Mr. Hambley offered the following resolution and moved the adoption of same, which was duly seconded by Mrs. Swedyk.

RESOLUTION NO. 21-0478

PROCLAIMING MAY 2021 AS OLDER AMERICANS MONTH AND

MAY 18, 2021 AS SENIOR DAY IN MEDINA COUNTY

WHEREAS, Medina County, Ohio, includes a growing number of older Americans who have built resilience and strength over their lives through successes and difficulties; and

WHEREAS, Medina County, Ohio benefits when people of all ages, abilities, and backgrounds are included and encouraged to share their successes and stories of resilience; and

WHEREAS, Medina County recognizes our need to nurture ourselves, reinforce our strength, and continue to thrive in times of both joy and difficulty; and

WHEREAS, Medina County can foster communities of strength by:

creating opportunities to share stories and learn from each other;

engaging older adults through education, recreation, and service; and

encouraging people of all ages to celebrate connections and resilience.

NOW, THEREFORE, BE IT RESOLVED that we, the Board of Commissioners of Medina County, Ohio, do hereby proclaim May 2021 to be Older Americans Month and Tuesday, May 18, 2021 to be Senior Day in Medina County. The Commissioners urge every resident to recognize older adults, and the people who support them as essential contributors to the strength of our community.

RESOLUTION NO. 21-0479

PROCLAIMING MAY 2021 AS COMMUNITY ACTION MONTH

WHEREAS, Community Action has made essential contributions to individuals and families across this Nation by creating economic opportunities and strengthening communities; and

WHEREAS, Community Action is a robust state and local force connecting people to lifechanging services and creating pathways to prosperity in 99% of all American counties; and WHEREAS, Community Action builds and promotes economic stability as an essential aspect of enabling and enhancing stronger communities and stable homes; and

WHEREAS, Community Action promotes community-wide solutions to challenges throughout our cities, suburbs, and rural areas; and

WHEREAS, Community Action delivers innovative services and supports that create greater opportunities for families and children to succeed; and

WHEREAS, Community Action insists on community participation and involvement ensuring that all sectors of the community have a voice and will be heard; and

WHEREAS, Community Action is celebrating 57 years of innovation, impact, and providing proven results for Amercians.

NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of Medina County, Ohio, hereby proclaims May 2021 as Community Action Month in recognition of the hard work and dedication of all Medina County Community Action Agencies.

RESOLUTION NO. 21 -0480

DETERMINING THE NECESSITY TO CLOSE

CHIPPEWA ROAD (C.H. 50) BETWEEN FRIENDSVILLE ROAD (C.H. 35) AND WESTFIELD ROAD (C.H. 15)

WHEREAS, per Section 5543.17 of the Ohio Revised Code, the Medina County Engineer has determined it necessary to close Chippewa Road (C.H. 50) in Lafayette Township, between Friendsville Road (C.H. 35) and Westfield Road (C.H. 15), on Thursday, May 13, 2021 for the replacement of Culvert No. 16B; and

WHEREAS, Culvert No. 16B is located approximately 17 east of Friendsville Road (C.H. 35);

and

WHEREAS, the Medina County Highway Department will perform the replacements under the direction of the Medina County Engineer; and

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Medina County, Ohio, that Chippewa Road (C.H. 50) will be closed on Thursday, May 13, 2021, as determined necessary by the Medina County Engineer.

DETERMINING THE NECESSITY TO CLOSE

ROOT ROAD (C.H. 58) BETWEEN CHATHAM ROAD (S.R. 162) AND SPENCER LAKE ROAD (C.H. 45)

WHEREAS, per Section 5543.17 of the Ohio Revised Code, the Medina County Engineer has determined it necessary to close Root Road (C.H. 58) in Chatham Township, between Chatham Road (S.R. 162) and Spencer Lake Road (C.H. 45), on Thursday, May 13, 2021 for the replacement of Culvert No. 1; and

WHEREAS, Culvert No. 1 is located approximately 203 feet north of Spencer Lake Road (C.H.

45); and

WHEREAS, the Medina County Highway Department will perform the replacements under the direction of the Medina County Engineer; and

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Medina County, Ohio, that Root Road (C.H. 58) will be closed on Thursday, May 13, 2021, as determined necessary by the Medina County Engineer.

DETERMINING THE NECESSITY TO CLOSE

STERLING ROAD (C.H. 43) BETWEEN BELL ROAD (T.R. 148) AND MILL ROAD (T.R. 147)

WHEREAS, per Section 5543.17 of the Ohio Revised Code, the Medina County Engineer has determined it necessary to close Sterling Road (C.H. 43) in Guilford Township, between Bell Road (T.R. 148) and Mill Road (T.R. 147), beginning Tuesday, May 11, 2021 through Wednesday, May 12, 2021 for the replacement of Culvert No. 3; and

WHEREAS, Culvert No. 3 is located approximately 680 feet north of Bell Road (C.H. 102); and WHEREAS, the Medina County Highway Department will perform the replacements under the direction of the Medina County Engineer; and

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Medina County, Ohio, that Sterling Road (C.H. 43) will be closed beginning Tuesday, May 11, 2021 through Wednesday, May 12, 2021, as determined necessary by the Medina County Engineer.

Mr. Hambley offered the following resolution and moved the adoption of same, which was duly seconded by Mrs. Swedyk.

RESOLUTION NO. 21-0483

FINDING THAT PUBLIC CONVENIENCE AND WELFARE REQUIRES THE REPLACEMENT OF BRIDGE NO. 8 ON GARVER ROAD (T.H. 177) IN CHATHAM TOWNSHIP, MEDINA COUNTY, OHIO AND AUTHORIZING THE MEDINA COUNTY

ENGINEER TO REPLACE SAID BRIDGE

WHEREAS, the Medina County Engineer has prepared and filed copies of the surveys, plans, profiles, cross-sections, estimates of costs, and specifications for the replacement of Bridge No. 8 on Garver Road (T.H. 177) in Chatham Township; and

WHEREAS, Section 5555.06 of the Ohio Revised Code authorizes the Board of County Commissioners by unanimous vote to find that public convenience and welfare requires the improvement of a public road, or part thereof, by grading, draining, paving, straightening, widening such road, and constructing or reconstructing any bridges and culverts necessary for such improvement; and

WHEREAS, the presentation of the County Engineer on this date clearly indicates need for the replacement of Bridge No. 8 on Garver Road (T.H. 177); and

WHEREAS, Section 5555.43 of the Ohio Revised Code authorizes the Board of County Commissioners by unanimous vote to order that all costs of such a construction project be paid out of any tax levies for road purposes on the grand duplicate of the County or the Township, or out of any road improvement funds available therefor; and

WHEREAS, the estimated cost of replacing Bridge No. 8 will be in excess of Fifty Thousand Dollars ($50,000.00) each; and

WHEREAS, the Board of County Commissioners has deemed it to be in the best interest of the people of Medina County to provide such work; and

WHEREAS, the Board of Commissioners of Medina County, Ohio, that the Medina County Engineer be, and is hereby authorized for the replacement of Bridge No. 8.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Medina County, Ohio, that:

A. This Board unanimously finds that public convenience and welfare requires the replacement of Bridge No. 8 on Garver Road in Chatham Township.

B. This Board unanimously votes that the costs of said improvement be paid for from appropriate road improvement funds.

C. The County Engineer is hereby ordered to immediately file with this Board, the previously-prepared surveys, plans, profiles, cross-sections, estimates of costs and specifications for the improvement herein.

D. The County Engineer is hereby ordered to advertise for bids to replace Bridge No. 8.

RESOLUTION NO. 21 -0484

DECLARING A NO PARKING ZONE ALONG PORTIONS OF

C.H. 78, KENNARD ROAD IN WESTFIELD TOWNSHIP, MEDINA COUNTY, OHIO

WHEREAS, the Medina County Engineer has been notified of and has witnessed motorists parking in both directions of Kennard Road near the intersection of T.H. 159, resulting in a single lane for two-way traffic; and

WHEREAS, the local residents have complained about motorists parking their vehicles on Kennard Road and in their yards to photograph a bald eagle nest; and

WHEREAS, the Medina County Engineer maintains this section of Kennard Road; and

WHEREAS, the Medina County Engineer believes that the practice of parking vehicles on Kennard Road at this location is causing a dangerous situation; and

WHEREAS, Section 4511.68 of the Ohio Revised Code allows for the prohibition of parking at any place where signs prohibit stopping.

NOW, THEREFORE BE IT RESOLVED by the Board of County Commissioners of Medina County, Ohio, that the installation of No Parking signs by the Medina County Engineer along a portion of C.H. 78, Kennard Road, for public convenience and welfare is necessary.

BE IT FURTHER RESOLVED that Medina County Engineer shall journalize the location of the signs with the Ohio Department of Transportation as necessary.

AMENDING THE APPROPRIATION MEASURE RESOLUTION

WHEREAS, the Board of County Commissioners adopted appropriation measure Resolution, No.

20-1065, on December 29, 2020 to provide for the current expenses and other expenditures of Medina County, and

WHEREAS, the amounts to be appropriated are within the amounts available on the Certificate of Estimated Resources, and

WHEREAS, changes in the appropriation levels are now necessary.

NOW, THEREFORE, BE IT RESOLVED by this Board of County Commissioners that it’s Resolution No. 20-1065, adopted December 29, 2020 be amended as follows:

RESOLUTION BY TRANSFERRING APPROPRIATIONS

WHEREAS, O.R.C. 5705.4 provides that any appropriation resolution may be amended or supplemented, and

WHEREAS, it has been determined that expenditures within certain appropriations will be in excess of the amount previously determined, and

WHEREAS, it has been determined that certain appropriation items are in excess of the amounts to be encumbered, and

WHEREAS, the following transfers will not reduce any appropriation below an amount sufficient to cover all unliquidated and outstanding contracts or obligations certified from or against the appropriations.

NOW, THEREFORE, BE IT RESOLVED by this Board of County Commissioners that the following transfers of appropriations be made to be effective with the passage of this resolution.

RESOLUTION NO. 21-0487

AUTHORIZING THE COUNTY AUDITOR TO TRANSFER FUNDS FOR THE COSTS OF THE COUNTY INSURANCE POLICIES

WHEREAS, the county general liability, property, and vehicle policies for the 2021-2022 policy year have been renewed, and

WHEREAS, the county general fund has paid the full cost of these policies, and

WHEREAS, the Board of County Commissioners has determined it necessary to transfer funds from various department accounts for reimbursement to the general fund for the department's share of the insurance costs, and

WHEREAS, written approval has been received from said departments authorizing the County Finance Department to implement such transfers for this service.

NOW, THEREFORE, BE IT RESOLVED by the Medina County Board of Commissioners that the County Auditor be and is hereby authorized to transfer the following funds:

RESOLUTION NO. 21-0488

AUTHORIZING THE COUNTY AUDITOR TO TRANSFER FUNDS FROM VARIOUS COUNTY DEPARTMENT ACCOUNTS TO

THE MEDINA COUNTY PRINT SHOP REVENUE LINE ITEM

WHEREAS, O.R.C. 5705.15 provides for the transfer of funds from one fund to another, and WHEREAS, the Board of County Commissioners has determined it necessary to transfer funds from various department accounts for the Medina County Print Shop services rendered during the month of April 2021, and

WHEREAS, written approval has been received from said departments authorizing the County Finance Department to implement such transfers for these services.

RESOLUTION NO. 21-0489

AUTHORIZING CASH TRANSFER FOR THE COUNTY HOME LEVY FUND

WHEREAS, funds have been appropriated in the County Home Levy Fund for the purpose of transfer into the County’s General Fund, and

WHEREAS, the transfer amount is determined by the differential of facility operating costs and total resident fee and miscellaneous revenue received on a periodic basis,

WHEREAS, sufficient tax levy revenue has been received to allow for a transfer to occur for the period of January 2021 through March 2021.

NOW, THEREFORE, BE IT RESOLVED by this Board of County Commissioners that the County Auditor be and is hereby authorized to transfer the following available cash from the County Home Levy Fund to the General Fund, as itemized below:

RESOLUTION NO. 21-0490

APPROVING THE DONATION OF A SHERIFF CRUISER TO THE MEDINA COUNTY CAREER CENTER BOARD OF EDUCATION

WHEREAS, the Board of County Commissioners declared a 2015 Ford Explorer Sheriff cruiser, vin number 1FM5K8AR9FGA78624, as excess property on resolution 21-0250 dated April 6, 2021; and

WHEREAS, the Medina County Sheriff would like to now donate this vehicle to the Medina County Career Center Board of Education for use by the Medina County Law Enforcement Academy as well as in their Criminal Justice Program; and

WHEREAS, the donation of the decommissioned cruiser with vehicle stripping and markings would also include equipment of lights, sirens, console and cage; and

WHEREAS, the Board of County Commissioners, under O.R.C. 307.12 (D), finds by resolution that regardless of the property’s value, the board may sell or donate county personal property, including motor vehicles, to the federal government, the state, any political subdivision of the state, or a county land reutilization corporation without advertising or public notification; and

WHEREAS, the Medina County Career Center Board of Education is political subdivision of the state of Ohio and is interested in accepting the decommissioned cruiser donation.

NOW, THEREFORE, BE IT RESOLVED by this Board of County Commissioners that the 2015 Ford Explorer should be donated to the Medina County Career Center Board of Education for use by the Medina County Law Enforcement Academy and Criminal Justice Program.

AUTHORIZING THE COUNTY SANITARY ENGINEER TO INVEST

THE RETAINER OF FECHKO EXCAVATING, INC. FOR THE SHARON TOWNSHIP WATER AND SEWER IMPROVEMENTS 2020 PROJECT IN AN

ESCROW ACCOUNT MCSE# SW-500/100-281.10

WHEREAS, the Board of County Commissioners of Medina County, Ohio have previously entered into a contract with Fechko Excavating, Inc. by Resolution No. 20-0320, for the construction of a sanitary force main and water mains in Sharon Township; and

WHEREAS, Section 153.13 of the Ohio Revised Code states that upon completion of 50% of the contract, as evidenced by payments to the Contractor, that all funds retained pursuant to Section 153.12 and 153.14 of the Ohio Revised Code shall be deposited in an Escrow Account designated in Section 153.63 of the Ohio Revised Code and that no further funds shall be retained; and WHEREAS, Section 153.13 of the Ohio Revised Code also provides that the funds placed in the Escrow Account shall be paid to the Contractor thirty (30) days from the date of completion and acceptance by the County along with the accumulated interest.

NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Medina County, Ohio, that:

1. The County Sanitary Engineer is hereby directed to request release of funds for Fechko Excavating, Inc., in the amount of $177,575.03 to invest in securities that would yield the best rate of interest depending on the length of time invested on the total amount determined by the Escrow Agency.

2. That said funds in the escrow account shall be made payable to the County of Medina to the benefit of the contractor for which said funds are due and shall be paid to said contractor along with the accumulated interest within thirty (30) days from the date of completion and acceptance of the work performed under this contract.

3. That the Escrow Agency shall hold the escrowed principal and income until receipt of notice from the County that the amount of the escrow principal is to be released and the person to whom it is to be released. Upon receipt of such notice, the Escrow Agency shall promptly pay such amount of principal and proportionate amount of escrow income to said contractor.

FOR THE MEDINA ROAD (S.R. 18) WATER MAIN RELOCATION PROJECT IN AN ESCROW ACCOUNT MCSE# WR-500/00-7.0.1 WHEREAS, the Board of County Commissioners of Medina County, Ohio have previously entered into a contract with X-Press Underground, Inc. by Resolution No. 20-0972 for the relocation of existing water mains that were in conflict with the Ohio Department of Transportation’s (ODOT) State Route (SR) 18 road widening project; and

WHEREAS, Section 153.13 of the Ohio Revised Code provides that upon completion of 50% of the contract, as evidenced by payments to the Contractor, that all funds retained pursuant to Section 153.12 and 153.14 of the Ohio Revised Code shall be deposited in an Escrow Account designated in Section 153.63 of the Ohio Revised Code and that no further funds shall be retained; and WHEREAS, Section 153.13 of the Ohio Revised Code also provides that the funds placed in the Escrow Account shall be paid to the Contractor thirty (30) days from the date of completion and acceptance by the County along with the accumulated interest.
