The School Board of the Sioux Falls School District 49-5 of Minnehaha County, South Dakota, was called into regular session, pursuant to due notice, on Monday, July 12, 2021 at 5:30 p.m. in the Instructional Planning Center, 201 East 38th Street, Sioux Falls, South Dakota, with the following members present: Nan Baker, Todd Thoelke, Vice President Carly R. Reiter, and President Cynthia H. Mickelson. Absent: Kate Parker. Dr. Jane Stavem, Superintendent of Schools, and Todd Vik, Business Manager, and Marc Murren, School Board Member-Elect, were also present.

Doug Morrison, Senior Director of Assessments, Technology, and Information Services and former School Board Member, read the following resolution:
RESOLUTION
WHEREAS, Todd Thoelke has served the Sioux Falls School District 49-5 for the past nine years, since July 2012; as a valued School Board Member, its Vice President, and President and,
WHEREAS, Mr. Thoelke has during these nine years ably served as Board Representative to the following committees: Affordable Housing Board, Budget Review Committee, PATH Committee, District Insurance Committee, Citywide PTA, Community Development Committee, Policy Review Committee, Sioux Falls Sports Authority, Safe and Secure Schools Council, Teacher of the Year Committee, Chamber of Commerce, as well as a contributing member of the City/Counties/Schools meetings, legislative liaison and on the negotiating teams for the Board; and,
WHEREAS, Todd provided outstanding leadership for Sioux Falls and the whole State of South Dakota through his tenure as the President of the Associated School Boards of South Dakota; and,
WHEREAS, Todd provided leadership and significant guidance to the District’s long-range financial planning, Five-Year Budget Plan, and was instrumental in passing the historic $190 million Capital Improvement Bond, while maintaining a high sense of fiscal responsibility and advocating strong, innovative academic programs; and,
WHEREAS, Mr. Thoelke during his tenure was instrumental and provided significant leadership during two Superintendent transitions that included national searches, interviews, and the ultimate hiring of Best In Class Leaders; .and,

WHEREAS, Mr. Thoelke encouraged a commitment to understanding and valuing diversity as well as the importance of providing multiple pathways for student success, while advocating for children with special needs; and,
WHEREAS, Todd’s commitment to excellence in education has enhanced opportunities for countless children; and his commitment to increasing involvement of citizens in the decision-making process regarding educational programs has contributed to the overall improvement of the District’s instructional program; and,
WHEREAS, Mr. Thoelke has ably served in these capacities at considerable personal sacrifice and with outstanding dedication to “placing children first” in all his decisions; whether considering budgets, boundaries, bussing, calendars, curriculum, or policies; and,
WHEREAS, we, the School Board, wish to express deep appreciation and thanks to Todd Thoelke on behalf of the members of the School Board, the administration and the entire School District;
NOW, THEREFORE, BE IT RESOLVED, that this resolution be spread upon the minutes of this meeting of the School Board of the Sioux Falls School District 49-5 held Monday, July 12, 2021, and a copy of this resolution be given to Todd Thoelke.
WHEREUPON, a motion was made by Carly R. Reiter and seconded by Nan Baker and with a majority vote of the School Board, adopting the foregoing resolution.

Todd Vik, Business Manager, administered the Oath of Office to Marc Murren as required by SDCL §13-8-14, which is filed with the Business Manager (see MRF #18689), thereby qualifying Marc Murren as a Member of the School Board. Marc Murren, thereupon, assumed the Office of Member of the School Board for a term of three (3) years, commencing with the Annual Meeting held July 12, 2021. No formal action was required since Action 38884, adopted May 24, 2021, declared Marc Murren a duly elected Member of the School Board, and the Business Manager issued a Certificate of Election to Marc Murren at that time.

A motion was made by Carly R. Reiter and seconded by Nan Baker, four (4) votes “yes” on roll call, approving the June 2021 payroll and claims to be paid as of July 12, 2021, as follows: A. Approving the payment of payroll to all employees of the District for the month of

A motion was made by Nan Baker and seconded by Marc Murren, three (3) votes “yes” and one (1) abstention (Carly R. Reiter abstained) on roll call, approving claims to Sanford Healthcare System, as follows:
A. Sanford Pentagon in the amount of $1,330.00 for dues and fees.
B. Sanford Power Center in the amount of $4,160.00 for professional services.

Todd Vik, Business Manager, acting as temporary chairperson, called for nominations for the Office of President for the ensuing year (see Action 38636, adopted 7/13/2020.) Carly R. Reiter nominated Cynthia Mickelson On roll call vote, four (4) votes were cast for Cynthia Mickelson. By majority vote, Cynthia Mickelson was elected to the Office of President of the School Board for the ensuing year. Cynthia Mickelson thereupon, assumed the Chair as President.

President Cynthia Mickelson called for nominations for the Office of Vice President of the School Board for the ensuing year (see Action 38637, adopted 713/2020). Nan Baker nominated Kate Parker for the Office of Vice President of the School Board. On roll call vote, four (4) votes were cast for Kate Parker electing Kate Parker as Vice President of the School Board for the ensuing year.

Reiter and seconded by Cynthia Mickelson, four (4) votes “yes” on roll call, appointing members of the Sioux Falls School Board (who are able) to attend the delegate assembly of the Associated School Board of South Dakota in accordance with SDCL §13-8-38 and §13-8-10.2; and authorizing School Board Members to be paid for attendance at the annual meeting; and designating Nan Baker to act as official delegate (see Action 38643, adopted 7/13/2021.)

In considering these conflicts of interest, as presented, the Board has determined that the matter underlying the contract is fair, reasonable, and not contrary to the public interest, and that it is appropriate to grant a prospective general waiver for any substantially similar contracts or transactions between the time of the authorization and the next annual disclosures date, a motion was made by Carly R. Reiter and seconded by Nan Baker, four (4) votes “yes” on roll call, approving waivers for conflict of interest from District administrators and directing the administration to send the waivers to the South Dakota Auditor General pursuant to SDCL Ch. 3-23 (see MRF #18692.)

Acknowledging the administration’s report of the study of bids which have been received during the prior 30 days and were opened, read, and tabulated in the Central Services Center—Purchasing Department and approving the bids of the lowest responsible bidders in accordance with the tabulated lists of contract awards that have been placed on file for reference purposes, as follows:1. Adopting the policies as set forth in sections A through L, inclusive of the Policy/ Regulation manuals of the District and Southeast Tech, from July 12, 2021, to the next annual meeting to be held on July 11, 2022, it being understood that the "policies are subject to revision at any time", in accordance with Policy BG; and approving Regulations as set forth in the Policy/Regulation Manual of the District for the same period of time, with the understanding that none of the regulations are contradictory to the specifics or intent of Board Policy (see Action 38648.B19, adopted 7-13-2020).
B27. Tuition Rates for 2021/2022
Approving the tuition rates for 2021/2022 as follows: a. Regular Education Tuition Rates
1. The tuition rate for in-state students transferring into the Sioux Falls School District will be received in accordance with SDCL §13-13 ($6,211). Students transferred from a school district receiving an allowance under SDCL §13-13-10.1 for having a population of less than 600 students will be charged the additional allowance. Any term less than a full year will be calculated on a pro-rata based upon a 175-day school year.
2. The tuition rate for out-of-state students transferring into the Sioux Falls School District will be $9,506 per year. Any term less than a full year will be calculated on a pro-rata based upon a 175-day school year.

Becky Dorman, Senior Director of Human Resource, presented a request for a public hearing to apply for waivers from administrative rule, as follows:
The Sioux Falls School District is requesting to apply for waivers from South Dakota Administrative Rule 24:43:02:08 – Plan of Intent for teachers employed during the 2020-21 school year. Nine teachers are impacted by these waiver requests.
24:43:02:08. Plan of Intent. Any district employing teachers or administrators who are non-certified or are serving outside their current certification shall have on file with the Department of Education a plan of intent stating how the district intends to ensure that all teachers and administrators are serving on a valid certificate in their certified areas. The Plan of Intent must be fulfilled in one calendar year. The district may request a one-time, one-year extension to the duration of the Plan of Intent to be granted at the culmination of the first year of the Plan of Intent cycle.
An approved Plan of Intent waiver allows teachers an additional year beyond the “one-time extension” described above to finish coursework or Praxis test requirements for certification in the areas of Special Education, Special Education (social sciences), Journalism, and Elementary Education within Spanish Immersion.
In most circumstances, Plans of Intent and Plan of Intent Waivers are utilized in teaching areas with limited candidate pools or employing candidates who are new to the profession or new to teaching in South Dakota. The overall number of Plans of Intent have varied depending on student coursework needs and teacher availability.

The increase in Plans of Intent over the past two years is associated with the SD Department of Education’s changes in requirements for teaching core content classes to students with disabilities. Qualifications of teachers are determined by the age (high school, middle school, elementary) and content of the course in which the students are participating. This change requires Special Education teachers to take additional Praxis exams, depending on the subjects they teach. High school Special Education teachers are most impacted by this change.
Teachers pursuing the required certification receive mentoring and support from fully certified, job-alike teachers and Instructional Coaches. The District supports teachers on Plans of Intent by funding the cost of Praxis exams and test preparation materials.

Demi Moon, Director of Middle School Curriculum and English Learners, presented an update on the results of the 2021 WIDA: ACCESS for ELLs 2.0 assessment, as follows:
The Sioux Falls School District is committed to providing the supports necessary to help each student succeed in a changing world. Immediately after enrolling, K-12 students new to the country who do not yet know English are enrolled in research-based, focused instruction to encourage language development through reading, speaking, listening, and writing.
As a member of the World-class Instructional Design and Assessment (WIDA) Consortium, the progress of SFSD English Learners is monitored with the ACCESS test for language proficiency. Test results help determine when students are ready to learn academic content without English language supports.
Of the 2614 EL students participating in the 2021 WIDA assessment, 195 students exited the EL program with a composite score of 5.0 or higher. The District will continue to support and assess English Learners to help them develop the language skills needed to be successful. The percentage of students on track to exit, based on the 2020-21 ACCESS, will be released to schools in the fall of 2021.
Following general discussion, a motion was made by Nan Baker and seconded by Carly R. Reiter, four (4) votes “yes” on roll call, acknowledging the update on the English Language Proficiency Report (see Action 38348, adopted 6/24/2019 and MRF #18703.)

The School Board began its budget process in November 2020 at which time the Board adopted guidelines and a timeline for the budget process. Between December and February, nineteen sub-committees comprised of administration, professional and classified staff, and community members developed program budgets that were presented to the Budget Review Committee, which included two Board members and representation from the sub-committees. In March, the Committee recommended a budget to present to the School Board. Board work sessions were held March 31, and April 7, at which the Board reviewed the budget. At its regular April 12 meeting, the Board conducted a public hearing and approved the tentative budget.

The budget presented to the Board is heavily influenced by the COVID pandemic that hit in the final quarter of FY20. Over $60 million in Federal funds are being expended during a four-year period on facilities, instruction, extended learning, health, remote learning, sanitization/social distancing, special education, virtual learning, and miscellaneous expenses to prepare schools for opening, staying open, learning, staying safe, and filling any gaps in learning because of the unexpected FY20 closure.
The State Aid formulas are set to increase 2.4 percent in FY22. Because over 80 percent of the District’s general fund expenditure budgets are salaries and benefits and over 80 percent of its discretionary revenues are derived from the State Aid formula, over time teacher salaries can only increase at the same rate as the formula increase. However, once again the Board has committed to increasing average salaries by 0.75 percent greater than the formula increase (3.15%) for all employee groups.
Since the tentative approval of the budget, to maintain competitive salaries in targeted areas that had fallen behind the Board further raised employee salaries as follows:
• Increased starting teacher salaries from $37,735 to $41,000 (8.7 percent),
• Increased Speech Learning Pathologist salaries by 34.8 percent for first year SLPs and 18.1 precent for those at the top of the schedule.
• Increased Education Assistant hourly pay by 12.2 percent.
To accommodate these increases, the General Fund budget increased by $1,230,340 and the Special Education budget increased by $1,605,518.
Overall, the Tax-Supported budget (General, Special Education, Capital Outlay, and Bond Redemption funds) is $279.5 million. The school levy is projected to decrease by 12 cents per $1,000 of valuation in 2022. The average school property tax increase over the last 22 years for a typical house in the Sioux Falls School District is approximately 1.7 percent per year.
