National Approval Request (Art. 5)

Describes the requirements and documentation needed to request the LoA • Legal constitution of the PPs

• The PDD shall correspond to the one that will be presented to the DOE for validation

• Fill out the template: requirements and evidences for sustainable development contribution (SDC)

• Provide documentation to prove how the project fulfill requirements and evidences for SDC

Evaluation Procedure for National Approval (Art. 6)

• Formal presentation to request for National Approval

• Preliminary revision of the documentation required to request National Approval (3 working days) – described in Art. 5

• The Climate Change Mitigation Group, studies and evaluates based on the requirements and evidences for SDC provided by the PPs in a format established by this Ministerial Resolution (12 working days)

• Finally, it is prepared a technical concept to the Viceministry of Environment for his consideration to approve or not the CDM project. The decision can be appealed

• It is communicated to the regional/local environmental authority that the CDM project has been approved

PPs Obligations (Art. 7)

• If there are considerable modifications to the PPD after the National Approval, the PPs shall inform the Ministry of Environment and formaly present the new PDD.

• Once the validation report has been delivered by the DOE, the PPs shall formally present to the Ministry of Environment.

• Once the project is registered by the CDM EB, the PPs shall comply with all evidences for sustainable development contribution, presented voluntary by the PPs and approved by the Ministry of Enviroment.

Motivations to revocate a LoA (Art. 8)

• Non compliance with project participants obligations (Art. 7)

• Non compliance with any of the declaration commitments made, regarding sectoral regulatory framework or the acknowledge of the potential CERs issuance and its monetary value

• Non compliance with the environmental regulation • Fake documentation presented

• Compliance with sectoral regulatory framework

– Legal existence of the PPs

– The PPs shall present a declaration commitment made regarding sectoral regulatory framework

• Compliance with environmental regulation

– The PPs shall present environmental licenses and any other environmental permits that the project activity requires.

• Demonstration that the PPs have the legal right to use the resources necessary to implement the project activity

– The PPs shall present the legal document that gives them the right to use the resources necessary to implement the CDM project activity

– The PPs shall present a declaration commitment made regarding the acknowledge of the potential CERs issuance and its monetary value

• Minorities and indigenous communities consultation

– If there is presence of Minorities and indigenous communities in the surrounding areas of the project: the PPs shall present evidence of assistance properly signed, meeting minutes and evidence that comments made regarding the project were taken into account.

– If there is no presence of Minorities and indigenous communities: the PPs shall present a certification from the Ministry of Internal Affairs indicating the absence of those communities.

• Information and socialization of the project

– Invitation to the socialization meeting shall be made within 15 working days in advance. The PPs shall provide evidence by a copy of the newspaper announcement, radio or TV.

– The PPs shall present evidence signed by the Major or the Community representative, that project information was left for public consultation.

– The PPs shall present evidence of assistance properly signed, meeting minutes and evidence that comments made regarding the project were taken into account.

• Community Complains

– The PPs shall describe and provide documentation of the procedures and mechanisms that are in place to address and solve community complains.

The PPs shall explain how the project activity will contribute to the sustainable development of the country and shall present documentation to evidence it. • Will the project make investments in health, education, sanitation, drinking

water, environmental preservation, low income housing and/or creation of family companies?

• Will the project give recruitment priority to the local communities during construction and implementation phases of the project activity?

• Will the project provide capacitation, training and/or education to workers from local communities in order to improve their skills for the project implementation?

• Will the project use clean/efficient equipment, technologies and processes that minimize resources use and environmental impacts? • Will the project provide technology and knowledge transfer?

• Will the project generate positive environmental impacts additional to GHG emission reductions?

• Will the project implement any adaptation measure, risk management and/or vulnerability reduction to the adverse effects of climate change?
