Practice

Yulchon’s International Dispute resolution (IDr) practice is one of the foremost international arbitration practices in Korea and the region generally.

Korea has traditionally encouraged the use of arbitration to resolve disputes between domestic parties. This familiarity with the arbitral process means that Korean companies and governmental organisa-tions have rapidly adopted arbitration as their preferred method to resolve international disputes. International companies investing in Korea or contracting with Korean companies are increasingly choos-ing arbitration for its perceived advantage as a neutral dispute resolu-tion forum.

Yulchon, with its long experience of advising Korean clients on mat-ters of Korean litigation and domestic arbitrations, has been at the forefront of this growth of international arbitration within Korea and the region and its use to resolve high value and complex international disputes.

Our IDr practice has advised on numerous high value international and domestic arbitrations and has experience across all the major worldwide arbitral institutions, including the Korean Commercial Arbitration Board (KCAB), the International Chamber of Commerce (ICC), the singapore International Arbitration Centre (sIAC), the China International Economic and Trade Arbitration Commission (CIETAC), the swiss rules of International Arbitration (srIA), International Centre for Dispute resolution (ICDr) as well as before ad hoc bodies under uNCITrAL rules.

This experience in Asian forums as well as before European and American institutions uniquely enables Yulchon to ensure that their clients’ rights are protected both within and outside Korea. • An ICC arbitration, sited in seoul, between a Korean municipal government and an international joint venture for a ppp. Before this arbitration was commenced, Yulchon successfully defended the client against relevant injunction proceedings before the Ko-rean court.

• A KCAB arbitration, sited in seoul, relating to a construction proj-ect between Korean and Cambodian companies.

• An ICC arbitration, sited in London, between a major us mobile technologies company and an Indonesian media company. • A CIETAC arbitration, between a Korean company and an Omani

company relating to distribution agreements.

• An arbitration before the Vietnam International Arbitration Cen-tre, sited in Hanoi, between a Vietnamese company and a joint venture comprising a Vietnamese company and a Korean com-pany regarding a dispute on real estate development.

• A KCAB arbitration, sited in seoul, between a Korean company and a us company in the entertainment sector. The arbitration was also the subject of preliminary court proceedings in California. • An ad hoc uNCITrAL arbitration, sited in seoul, between a major

Korean broadcasting company and a uK broadcasting solution provider. The dispute relates to licensing rights and international telecommunications and involved preliminary injunction cases be-fore the Korean courts.

• An ICC arbitration, sited in London, concerning a dispute be-tween a Korean telecommunications company and a south-Asian telecommunications company.

• An ICDr arbitration, sited in New Jersey, between a major Korean construction company and a us joint venture relating to breaches of a construction agreement for a project in Afghanistan.

• An ICC arbitration, sited in seoul, between a European oil and gas storage company against a Korean company in relation to a dispute over a joint venture.

• An ICDr arbitration, sited in seoul, between a Korean equipment manufacturer and a us distributor relating to distribution agree-ments.

• A sIAC arbitration, sited in singapore, between a Korean steel company and an English trading company relating to a letter of credit claim.

• A srIA arbitration, sited in Geneva, between a Korean biotech-nology company and a multinational pharmaceutical company relating to licensing.

• A KCAB arbitration, sited in Korea, between a German manufac-turer and a Korean distributor.

Young Seok Lee leads the international dispute resolution team at Yulchon. He has handled international arbitration cases in various fields of industry, including international trade, distributorship, construction, engineering, and shipbuilding. He is a member of the ICC Korea international arbitration committee, the KCAB international advisory board and the executive committee of the Korean Arbitra-tors’ Association. Mr. Lee is also a director of the Korean Council of International Arbitration. He regularly speaks on international dispute resolution and also sits as an arbitrator.

Professionals

Sae Youn Kim is a partner at Yulchon, who practices primarily in the areas of litigation and arbitration law with an emphasis on commercial and internation-al law. Before joining Yulchon, she served as a judge at various Korean district courts including the Seoul District Court, the Daejeon District Court, and the Suwon District Court. She was also an attorney at Lee & Ko for many years. Ms. Kim is currently an arbitrator at the KCAB and the KLRCA and is licensed to practice in Korea and New York.
