CONSUMER COMPLIANCE REVIEW

. . . .

Our comprehensive consumer compliance review uses a risk-based approach to provide an assessment of an institution’s compliance with the federal consumer protection regulations.

This review will simulate the consumer compliance exam performed by federal regulators. It will conduct testing to review the financial institution’s adherence with applicable consumer protection laws, regulations and supervisory guidance. This is an excellent way of monitoring continued compliance to ever-evolving regulations, and ensure regulatory readiness. In order to provide your financial institution with the most value, we always recommend changes with efficiency and cost-efficacy in mind.

FAIR LENDING & HMDA SERVICES

. . . .

Fair Lending Analysis

(Comparative Analysis, Matched Pairs, Regression) Each TRUPOINT Analytics™ reporting suite will be presented in detail with a review led by an experienced compliance consultant.

• Fair Lending HMDA Analysis: Compare your HMDA data for disparate impact.

• Peer HMDA Analysis: Compare your financial institution to others in your market(s).

• Non-HMDA Analysis: Analyze your non-HMDA data through the use of surrogates that assign gender and ethnicity to your data.

Regression Analysis

Regression Analysis is a powerful tool for Fair Lending Compliance. Regression can identify whether race, gender, ethnicity and other

prohibited bases factored into the decision to make or price a loan. Contact us to see if it’s right for you.

Risk Assessments

Identify weaknesses within your Fair Lending Compliance Management Program through a comprehensive review of your risk exposure. We follow the Interagency Fair Lending Examination Procedures. We offer two ways to identify your risk: our self-paced risk assessment tool, TRUPOINT RiskCheck™, or with a consultant.

We will review credit operations; compliance history; assess policies and procedures; review underwriting and pricing process; training; monitoring procedures; analytical procedures; review steering and redlining risks; and examine service and loss mitigation risks to ensure readiness for your next exam. Your risk assessment will be customized based on the regulatory requirements, asset size and complexity of your institution.

HMDA LAR Scrub Service

HMDA data verification services by reviewing your source documentation to your submission file. Review of policy, summaries of error rates and deviations from policy will be provided. We empower you to submit your data with confidence.

HMDA Policies and Procedures Review

We will evaluate potential weaknesses in you HMDA compliance program. We can also help you develop a plan for improvement, and minimize future risk.

CRA Geo-Analysis and Lending Data Review Consistent with the CRA performance standards, we examine the loan-to-deposit ratio, percentage of loans within the bank’s assessment area, compare lending to different income levels, and examine the geographic distribution of the financial institution’s loans. Reports include detailed analysis complete with maps, charts, graphs and executive summaries. Depending on your needs, reports are available annually, semi-annually or quarterly. CRA Review

Using the joint agency examination procedures (small, intermediate small or large financial institution criteria), we will assess your CRA

performance with the lending tests and community development standards. We will also review CRA policy, notices and public files.

Assessment Area Review and Determination We geographically and statistically examine

assessment areas and provide recommendations to ensure your unique market areas consist of political subdivisions and refrain from excluding

low-income census tracts. State-of-the-art geocoding capabilities let us consult and outline an optimal assessment area that can help you better meet your CRA compliance and business objectives.

INDEPENDENT BANK SECRECY ACT

AUDIT AND RISK ASSESSMENT

. . . .

We can conduct an independent review of your institution’s BSA / AML program as required by federal law. Review of the bank’s processes and procedures relative to the USA Patriot Act and OFAC regulations will also be conducted. The review will be tailored to the institution’s size, complexity of business lines, customer base, geographic diversity, and technology employed.

We will also ensure your written compliance program provides for Customer Identification Program; training program; a system of internal controls; independent testing or monitoring; and one or more designated individuals responsible for BSA.

Lastly, we will ensure policies and procedures for all consumer protection regulations are available.

POLICY DEVELOPMENT

We will help develop written compliance program and policy documents consistent with management objectives and regulatory requirements. Our

services include policy creation, implementation assistance, review of forms and disclosures.

COMPLIANCE TRAINING PROGRAMS

. . . .

We offer fully customizable regulatory compliance training services, which will be provided to the Board of Directors and your employees relative to their responsibilities and the risk posed by any area of regulatory compliance. Services range from two-hour webinars that meet annual requirements to full-day consumer compliance training sessions.

UDAAP REVIEWS

. . . .

UDAAP visibility and awareness has increased since the Dodd-Frank Act and the creation of the CFPB. Under the Dodd-Frank Act, it is unlawful for any provider of consumer financial products or services or a service provider to engage in any unfair,

deceptive or abusive act or practice.

Our reviews cover the key processes subject to UDAAP (advertising, mortgage lending and servicing, payment processing, and debt collection) and key products (sub-prime products or products geared toward the vulnerable or financially

unsophisticated, overdraft protection products, and prepaid cards).
