WEDNESDAY, DECEMBER 16, 2020

The Plan Commission/Historic Preservation Commission of the Village of Mount Horeb met on the

above date in a virtual meeting. Chair Randy Littel called the meeting to order at 7:00pm. Present

were Commissioners Destinee Udelhoven, Aaron Boehnen, Peggy Zalucha, Norb Scribner, and Sarah

Best. Brent Yauchler was absent. Also present were Village Administrator Nic Owen, Assistant

Village Administrator Kathy Hagen, Village Planner Mike Slavney, Youth in Government student

Delaney Mertz, and Deputy Clerk Chrissy Kahl.

Consider November 18, 2020 Plan Commission meeting minutes:

Scribner moved, Zalucha

seconded to approve the meeting minutes. Motion carried by unanimous voice vote.

AGENDA ITEM # 8 MOVED HERE:

Littel moved, Boehnen seconded. Motion carried by unanimous

voice vote.

Consider recommendation for revised extraterritorial jurisdiction Certified Survey Map for James

Leuzinger/Z&L Properties LLC, Section 13 Town of Blue Mounds:

Owen gave an overview. Zalucha

moved, Udelhoven seconded to recommend approval of the revised CSM. Motion carried by

unanimous voice vote.

Consider recommendation of Ordinance 2020-

20, “AN ORDINANCE PROVIDING FOR THE DIRECT

ANNEXATION OF A PORTION OF THE TOWN OF SPRINGDALE TO THE VILLAGE OF MOUNT HOREB,

DANE COUNTY, WISCONSIN”

:

Owen gave an overview. Scribner moved, Zalucha seconded to

recommend approval of Ordinance 2020-20. Motion carried by unanimous voice vote.

PUBLIC HEARING: To rezone Lot 1 CSM 14813 in Town of Springdale from A-1 Agriculture to PB

Planned Business with PD-1 Planned Development following annexation for proposed

convenience store with fueling station and carwash:

The public hearing opened at 7:05pm. Those

who spoke were Nic Owen to give a review and Brad Murphy who spoke in favor. The public hearing

closed at 7:07pm.

Consider Kwik Trip applications:

a)

Recommendation for draft Ordinance 2020-19

, “AN ORDINANCE CHANGING THE

ZONING CLASSIFICATION OF LOT 1 CSM 14813 TO PB PLANNED BUSINESS WITH PD-1

PLANNED DEVELOPMENT”

with General Development Plan:

Udelhoven moved, Scribner seconded to recommend approval of Ordinance

2020-19. Motion carried by unanimous voice vote.

Scribner moved, Zalucha seconded to recommend approval as submitted of the

General Development Plan to include the

Village Planner’s recommendations

and request that Mount Horeb Police Department offer its opinion on overnight

truck parking. Motion carried by unanimous voice vote.

b)

Design Review:

Scribner moved, Zalucha seconded to approve the design to find the proposed

design to be fully consistent with requirements of the ordinance subject to the

following waivers: the waiver to place the building within 30 feet of the

Springdale Street right-of-way, the acceptance of the design of the building

tower element, waive the prohibition of the spandrel glass and car wash doors,

waive the requirement for decorative doors, acceptance of decorative light poles

and fixtures, waiver on requirement for porous pavement, waiver on requiring

full extent of sidewalk along Ridgeview Road, requirement to add a cross walk,

acceptance to waive the requirement for a 10 foot deep planter bed. All other

requirements have been met. Motion carried by unanimous voice vote.

c)

Specific Implementation Plan:

Zalucha moved, Scribner seconded to recommend approval of the SIP to

incorporate all the flexibilities granted in the General Development Plan, Plan

Commission

’s

approval of all the Design Review requirements and waivers,

incorporates the most recent set of plans, and require the site to remain

consistent with the requirements of the Planned Zoning District. Motion carried

by unanimous voice vote.

PUBLIC HEARING: To revise Zoning Code Chart 1 Footnote 4 for zero lot line structures:

The public

hearing opened at 8:20pm. Owen gave an overview. No one else spoke. The public hearing closed

at 8:22pm.

Consider recommendation for Ordinance 2020-

18, “AN ORDINANCE TO AMEND CHAPTER 17

CHART 1 FOOTNOTE 4 OF THE CODE OF ORDINANCES RELATING TO ZERO LOT LINE STRUCTURES”:

Zalucha moved, Udelhoven seconded to table this item for further discussion. Motion carried by

unanimous voice vote.

Re: Draft Zoning Ordinance Provisions for V-Shaped Duplexes and Twin Homes

Date: January 21, 2021

At the December Plan Commission meeting, members discussed potential Zoning Ordinance

amendments to address V-Shaped duplexes and twin homes. I believe two code amendments are

necessary to implement the Plan Commission’s conclusions.

1.

Amend Chart 1: Lot, Yard and Building Requirements

Note 4: The lot adjacent to a common wall shall be 0 feet from a side yard

Building Code and Fire Code in the case of V-Shaped Duplexes and Twin Homes

Amend Section 17.20: Detailed Land Use Descriptions and Regulations

Subsection (1)(a)2. Duplex: These dwelling unit types consist of a single-family dwelling

which is attached on one side to another single-family residence. A minimum building code

required fire rated wall assembly division, separating living areas from the lowest level to

flush against the underside of the roof, and individual sanitary sewer and public water

laterals, is required between each dwelling unit. The 2 residences are located on the same

lot. These dwelling unit types may not be split into additional residences. Refer to Chart 1

for setback requirements. Refer to

§17.132

for parking requirements.

V-Shaped Duplex

: This form of duplex is constructed with the two dwelling units attached

at the front interior corner of the foundation, and with the two dwellings becoming

increasingly separated from one another as distance increases from the building front to

the building rear. The open area between the two dwellings from the attached front corner

to the rear corner of each dwelling is described as the “V-Area” – see the following

diagram. Once originally constructed, no additions to either dwelling and no outdoor

activity areas may be constructed or used within the V-Area. All other rules applying to a

duplex shall also apply to a V-Shaped Duplex.
