Accepting the quote from Tri-County International Trucks, Inc., in the estimated amount of $22,724.72 for engine repair of a 2013 Navistar dump truck and in the event that the engine cannot be repaired to authorize the purchase of a replacement engine in the estimated amount of $33,000.00. (Motor Vehicle Pool Fund)

On March 16, 2020, the City of Port Huron’s Department of Public Works received the following quote from Tri-County International Trucks, Inc., for the engine repair of a 2013 Navistar Dump Truck/Plow (Vehicle #128) used by the Streets Division:

Tri-County International Trucks, Inc. / C & S Motors, Inc. (Flint, MI) $22,724.72

In addition to this quote for the engine repair of Vehicle #128, an estimate of cost was given for a replacement engine (remanufactured/renewed) in the event that the engine cannot be repaired. The estimated cost for a replacement engine for this vehicle is $33,000.00. In addition, the City would also be charged the cost for the disassembly and inspection of the original engine.

IT IS THEREFORE RECOMMENDED that:

1. The quote from Tri-County International Trucks, Inc., 113 South Dort Highway, Flint, Michigan 48503 in the amount of Twenty-Two Thousand Seven Hundred Twenty-Four and 72/100 Dollars ($22,724.72) be accepted and that the appropriate City officials be authorized to execute the necessary documents.

2. In the event that the engine cannot be repaired from Tri-County International Trucks, Inc., authorizing the purchase of a replacement engine (remanufactured/renewed) in the estimated amount of Thirty-Three Thousand and 00/100 ($33,000.00), with additional charges assessed for the disassembly and inspection of the original engine be accepted and that the appropriate City officials be authorized to execute the necessary documents.

Re: 2013 Navistar Dump Truck Plow Unit (#128) – Engine Failure

Mayor and Council,

During the last snow event of this year, ehicle #128 had a major engine failure. This vehicle is a 2013 Navistar Dump truck/plow unit. In order to diagnose the cause of the engine failure, the vehicle was towed to Tri-County International Trucks, Inc. / C & S Motors, Inc. branch location in Flint. Tri-County International Trucks, Inc. is Navistar Corporation’s franchise holder and authorized dealership for its products and services in Southeast Michigan and the surrounding areas. Tri-County International and its predecessor, C&S Motors, have successfully served the Michigan business community for over 50 years.

At the time of the engine failure, vehicle #128 had 20,878 miles with 2,115 engine hours. Tri-County International Trucks, Inc. / C & S Motors, Inc. recently provided an estimate for disassembly, inspection and repair of the current engine. The estimated cost for the repair is $22,724.72. In the event that the base engine cannot be repaired, the City would only be charged for the disassembly and inspection.

If it is determined that the engine cannot be repaired, a replacement engine (remanufactured/renewed) would be required. The estimated cost for a replacement engine for this model of truck is approximately $33,000.

Additional quotes were not obtained as it is not cost effective to transport this vehicle by wrecker service to other locations to obtain quotes. More importantly, the work would not be performed by a Navistar authorized dealership and certified repair center which has the required specialized tools and equipment to properly diagnose the engine failure and make the appropriate repairs. Attached is the warranty information provided by Tri-County International Trucks, Inc. / C & S Motors, Inc. The current Motor Vehicle Pool budget includes monies for these type of unexpected repairs.

FROM THE CITY MANAGER:

The Department of Information and Technology uses Veritas Backup Exec to back up the data for all departments on servers in our Data Center. With the City moving forward with more BS&A applications, the amount of data being backed up has substantially increased, thus creating the need for additional storage. Veritas Backup Exec also meets the City’s backup and recovery objectives.

On May 19, 2020, the City of Port Huron received the following quote for the renewal of Veritas Backup Exec Essential Support, extended service agreement for one year:

Insight (Temple, AZ) $5,990.00

It is recommended that the quote from Insight, 6820 S Harl Avenue, Temple, AZ 85283 in the amount of Five Thousand Nine Hundred Ninety and 00/100 Dollars ($5,990.00) for the renewal of the Veritas Backup Exec Essential Support be accepted; and

Be it further recommended that the Information Technology Director, a position currently held by Bruce J. Fiedler, be authorized to execute the necessary documents and to pay the required fee for the annual renewal while the City is using the system.

WHEREAS, the Capital Improvement Program for 2020-2021 through 2025-2026 has been prepared; and

WHEREAS, a draft of the Capital Improvement Program was reviewed by the City's Planning Commission and they recommended approval of the plan at their May 5, 2020, meeting; and

WHEREAS, City Council conducted a public hearing on May 11, 2020, at 7:00 p.m., in the Public Meeting Room, Municipal Office Center, to hear comments from interested citizens about the proposed Capital Improvement Program;

NOW, THEREFORE, BE IT RESOLVED that the Port Huron City Council does hereby adopt the Capital Improvement Program for the 2020-2021 through 2025-2026 fiscal years to be used as a guide for capital expenditures during this period.

Submitting Dept: Finance RES #20-043 May 26, 2020 BE IT FURTHER RESOLVED that the City Manager is hereby authorized to make budgetary transfers within and between the activity centers of each fund established through this budget and that all budgetary transfers between funds may be made only by further action of the Council pursuant to the provisions of the Michigan Uniform Accounting and Budgeting Act; and

BE IT FURTHER RESOLVED that the Director of Finance is hereby authorized, if necessary, to transfer up to 25% of the fiscal year 2020-2021 Motor Vehicle Highway Distribution revenue from the Major Street Fund to the Local Street Fund as provided for in Section 13d of Public Act 51 of 1951; and

BE IT FURTHER RESOLVED that in accordance with Chapter 48, Water and Sewer Service Charges, Section 48-154, Water Rates and Charges, Section 48-156, Sewer Rates Generally, which allow for water and sewer rates to be adjusted by resolution of the City Council from time to time, the commodity and monthly readiness to serve charges for water and sewer services, including for the various meter sizes, for City users and users outside the City, will be in accordance with the attached Schedule of Water and Sewer Rates; and

BE IT FURTHER RESOLVED that a schedule of parking fees, rates and charges established by the City Manager during the previous twelve month period and for any prior periods is attached and are hereby confirmed by the City Council, in accordance with Ordinance No. 835; and

BE IT FURTHER RESOLVED that there is hereby levied on each dollar of taxable value, against all real and personal taxable property in the City of Port Huron, 19.9931 mills for operating purposes, being 11.2132 mills for general operations, 2.9901 mills for police and fire, 0.9967 mills for parks and recreation, 2.8031 mills for the collection of refuse and 1.9900 mills for street improvements; and

BE IT FURTHER RESOLVED that in accordance with the recommendation of the Downtown Development Authority, there is hereby levied on each dollar of taxable value, against all real and personal taxable property in the Downtown Development District, 1.9874 mills for operating purposes; and

BE IT FURTHER RESOLVED that said 19.9931 mills for various operating purposes and said 1.9874 mills for operations of the Downtown Development Authority be levied on July 1, 2020; and

BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to certify said tax for levy and collection to the City Treasurer by delivering a certified copy of this resolution; and BE IT FURTHER RESOLVED that the City Treasurer is hereby authorized and directed to accept payment on taxes due July 1, 2020, with penalty as follows:

1. Taxes shall be collected without additional charge through July 31, or thirty (30) days after the mailing of the tax bill, whichever is later.

2. A penalty of one percent (1%) on the unpaid tax will be added on the first day of August, and on the first day of each month thereafter in the succeeding months; and

BE IT FURTHER RESOLVED that in accordance with MCL 211.44, a property tax administration fee of one percent (1%) on the total tax bill shall be charged per parcel to offset the costs incurred in assessing property values, in collecting the property tax levies, and in the review and appeal processes; and

Authorizing payment to Midwest Public Safety, LLC, in the amount of $15,847.92 for the annual GETAC Cloud Storage fee for body, in-car and video room police cameras.

WHEREAS, on March 11, 2019, City Council authorized the Police Department to purchase body, in-car and video room cameras and accessories to record police interactions through the 2015 Homeland Security grant funding program; and

WHEREAS, the data storage fees associated with the annual GETAC Cloud Storage of $293.48 per device were included in the original purchase for the first year; and

WHEREAS, the annual fees for the period of July 1, 2020 through June 30, 2021 associated with these cameras in the amount of $15,847.92 is due; and

WHEREAS, each year the Police Department is able to write a grant through MMRMA for the data storage/cloud fees to request 50% of the fees; and

WHEREAS, it would be advantageous to authorize the Police Department to continue to pay this annual fee for cost associated with data storage and to apply annually through MMRMA to assist with 50% of the data storage/cloud fees;

NOW, THEREFORE, BE IT RESOLVED that the Port Huron City Council does hereby authorize payment to Midwest Public Safety, LLC, 2665 Harryland Road, Decatur, IL 62521 for the annual GETAC Cloud Storage for body, in-car and video room cameras in the amount of Fifteen Thousand Eight Hundred Forty-Seven and 92/100 Dollars ($15,847.92); and

BE IT FURTHER RESOLVED that the Chief of Police, a position currently held by Joseph A. Platzer, is hereby authorized to pay the required annual GETAC Cloud Storage fee associated with all body, in-car and video room cameras while the City is using the system and to apply annually through MMRMA to assist with 50% of the data storage/cloud fees.

WHEREAS, Chapter 36, Parks and Recreation, of the Code of Ordinances of the City of Port Huron, Section 36-13, requires persons who launch boats and other watercraft at the 12th Street and Riverside boat ramps shall be required to pay a launch fee; and

WHEREAS, the ordinance allows yearly launch permits to be purchased at locations other than City Hall with the approval by resolution of City Council;

NOW, THEREFORE, BE IT RESOLVED that the Port Huron City Council does hereby approve the sale of yearly launch permits at Jay’s Marine Hardware, located at 207 Water Street, Port Huron, Michigan, 48060 and authorizes City Administration to enter into an agreement with Jay’s Marine Hardware for the sale of yearly launch permits.

BOAT LAUNCH PERMIT AGENT AGREEMENT

THIS AGREEMENT by and between Jay’s Marine Hardware, hereinafter referred to as the “Agent”, whose business address is 207 Water Street, Port Huron, Michigan and the City of Port Huron (City), a municipal corporation in the County of St. Clair and State of Michigan, by and through its City Manager, is effective as of the date of signature by both parties.

THE PARTIES agree as follows:

1. The Agent agrees to provide services to the City for the sale of daily and/or seasonal boat launch permits for use at City of Port Huron owned boat launch sites in conformity with City Ordinance, Administrative Rules and official directives to the Agent issued by the City. Such sales shall only be made from the Agent’s business at the address identified above.

2. The City shall provide Agent with the seasonal boat launch permits for sale which may be sold for $24.00 for each seasonal permit. The Agent is also authorized to charge a convenience fee of up to $1.00 for each seasonal permit sold.

3. The Agent shall account for all seasonal permits the City may provide to Agent. Agent shall return all unused seasonal permits to the City at such time as directed to do so by the City. Agent shall remit to the City the sum $24.00 for each seasonal permit that is not returned to the City when return is requested.

4. The Agent shall record the name, address, driver’s license number and telephone number of each person purchasing a seasonal boat launch permit and shall record the number of the boat launch permit sold to such person.

5. The Agent shall remit to the City all funds received for permits sold no less often than biweekly.

6. The City shall identify Agent and his or her business name, location and telephone number on the City’s web site as a location where boat launch permits for City boat launches may be obtained. The City reserves the right to identify off-site sales locations for permits by signage at the boat launch, through newsletters and other media.

7. The Agent agrees to comply with all federal and state laws, rules and regulations involving non-discrimination on the basis of race, color, religion, origin, disability, age or sex.

8. The parties agree that this Agreement may be terminated by the Agent at any time by written notice to the City Manager, provided that the Agent has returned to the City all unused seasonal boat launch permits and fully compensated the City for any seasonal boat launch permits that are not returned.

9. The parties agree that the City may terminate this Agreement at any time due to lack of need of continued services by the Agent or for failure by the Agent to meet the terms and conditions of this Agreement. If the City terminates this Agreement, Agent shall return to the City all unused seasonal boat launch permits and fully compensate the City for any seasonal boat launch permits that are not returned.

10. This agreement once signed and dated by both parties, supersedes all previous agreements between the Agent and the City.

I have read the conditions governing this Agreement and agree to abide by them in the conduct of my operations under this Agreement.

WHEREAS, Michael Rossow, Bruce Seymore II and Lynne Secory’s current terms expired on April 14, 2020 and all three wish to continue serving;

Membership; compensation; removal. The historic district commission shall consist of nine members whose residence is located in the city. They shall be appointed by the city council for terms of office of three years on a staggered term basis. At least two members of the commission shall be appointed from a list of citizens submitted by a duly organized and existing preservation society or societies. The commission shall include, if available, a graduate of an accredited school of architecture who has two years of architectural experience or who is an architect registered in this state. A majority of the members of the commission shall have a clearly demonstrated interest in and knowledge of historic preservation...”;
