TIMBER RIDGE HOMEOWNERS ASSOCIATION STANDARDS
AND GUIDELINES
INTRODUCTION
The Timber Ridge Homeowners Association Board of Directors has the authority to establish an Architectural Review Committee (ARC),
consisting of not less than three members appointed by the Board, in order to assure that the private and Common Property shall always be maintained in a manner:
(1) Providing for visual harmony and soundness of repair;
(2) Avoiding activities, structures or improvements detrimental to the values of the Property;
(3) Promoting the general welfare and safety of
owners, tenants, guest, employees, agents and invitees; and (4) Insuring architectural compatibility.
The authority for maintaining the quality of design in the community is founded in the Declaration of Covenants, Conditions and Restrictions (CCR) which are a part of the deed to every property in Timber Ridge. The bylaws and covenants establish the basis for Timber Ridge Homeowners
Associations7 Architectural Review Committee. These guidelines pertain only to exterior alterations, in accordance with the Declaration of Covenants, Conditions and Restrictions.
OBJECTIVES
The specific objectives of this document are:
(1) To highlight the requirements set forth in the CCR;
(2) To provide uniform guidelines to be used by the ARC in reviewing applications in accordance with the direction of the CCR;
(3) To assist homeowners in presenting an acceptable Application for Architectural Change to the ARC.
AMENDMENTS TO THE ARCHITECTURAL GUIDELINES
These guidelines may be amended. It is anticipated that any changes will be primarily additive and will not involve substantive changes of existing guidelines. These, too, however, may be amended to reflect changing conditions or technology.
The ARC will conduct periodic evaluations of the guidelines to determine if amendments are necessary. Owners may also submit to the ARC requests for additions and/or changes to the guidelines. The ARC will present suggested amendments to the Board of Directors. The Board of Directors will conduct an open Board of Director's meeting at which property owners concerns about the proposed amendments will be heard. The Board of

Directors shall render a decision, as to the adoption of the amendment(s), within a reasonable time.
APPLICATION SUBMISSION PROCEDURES
Prior to commencement of any exterior change to any lot within the community of Timber Ridge, the homeowner is required to submit an application to the ARC. Each application is reviewed by the ARC on an individual basis. There are no "automatic" approvals, unless provided for specifically in these guidelines.
All applications should be submitted on the appropriate application form provided by the ARC and/or the Management Agent. The application requires the following information:
A. Name(s) of Owner(s);
B. Property address and Lot number
C. Type of Change (with sketch showing dimensions, location of house, lot lines, and other structures).
D. Samples of or specifications for the materials and paint chips for colors to be used and an indication of the existing colors and materials.
E. Signatures of all neighbors whose properties are directly adjacent to the applicant's verifying that they have been made aware of the requested changes
F. Estimated commencement and completion dates
The address to which the application must be sent is found at the bottom of the form.
If the application contains insufficient information to permit the ARC to carry out its review, the application will be returned to. the owner with a request to provide the missing information. An application returned for missing information will not be considered to be a completed
application.
APPLICATION REVIEW PROCEDURES
Upon receipt of a form containing all of the required information, the ARC will convene to review the application. In some instances, a site visit may be necessary. The decision of the ARC is based on a simple majority.
The ARC shall provide the owner with a written response to the mailing address on the application within forty-five (45) days from the day of receipt by the management company of the completed application. (If hand delivered, the application is deemed to have been received on the date of delivery. If sent by United States mail, the application is deemed to have been received six days after the postmark date.) The owner will be notified that the application has been approved, approved with
stipulations, or disapproved. If the application has been disapproved, the reasons for the disapproval will be cited. If the ARC fails to notify the applicant within forty-five (45) days of receipt of the application, the application shall be deemed approved. However, approval shall not be

considered a waiver of any covenant, condition or restriction provided in the CCR.
The following criteria will be used in reviewing and evaluating each application and design:
Validity of Concept - The basic idea must be sound and appropriate to its surroundings.
Design Compatibility - The proposed improvement must be compatible with the architectural characteristics of the applicant's house, adjacent houses and the neighborhood setting. Compatibility is defined as similarity in architectural style, quality of
workmanship, similar use of materials, colors and construction details.
Location and Impact on Neighbors - The proposed alteration should relate favorably to the landscape, the existing structure and the neighborhood. The primary concerns are access, view, sunlight, ventilation and drainage.
Scale - The size of the proposed alteration should relate well to adjacent structures and its surroundings.
Workmanship - The quality of work should be equal to or better than that of the community.
Timing - Projects which remain incomplete for more than twq (2) months are objectionable because they can be a nuisance and safety hazard for neighbors and the community. All work must be completed by the stated completion date, unless an extension of time has been requested and approved in advance in writing.
APPEAL PROCESS
If an application is disapproved by the ARC, any aggrieved party, defined as any director or any Owner whose personal, pecuniary, or property rights have been, or may be, affected by the decision of the ARC, may appeal the decision of the ARC to the Board of Directors by submitting, in writing, postmarked within fifteen (15) days following the issuance of the ARC decision, a request that the Board of Directors review the decision. The Board of Directors shall review the matter, based upon the information submitted with the request for reconsideration by the property owner and upon the information provided by the ARC. As any aggrieved party may appeal and ARC decision within a fifteen (15) day period following that decision, property owners may find it advisable to begin any modifications after the appeal period has expired. Consideration of any review request received by the Board of Directors will be based on the considerations stated above and without regard for any owner’s time, effort and/or expenses incurred by alterations undertaken prior to the expiration of the 15-day appeal request period. The Board of Directors may uphold the decision of the ARC in its entirety, may amend such decision, or may overturn such decision. The decision of the Board of Directors shall

be rendered within forty-five (45) days of receipt of request for reconsideration, and shall be the final word within the Association on the matter.
GUIDELINES
The following guidelines address a broad range of exterior alterations for which owners frequently submit an application to the ARC. It would be impossible to address each specific design condition; as a result, these guidelines present the principal factors which should be considered when developing a design, such as defining the limits to size, quality of construction, location, materials and colors based on the intended use and relationship to adjacent properties rather than focusing on a particular construction detail or specific design alternative.
There may be exceptions to the guidelines which are justifiable. If a homeowner feels that he/she has such an exception they may request an exception to the guidelines.
It is the owner's responsibility to obtain all required local, state and federal approvals prior to construction or alteration of any lot or dwelling. Authorities should be contacted and permits obtained prior to commencement of work. However, approvals on the local, state or federal level do not preclude the necessity for ARC approval.
If any excavations are required, the owner is responsible for contacting all utility companies prior to commencement of work.
An approved application must be obtained prior to the construction, installation and/or modification of the following unless otherwise indicated herein. Additionally, for exterior modifications not addressed in these guidelines, ARC approval may also be required, and the homeowner is advised to contact the ARC prior to commencing such construction, installation and/or modification to determine the requirement for approval.
A. FENCES - An approved application is required for all fences prior to construction/installation, whether new or rebuilt, except as otherwise herein stated. The application must include design, dimensions, location, material, color and any structural changes to accommodate the design. The design should be in the form of a sketch on a plot plan. Any pictures, sketches, etc., submitted with the application will be retained by the ARC, and, therefore, cannot be returned to the applicant. An approved application is required prior to painting or staining a previously unpainted or unstained fence or when changing the color of a fence.
1. Location
a. Fences will be restricted to rear and side yards and will consist of one style and one height per lot. Side yards are defined as the portion of the yard behind a line extending parallel to the front of the house extending from the front corner of the house to the lot line.
2. Height

a. Fences must not be of a height less than three (3) feet nor greater than six (6) feet if the fence comes from the back corner of the house (i.e. not fencing side yard). If the side yard is to be fenced, the height is restricted to a maximum of four (4) feet.
3. General Design
a. Design and style of fence should be compatible with the following:
1. Fencing which is finished on one side only must be constructed with the finished side facing out.
2. Gates must match fencing in design, height, material and color.
3. Wire type fences are not acceptable (e.g. chain link, barbed, chicken, pig or hog wire), except as liners to split rail fences to contain pets.
4. Stockade style fences are not acceptable.
5. Color
a. Fences may be left natural, stained in a redwood or other wood color stain, or painted white.
b. The inside of a fence may be painted any color as long as it is not visible from outside the yard.
6. Maintenance
a. Fences must be properly maintained. This includes maintaining the structural integrity, painting, staining, and/or sealing.
B.SHEDS AND DOG HOUSES - An approved application is required for all sheds and dog houses prior to construction or installation, whether new or rebuilt. Information must include design, dimensions, location, material, color and any structural changes to accommodate the design.
The design should be in the form of a sketch on a plot plan. Any pictures, sketches, etc., submitted with the application will be retained by the ARC, and, therefore, cannot be returned to the applicant. An approved application is required prior to painting or changing the color of a shed or dog house.
1. Sheds
a. Sheds may be of the free standing type or attached to the house.
b. Location
1. Sheds must be located in the rear yard.
2. If the yard is fenced, the shed must be within the fenced area.
c. General Design
1. Design and style of sheds should be compatible with other approved sheds in the Timber Ridge neighborhood and relate to or complement the architectural design of the house.

2. Wood sheds and sheds finished in vinyl siding are strongly preferred. However, sheds
constructed of other materials may be approved through the Architectural exterior
modification process providing complete
application forms are received and the shed is approved by the Architectural Review Committee (ARC). Sheds need to complement the
architectural design of the house and be in keeping with the scale, material, and color of similar structures in the neighborhood.
3. The color of the shed must complement the siding color of the house, or, if the shed is wood, may be left in a natural wood color or stained to match any other approved stained structure within the homeowner's yard.
d. Maintenance
1. Sheds must be properly maintained. This would include maintaining the structural integrity, painting, staining, and/or sealing.
2. Dog Houses
a. General Design
i. The color of the dog house must match the siding color of the house, or the dog house may be left in a natural wood color or stained to match any other stained structure within the homeowner's yard.
C. PATIOS AND DECKS - An approved application is required prior to construction of all patios and decks. Information must include design, dimensions, location, material, color and any structural changes to accommodate the design. The design should be in the form of a sketch, preferably on a plot plan. Any pictures, sketches, etc., submitted with the application will be retained by the ARC, and, therefore, cannot be returned to the applicant. An application is not required when restaining a previously stained deck with the same color stain.
1. Location
a. Patios and/or decks should be located in rear yards.
2. General Design
a. Design and style of patios and decks should be compatible with other patios and decks if visible to surrounding area. They should relate to or compliment the
architectural design of the house.
b. When design includes other exterior changes such as lights, plantings, awnings, etc., other appropriate sections of these guidelines must be consulted prior to application.
c. If design calls for under-deck storage, a visual barrier or landscaping may be required to maintain a neat, uncluttered appearance.

d. If changes in grade or other conditions which affect drainage are anticipated, they must be indicated on application.
3. Color
a. No painting of decks is allowed.
b. Decks may be kept natural or stained in a redwood or other wood color stain.
D. SUN CONTROL DEVICES - An approved application is required prior to the installation of all sun control devices. Information must include color, materials and style along with design specifications such as dimensions and construction details.
1. Devices should be compatible with the architectural design of the house in terms of style, color and materials.
2. Sun control devices must not adversely affect view, light, winter sun or natural ventilation of adjacent properties.
E. SOLAR EQUIPMENT - An approved application is required prior to the installation of all solar equipment. Information provided must include manufacturer's design information, installation plans and all city-county and other government requirements for permits and approval.
1. Because of the variety of design of solar equipment, installation will be considered on its individual merits.
2. Solar equipment may not be seen from the street.
F. PRIVATE POOLS - All pools require an approved application prior to construction/installation. Information provided must include
manufacturer's design information, installation plans and all city/county and other government requirements for permits and approval.
G. MAJOR ALTERATIONS - All such alterations require an approved application prior to construction, installation and/or
modification. It is suggested that the information provided be a duplicate of those documents which are to be submitted to Fairfax County for a building permit. In addition, landscape plans, colors, etc., must be provided.
1. Major alterations include any substantial structural or site changes such as chimneys, driveway modifications, greenhouses, playhouses, playsets, swingsets, and
porches, etc.
2. All such alterations must be compatible in scale, material and color with the applicant's house.
H. SIDING. ROOF. TRIM. SHUTTERS. FRONT DOOR, AND GARAGE DOOR -All changes to siding, roofs, trim, shutters, front doors, and garage doors require an approved application prior to installation, construction, painting or repainting. Information must include design, dimensions, location, material, color chip card supplied by the manufacturer, and any structural changes to accommodate the design. The design should be in the form of a sketch, preferably on a plot plan. Any pictures, sketches, etc., submitted with the application will be retained by the ARC, and, therefore, cannot be returned to the applicant.
9 1. Color Changes
a. Any exterior color change must be in keeping ..with the following "packages."
1. Exterior colors in accordance with the 18 original color packages offered by the builders to original home purchasers, as reflected in the following table are acceptable.

2. Other color combinations will be considered upon request.
Exterior color changes will be limited to the current McCormick exterior colonial paint chart.
I. AIR CONDITIONERS - ARC approval is not required; however the following guidelines must be met.
1. Exterior units (heat pumps) may be added or relocated to areas where they do not interfere visually and/or acoustically with the surroundings.
2. Exterior units shall be oriented or screened so as not to discharge hot air onto adjacent property.

3. Fencing or landscaping may be used as screening.
J. CLOTHESLINES - ARC approval is not required; however, the following guidelines must be met.
1. Clotheslines must be retractable or dismountable and taken down when not in use.
2. Clotheslines must be placed in the rear of the property, out of sight from the street.
K. DOG RUNS - An approved application is required prior to the installation of a dog run.
1. Chain link fences for dog runs will only be considered if they are erected inside solid privacy fencing and do not extend above the fence line.
L. EXTERIOR LIGHTING - ARC approval is not required (except as noted below); however, the following guidelines must be met.
1. Exterior lighting must not be directed beyond the property lines.
2. Light fixtures which are to replace original fixtures must be compatible in style and scale with the homeowner's house.
3. A free standing lamp post may be painted to match the house trim or front door; however, an approved application is required prior to painting.
M. WROUGHT IRON RAILING - An approved application is required prior to painting if the paint color to be used is not black.: If a color other than black is to be used, it should match the color of the front door or trim, and an application is required.
N. FLAGPOLES - ARC approval is not required; however, the following guidelines must be met.
1. Free standing flagpoles are not allowed.
2. Temporary flag staffs, placed at an incline on a front wall or pillar of a house, not exceeding six (6) feet in length, are allowed.
0. GUTTERS AND DOWNSPOUTS - ARC approval is not required; however, the following guidelines must be met.
1. Gutters and downspouts should match those existing in color and design and must not adversely affect drainage on adjacent property.
P. GARBAGE AND TRASH - ARC approval is not required; however, the following guidelines must be met.
1. Trash cans and other containers for garbage and trash must be stored out of sight.
2. Full containers must not be placed out at curbside earlier than 7:00 PM the night before trash collection is to be made. Empty containers must be retrieved and stored out of sight not later than 7:00 PM the day of trash collection.
3. Storage of an accumulation of trash or litter, to include new and used building materials, is prohibited on all lots.

Q. STORAGE OF VEHICLES. BOATS. ETC. - ARC approval is not required when vehicles are to be stored inside an attached garage; however, the following guidelines must be adhered to. An approved application is required prior to storage of vehicles elsewhere on the property; and the following guidelines must be adhered to.
1. Definition
a. “Permitted Motor Vehicles” means passenger automobiles, motorcycles, passenger vans without commercial lettering or tools, and passenger SUVs. “Restricted Vehicles”
includes, but is not limited to, the following types of vehicles: boats, junk vehicles, recreational vehicles, house trailers, camping equipment, commercial vehicles, industrial vehicles (i.e., moving vans, trucks, tractors, trailers, vans, wreckers, buses, etc.)
2. Location
a. Storage of permitted vehicles is limited to the inside of an existing attached garage on private property. The garage door(s) must be able to close with the vehicle inside the garage. Permitted vehicles may also be stored and parked in the resident’s driveway.
b. Storage of restricted vehicles is permitted in the rear yard under the following conditions; however, ARC approval is required prior to the storage of the vehicle(s):
1. The restricted vehicle is stored beneath an
approved deck, and lattice work is attached to the underside of the deck to screen the vehicle from view.
2. The restricted vehicle is located in the rear yard in such a manner as it is not visible from outside the property line, from an adjacent house, or from ground level elsewhere. (NOTE:A fenced back yard does not guarantee that the restricted vehicle is not visible from an adjacent house.)
c. Except as stated in (a) and (b) above, no vehicle, as defined in this section, may be regularly or habitually stored or parked on private property or common property. (Covering a vehicle with
tarpaulin is not acceptable.)
d. Restricted vehicles not normally stored or parked on private property may be parked in the resident's driveway for cleaning or minor maintenance, subject to a maximum of four (4) consecutive days in any fifteen (15) day period.
R. FIREWOOD - ARC approval is not required; however, the following guidelines must be adhered to.
1. Firewood must be kept neatly stacked at a height which does not exceed the height of any existing fence.
2. Firewood stacks must be located at the rear of the property within the property line and within the fence (if yard is fenced).

3. Firewood stacks may be covered by clear plastic without ARC approval. Other covers require an application and ARC approval.
S. SIGNAGE - ARC approval is not required; however, the following guidelines must be adhered to.
1. Real estate signs must meet county regulations with respect to size, content, and removal and may not be posted on common property, and, furthermore, may not be more than four (4) square feet in area. All signs advertising the property for sale or rent must be removed within three (3) days from the date of execution of any agreement of sale or rental.
2. No sign, advertisement, or message, other than for
identification purposes only, may be displayed on any lot which offers or implies commercial or professional services.
T. COMPOST PILES - ARC approval is not required; however, the following guidelines must be adhered to.
1. Compost piles must be located at least five (5) feet from a lot line at the rear of the property.
2. Compost piles must not exceed four feet in height.
3. Compost piles must be maintained within a frame or container which will control the size and volume of the pile.
4. A compost pile must be maintained in such a way as to prevent odors from escaping.
U. LANDSCAPING AND VEGETABLE GARDENS
1. Landscaping - An approved application is required prior to planting hedges which would exceed the height of fences or screens.
a. Trees and shrubs must not be planted in locations which would obstruct the line of sight for vehicular traffic.
b. Trees and shrubs must not be planted in such a way as to violate any Fairfax County ordinances.
c. Trees and shrubs must not be planted in locations which would obstruct public or Association walkways.
d. Planted beds must be kept in a neat and orderly manner.
Trees must be kept trimmed and neat.
e. The planting of trees and shrubs on Association property is prohibited without the consent and approval of the Common Grounds Committee.
f. All private property lawns shall be kept mowed and shall not be permitted to grow beyond a height of 6 inches.
g. All private property lawns shall be kept reasonably free of weeds and crabgrass.
2. Vegetable Gardens - ARC approval is not required; however, the following guidelines must be adhered to.
a. Location
1. Gardens must be between the rear of the house and the back of the property line.
2. Gardens must be planted on a grade of less than five (5) feet to one hundred (100) feet.
3. Gardens must not encroach on Association property.
b. General Design

1. Gardens must be neatly maintained throughout the growing season.
2. Following the growing season, all debris, unused stakes, or trellis' must be removed.
V. STORM DOORS - An approved application is required prior to the installation of a new storm door and prior to repainting an existing storm door.
1. General Design
a. Storm doors may be all glass or partial glass;, however, the painted portion of the storm door must be white or must match the front door, shutters, or trim color.
W. TELEVISION ANTENNAE AND SATELLITE DISHES – ARC approval is not required prior to the installation of any television antennae and/or satellite dish so long as the device and its installation is consistent with the Federal Communications Commission Over-the-Air Reception Devices Rule (OTARD).
However, owners are strongly encouraged to seek advice from the ARC prior to installation, as there are instances in which the Association can restrict placement of antennae and satellite dishes.
X. ANIMALS - ARC approval is not required; however, the following guidelines must be adhered to.
1. Common household pets such as dogs and cats are allowed provided that they are not kept or maintained for commercial purposes and are kept in compliance with Fairfax County ordinances.
2. Horses, ponies, cows, chickens, pigs, hogs, sheep, goats or other domestic or wild animal (except as defined above) may not be kept or maintained on any Lot.
Y. ROCKS - Painting of rocks located in a resident's yard is not permitted.
Z. MAILBOX AND SUPPORT POST - An approved application is required prior to changing (e.g., replace, modify materials or color)an existing mailbox or mailbox support post.
1. General Design
a. Only United States Postal Service approved mailboxes are allowed. Mailboxes must be located where a carrier can safely reach inside without leaving the delivery vehicle.
USPS guidelines call for positioning the bottom of the mailbox 41” to 45” above ground level and the front of the mailbox back 6” to 8” from the curb. Clearly display the house number on your mailbox, not the support post.
b. Mailboxes must be black in color. No other color or decorative cover is allowed.
c. The mailbox can be metal (preferred) or plastic.
d. The mailbox must be supported by a support post made of either high quality composite decking material or wood and be approximately four inches by four inches thick and be the same thickness from top to bottom.
e. The support post may be left natural (if wood), manufactured (or stained) in a wood color, or painted to match the approved siding or trim color of the

residence listed in section “H” of the guidelines.
The post may also be black.
AA. BASEMENT WALL
1. The color of the exterior basement walls must match the color of the exterior siding.
AB. DRIVEWAYS
1. Asphalt driveways - ARC approval is not required; however, the following guidelines must be adhered to:
a. Painting of asphalt driveways is not allowed.
b. Application of black asphalt driveway sealer is allowed.
2. Concrete driveway - An approved application is required prior to replacing an existing asphalt driveway with a concrete driveway
a. Concrete must be left in its natural state.
b. Painting of concrete is not allowed.
3. Gravel and Grass Driveways
a. Gravel and Grass driveways are not allowed.
4. An approved application is required prior to adding to an existing driveway or adding a parking apron..
AC. PORCH AND STEPS - An approved application is required prior to painting/repainting the porch and steps to the entrance of the house.
1. It is preferred that these areas are not painted; however, if painting is desired, only a color matching the existing concrete is allowed. No other color, including white, is permitted.
AD. Outhouses – Neither permanent nor temporary outhouses
(“Port-o-Potties”) will be permitted in the Timber Ridge Community.
MAINTENANCE
Property ownership includes the responsibility for maintaining the exterior of the dwelling and all other structures which are part of the property, such as decks, fences, sheds and play equipment. Maintenance affects the visual character and economic values of the property and neighborhood, and in some cases, safety.
While it is difficult to provide precise criteria for what the Association deems an unacceptable condition, the following cases represent some of the conditions which would be considered a violation of the Association's CCR:
1. Peeling paint on exterior trim, doors or shutters.
2. Play equipment which is either broken or in need of repainting.
3. Fences with broken, missing or improperly installed parts.
4. Sheds with broken doors.
5. Decks with missing or broken railings or posts.
6. Broken screens or windows.
VIOLATIONS OF GUIDELINES

Violations to the guidelines provided herein or to the CCR may be reported to any member of the Board of Directors, any member of the ARC, or the Management Agent. Violations may be reported by any member of the community.
Upon receipt of notice of a potential violation, the ARC makes a site visit to verify the complaint. Upon verification, an informal request is made to the property owner to correct the act or omission which appears to be in violation of the governing documents. If the informal request does not result in compliance, a written complaint will be filed with the Board of Directors, and the matter shall be resolved as defined in Policy Resolution #1.
Frequently, the following violations may occur, and the matter can be resolved informally as follows:
(1) Application was approved; however, modification was not-executed by the applicant in accordance with the approved application. The owner is notified, in writing, that the modification is not in conformance with the approved application, and the owner is requested to correct the violation or meet with the ARC to determine what modifications must be made in order to receive ARC approval. An amended application would be required to obtain ARC approval of these modifications.
(2) Application was disapproved; however, exterior modification was made. The owner is notified in writing that the modification was not approved, and the owner is requested to correct the violation or meet with the ARC to determine what modifications must be made in order to receive ARC approval. An amended application would be required to obtain ARC approval of these modifications.
(3) Application was not submitted to the ARC for approval prior to modification. The owner is notified in writing that the modification was made without an approved application, and the ARC requests that an application be submitted for approval. Once submitted, the application is processed. If the application is disapproved, the owner is notified, in writing, and the owner is requested to correct the violation or meet with the ARC to determine what modifications must be made in order to receive ARC approval. An amended application would be required to obtain ARC approval of these modifications.
(4) Modification made by previous owners. Purchasers of resale homes are responsible for any exterior modifications made by previous owners.
New owners may wish to check with the ARC to determine if an approved application is on file for these modifications. If an approved application is not on file, and a complaint is received, the owner is notified, in writing, that the modification was made without an approved application, and the ARC requests that an application be submitted for approval. Once submitted, the application is
