CHAPTER
—I
PRELIMINARY
Short
title,
1.(1)
This Act may be called extent andthe Delhi
Nursing
CouncilAct, commencement. 1997.
(2)
It extends to the whole of the NationalCapital
Territory
of Delhi.(3)
It shall come into force onsuch date as the
Government
may,
by'
notification
in theofficial
Gazette,
appoint.
Definitions.
2. In thisAct, unless the context
otherwise
requires,
(a)
”affiliatedinstitution"
meansan
institution
orhospital
orhealth centre for
preventive,
promotive,
curative care andrehabilitative
nursing
servic—es, which is
recognised.
and affiliated to theCouncil;
(b)
”auxiliary
nurse-midwife”
or“female health worker” means
a
person who possesses a cer~
tificate
ofauxiliary
nursemidwife,
or, as the case maybe,
of female health workerfrom a
recognised
institution
registered
under section 13;(c)
”council" means the DelhiNursing
Councilconstituted

"Inspector”
means a nurseappointed by
theCouncil;
"list” means a list of
nurses,
midwives,
auxiliary
nurse—midwives
orfemale
health
workers or female healthassistants
orsupervisors
maintained
undersection
16; ”member” means a member ofthe
Council;
”nurse” means a person who possesses acertificate
innursing
andmidwifery
from aninstitution
recognised
in thisbehalf
andregistered
with the
Council;
"prescribed”
means prescribedunder the
rules;
”President”
means the Presi—Constitution
andincor-poration
of the Council. 3.(p)
“register"
means aregister
maintained
under section 15;”registered”

in accordance with the

“regulation”

II
Delhi
Nursing
Council(1) The Government
shall,
assoon
as may be after
the commencement of this Act, constitute a Council called
'The Delhi
Nursing
Council'.The Council shall
consist of
the
following
Inembers,
namely:—
(a) The Director of Health
Services,
Government ofNational
Capital
Terri-tory
of Delhi —Ex—Offi— cio.
(b)
TheDirector
of IndianSystems
ofMedicine
andHomoeopathy
—Ex—Officio. (c) The Medical Officer of
Health,
Municipal
Corpo—
ration of Delhi ~Ex—
(d)
TheNursing'
Advisorto
the
Government
of India —Ex—Officio.
Three
Nursing
ChiefOfficers
of thehospitals
in the NationalCapital
Territory
of Delhi torepresent one
hospital
each,
to be nomi— natedby
the Governs mentby
rotation,
from thefollowing
—(i)Hospitals
of CentralGovernment;
(ii)Hospitals
of Govern— ment of NationalCapital
Territory

The Council shall be abody
corporate,
having
aperpetual
succession and a common
seal,
with power to
acquire,
hold anddispose
ofproperty,
whether movable orimmovable,
and to contract and to do all
things
necessary
for thepurposes of this Act, and may
by
the name aforesaid sue orbe sued.
The President and the Vice— President of the Council shall be elected from amongst the
members,
according
to theprocedure
as may be pre—scribed.

a new member shall benominated

the Government and such nominated member shall hold officeonly
for the remainder of the termfor which the member was
nominated.
A member shall be deemed
to
have vacated office if he
absents himself from three consecutive
meetings
of the Council :ithout leave of theCouncil.
(a) The President
may
resign
from his office
by
notice inwriting
ad— dressed to theSecretary
of the Council. Suchresignation
shall take effect from the date onwhich it is
accepted
by
the Council.
(b)
A member mayresign
fromoffice
by
notice inwriting
addressed to thePresident and every such
resignation
shall take effect from the date onwhich it is
accepted
by
the President.Notwithstanding
anything
contained in this
Act,
the Government may —(a)
remove a member fromoffice on
being
founddisqualified
as per sub~section (8) of this

(b) if the Council decides
at
a
meeting
by
two~thirdsmajority
of the totalmembership
that thecontinuation
of a member in office isprejudicial
to the
interest
of theCouncil,
remove the member from office.
A person shall be
disqualified
forbeing
electedor nominat—
ed,
and forcontinuing,
as amember —
(a)
if he is anundischarged
insolvent;
or(b)
if he is of unsound mind and stands sodeclared
by
a competent
court; or
(c)
if his name has beenremoved from the
registei
and has not been re—entered
therein,
or(d)
if he is awholertime
officer or servant of the
Council;
or(e)
completes
65years of
age.
The Council shall meet atleast
once in a year and
may also
meet as many times
as neces—
sary in a year to
transact its
business.
The
President,
whenpresent, shall
preside
overmeetings
of the Council and in hisabsence the
Vice—President
shall
preside.
In case both areabsent,
any other memberelected
by

at suchmeetings.
(3) All transactions of
business
at a
meeting
shall bedecided
by
majority
vote.(4) In the case of equal votes the President shall

ing
thePresident;

meeting
ofthe Council a quorum is
not
present, the President or the
presiding
member,
as the case maybe,
shalladjourn
thefleeting

notice onthe Notice Board at the office of the Council. The business before the
original
meeting
shall bebrought
before theadjourned
meeting
and may bedisposed
of at suchmeeting
orany
subsequent
adjournment
thereof,
whether therebe a quorum present
or not.
No act or
proceeding
of theCouncil shall be
invalid
by
reason ofexistence
of a vacancy in theCouncil or on account of
any defect
or
irregularity
in itsconstitu— tion.
The Executive Committee
shall consist of five members who shall
be elected
by
the Council fromamongst its members in the manner
as may be
prescribed.
The Council may constitute sub<
committees for such purposes as the Council considers
necessary.

Deputy
Registrar
and suchother staff as may be neces—

The Council shall

to the
Registrar,
officers and otheremployees
of the Council shall be fixedby
the Councilwith the
previous
approval
ofthe Government.
The Council may, with the
previous
sanction of theGovernment,
suspend,
dismissor remove any person
appointed
as the
Registrar,
orimpose
any other
penalty
upon him inthe manner as {nay be
provided
by regulations.
