TIME OFF FOR TRADE UNION EDUCATION COURSES

Trade Union Representatives/Shop Stewards, Health and Safety Representatives and Union Learning Representatives have statutory rights to time off for trade union education and training courses.

The Trade Union and Labour Relations (Consolidation) Act 1992 (TULR(C)A) states ‘ Employees who are officials of an independent trade union recognised by their employer are to be permitted reasonable time off during working hours to undergo training relevant to the carrying out of their trade union duties….’

‘The training must also be approved by the Trades Union Congress or by the independent trade union….’

Time off for basic training (i.e. Stage 1 & Stage 2 Union Reps and H & S Reps) should be given as soon as possible after election or nomination as a Union Rep. Union Learning Reps should receive their basic training within 6 months of election. You or your union should notify your employer, giving prior notice of the date of the course, in good time, so you can be released from work.

The law also recognises that reps will require additional, follow on and advanced training in order to keep abreast of changes.

Your rights to time off for training can be found in the ACAS Code of Practice 3 (January 2010)

(Time off for trade union duties and activities) http://www.acas.org.uk/CHttpHandler.ashx?id=274 For more information consult your trade union official.
