Responsibilities of Ownership

Dear BMW Owner;

Congratulations on the purchase of your new BMW motorcycle. Whether you have just purchased your first BMW or you are a previ-ous owner, we hope your new BMW will live up to your expectations in every way.

The proper care and service of your new BMW is essential to its safe, dependable operation, lon-gevity and to the protection of your investment.

Your BMW is covered by a new motorcycle limited warranty, noise emission warranty/tampering pro-visions and an emissions related defect warranty. Detailed warranty information is contained on pages 9-26.

Our Customer Relations and Ser-vices Department, now accessible via a toll free number, is at your service. The phone number is 1-800-831-1117.

We recommend that you place all the service needs of your BMW in the hands of your BMW motorcycle dealer who has made a substantial

investment in Service Training, Special Tools, Diagnostic Equip-ment and Original BMW Parts. Certified Technicians perform high quality repairs in a minimum amount of time.

BMW personnel work closely with BMW motorcycle dealers to main-tain the highest standards for their service and parts department. This booklet is provided by BMW Motorrad USA to inform you of applicable motor cycle warranties. BMW manufactures its motor-cycles to high production quality standards. Your Rider’s Manual for your BMW motorcycle will provide information on operating instruc-tions, safety and riding hints, general specifications, as well as care and maintenance procedures and intervals.

The finish of your motorcycle will be enhanced by regular washing with approved cleaning products, avoiding high pressure washing systems, and touching up any stone chip damage immediately. Since paint finishes are susceptible to fading from environmental influences, we strongly recommend that your

(5)

motor cycle remain covered when not in use. Your authorized BMW motorcycle dealer sells a complete line of care products approved by BMW Motorrad USA.

Safe operation of the disc brake system on your motorcycle will be realized by following BMW’s rec-ommendation to change brake fluid bi-annually regardless of mileage. More frequent changes may be dic-tated by the climatic severity of your geographic location.

When your motorcycle is not in regular use, the Rider’s Manual for your BMW motorcycle gives you suggested steps in the proper storage of your motorcycle and specific instructions regarding care of your motorcycle battery. The effort you make to provide regularly scheduled mainten - ance, proper care for the finish and consistent annual servicing will reward you with years of safe and reliable enjoyment of your motorcycle. Always carry your vehicle documentation when traveling.

Limited Warranty —

BMW Motorcycles 2012 Models

(Valid only in the U.S.A.)

BMW of North America, LLC

(“BMW NA”) warrants to the first retail purchaser and each sub-sequent purchaser of 2012 US specification BMW Motorrad USA motor cycles, imported by BMW NA, or sold through the BMW NA Military Sales Program to be free of defects in materials or workman-ship for a period of three (3) years or 36,000 miles (whichever occurs first), commencing with the date the motor cycle is delivered to its first retail purchaser, or, if the motor-cycle is first placed in service as a BMW Press motorcycle, BMW

Em-ployee Lease motorcycle, BMW

Motorcycle demonstrator, BMW Dis-play motorcycle, BMW Fleet Motor-cycle or BMW MotorMotor-cycle dealer demonstrator prior to sale at retail, on the date the motor cycle is first placed in such service.

To obtain service under this war-ranty, the motorcycle must be brought, upon discovery of the de- fect, to the workshop of any autho-rized BMW motorcycle dealer. This BMW motor cycle dealer will, with-out charge for parts or labor, either repair or replace the defective part(s) using new or authorized remanu fac -tured parts. The decision to repair or replace said part(s) is solely the

prerogative of BMW NA. Parts for which replacements are made be-come the property of BMW NA. BMW NA makes no other express warranty on this product except the warranty as to the emission control system. The duration of any implied warranty of merchant-ability, is limited to the duration of the express warranty herein. BMW NA hereby excludes inci- dental and consequential dam-ages, including loss of time, in- convenience, or loss of use of the vehicle, for any breach of any ex-press or implied warranty, includ- ing implied warranty of mer-chantability that may be appli- cable to this product. Some states do not allow limitations on how long an implied warranty lasts, or the ex- clusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you.

This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state. Any legal claim or action arising from any express or limited warranty con- tained herein must be brought within 12 months of the date it arises.

(12)

The following items are war-ranted for defects in material and workmanship only for the first 6 months:

• Halogen, Xenon and LED bulbs

The following items are war-ranted for defects in material and workmanship only for the first 12 months:

• Paint and powder coat finishes • Chrome

The following items are war-ranted for defects in material and workmanship only for the first 24 months:

• Battery

This warranty does not apply to the following:

a) Maintenance Services: This includes scheduled maintenance, such as oil changes, wheel balanc- ing; mechan ical adjustments or re- pairs that become necesary through normal wear and tear such as throttle body synchroni-zation, poly V-belt adjustments or steering bearing adjustments; or periodic maintenance such as input and Paralever drive shaft spline lubrications.

b) Service and Wear Items: This in- cludes the replacement of light bulbs, brake pads, linings and rotor assemblies, clutch plates, steering head, wheel and swing arm

bear-ings and ball joints, fuses, control cables, poly V-belt replacement, drive chains, belts, sprockets and pulleys, exhaust pipes and muf-flers for discoloration of finish and rubber items such as hand grips, heated hand grips, foot rests, foot shift and control cable shields.

c) Batteries: Batteries that exhibit signs of neglect and/or overcharging.

d) Tires: Tires and tubes are war-ranted by their respective manu- facturer for de fects in materials and workmanship.

e) Garmin Products: Garmin prod- ucts, manufactured by Garmin In-ternational and marketed by BMW NA through BMW or for “Motor- cycle” dealers are warranted by their manufacturer, Garmin Inter-national, for defects in material and workmanship. Please refer to the warranty information provided with these products for further details.

f) Improper fuel usage: Only use fuels advertised to have adequate detergency and low alcohol (etha-nol) content. Please refer to your owner’s manual for important infor-mation on the fuel recommended for use in your vehicle. Use of fuels with insufficient detergent and/or excess alcohol can cause driveability problems that neces-sitate cleaning intake valves and fuel injection valves, and, when

(13)

applicable, adjusting the engine idle. We suggest having this work performed by your authorized BMW dealer, perhaps while regular maintenance is performed. Your BMW dealer can also recommend a gasoline additive that will provide sufficient detergency. While this recommended unscheduled main-tenance is not required in order to maintain the emission warranty, cleaning of intake valves or, when applicable, fuel injection valves, or adjustment of engine idle, neces-sitated by use of inappropriate fuel, it is not covered by warranty because no defect in material or workmanship or component failure is involved.

g) Failure to Service: This in-cludes, but is not limited to, damage attributable to failure to perform maintenance services at the spec i - fied intervals or in accordance with the instructions in the Rider’s Manual. Proof must be provided either by a paid invoice copy or fill-ing in the appropriate boxes in the Rider’s Manual.

h) Damage: This includes, but is not limited to, damage resulting from negligence, improper treatment, extreme lack of use or improper stor-age, the installation and use of side cars, three wheel conversions, trailer hitches, the towing of trailers of any description, acci dents or im-

proper accident damage repairs, corrosion from road salts, battery acid, cleaning agents, environ mental influences, or treatment contrary to the Riders Manual.

i) Non-BMW Parts: Damage to a component or assembly due to the installation of replacement parts with specifications that differ in any material respect from Original BMW Parts.

j) Towing: Limited towing assis -tance is available through the BMW Motorcycle Roadside Assistance Plan.

The warranty shall be null and void if:

1. The motorcycle is used in any competitive events.

2. The motorcycle has been de-clared a total loss or sold for salvage purposes.

3. If the Vehicle Identification Number has been altered or cannot be read.

4. Any performance accessory or components attached to the vehicle alters the original engi- neering and/or operating speci- fications which results, or may result, in damage to other original components.

Warranty Statement Your Warranty Rights and Obligations

The California Air Resources Board

and BMW of North America, LLC

(BMW NA) are pleased to explain the emission control system war-ranty on your 2012 motorcycle. In California, new motor vehicles must be designed, built and equipped to meet the State’s stringent anti-smog standards. BMW NA must warrant the emission control system on your motorcycle for the periods of time listed below provided there has been no abuse, neglect or im- proper maintenance of your motor- cycle.

Your emission control system may include parts such as the fuel-in- jection system, the ignition system, and engine computer. Also included may be hoses, belts, connectors and other emission-related assem- blies.

Where a warrantable condition ex-ists, BMW NA will repair your motor-cycle at no cost to you including diagnosis, parts and labor.

Manufacturer’s Warranty Coverage:

— For 5 years or 18,700 miles (30,000 kilometers) whichever occurs first:

If an emission-related part on your motorcycle is defective, the part will be repaired or replaced by BMW NA. This is your emis-sion control system DEFECTS WARRANTY.

Owner’s Warranty Responsibilities:

— As the motorcycle owner, you are responsible for the performance of the required maintenance listed in your Rider’s Manual and/or in this booklet. BMW NA recommends that you retain all receipts covering maintenance on your motorcycle, but BMW NA cannot deny warranty solely for the lack of receipts or for your failure to ensure the performance of all scheduled maintenance. — You are responsible for pre-

senting your motorcycle to an authorized BMW motorcycle dealer as soon as a problem exists. The warranty repairs should be completed in a

(17)

sonable amount of time, not to exceed 30 days.

— As the motorcycle owner, you should also be aware that BMW NA may deny you warranty cov- erage if your motorcycle or a part has failed due to abuse, ne- glect, improper maintenance or un approved modifications. If you have any questions regarding your warranty rights and responsi- bilities, you should contact:

BMW Motorrad USA, Customer Relations and Service Dept., P.O. Box 1227, Westwood, NJ 07675-1227 or call: 1-800-831-1117, or the California Air Resouces Board, 1001 I Street, Sacremento, CA 95812.

BMW of North America, LLC war -rants to the first purchaser and each subsequent purchaser that this motor cycle is designed, built, and equipped so as to conform at the time of sale with all California Air Resources Board emission regula-tions applicable at the time of manu-facture and that this motorcycle is free from defects in materials and workmanship which cause it to fail to conform with applicable regula-tions within the first 5 years or 18,700 miles (30,000 kilometers), whichever occurs first.

The 5 year/18,700 mile (30,000 kilo- meters) warranty period shall begin on the date the motorcycle is deliv-ered to the first retail purchaser or, if the motorcycle is first placed in ser-vice as a BMW Press motorcycle,

BMW Employee Lease motorcycle,

BMW Motorcycle demonstrator, BMW Display motorcycle, BMW Fleet Motorcycle or BMW Motor- cycle dealer demonstrator prior to sale at retail, on the date the motor- cycle is first placed in such service. To obtain service under this war-ranty, the motorcycle must be brought, upon discovery of the defect, to the workshop of any authorized BMW motorcycle dealer. This BMW motorcycle dealer opera tor will, without charge for parts or labor (including diagnosis), either repair or replace the defective part(s) and other parts affected by the failure of the warranted part, if any. The deci - sion to repair or replace said part(s) is solely the prerogative of BMW of North America. Parts for which replacements are made become the pro p erty of BMW of North America.

You are responsible for the perfor-mance of all required maintenance. A failure caused by the lack of re- quired maintenance will not be

(18)

BMW of North America strongly urges that the motorcycle be main-tained and serviced (at the owner’s expense) as prescribed in the main- tenance schedule for the BMW Emission Control System. The re- quired maintenance intervals for your model can be found under the Emission Control Maintenance Schedule in this booklet.

It is recommended that any replace-ment parts used for maintenance, repair or replacement of emission control systems be Original BMW Parts or Original Remanufactured BMW Parts. The owner may elect to have maintenance, replacement or repair of the emission control devices and systems performed by any motorcycle repair estab- lishment or individual, and may elect to use parts other than Origi- nal BMW Parts or Original Re - manu factured Parts for such mainten ance, replacement or re- pair without invalidating this war-ranty; the cost of such service or parts, however, will not be covered under the warranty except in cases of emergency.

Use of replacement parts which are not of equivalent quality may impair the effectiveness of emission con-trol systems. If other than Original BMW Parts or Original Remanu-factured BMW Parts are used for maintenance, replacement or repair of components affecting emission control, the owner should obtain as- surances that such parts are war-ranted by their manufacturer to be equivalent to Original BMW parts in performance and durability. BMW NA assumes no liability under this warranty with respect to parts other than Original BMW Parts and Origi-nal Remanufactured BMW Parts. However, the use of non-BMW re-placement parts does not invalidate the warranty on other components unless non-BMW parts cause damage to warranted parts. In the case of emergency where an authorized BMW motorcycle dealer is not available, repairs may be performed at any available service establishment or by any individual using any replacement part. A part not being available or a repair not being complete within 30 days constitutes an emergency. BMW NA will reimburse the owner for such repair (including diagno- sis) not to exceed the manu- facturer’s suggested retail price of all warranted parts replaced and

BMW recommends that you retain all receipts and maintenance records as proof of maintenance and service or filling in the appro-priate boxes in the Rider’s Manual and/or this booklet. Further, main-tenance, replacement, or repair of the emission control devices and systems may be performed by any motor cycle repair estab-lishment or in dividual using any equivalent part without invalid-dating the warranty.
