In consideration of the covenants and agreements herein contained and other valuable considerations I do hereby remise, release and forever discharge Lock 1 Marina & Shipyard, LLC, it's successors and assigns of and from all, and all manner of action and actions, cause and causes of actions, suits, debts, dues, sums of money, accounts, reckoning, bonds, bills, specialties, covenants, contracts, controversies, agreements, promises, variances, trespasses, damages, judgments, extents, executions, claims, and demands whatsoever, in law or equity which against the said company, its successors, and assigns I ever had, now have, or which I, my heirs, executors or administrators, hereafter can, shall or may have for, upon or by reason of any loss or damage for any reason to boats or other property or contents hereof placed with them for storage, repairs, testing or any other reason other than as a result of the negligence of Lock 1 Marina & Shipyard, LLC, or its employees.

By signing this Dockage Agreement, I accept and agree to abide by the terms hereof and all the Rules and Regulations on the following page.

By signing the Summer Dockage Contract all of the following is agreed and understood between Lock 1

Marina & Shipyard and the Applicant:

The items listed below are not intended to restrict your boating fun throughout the summer. Instead they are

there to ensure that all of our boaters will continue to enjoy a safe, relaxing and peaceful time while on your

boat in our marina. Please read the guidelines carefully. They are here to help us become prudent and safe

boaters and to keep the Marina surroundings a very safe, pleasant, and clean place to come and enjoy. If you

have a question, just ask us, and we’ll be glad to help. We like boating too!

GENERAL

Lock 1 Marina & Shipyard grants to the applicant permission to use the berth as described by the Dock Master for the term of May 1st to November 1st 2012 pending NYS Canal Navigation Schedules.

Slips are contracted to specific boats as specified within this signed agreement. Neither substitution of other craft nor subletting of slips is allowed without the Dock Master’s permission. Dock assignments are specific and no “dock hopping” or use of spaces other than that assigned to your boat is allowed.

The above contract rates are determined by customary and usual seasonal use of a boat while berthed at Lock 1 Marina. This is typically, but not limited to, staying on board your boat Friday, Saturday and Sunday and up to two one week periods (vacations) throughout the summer, plus extra days for Memorial Day, 4th of July and Labor Day weekends. “Live-a-boards”, boaters that stay on their boat throughout the week or most of the week and most of the summer, will incur additional charges not indicated on the contract.

If you stored with us, the Dock Master must be notified by May 1 of your approximate intended launch date; summer storage rates will become effective May 15, unless we have a firm launch date scheduled.

The Dock Master reserves the customary right to use or rent any vacant berth in the absence of the regular tenant, and season rental rates are quoted with this privilege in mind. You shall notify the Dock Master of the extent of your absence if it is longer than 2 days. Air conditioning units must be reported to the Dock Master and additional rent paid thereon. Air Conditioners and heaters are not allowed to operate while your boat is docked, vacant, and you are not on the marina premises. This is dangerous and

unnecessarily increases our electric rates; our slip fees are the lowest on the river, we want to keep it that way for you.

The Marina reserves the right to haul an Owner’s boat if the Dock Master has determined that an un-seaworthy condition exists requiring the boat to be hauled. Owner agrees to pay for each hauling, together with necessary repairs, at prevailing rates.

Lock 1 Marina & Shipyard reserves the right to haul your boat for winter storage beginning October 1st unless arrangements have been made with the Dock Master to specify a hauling date. Your boat must be removed from the Marina basin no later than November 1st. This date is subject to NYS Canal Navigation schedules and may change.

Your boat will be placed in and out of the water at the boat owner’s risk. In the event that the structural integrity of the boat is insufficient to withstand such lifting, the damage to the boat shall be the responsibility of the owner.

INSURANCE-DAMAGES-RESPONSIBILITIES

The boat described herein is not and will not be insured by Lock 1 Marina And Shipyard, LLC for the benefit of the boat owner against fire or any other hazard or casualty.

Applicant agrees to have his boat properly insured for in water use and on land storage including Liability & Fire. Lock 1 Marina & Shipyard, LLC assumes no responsibility for your boat or equipment due to wind, waves, theft, electric, collision, chafing, vandalism, fire, terrorism, or any other cause. A copy of your insurance policy pertaining to coverage for your boat must be attached to your contract.

The boat slip is rented for use in accordance with prevailing customs and subject to such control or regulation, as Lock 1 Marina & Shipyard may deem necessary. If it is considered by the Marina to be in the best interests of the Marina, Lock 1 Marina & Shipyard reserves the right after 10 days notice to cancel this agreement. In which case no refund of monies paid will be issued.

You shall be held responsible for damage, which you may cause, to other boats in the marina or for damage to any structure. SAFETY

No Charcoal fires or any open fires of any kind are allowed within the confines of the Marina except in designated areas.

No unauthorized persons except yourself or your designated guests are allowed on Marina property. Please make your guests aware of Marina policies listed on this document. Children under the age of 13 years old must wear life jackets on docks and must be

accompanied by an adult at all times.

You acknowledge that Lock 1 Marina & Shipyard makes no representation regarding the adequacy of the water level. Lock 1 Marina is not responsible for damages resulting directly or indirectly from low or high water levels.

For the safety of all boaters please adhere to the following guidelines: No swimming is allowed from Marina docks.

Boaters are not allowed to fuel their boats within the Marina basin. For small boats with outboard motors, fueling may be done at the pump out dock, provided no other boats are docked. Any fuel spillage is the responsibility of the boater.

Please ventilate your boat’s bilge before starting the engine. SEAMANSHIP-DOCKING

Your boat shall be tied up in its slip in a manner customary with good seamanship practices.

You must furnish your own mooring lines and fenders of sufficient strength and size to assure the safety of your boat and to avoid damaging adjoining boats. For the safety of all concerned, all lines should be checked each season and replaced if necessary. While within the Marina basin you shall operate your boat or jet ski at a slow and safe speed so as to not cause any wake. Prudent seamanship dictates maintaining a slow speed when in or near a marina. This includes heading south towards the lock, please NO WAKE while passing the Marina.

Your boat shall be in seaworthy condition and shall not constitute a fire hazard or it shall be removed from the Marina at the expense of the owner. If your boat should sink in the Marina, it is the owner’s responsibility to arrange for salvage operations and hazardous cleanup costs.

You shall not store supplies, materials, accessories, or debris upon any walkway or dock and shall not construct thereon any lockers, chest, dock boxes, cabinets, steps, ramps or similar structures except with the permission of the Dock Master. All water hoses should be neatly coiled and stowed when not in use.

In the event that Lock 1 Marina & Shipyard’s services are required to provide emergency pump-out services to your boat, an appropriate fee for labor and equipment may be assessed.

DOCK BOXES & DOCK CARTS

Dock boxes are only allowed with the permission of the Dock Master, and only in certain areas of the Marina. Your name must be clearly and permanently marked on the Dock Box. If you have a dock box, only the dock box is allowed for storage. All items should be stowed inside the dock box; no items are to be left outside the dock box. This prevents flying debris and possible damage to other boats during high wind conditions.

New Dock carts will be provided as a convenience to boaters to transport food, drinks, and clothing items to and from their boat and car. When you are done with the cart please return it so that others may use it when they arrive. Do not use the cart for extremely heavy items, hazardous fluids, parts from motors and transmissions etc. Keeping the cart clean will make it more usable for personal items.

TENDERS, DINGHIES, KAYAKS, & CANOES

Dinghies, tenders, or other type of small craft, shall be stored on board larger vessels in such a manner that will not interfere with other boaters. If you desire to store your tender/kayak on the Marina premise, please notify the Dock Master. They are only to be stored on land near the pump out dock as described by the Dock Master. The vessel must be securely tied or anchored to prevent dislodging during severe winds. The owner’s name must be marked on the vessel.

CONTACT INFORMATION

You shall furnish the marina with day and night telephone numbers, addresses, and email at which you can be reached in an emergency. If any of the above changes please notify us. You further authorize Lock 1 Marina to take such action, as it deems prudent, should an emergency arise.

ENVIRONMENTAL RESPONSIBILITIES, GUESTS

PLEASE HELP US KEEP OUR MARINA & THE HUDSON RIVER CLEAN, AND MAINTAIN THE PEACEFULLNESS OF THE AREA AT ALL TIMES

A dumpster is provided for you and your guests to place all garbage, beverage cans, and general refuse located behind the apartment building. Please do not place any garbage in the Marina bathroom trash receptacle. Under no circumstances shall any hazardous materials such as, oil & oil filters, antifreeze, gasoline, diesel fuel or any other hazardous materials be placed in dumpster. These items must be properly removed and discarded according to state and local laws. A fee will be charged to your account for any debris left behind. There will be absolutely no over board discharge of marine toilet waste.

Noise shall be kept to a minimum at all times. You shall use discretion in operating motors, generators, or bilge pumps so as not to disturb other boaters. Electric or air operated tools used during boat repairs by the boat owner shall be operated only during such days or hours prescribed by the Dock Master.

Disorder, depreciation or indecorous conduct by you or your guests that may injure a person, cause damage to the property or harm the reputation of the Marina shall be cause for immediate removal from the Marina. No private parties (6 or more guests, children

included) are allowed on the grounds without advanced notice and permission from the Dock Master. Keep in mind that many boaters like the peacefulness of the Marina for relaxation.

Please be wise when using water; do not leave hoses running unnecessarily. Notify the Dock Master if you see any leaks. The Marina bathroom is on a septic system, please keep this in mind when taking showers and escort all children while in the bathrooms.

BOATER’S PETS

Boats with pets are only allowed when the Dock Master has been notified in advance of your intentions to have a pet at the Marina. Guests are not allowed to bring their pets. Pets are to be quiet and should not be a disturbance to the peacefulness of the Marina. If you cannot control your pet, your privilege will be revoked, or you will be asked to leave. Since most Marina parties & activities are on the island, dogs and cats are not allowed.

All dogs and cats must be kept on a leash at all times when off your boat, always, no exceptions. Lock 1 Marina & Shipyard will review incidents of injury, disturbances, or other undesirable acts caused by boat owner’s pets for possible restrictions. Please pickup

SHRINK-WRAP & FRAMING

The shrink-wrap, strapping & wood frame used is the responsibility of the boat owner and is not to be thrown in the

dumpster. Upon uncovering your boat for commissioning preparation, the shrink-wrap must be tightly folded repeatedly into as small a square/rectangle as possible; approximately a 3’ x 3’ or 4’ x 4’ size. All straps, and pieces must be contained within or disposed of properly. Secure the shrink-wrap with a piece of “scrap” strapping and tie it securely. Stow the shrink-wrap under your boat, out of the way. The Marina will dispose of it for you. The boat owner must remove the wood framing, used in some shrink-wrap operations, from the Marina. If you plan on re-using the wood frame and would like to leave it on the premises, you must neatly strap together all pieces; clearly mark your name on them in several locations. The Marina will charge a $10 fee for storage of the framing.

SUSPICIOUS ACTIVITY

Please notify us if you see any suspicious activity or strangers on the Marina premises. There is nothing wrong with you giving a polite “may I help you” to an unknowing person. Most people just come to view the beauty of the marina or may be looking for a new marina to stay at. Remind them that the Marina is private and for contracted boat owners and they should check in with the Dock Master. Please let us know and we will be glad to help. Provide them our phone number, 518-238-1321, if we are not immediately available.

If anything looks suspiciously dangerous or threatening do not approach anyone but please call 911. The Marina address is 461 Hudson River Rd, Waterford, NY 12188 and is patrolled by the Saratoga County Sherriff.
