Qualified Person’s Statements and Certifications

As the qualified person, I certify that:

A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

As of 2014/11/20, no phase two environmental site assessment is required by the regulation for the

RSC property and based on the phase one environmental site assessment for the RSC property, in my opinion, it is not necessary for any other reason to conduct a phase two environmental site assessment for the RSC property.

As of 2014/11/20, in my opinion, based on the phase one environmental site assessment, there is no

evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that, if the RSC property were put to any of the types of property uses listed in subsection 1 (2) of the regulation, are likely to

interfere with any of those types of property uses.

I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.

I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry.

Phase One Conceptual Site Model (CSM)

1.1

Phase I Environmental Site Assessment

A Phase I ESA was conducted by AEL, as reported to the Client in January, 2015. Figure 1 shows the Phase I study area. The Site consisted of the property located at 0 Moulin Rouge Crescent, Mississauga (herein referred to as “the Site”), consisting of gravel covered land. A mix of residential, community and commercial lands surrounded the Site. Figure 2 outlines the site and surrounding property addresses. Table 1 outlines current property owners within the Phase I study area, and the property use as determined during the site walk over.

The Site was operational at the time of the Site walk over, consisting of gravel covered land. The Site periodically functions as overflow parking for the neighbouring property to the north east (Masjid Al-Farooq Islamic Centre). Driveway access was from the north east. A fence line was present around portions of the property.

A titles search and city directory search indicate that the property was first developed around the late 1960’s for residential use, and in the late 2000’s for its current use. National Air Photo Library (NAPL) aerial photos show clear evidence of development on the Site by 1969. Prior to this period, the Site was likely farmland, vacant prior to the 1800s, with signs of initial development by the 1960’s. Surrounding lands were developed around the same time.

The future use of the Site is intended to be an institutional development. On the basis of the reviewed materials and documents it is the opinion of the Qualified Person that there are currently no environmental liabilities at the Site as of the report date and the Site is suitable for institutional property use.

Areas of Potential Concern (APC)

No APC were identified on site during the Phase I ESA. At the time of reporting, the land use type at the Site is community. The Site was operational as periodic overflow parking for the neighbouring property to the north east (Masjid Al-Farooq Islamic Centre), with the client preparing to change the property use to institutional. A titles search, city directory search and interviews indicate that the property was first developed around the mid to late-1960’s as a residence. It was first developed for its current use in the late 2000’s. National Air Photo Library (NAPL) aerial photos show clear evidence of development on Site by 1969. Prior to this period, NAPL aerial photos show the site as likely farmland in 1946 and 1960. Prior to this, no information is available, but the Site was likely farmland, vacant prior to the 1800s, with signs of initial development by the mid to late-1960’s. Aerial photographs and a city directory search indicate surrounding lands were developed around the same time.

No staining was observed during the site walk over.

1005 Eglinton Avenue West, located adjacent to the south west side of the Site, was operational as a commercial garden centre at the time of the Site walk over. Records reviewed indicate that the garden centre was a limited vendor of pesticides at one time. This would be considered a potentially contaminating activity (PCA). However, this property is located down-gradient to the Site with respect to the inferred local and regional groundwater flow in an area of soils with low permeability. Based on this the property is not considered a potential impacting source to the RSC property.

1.3

Contaminants of Potential Concern (COPC)

No COPC were identified on site during the Phase I ESA.

1005 Eglinton Avenue West, located adjacent to the south west side of the Site, was operational as a commercial garden centre at the time of the Site walk over. Records reviewed indicate that the garden centre was a limited vendor of pesticides at one time. Pesticides would be considered a COPC. However, this property is located down-gradient to the Site with respect to the inferred local and regional groundwater flow in an area of soils with low permeability. Based on this the property is not considered a potential impacting source to the RSC property.

1.4

Effects of Underground Utilities

At the time of the investigation there were no subsurface structures present on site. The site is not service by telephone, gas, hydro or water. A catch basin was located near the east side of Moulin Rouge at the north edge of the Site. This catch basin is believed to be connected to sewer lines along Moulin Rouge Crescent, away from the Site. Residential properties are north of the site so no contaminants of concern from this direction are anticipated.

1.5

Geological and Hydrogeological Conditions

1.5.1

Topography

The OBM map updated between 1978 and 1995 shows the Site at an approximate elevation of 175 m above sea level (asl). The closest visible body of water is a tributary of Mary Fix Creek, located approximately 330 m north of the Site, which is connected to the Credit River and Lake Ontario. The local site topography is almost flat with a slight slope towards the south and Etobicoke Creek.

1.5.1

Physiography

The regional physiography is dominated by the South Slope. Lying between the Iroquois Plain and Peel Plain, it occupies about 2400 square kilometers, extending from the Niagara escarpment to the Trent River.

AEL did not undertake a geotechnical investigation of the Site. Upon review of the Ministry of Northern Development and Mine’s “Surficial Geology” layer from OGSEarth, the surficial soils consist of clay to silt-textured till, derived from glaciolacustrine deposits or shale. AEL reviewed the Canada Land Inventory, and found the Site soils are predominately Chinguacousy Clay Loam, characterized by high runoff potential and low infiltration rates, due to the clay components. These materials will resist the infiltration of fluids.

1.5.1

Geology

Upon review of the Ministry of Northern Development and Mine’s “Bedrock Geology” layer from OGSEarth, the bedrock consists of Georgian Bay, Blue Mountain and Billings Formations, Collingwood Member and Eastview Member (shale, limestone, dolostone and siltstone) of the Phanerozoic, Paleozoic, Ordovician, Upper Ordovician eras. The depth to bedrock is anticipated to be less than 25 meters, based on information gleaned from MOE water well records for four (4) wells located within the Phase One study area.

1.5.1

Fill Materials

During the Site walkover AEL observed gravel fill over the entire Site. Fill appeared to be for surface cover only, with no staining visible.

1.5.1

Water Bodies and Areas of Natural Significance

The closest visible body of water is a tributary of Mary Fix Creek, located 330 m north of the Site. It is connected to the Credit River, which drains into Lake Ontario.

1.6

Uncertainties

Uncertainty or absence of information obtained regarding all spills and the presence, or not, of any above-or-underground tanks on neighbouring Sites in each of the components of the phase one environmental site assessment could affect the validity of the CSM. Due to the predominantly residential and new nature of surrounding developments the presence of tanks that could affect the site on surrounding lands is minimal.
