Your Insurers

This Tenants Contents Insurance is arranged by: Auto Legal Protection Services with UK General Insurance Ltd on behalf of Ageas Insurance Limited, Registered in England No.354568. Registered Office: Ageas House, Hampshire Corporate Park, Templars Way, Eastleigh, Hampshire SO53 3YA.

Your Cover

If you have paid the premium as shown in the schedule, we will agree to insure you, subject to the terms, conditions and any endorsements attaching to this policy, against loss or damage or legal liability you may incur for accidents or losses occurring during the period of insurance as shown in the schedule.

Please take time to read the contents of this policy, including how to make a claim. This policy and its schedule are important documents. Please keep them in a safe place in case you need to refer to them for any reason. If you do need to discuss any aspect of this policy, please contact the agent who helped you complete this insurance.

Cancellation Cancellation

If You decide that for any reason, this Policy does not meet Your insurance needs then please return it to

Your agent within 14 days from the day of purchase or the day on which You receive Your policy

documentation, whichever is the later. On the condition that no claims have been made or are pending, We will then refund Your premium in full.

If You wish to cancel Your Policy after 14 days You will be entitled to a pro- rata return of premium. Thereafter You may cancel the insurance cover at any time by informing Your agent however no refund of premium will be payable.

The Insurer shall not be bound to accept renewal of any insurance and may at any time cancel any insurance document by giving 14 days notice in writing where there is a valid reason for doing so. A cancellation letter will be sent to You at Your last known address. Valid reasons may include but are not limited to:

a) Fraud

b) Non-payment of premium

c) Threatening and abusive behaviour

d) Non-compliance with policy terms and conditions

Provided the premium has been paid in full You will be entitled to a proportionate rebate of premium in respect of the unexpired period showing on the insurance.

Governing Law

This Policy shall be governed by and construed in accordance with the laws of England and Wales, unless the Policy holder’s habitual residence (in the case of an individual) or central administration and/or place of establishment is located in Scotland, in which case the laws of Scotland shall apply.

DEFINITIONS  

The following definitions have the same meaning wherever they appear in your policy or schedule and are highlighted in bold:

Accidental Damage

Sudden and unexpected damage, occurring at a specific time and caused by external means.

Consequential Loss

Any other costs that are directly or indirectly caused by the event which led to Your claim unless specifically stated in this Policy. For example, mobile phone calls following the theft of the phone.

Contents

Household goods, furniture, fittings, Home Entertainment Equipment, Personal Effects and Personal

Possessions including Valuables up to £2000, Money up to £150, tv aerials and masts within Your Home

which are the property of Yourself or members of Your Family permanently residing with You or for which

You are legally liable.

This definition excludes;

a) office equipment in the Home used for Your business.

b) Personal Possessions belonging to visitors or employees living in Your Home. c) mobile phones, laptops and ipads.

d) Valuables where a single item exceeds £750. e) Credit Cards.

f) Vehicles and Craft and their accessories. g) animals.

h) Deeds and documents other than driving licenses, passports or proof of age cards.

Documents and certificates relating to ownership of shares, bonds and other financial investments.

Credit Cards

Credit, Cheque, Debit, Charge or Cash Cards belonging to You or members of Your Family (held solely for private and domestic use).

Endorsement

A specific term, condition or variation to the Policy.

Excess

The first amount of any claim for which You are responsible.

Family

You, Your domestic partner and other relations that permanently reside with You. Home

The private dwelling shown in Your Policy Schedule together with its garages and domestic outbuildings.

Home Entertainment Equipment

Television, DVD, Video players and recorders, audio equipment, Home Computer equipment (excluding equipment designed to be portable), static games consoles and satellite or digital receiving boxes.

Insurers / We / Us / Our

UK General Insurance Limited, on behalf of Ageas Insurance Limited.

Money

Personal Money held for private purposes by You or Your Family including coin and bank notes used as legal tender, postal stamps (not in a collection), postal and money orders, cheques, including travellers cheques, saving and trading stamps, saving certificates and bonds, luncheon vouchers, travel tickets and gift tokens.

Period of Insurance

The period stated in the Schedule for which We agree to grant cover, providing that the full premium has been paid to Us.

Personal Effects

Clothing or other items normally carried on or about You, excluding the following:-

Valuables, Money, household goods, pedal cycles, sports equipment, camping equipment. Personal Possessions

Jewellery, Watches, Valuables, Money, household goods, pedal cycles, sports equipment, camping

equipment.

Policy

The Policy incorporates the Policy booklet, the Schedule and all terms, conditions and endorsements of Your insurance contract with Us.

Premium

The amount that You have agreed to pay Us in respect of insurance cover under this Policy as detailed within

Your Policy Schedule. Schedule

The document which provides specific details of the insurance cover in force.

Sum Insured

The amount as shown in the Schedule and being the maximum amount We will pay in the event of any claim on this Policy.

Uninsurable Risks

Wear and tear, depreciation, fungus, rot, vermin or insect damage, mechanical or electrical fault, process of cleaning, repairing, restoration, renovating or any gradually operating cause or process.

United Kingdom

Great Britain, Isle of Man, Channel Islands and Northern Ireland.

Unoccupied

Not lived in by You or without sufficient furniture and furnishings for normal living purposes.

Valuables

Articles made from precious metals, jewellery, watches, stamps, medals, Money, photographic equipment, furs,

curios, works of art and Home Entertainment Equipment.

Vehicles and Craft

Any electrically or mechanically-powered Vehicles, caravans, trailers, watercraft including surfboards, hovercraft, aircraft, all-terrain Vehicles or quad bikes, other than domestic gardening equipment, battery-operated golf trolleys or wheelchairs, battery- or pedestrian-battery-operated models or toys.

You/Your(s)/Yourself

The person(s) as specified in the Schedule and any member of Your Family, or in the event of their death, their legally appointed representative.

SECTION  1  –  CONTENTS    

We will cover Your Contents whilst in the Home against loss or damage caused by the following insured perils:

1. Fire, smoke, explosion, lightning, or earthquake.

Excluding

a) the Policy Excess

b) loss or damage caused by smog, industrial or agricultural work or any gradual process.

2. Storm or flood.

Excluding

a) the Policy Excess

b) Contents in the open.

c) loss or damage caused by frost.

d) loss or damage to domestic fixed fuel-oil tanks in the open, drives, patios and terraces, gates and fences, swimming pools, tennis courts.

e) loss or damage caused by rising water table levels.

3. Escape of water or oil from any fixed water or heating installation, apparatus and

pipes.

Excluding

a) loss or damage whilst Your Home is Unoccupied for 14 days or more.

b) loss or damage to the apparatus and/or pipes from which water and/or oil has escaped. c) loss or damage caused by gradual emission.

d) the first £250 of every claim, unless otherwise specified in the Schedule.

4. Theft or attempted theft caused by violent and forcible entry or exit.

Excluding

a) the Policy Excess

b) theft or attempted theft by any You or Your Family or any person lawfully on the property.

c) loss or damage whilst Your Home is Unoccupied for 14 days or more.

d) loss or damage to Contents within detached domestic outbuildings and garages. e) loss of any item whilst in the open.

f) loss or damage caused by deception unless deception is only used to gain entry.

5. Collision or impact by any animal, vehicle, aircraft or aerial devices and including items

dropped from them.

Excluding

a) the Policy Excess

b) loss or damage caused by domestic pets.

6. Riot, civil commotion, labour and political disturbances.

Excluding

a) the Policy Excess

b) loss or damage caused by domestic pets.

7. Malicious damage or vandalism.

Excluding

a) the Policy Excess

b) loss or damage whilst Your Home is Unoccupied for 14 days or more.

c) Malicious damage or vandalism caused by You, Your Family, or any person lawfully in Your

8. Subsidence, landslip or heave of the site upon which the Buildings stand.

Excluding

a) loss or damage caused by erosion of any coast or riverbank.

b) loss or damage caused by structural repairs, alterations, demolitions or extensions. c) loss or damage arising from faulty or defective workmanship, designs or materials. d) normal settlement, shrinkage or expansion.

e) the first £1,000 of every claim, unless otherwise specified in the Schedule. f) loss or damage that originated prior to the commencement of this insurance.

h) loss or damage caused by the movement of solid floors, unless the foundations beneath the floor are damaged at the same time and by the same cause.

i) loss or damage to Your Contents caused by the action of chemicals or by the reaction of chemicals with any material which forms part of the buildings.

9. Falling trees, telegraph poles, lamp-posts, fixed aerials, dishes and masts.

Excluding

a) the Policy Excess

b) loss or damage caused by maintenance to trees. c) loss or damage to aerials, dishes and masts.

10. Loss or damage to Deep Freezer Contents caused by a rise in temperature caused by

failure of the public gas or electricity supply or from contamination by refrigeration fumes.

Excluding

a) loss or damage from freezers over 10 years from new.

b) loss or damage caused by any deliberate act of the power supply authority or its employees. c) loss or damage occurring after Your Home has been Unoccupied for more than 14 days in a

row.

d) any amount in excess of £200

11. Costs of alternative accommodation incurred by You, as a result of Your Home

becoming uninhabitable following loss or damage caused by any of the perils 1-9 listed in Section 1 of this policy.

Excluding

a) the Policy Excess

b) any amount in excess of 15% of the Contents sum insured or up to a maximum of 12 months ground rent, whichever is the less.

b) losses insured by the landlord.

12. Costs of replacing locks for external doors to Your Home if Your keys are stolen or lost.

Excluding

a) the Policy Excess

b) losses not reported to the Police within 24 hours. c) any amount exceeding £250.

SECTION  2  –  PEDAL  CYCLE  COVER  

We will pay for theft or Accidental Damage of Your pedal cycle whilst in the UK.

Excluding

a) The first £100 of each and every claim

b) Pedal cycle accessories unless the pedal cycle is stolen or damaged at the same time c) Theft or attempted theft by You or Your Family or any person lawfully on

d) the property

e) Theft or damage whilst Your Home is Unoccupied for 14 days or more f) Theft or damage whilst within detached domestic outbuildings and garages g) Theft or damage caused by deception unless deception is only used to gain entry h) Theft from an unattended motor vehicle

i) Any theft not reported to the police within 24 hours and a crime reference number obtained j) Accidental loss

k) Damage whilst the pedal cycle is being used for racing

l) Theft whilst unattended unless in a locked building or locked to a permanent fixture m) Any amount over £500

n) Damage caused by anything that happens gradually

o) Damage caused by wear and tear, damp, vermin, fungus, cleaning, altering or repairing, restoration, mechanical or electrical breakdown, loss of value

SECTION  3  –  LAPTOP  COMPUTER  COVER  

We will pay for the loss or Accidental Damage to Your laptop computer whilst in the UK.

Excluding

a) The first £100 of each and every claim

b) Laptop computer accessories unless the laptop computer is lost or damaged at the same time c) Theft or attempted theft by You or Your Family or any person lawfully on the property d) Theft or damage whilst Your home is Unoccupied for 14 days or more

e) Theft or damage whilst within detached domestic outbuildings and garages f) Theft or damage caused by deception unless deception is only used to gain entry g) Theft from an unattended motor vehicle

h) Any theft not reported to the police within 24 hours and a crime reference number obtained i) Theft whilst unattended unless in a locked building

j) Any amount over £500

k) Damage caused by anything that happens gradually

l) Damage caused by wear and tear, damp, vermin, fungus, cleaning, altering or repairing, restoration, mechanical or electrical breakdown, loss of value

m) Theft or damage whilst being used for business

n) Depreciation in value, consequential loss or property more specifically insured by this or any other insurance

o) Loss or damage by any heating process p) Lawful confiscation by any Authority

q) The cost of replacing data and software, which has not been purchased

r) Any loss, damage, breakage or destruction to any property or consequential loss or liability directly caused by or contributed to by or arising from:

The failure or inability of any electronic equipment to correctly recognise any data, correctly capture, save, retain, manipulate, interpret or process any data information command or

instruction, whether or not such had been programmed into the equipment to correctly recognise any data, correctly capture, save, retain, manipulate, interpret or process any data information data command or instruction, whether or not such had been programmed into such equipment

Interruption of or interference with data in electronic equipment resulting in the loss destruction or corruption transmission or corruption of data.

The transmission or impact of any Virus, Worm, Logic Bomb, Trojan Horse or the like unauthorised access to a system or data for the purpose of this exclusion data means information represented or stored electronically including but not limited to code series of instructions operating systems software programs and firmware

SECTION  4  –  MOBILE  PHONE  COVER  

We will pay for the theft or Accidental Damage of Your mobile phone whilst in the UK.

Excluding

a) The first £100 of each and every claim b) Mobile phone accessories

c) The cost of unauthorised calls d) Theft from unattended motor vehicles

e) Any theft not reported to the police within 24 hours and a crime reference number obtained f) Accidental loss

g) Cosmetic damage which does not affect the operation of the handset h) Damage caused by anything that happens gradually

i) Damage caused by wear and tear, damp, vermin, fungus, cleaning, altering or repairing, restoration, mechanical or electrical breakdown, loss of value

j) Lawful confiscation by any authority

CONDITIONS THAT APPLY TO SECTIONS 1 - 4 Basis of Claims Settlement

In the event of loss or damage to Your Contents, We will replace the damaged Contents as new, provided that the sum insured is at least equal to the cost of replacing all Your Contents. At Our option, We may either pay the cost of replacing the lost or damaged item as new, or pay the cost of repairing the item or in the case of Section 3 - Laptop Computers and Section 4 - Mobile Phones replacing with an equivalent reconditioned model at Our option.

In respect of any claim made under this Policy, Our liability will not exceed the Contents sum insured on Your

Schedule.

It is your responsibility to ensure that, at all times the Contents sum insured reflects the total cost of replacement as new.

We will not pay for the cost of replacing or repairing any undamaged item(s) of the Contents of Your Home

which forms part of a pair, set, suite or part of a common design.

We will not reduce the sum insured under this section following a claim, provided that You agree to carry out

any recommendations which we make to prevent further loss or damage.

SECTION  5  -­‐  LIABILITY  

1. Tenants Liability for accidental damage to landlords fixtures and fittings for which You

are legally responsible for under the terms of Your tenancy agreement.

Excluding

a) the Policy Excess

b) any amount in excess of £2500.

b) loss or damage if Your Home has been left Unoccupied for more than 14 days. c) Malicious damage, theft or attempted theft caused by You, Your Family or any person

lawfully in Your Home.

d) Damage resulting from corrosion or normal wear or any gradually operating cause. e) Loss or damage caused by chewing, scratching, tearing, or fouling by Your domestic pets.

2. Legal liability to the public in respect of all sums for which You or a member of Your

Family permanently residing with You are legally liable, as the occupier, to pay as compensation for accidental death or injury to any person, or loss or damage to third party property, including defence costs and expenses incurred with our prior consent.

Excluding

b) bodily injury or death to any person who is engaged in Your service, or is a member of Your

Family.

c) liability arising from ownership of any land or building.

d) any claim arising directly or indirectly from the transmission of any communicable disease. d) damage to property under Your custody or control.

e) any claim arising out of any profession, occupation or business. f) any claim arising out of the ownership, possession or operation of:

i) any mechanically propelled vehicle (other than a private garden vehicle) operated within

Your Home.

ii) any power operated lift. iii) any aircraft or watercraft. iv) a caravan, whilst being towed.

v) any dogs designated as dangerous under the Dangerous Dogs Act 1991. g) any claim arising out of pollution or contamination.

h) any claim where you are entitled to indemnity under any other insurance. i) any cost or expense not agreed by Us in writing.

j) any liability for a contract that states You or Your Family are liable for something which You would not otherwise have been liable for.

GENERAL  CONDITIONS

APPLICABLE TO ALL SECTIONS OF THIS INSURANCE Consumer Insurance Act

You are required by the provisions of the Consumer Insurance (Disclosure and Representations) Act to take care

to:

a) supply accurate and complete answers to all the questions We or the administrator may ask as part of

Your application for cover under the policy;

b) to make sure that all information supplied as part of your application for cover is true and correct; c) tell Us of any changes to the answers You have given as soon as possible.

Failure to provide answers in-line with the requirement of the Act may mean that Your policy is invalid and that it does not operate in the event of a claim.

Duty of Care

You must take actions to prevent and reduce any costs, damage, injury or loss. Changes in Circumstances

You must notify Us if any of the information on which this insurance is based changes. Failure to do so may

result in Your insurance no longer being valid and claims not being paid. If in doubt about any change, please tell Us. If Your Policy is amended as a result of any change, We will be entitled to vary the Premium and terms for the rest of the period of insurance.

This Policy may be voidable in the event of failure to comply with the requirements of the Consumer

Insurance Act.

Contracts (Rights of Third Parties Act)

No person, company or entity who is not party to this policy shall have any rights to enforce any terms or conditions of this policy. This shall not affect the right or remedy of the third party that exists, or is available apart from this act.

Other Insurance

If You have any other insurance which covers the same loss, damage or liability, We will only pay Our share of any claim.

Fraudulent / False Claims

If You make any claim knowing the claim to be false or fraudulent, this insurance shall become void and all claims shall be forfeited. We have the right to notify the Police, or other relevant authority or body of any such instances or circumstances.

GENERAL  EXCLUSIONS    

APPLICABLE TO ALL SECTIONS OF THIS POLICY This Policy does not cover the following:

a) Radioactive Contamination

loss or damage to any property resulting or arising from any consequential loss, legal liability directly, or indirectly caused by, or contributed to by, or arising from:

i) ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel.

ii) the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear components.

b) War

loss or damage occasioned by the consequence of war, invasion, acts of foreign enemies, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection, military or usurped power, or confiscation, nationalisation, requisition, destruction or seizure to property under the order of any government or public or local authority or other body.

c) Terrorism

loss or damage directly or indirectly caused by, or in connection with any act of terrorism, regardless of any other cause or event.

For the purpose of this exclusion ‘terrorism’ includes the use of any destructive, or potentially destructive weapon or device, biological chemical and/or nuclear chemical and/or nuclear force or contamination and/or threat thereof by any person or group of persons, whether acting alone or on behalf of or in connection with any organisation(s) or government(s), committed for political, religious ideological or similar purposes, including the intention to influence any government and/or to put the public in fear. Losses caused by, or resulting from riot, attending a strike, civil commotion and malicious damage are not excluded hereunder.

d) Deliberate Act

loss or damage caused intentionally by You, or anyone working on Your behalf. e) Existing Damage

loss or damage occurring prior to the commencement of Your insurance cover. f) Sonic Pressure

loss or damage from pressure waves caused by aircraft, or other flying devices travelling at sonic or supersonic speeds.

g) Consequential Loss

consequential loss as a result of any claim under this Policy. For example, mobile phone calls following the theft of the phone.

h) Wear and Tear

loss or damage as a result of wear and tear, rusting or corrosion, wet or dry rot or fungus or any gradually operating cause.

i) Computer Date Recognition and Viruses

loss or damage to computer equipment caused by computer date changes and/ or computer viruses. For the purposes of this exclusion, “viruses” includes any programs or software which affects computer programs and/or functionality.

j) Motor Vehicles

loss or damage caused to any motor vehicles (other than a private garden vehicle), caravans, trailers or watercraft and/or their accessories.

k) Domestic Pets

loss or damage caused by domestic pets, insects or vermin.

UK General are an insurers agent and in the matters of a claim act on behalf of the insurer.

CLAIMS  PROCEDURE  AND  CONDITIONS    

APPLICABLE TO ALL SECTIONS OF THIS INSURANCE

If you need to make a claim under this policy, You must do the following:

a) Provide us with full details of Your claim as soon as possible after the event and always within 30 days. b) Immediately notify the police following loss or damage by theft, attempted theft, malicious damage,

violent disorder, riots or civil commotion and obtain the Crime Reference Number. c) Take all steps necessary to reduce further loss, damage or injury.

d) Provide Us with all information and evidence, including written estimates and proof of ownership and value that We may request.

e) Do not, under any circumstances effect full repairs without Our prior written consent.

f) Under no circumstances must You admit any liability or responsibility or negotiate or settle any aspect of any claim without Our permission in writing.

g) A deduction for wear and tear will be made if the Contents are not properly maintained and in a good state of repair.

h) If the sum insured for Contents at the time of loss or damage, is less than the actual cost of replacing all the Contents as new, the amount We will pay for any claim will be reduced by the proportion that the maximum amount payable bears to the full cost of replacing the Contents as new.

i) We have the right to take over the and conduct in Your name, the defence or settlement of any claim.

We may also take action in Your name at Our expense and for Our benefit in order to recover from

On receipt of a notification of a claim, We may do the following:

a) Enter any building following loss or damage.

b) Negotiate, defend or settle any claim made against You.

c) Prosecute in your name for Our benefit, any other person in respect of any claim We may have to pay. d) Appoint a loss adjuster to handle the claim on Our behalf.

e) Arrange to repair the damage to the building and/or any other property or item and handle any salvage appropriately.

It is the intention to give You the best possible service but if You do have any questions or concerns about this insurance or the handling of a claim You should follow the Complaints Procedure below:

FINANCIAL SERVICES COMPENSATION SCHEME

Ageas Insurance Limited is covered by the Financial Services Compensation Scheme (FSCS). You may be entitled to compensation from the scheme if an insurer cannot meet its obligations. This depends on the type of business and the circumstances of the claim. Most insurance contracts are covered for 90% of the claim, with no upper limit.
