I conducted a special investigation because the child care licensing division received a complaint against your facility that related to licensing rules or law. The allegations were related to the following:

R 400.8335(8)(a) Food services and nutrition; provided by center. R 400.8335(8)(c) Food services and nutrition; provided by center.

The details of the allegations are in the attached report. To investigate the allegations:  I interviewed: the person who made the complaint, program director, licensee,

licensee designee, and caregivers.

 I completed on-site inspections on the following dates: 07/23/2020. As a result of this investigation, I found the following violation(s):

R 400.8335(8)(a) Food services and nutrition; provided by center. R 400.8335(8)(c) Food services and nutrition; provided by center.

I recommend no change to the current license status.

Due to the violations, you must send us a corrective action plan by 09/30/2020. You can use our corrective action plan form or create your own.

If you need help writing the corrective action plan, please contact me. If you do not send a corrective action plan, you may face disciplinary action. The corrective action plan must include the following:

 How compliance with each rule will be achieved.

 Who is directly responsible for implementing the corrective action for each violation.

 Specific time frames for each violation as to when the correction will be completed or implemented.

 How continuing compliance will be maintained once compliance is achieved.

 The signature of the responsible party and a date.

ALLEGATION: A staff member served spoiled milk to children.

INVESTIGATION: The complaint received on 07/21/2020 stated that, on 07/20/2020

at approximately 7:30AM Program Director, Mychell Molnar, asked if classes needed milk for the children. After the staff members responded, Ms. Molnar brought breakfast carts with food and milk for classrooms that requested it. The complainant stated that a staff member in one of the classrooms began serving the children their breakfast and milk. Once every child in that classroom had a plate and a cup a staff member turned to look at the milk gallon and realized that the milk was already half empty but was dated for July 10th. The caregiver immediately sniffed the gallon of milk and realized it was spoiled. The caregiver disposed of the milk into the kitchen sink and went to the office to get a new container of milk.

On 07/23/2020 I conducted an onsite inspection at the child care center. During this inspection I observed all the child care classrooms. My inspection occurred around lunch time and therefore I was able observe the milk that was distributed. I also observed the two refrigerators that are used for milk storage. During my inspection all the milk that I observed was sanitary and appropriately dated.

During the onsite inspection, I conducted an interview with Licensee, Brenda Browers, and Staff Member, Holly Spencer.

Ms. Browers stated that she is not aware of spoiled milk being an ongoing issue at the child care center. She added that Ms. Molnar and Ms. Spencer are responsible for providing the milk and food to the classrooms. She believes that these two staff members normally dispose of the expired milk before it gets to the classrooms but she added that the staff members who work in the classroom typically catch if any spoiled milk is delivered to the classroom before it is given to the children.

Staff member, Holly Spencer, stated that she does not recall a time where she delivered expired milk to any of the classrooms. She added that she and Ms. Molnar are “good” about dating the milk and putting the milk in the appropriate refrigerator depending on if the milk is opened or closed. Ms. Spencer described the process of

delivering milk and food to the classrooms as the food being prepared and placed on the cart to deliver to the classrooms. She added that she or Ms. Molnar will call down to the classrooms to see if they need milk. If milk is needed, they place milk on the cart and deliver it to each classroom. She added that some classrooms do not always need milk because they have refrigerators that they can store milk and use it throughout the day.

Ms. Spencer stated that if a container of milk is returned to them partially used, they will check to ensure it is not set to expire. If the milk is not going to expire within the next few days, they will date it with the date the milk was opened and put it in the refrigerator that is in the kitchen area. She stated that if the milk is close to its expiration date, they try to use it that same day.

Ms. Spencer further explained that all opened milk is placed in the refrigerator in the kitchen area. She stated that normally all the “good” milk is put on one side in the front of the refrigerator and the “old” milk is placed on the opposite side of the same refrigerator. She indicated that the old milk is placed in the refrigerator until it is poured out.

Ms. Spencer stated that the other staff members do not assist in the food preparation and delivery because it is just easier to have only a couple of people responsible for it. Ms. Spencer stated that she has never had any one complain to her about issues with the milk and she believes that if expired milk was taken to the class, it was the results of a simple miscommunication.

On 07/31/2020, I conducted phone interviews with staff member, Sara Carrasco. Ms. Carrasco stated that she was working in the wobbler classroom on a day that children were served spoiled milk. She added that the wobbler classroom normally has a gallon of milk in their refrigerator, but they did not have enough so they requested more milk from Ms. Molnar. Ms. Carrasco stated that Ms. Molnar brought milk to the classroom and that milk was served to the children as the staff members prepared the children’s plates. After Ms. Carrasco gave all the children their food, she stated that she looked at the container of milk and saw that it was dated 07/10/2020. She then smelled the milk and realized that it was spoiled. Ms. Carrasco stated that she told the other staff member she was working with and they then gathered all the milk from the children. Ms. Carrasco stated that she took the milk container to the office and informed Ms. Molnar that the milk was expired to which Ms. Molnar’s only response was “oops, I didn’t even look.” Ms. Carrasco stated that she got a new container of milk to serve the children.

Ms. Carrasco stated that it was early on a Monday morning when this occurred. She stated that the milk provided was already opened but did not have a handwritten date on it. She stated that there was only enough milk in the container to serve four to five children with only a small amount left over. She added that at least one of the children drank the expired milk.

5 Ms. Carrasco stated that it is not the responsibility of the staff members in the classrooms to ensure the quality of the food. She added that Ms. Molnar and Ms. Spencer are the ones responsible. She indicated that she does think that the staff members in the classroom should also inspect the food as an added measure of safety.

On 07/31/2020, I conducted a phone interview with staff member, Elisabeth Elliott. Ms. Elliott stated that she was aware of the children receiving expired milk as she was working in the classroom on the day that it occurred. She described the incident and confirmed that it happened as described in the complaint. Ms. Elliott added that the date of the milk was the 10th. She also stated that the milk was not fresh as the

container had already been opened. Ms. Elliott stated that a couple of the children sipped the milk before Ms. Carrasco noticed that the date on the milk was the 10th.

Ms. Elliott stated that she has heard of children in the child care center being served expired milk in the past, but she has not witnessed it happen prior to this incident. On 08/05/2020, I conducted a phone interview with program director, Mychell Molnar. I explained the allegation to Ms. Molnar, and she stated that the incident occurred due to miscommunication. She explained that there are two refrigerators that are used to store milk for the child care center. She stated that on Friday, 07/17/2020, she moved two gallons of milk from one refrigerator to the other refrigerator to be dumped because they expired. She stated that she communicated with Ms. Spencer to dump out the expired milks, but she does not think that they were thrown out because one was opened in the kitchen refrigerator on Monday 07/20/2020. Ms. Molnar stated that because the milks were not thrown out, she accidently grabbed the old milk and took it down to a classroom. She acknowledged that she grabbed the milk without first looking at the date. Ms. Molnar confirmed that Ms. Carrasco brought the expired milk back to her. She stated that she was not sure of the date on the milk that was returned, she just dumped it after finding out it was expired.

On 09/08/2020, I conducted phone interviews with staff members, Gabrielle Sheldon, and Grace Fahrni. Both staff members stated that they heard about the incident with the expired milk, but neither of them witnessed it.

APPLICABLE RULE

R 400.8335(8)(a) Food services and nutrition; provided by center. (8) All of the following shall apply to milk:

(a) Containers shall be labeled with the date opened. ANALYSIS: The milk container that was brought to the class had a store

date stamp of 07/10/2020. The milk had previously been opened but had no handwritten date identifying when the milk was first opened.

APPLICABLE RULE

R 400.8335 Food services and nutrition; provided by center. (8) All of the following apply to milk:

(c) Milk must not be served if the contents appear to be unsanitary or have been unrefrigerated for a period exceeding 1 hour.

ANALYSIS: The milk had a sell by date of 07/10/2020 but was brought to the classroom for use on 07/20/2020. Despite the date on the milk, no one checked to ensure that they milk was sanitary prior to it being served to the child care children.

CONCLUSION: VIOLATION ESTABLISHED

IV. RECOMMENDATION
