier Darrell Dexter and other key stakeholders in preparation for the Council of the Federation. Just last week, he also attended an informative public forum on health care organized by the Nova Scotia Nurses’ Union.

Among his goals for his two-year tenure as President, Peter wants to make the College more relevant to members and increase their appreciation for the value of self-regulation. He would like to begin by connecting with as many RNs/ NPs as possible and so has his sights set on a province-wide ‘road trip’. To learn more about Peter and his vision for the College, the nursing profession and health care, stay tuned for his President’s column in upcoming issues of Nursing in Focus (starting this fall). 2012 AGM Highlights

Resolution 1: The date for the 2013 election of councillors, and the deadline by which eligible ballots must be received, is set as 1500 hours on Friday, April 5, 2013.

Motion 1: The College establish a working group, one that includes 50% of frontline staff, which is representative of various nursing practices and geographic areas, to provide consultation to the CRNNS, to identify scope of practice issues and clarify the role of RNs, with the purpose of protecting the public and preserving the integrity of the nursing profession. This strategy will encourage and promote a professional quality workplace environment as it pertains to the changing healthcare system.

More than 100 people attended the College’s 2012 annual general meeting (AGM), including 84 RNs who registered as members of the voting body. In addition to the reports regularly presented at the business meeting (e.g., President, Executive Director, and auditor), the following resolution and motions from the floor were debated and passed by the voting body.

All resolutions and motions passed at the annual general meeting (AGM) will be presented to Council at the September Council meeting and brought back to the membership at the 2013 AGM.

The Nominations Committee announced the results of the 2012 Council Election. Congratulations to the newest members of the College’s Council:

New Council Members Announced

Motion 2: CRNNS consider the introduction of a reduced registration fee for RNs 65+, in good standing, wishing, willing and able to continue working, thus contributing to the future of nursing and health care in Nova Scotia. Motion 3: CRNNS explore the opportunity for interested Nova Scotia RNs to “mentor for the day” with a member of the College staff, including the Executive Director, to gain an appreciation of the intricacies and complexity of governance and regulation of the nursing profession in Nova Scotia.

Based on a motion passed at the 2011 AGM, Council decided in December 2011 to allocate new resources to enable the College to partner with the Nova Scotia Health Research Foundation (NSHRF) in an exciting new initiative - to determine how best to shape the future for registered nurses in Nova Scotia.

The fi rst phase of this three-year strategy was launched earlier this year, in January, with a highly successful ‘thought leaders’

Representatives from the Canadian Nurses Association were in Halifax recently as the Council of the Federation (provincial/territorial premiers) met to discuss From Innovation to Action, a report from the Council’s healthcare innovation working group. CNA participated in this group, along with the Canadian Medical Association and Health Action Lobby.

While in town, the CNA crew wanted to see some ‘real life’ examples of healthcare innovation in Nova Scotia, and visited the Collaborative Emergency Centre (CEC) in Springhill, Halifax’s North End Community Health Centre, and Capital Health’s Mobile Outreach Street Health (MOSH) unit.

Fortunately, Peter MacDougall, President of the College, was able to join Barbara Mildon, President of CNA, on her visit to MOSH. CNA was aptly impressed with the nursing achievements at all sites – kudos to everyone involved.

The deadline for receipt of College awards will now be the fi rst business day in February, instead of the fi rst business day in March. The deadline will be Friday, February 1, 2013.

CRNNS signs contract with NCSBN

• In accordance with a motion passed by the Council of the College of

Registered Nurses of Nova Scotia, the College has signed a contract with the National Council of State Boards of Nursing (NCSBN) to partner in the development of a new RN entry-to-practice exam, to be used by the College for the purpose of licensure beginning in January 2015.

• The Council is satisfi ed that the contract meets all the requirements set out in the initial Request for Proposals, issued in September 2011, as well as additional criteria established by the Council.

• Given that the 10 RN regulators who issued the initial Request for Proposals have now signed the contract with the NCSBN, plans for transitioning to the new examination will get underway this summer. These plans, along with accompanying information about the transition, should answer questions that you and other stakeholders might have. Please visit www.crnns.ca for regular updates.

Annual Licence

Renewal time is

here again!

Starting in June, the College mailed and emailed reminders about your 2013 licence renewal, which opened on July 16th. Renew by October 1st and you just might win $450.80!

Here are four important things to know when renewing your licence this year. 1. The entire process is electronic and pre-formatted application forms will

be completed online. (Password will be required.)

2. You will be notified by email when your licence has been processed. 3. A printable income tax receipt will be attached to the email noted above. 4. Proof of your licence status will be available at crnns.ca, under Licence

Status Check, one day after you receive email confirmation that your licence has been processed.

To ensure you receive a link to your 2013 renewal application, please notify the College as soon as possible if your email address has changed within the past year. Please email registration@crnns.ca or call 491.9744 (1.800.565.9744 in NS) ext. 221 or 249.

If you would like to influence who will be future leaders of the College’s governing Council, apply now to be a member of the Nominations Committee. The role of this committee is to ensure there is a competitive and representative list of nominees for RN positions on the College’s Council. The Council needs two members (active-practising, in good standing) to serve on the Nominations Committee for the next two years. The deadline for applications is Thursday, August 23, 2012, but you can submit your application now!

The College’s Council is also seeking members (active-practising, in good standing) to serve on the following committees, for terms commencing January 1, 2013:

Professional Conduct Decisions

Gayle Marie Turnbull Truro, NS

CRNNS Registration No. 24394

Consent Reprimand Consent to Condition and Restriction

On March 12, 2012, the Complaints Committee of the College of Registered Nurses of Nova Scotia (the College) ordered that pursuant to s.58(3)(d) of the

Registered Nurses Regulations, and with the consent of Ms. Turnbull, she receive a reprimand for, between July 2009 and March 2011:

(i) failing to provide appropriate care to her patients; and

(ii) failng to be accountable and responsible for her actions and decisions.

The committee also decided pursuant to s. 58(3)(e), with Ms. Turnbull’s consent, to impose the following condition and restriction on her licence:

Ms. Turnbull will complete a College-approved health assessment course (such as the self-study module offered by Grant MacEwan University) within 8 weeks of her consent to the decision.

Ms. Turnbull is restricted from practising independently for the first four weeks after her return to work. This means that Ms. Turnbull must be preceptored by another registered nurse during that time.

Furthermore, if Ms. Turnbull changes her employment within two years of the date of the Complaints Committee decision, a copy of the decision will be provided to her new employer.

The issues related to Ms. Turnbull’s care of patients included, on occasion: failing to appropriately assess, monitor, and provide appropriate care, failing to appropriately communicate; failing to ambulate a post-operative patient; failing to document appropriately; failing to administer medications as ordered; and failing to notify a physician of changes in her patients’ conditions.

The issues regarding Ms. Turnbull’s lack of accountability included: falling asleep while on duty; going to work when fatigued; and not dealing appropriately with personal stress and health issues, negatively impacting her ability to provide safe care.

The Complaints Committee determined that Ms. Turnbull’s actions breached the Standards for Nursing Practice (2004) and constituted professional misconduct as defined in the Registered Nurses Act. However, the committee also determined that since the date upon which the complaint was received, Ms. Turnbull has actively addressed the sleep, personal stress and health issues impacting her nursing care. The committee also noted that prior to this complaint Ms. Turnbull practised nursing for approximately 20 years with no complaints being lodged with the College. Therefore, the committee concluded that the issuance of a reprimand and the imposition of a condition and restriction on Ms. Turnbull’s licence would provide appropriate protection to the public and was the appropriate disposition in this case.

On April 13, 2012, Ms. Turnbull consented to the reprimand, as well as the condition and restriction on her licence.

Jennifer Leigh Anne Forrest Lower Sackville, NS

CRNNS Registration No. 27298

Consent Reprimand Consent to Condition

On May 29, 2012, the Complaints Committee of the College of Registered Nurses of Nova Scotia (the College) ordered that pursuant to s.58(3)(d) of the

Registered Nurses Regulations, and with the consent of Ms. Forrest, she receive a reprimand for, between June and August 2011, failing to:

i) practice within the scope of a nurse practitioner;

ii) collaborate and/or consult with an attending physician and/or colleague on a number of occasions;

iii) document on numerous occasions; and

iv) appropriately assess, intervene and/or re-evaluate/follow-up with her patients on more than one occasion.

The Committee also decided pursuant to s.58(3)(e), with Ms. Forrest’s consent, to impose the following condition on her licence:

Ms. Forrest must work with a nurse practitioner preceptor for the first 240 hours of her return to nurse practitioner practice. During the preceptored time, Ms. Forrest must meet with

her preceptor once every two weeks to review her practice. This condition will remain on Ms. Forrest’s licence until her employer provides a letter to the Professional Conduct Consultant confirming that Ms. Forrest has successfully completed the preceptored hours. Any additional practice concerns noted by Ms. Forrest’s employer are to be reported to the Professional Conduct Consultant for consideration. Furthermore, if Ms. Forrest changes her employment before the completion of the above condition, a copy of the decision will be provided to her new employer.

The above incidents occurred while Ms. Forrest practiced as a nurse practitioner (NP) on a cardiovascular surgery unit. On one occasion on June 14, 2011, Ms. Forrest reviewed and interpreted a patient’s x-ray without consulting with a physician, outside of her scope of NP practice. On more than one occasion, Ms. Forrest failed to appropriately collaborate and/or consult with an attending physician or another NP colleague in order to formulate an appropriate diagnosis and treatment plan based on x-ray results, consider alternate treatment options for a patient with a deteriorating respiratory status and determine the appropriate type of follow-up x-ray to order for a patient. The issues related to Ms. Forrest’s lack of documentation include failing to adequately document her assessments, or clinical rationale for interventions. The issues regarding Ms. Forrest’s failure to assess, intervene and/or re-evaluate/ follow-up included her care of a patient with a deteriorating respiratory status, her failure to appropriately intervene with and re-evaluate a patient’s decreased urine output and her failure to appropriately order a particular type of x-ray for a patient to determine the cause of the patient’s subcutaneous emphysema.

The Complaints Committee determined that Ms. Forrest’s actions breached the Standards for Nursing Practice (2004) and the Standards of Practice for Nurse Practitioners (2009) and constituted professional misconduct and incompetence as defined in the

Registered Nurses Act. However, the committee determined that since the date the complaint was received, Ms. Forrest has actively addressed her issues with regards to competence and documentation through self-study and continuing education. The Committee also noted that prior to this complaint, Ms. Forrest practiced nursing (both as

an RN and as an NP) for approximately 20 years with no complaints being lodged with the College. Therefore the Committee concluded that the issuance of a reprimand and the imposition of a condition on Ms. Forrest’s licence would provide appropriate protection to the public and the appropriate disposition in this case.

On June 7, 2012, Ms. Forrest consented to the reprimand, as well as the condition on her licence.

Andrew Dale Stuckless Halifax, Nova Scotia

CRNNS Registration No. 27974

Consent Revocation

The Professional Conduct Committee of the College of Registered Nurses of Nova Scotia (the College) met on July 19, 2012 to review a Request for Consent Revocation from Andrew Dale Stuckless, which had been agreed upon by the College. The Request for Consent Revocation was advanced pursuant to Section 86 of the

Registered Nurses Regulations. The following allegations of professional misconduct arose from a complaint against Mr. Stuckless that was investigated by the College:

(I) Between December 2005 and January 2011, Mr. Stuckless was rough in his physical interactions with patients.

(II) Between December 2005 and January 2011, Mr. Stuckless communicated in an unprofessional,

disrespectful and inappropriate manner with and about patients and their family members.

(III) Between December 2005 and January 2011, Mr. Stuckless failed to provide appropriate care to patients and refused to assist his colleagues with their care of patients.

(IV) Between December 2005 and January 2011, Mr. Stuckless communicated and interacted in an unprofessional, disrespectful, and inappropriate manner with colleagues.

(V) Between December 2005 and January 2011, Mr. Stuckless failed to be accountable and responsible for his own nursing practice. Mr. Stuckless did not contest the allegations and agreed to the revocation of his licence.

The Professional Conduct Committee found that the foregoing conduct amounted to “professional misconduct” as defined in the Registered Nurses Act. The Professional Conduct Committee accepted Mr. Stuckless’s request and permanently revoked his licence to practise nursing. Because the revocation ensures that Mr. Stuckless will never practice as a registered nurse in the future, the Professional Conduct Committee found that the resolution of this matter serves and protects the public interest, preserves the integrity of the nursing profession and maintains the public’s confidence in the ability of the nursing profession to regulate itself.
