NOTICE OF THE SPECIAL MEETING OF THE BOARD OF DIRECTORS OF WARDELLE STREET TOWNHOUSES, LLC

(AN AFFILIATE OF THE SOUTHERN NEVADA REGIONAL HOUSING AUTHORITY) TO BE HELD ON THURSDAY, JULY 15, 2021 AT 12 NOON

The amount of discussion, as well as the amount of time any single speaker is allowed, will be limited to 3 minutes. Public comment that is repetitious, slanderous, offensive and inflammatory, amounts to personal attacks or interferes with the rights of other speakers is not allowed. Any person who acts in violation of these rules will be excused for the remainder of the meeting.

3. FOR DISCUSSION AND POSSIBLE ACTION: Public Hearings may be declared open by the Chairperson, as required, for any of the items on this Agenda designated for discussion and possible action. a) Approval to Grant the City of Las Vegas a Right-of-Way Easement at the Wardelle Street Townhouses

In consideration of others, avoid repetition, and limit your comments to no more than three (3) minutes. To ensure all persons equal opportunity to speak, each subject matter will be limited to twelve (12) minutes. a) Approval to Grant the City of Las Vegas a Right-of-Way Easement at the Wardelle Street Townhouses

Background: The City of Las Vegas (City) is seeking to undergo a sidewalk widening project located at the corner of Harris Avenue and Wardelle Street, which would run along the newly constructed Wardelle Street Townhouses (APN 139-25-405-011).

The City wishes to allow for easier pedestrian travel, accessibility and to ensure line of sight around the corner remains unobstructed. In an effort to be more transparent and to expedite this request the Southern Nevada Regional Housing Authority (SNRHA) seeks to grant the City a right-of-way easement at this location.

The SOUTHERN NEVADA REGIONAL HOUSING AUTHORITY1, a Nevada municipal

corporation (“Grantor”), in consideration of mutual benefit, and other valuable consideration, hereby grants and conveys unto the CITY OF LAS VEGAS, a Nevada charter city, and its successors and assigns (collectively, the “City”), a right-of-way easement (the “ROW Easement”) for public purposes as further defined herein, over, on, upon, and across a portion (the “Easement Area”) of Clark County Assessor’s Parcel Number 139-25-405-011 (the “Parcel”) and as legally described and depicted on Exhibit A and Exhibit B, respectively, and attached hereto and incorporated herein by this reference

The scope, nature, and character of the ROW Easement shall be as follows:

1. The purpose of this ROW Easement is to grant a permanent non-exclusive easement over, on, upon, and across the Easement Area for any lawful right-of-way purposes including without limitation streets, roadways, sidewalks, municipal utilities, traffic control devices, storm water facilities,

landscaping, and such other uses that the City may make of rights-of-way from time to time, now or in the future, for the use and benefit of the public, over, under, upon, and across the Easement Area. All such uses are unrestricted in location within the Easement Area and shall not be limited in any way whatsoever by the state of being, condition, or location of the street or roadway.

2. This ROW Easement shall remain in full force and effect in perpetuity, shall run with the land, and shall be binding upon the Grantor and any successor in interest to the Parcel.

3. This ROW Easement may only be amended, altered, or released only by written agreement

4. Grantee agrees that this ROW Easement is granted and accepted subject to other easements, covenants, conditions, and other matters concerning the Parcel, including without limitation, all matters of record and all matters that can be discerned by a reasonable physical inspection of the Parcel.

IN WITNESS WHEREOF, the Grantor has hereunto caused this Grant of Easement for Right-of-Way Purposes to be executed by its duly authorized representative on the date signed below.
