Wow what a difference a year makes. The ARI 1st Annual Tri-State Summit and Expo Connect 2019 was one for the record books. I could not be happier with the outcome. Special thank you to KATRA and Jim McKinney for helping to encourage Kentucky and Ohio recyclers to participate in our conference. It was great to see not only our Indiana recy-clers but Michigan, Ohio and Kentucky as well in attendance. Thank You Mary Lauria for putting together a great program with dynamic speakers. It is crucial that we continue building programs such as Tri-State Summit and Expo to bring educa-tion, networking and exposure to our industry suppliers to our members in Indiana and surrounding states. Hopefully this year will give us a platform to build on for future events. We will next be gearing up for the 2020 Legislative session soon. It has already come to my attention that there will be a few items of interest to our members being introduced soon. I have been on several calls with our scrap recycling partners to discuss their concerns with some existing laws that they would like to address in 2020. We have been in discussions with the Secretary of State and law enforcement to assure we can work harmoniously with them during the session. Have a great fall and make sure to be thankful for all our blessings. We are truly blessed to be in such a wonderful industry surrounded by caring and noble people. Thank you for allowing me to be a part of your recycling family, it is truly an honor to represent auto recyclers in Indiana. Keep recycling those original equipment manufactured parts.

• Proper Phone Etiquette and Call Management are a Must! Speak and conduct yourself always in a pro-fessional manner. Be businesslike but also be polite and personable. Always ask and address your customer by name. i.e.: “How can I help you, Joe?” not “What do you need, man?”

• Manage your time on phone calls: In most cases, a normal part request call should not exceed 3 minutes. If you are on the phone with a customer, do not lay the phone down to talk to someone else. If necessary, put the customer on hold or simply ask them if you can call them back. The same rule applies if the customer does not have all the information you need to properly quote their request.

• Respect your customer’s time: try to keep calls brief and to the point.

• Answering the phone: Give Company name, then your name and ask “How can I help you?”

• Identify your customer: Ask, “Who is calling?”

• Ask what they need. Also have a pen and notepad at hand and jot down year, make, and model so you don’t have to ask them to repeat it while you’re looking up the order.

• After they have told you what they need, look up re-quest and check previous quotes.

• If this is a shop, ask them if they have the job or if they are writing an estimate? If they say they have the job, you can now assume that they are ready to purchase the part and they probably have a price to work with. Now you can ask how soon do they need it, then you can ask, “What do you have to work with for a price?”

• If they say they are writing it (estimate), after looking up the request, still ask them when they would need it. Then give them availability, price, and delivery time.

• Control the Conversation: Try to get as much infor-mation from the customer as you can. Do not be just an “information desk.”

• When you are finished with the request, whether this is just a quote or an order, repeat the request to the customer. Do not use, “right” or “left.” Use, “Driver side” or “Passenger side.”

• When you are finished with the request, ask for the sale. Always give your customer a quote number and tell them to use this number if they call back so that it will be easier to help them.

• At the point of order, always get the VIN number for the vehicle and decode it to verify correct year, make, and model.

• As for giving a quote and requesting a VIN number, ex-plain to the customer the reason for this is to give them the right part the first time and to make it easier for them should they have to call back to order it or if you need more information from them.

• When you have idle time, check your previous quotes. Contact some of these customers to see if they still need the part; or if you find out they purchased it elsewhere, this will at least give you information (if the customer is willing to share), as to why you did not get the order.

• Lastly, make follow-up calls on previous purchases. Ask the customer if all was okay, if they were happy, and if the purchase met their expectations. Also ask, “Is there something we could’ve done better?” Ask them if there is anything else that they need while you have them on the phone. Thank them for their business.

• Remember, the salespeople that quote the most and do these fundamentals consistently are always the best performers. Also remember, doing this will keep customers coming back, and make for a better day with less drama, all which equals increased sales and fu-ture opportunities for the company.

Let’s Talk Recalls . . .

Auto Recyclers Save Lives

Congratulations to our Auto Recycling Community in the US & Canada. We have reached a milestone in the recov-ery of Defective Takata Airbags; The successful recovery and destruction of 500K airbags. We don’t know how many of that amount could have resulted in death or serious injury. More important-ly, it recognizes the efforts our industry has put forth to ensure the driving pub-lic that Auto Recyclers are aggressively identifying and removing these danger-ous airbags from circulation.

As the primary contractor for the Au-tomakers, RAS takes its responsibili-ties very seriously. RAS has committed massive resources in people, facilities, technology, marketing, logistics, sup-port, and leadership to lead this project. Providing the tools and systems to allow Recyclers to effectively and safely re-move these airbags from inventory has been paramount. We have enhanced our original desktop software with a new mobile platform for the process-ing of physical airbags, as well as our recently introduced Mobile App (nick-named the YAPP -Yard Airbag App), allowing Recyclers to capture Bounty for “Deployed” airbags without ever re-moving them from a vehicle.

A more significant number you might be interested in is 250K. That is the number of Defective Takata Airbags we are

pro-jected to process in 2019. That represents half of our total recovered bags to date, which means our path to 1,000,000 air-bags will be that much quicker.

We are grateful for the following part-ners that have led the way with inte-grations in their software that make identifying and recovering Takata air-bags more efficient. Hollander, Buddy Innovations, and URG deserve praise for their willingness to invest precious dollars in development to provide data and tools to their customers; the Auto Recyclers. Car-Part and eBay have blocked the posting of airbags that fall into the general make, model, and year ranges on their on-line platforms pro-viding protection for Recyclers.

What’s next? ARA and other industry leaders are looking to the major industry Yard Management Systems to step up to the next level of “Recalls” by develop-ing new technology for identifydevelop-ing and tracking recalled parts as part of their in-ventory process. Not all Recalls will have a Bounty attached to it, but Federal law provides stiff penalties for selling recalled auto parts and our Yard Management Systems are our first line of defense. Nearly every company with a commercial motor vehicle (powered units of more than 10,001 lbs Gross Vehicle Weight (GVW), or combined powered units and trailers of more than 10,001 lbs Gross Combined Weight (GCW) that cross-es state lincross-es must have the MCS-90 endorsement (“MCS-90”) added to its commercial automobile insurance policy. The MCS-90 is required for any commercial motor vehicle (CMV) operated by an insured with motor carrier author-ity, as well as any private carrier transporting any hazardous materials. Because “private carrier” includes any insured with a CMV of greater than 10,001 lbs GVW/GCW that hauls his or her own goods, this requirement can apply to a wide va-riety of insureds operating as private carriers, such as roofers transporting their own cut-off saw or roof cutter.

However, regulation 49 CFR §387.7 stipulates that any in-sured transporting goods in interstate commerce is required to have a MCS-90 if it hauls hazardous material. Hazardous material can be just about anything, salt water, for example in enough quantity is considered hazardous material. Further, you may never leave the state and still be required to have a MCS-90. If the load you are carrying, a pallet of shingles or insulation, originated out of your state, then you are likely in interstate commerce and subject to the regulation.

Under Federal Motor Carrier Safety Administration Regula-tion § 387.9 - Financial responsibility, minimum levels, the U.S. Department of Transportation lists gasoline as a hazard-ous material. The regulation requires for-hire and private mo-tor carriers transporting any quantity of oil in interstate or foreign commerce to have a minimum $1,000,000 of finan-cial responsibility coverage. The Clean Water Act of 1973, as amended, declares that gasoline is oil. The $1,000,000 coverage also applies to for-hire and private motor carriers transporting gasoline in bulk in intrastate commerce. Conse-quently anyone hauling a cut-off saw or a generator in a Ford F-350 or a Ford F-150 with a trailer, and crossing state lines, is likely required to carry a MCS-90 Endorsement showing $1 million combined single coverage limit on their policy. Failure

to have the coverage form or the required minimum limit can expose your company to fines of up to $11,000 per day. The federal motor carrier safety regulations (49 CFR §390.5) define ”interstate commerce” as: trade, traffic, or transporta-tion in the United States that is between a place in a state and a place outside such state or is between two places in a state through another state or a place outside the United States. Simply stated, interstate commerce involves at least one state and another state or foreign jurisdiction.

Several courts have held that vehicles that never leave the state were involved in interstate transport where the goods being transported would ultimately enter interstate com-merce, and under the circumstances of those cases, the MCS-90 applied. The DOT and/or the courts are

ing the requirement for both a USDOT number and the MCS-90 for insureds that do not leave the state but transport items that were obtained from, or will eventually be shipped, out of state. The MCS-90 endorsement does not, in fact, offer any additional coverage. It is a federally mandated form that guar-antees financial responsibility for loss caused to the general public or the en-vironment, such as for pollution clean-up. For instance, with the MCS-90, the insurance carrier is guaranteeing pay-ment of damages or cleanup costs up to that endorsement limit extends to a pollution incident, even if you have no pollution coverage. However, the MCS-90 also gives the insurance carrier the right to seek reimbursement from you for any damages or cleanup costs for which you do not otherwise have coverage.

Bottom line is that the federal govern-ment regulations apply countrywide (and 32 states have adopted even more

restrictive registration laws requiring a USDOT number for all vehicles regis-tered in those states.) Under the “inter-state commerce” definition, all insureds with commercial motor vehicles (over 10,001 GVW/GCW) will be subject to the requirement for both a USDOT number and a MCS-90 endorsement. The “materials of trade” exception (49 CFR §173.6) applicable to transporta-tion of small quantities of certain haz-ardous materials does not apply to the need for the MCS-90; that exception basically applies only to the placarding portion of the hazardous material regu-lations.

If you need a USDOT number, you can go to http://www.fmcsa.dot.gov/forms/ print/r-l-forms.htm and complete the MCS-150 form. Per those instructions, you can apply for the USDOT number online, in a minimum amount of time and cost. The majority of the real work comes after you get the USDOT num-ber in keeping your driver qualification files updated.

ARA recently updated its advocacy toolkit on OEM repair procedure legislation. The issue is expected to dominate the 2020 state legislative agenda again next year and ARA is urging members to remain vigilant and familiarize themselves with the ARA talking points on the issue.

New Damage Codes for Rear and Front Bumper ARA wants to make sure all members are aware of the new damage codes for rear and front bumpers, published this year by the Educational Foundation.

ARA is proud that we have a direct approach to defining what we have done for so many years.
