TERMS AND CONDITIONS IMPORTANT

Please read very carefully the terms and conditions herein and only use your AEON Credit Service (M) Berhad VISA Card or Master-Card if you are agreeable to the terms and conditions herein. By using your Master-Card, you shall be deemed to have accepted the terms and conditions herein and shall be bound by them.

GENERAL

In consideration of AEON Credit Service (M) Berhad (Co. No 412767-V), Kuala Lumpur (hereinafter called “AEON Credit”) agreeing to make available to the Cardmember (as herein defined) at the Cardmember’s request the following facilities (collectively, the “Facilities”) offered in connection with the use of the AEON VISA Card and/or AEON MasterCard (hereinafter referred to as “the Card”):

i. any payment for the purchase of goods and/or services which payment shall be charged to the Card Account (as herein defined);

ii. any cash advance which shall be debited to the Card Account;

iii. any other facilities as may be offered by AEON Credit from time to time, subject to prior arrangement with AEON Credit The Cardmember hereby agrees to the following terms and conditions:

1. DEFINITIONS

1.1 In this Agreement where the context so admits the following expressions shall have the following meanings unless otherwise provided:

1.1.1 the expression “additional charges” shall mean the additional charges referred to in Clause 13.1 hereof;

1.1.2 the expression “AEON Credit” means AEON Credit Service (M) Berhad, P.O. Box 12754, 50788 Kuala Lumpur and includes its successors-in-title and assigns;

1.1.3 the expression “AEON Credit Auto-Payment” means the payment service provided by AEON Credit whereby the

Cardmember authorizes AEON Credit to settle the Bill(s) presented by the Service Provider to AEON Credit by debiting Cardmember’s Card Account. The methodology of this service is more particularly described in the terms and conditions governing the use of AEON Credit Auto-Payment Service, attached herein as Appendix 2.

1.1.4 the expression “ATM” means automatic teller machine including cash deposit machines;

1.1.5 the expression “Bills(s)” means the periodic bill(s) issued by the Service Provider(s) to persons (natural or otherwise) who have subscribed for the provision of utilities or services from the Service Provider(s).

1.1.6 the expression “Card” means the VISA Card and/or the MasterCard, or both issued by AEON Credit to the Cardmember and shall include Co-brand Card issued in affiliation or association with any third party and/or under any product or select names or references and also includes Supplementary Cards;

1.1.7 the expression “Card Account” means the Cardmember’s VISA Card account and/or the Cardmember’s MasterCard account, as the case may be, to which AEON Credit shall charge all sums as may be incurred by the Cardmember from the use of the Facilities including all interest, fees and charges payable in respect thereof;

1.1.8 the expression “Cardmember” means the individual named on the Card and includes his/her personal representative; 1.1.9 the expression “Co-brand Card” means any VISA Card or MasterCard issued solely by AEON Credit or jointly by AEON Credit and any body(ies) or corporation(s) as the case may be with whom AEON Credit has a joint agreement, scheme or programme for the issuance of the said Co-brand Cards. The terms and conditions governing the use of Co-brand Card is described herein in Appendix 3.

1.1.10 the expression “Credit Limit” means the credit limit granted by AEON Credit to the Cardmember;

1.1.11 the expression “Current Balance” means the full amount shown as due in the Statement or in any other written notice communicated to the Cardmember by AEON Credit;

1.1.12 the expression “Directory” means the Card welcome pack which the Cardmember shall receive when the Card is issued to the Cardmember;

1.1.13 the expression “Finance Charge” means the finance charge referred to in Clause 14 hereof;

1.1.14 the expressions “Handling Charge” and “additional charges” means the handling charge referred to in Clause 13.1(c) hereof; 1.1.15 the expression “Late Payment Charge” means the late payment charge referred to in Clause 15 hereof;

1.1.16 the expression “MasterCard International” means MasterCard International Incorporated, a company registered as per the laws of Delaware, U.S.A. and whose office is situated at 2000 Purchase Street, Purchase NY 10577-2509 and includes its successors-in-title and assigns;

1.1.17 the expression “Merchant” means any merchant supplying goods and services;

1.1.18 the expression “Payment Due Date” means the date by when the Cardmember has to settle the Specified Minimum Payment or the Current Balance and as specified in the Statement;

1.1.19 the expression “PIN” means the personal identification number of the Cardmember being a number code by which the services available from an ATM of AEON Credit or any bank or institution with whom AEON Credit has an arrangement for the use of the ATM of the said bank or institution can be accessed when using the Card;

1.1.20 the expression “Reward Points” means the points awarded to the cardmember under AEON Reward Points Programme. The terms and conditions governing the use of Reward Points is described herein in Appendix 4.

1.1.21 the expression “Service Provider” means any corporation or party which has entered into an agreement with AEON Credit to allow payment of Bill(s) by Subscriber(s) who are also Cardmember(s) through AEON Credit Auto-Payment or any

payment method as assigned by AEON Credit.

1.1.22 the expression “Specified Minimum Payment” means the highest of the payments required to be made by the Cardmem ber under Clause 14.1 hereof;

1.1.23 the expression “Statement” means the monthly AEON VISA Card Statement and/or the AEON MasterCard Statement issued by AEON Credit to the Cardmember which shows inter alia the amount so charged and the Payment Due Date; 1.1.24 the expression “Subscriber” means any person (natural or otherwise) subscribing to the goods or services provided by the Service Provider(s) and or their respective representative(s).

1.1.25 the expression “Supplementary Card(s)” means the additional card(s) issued by AEON Credit to the Supplementary Cardmember(s) nominated by the Cardmember and approved by AEON Credit;

1.1.26 the expression “Supplementary Cardmember(s)” means the individual nominated by the Cardmember to be an additional cardmember(s) and who has/have been issued a Supplementary Card(s) by AEON Credit;

1.1.27 the expression “VISA International means VISA International Service Association, an association incorporated in the

State of Delaware, United States of America with its registered office at 900, 901, 800, Metro Center Boulevard, Foster City, CA 94404-2172, United States of America of which AEON Credit is a member institution and includes its successors-in-title and assigns.

1.2 The headings herein are inserted for ease of reference only and shall be ignored in construing the terms and conditions herein.

2. SUPPLEMENTARY CARD

2.1 AEON Credit may in its absolute discretion and at the request of the Cardmember issue the Supplementary Card(s) to the Supplementary Cardmember(s). All the terms and conditions herein except this Clause 2 and Clause 20 shall apply mutatis mutandis to the Supplementary Cardmember(s) and the Supplementary Cardmember(s) may be subject to such other terms and conditions as AEON Credit may deem necessary.

2.2 The Cardmember shall be liable to AEON Credit for all sums and payments due and owing to AEON Credit howsoever arising from the use of both the Card and the Supplementary Card(s) but each of the Supplementary Cardmember(s) shall only be liable to AEON Credit for all sums and payments due and owing to AEON Credit howsoever arising from the use of his own Supplementary Card.

2.3 AEON Credit reserves the right to disclose any information pertaining to the Supplementary Cardmember to the Cardmember, including but not limited to transaction data and outstanding amount data on the Supplementary Card(s). 2.4 The validity of the Supplementary Card(s) is dependent upon the validity of the Card. Upon termination of use the Card or the Cardmember’s agreement with AEON Credit for whatever reason, the use of the Supplementary Card(s) issued there under shall also be terminated. Termination of the use of the Supplementary Card(s) or the Supplementary

Cardmember(s)’ agreement with AEON Credit for whatever reason on the other hand shall not terminate the Card or the Cardmember’s agreement with AEON Credit.

3. EVIDENCE OF AGREEMENT

3.1 Upon receipt of the Card, the Cardmember shall sign the Card immediately and such signature and/or the use of the Card shall constitute binding and conclusive evidence of the Cardmember’s agreement to be bound by the terms and conditions herein.

4. USE OF PIN

4.1 The PIN shall be issued and delivered to the Cardmember at the Cardmember’s own risk.

4.2 The PIN is strictly confidential and shall not be disclosed to any other person under any circumstances or by any means whatsoever whether voluntarily or otherwise.

4.3 The Cardmember shall not keep any written record of his/her PIN in any place or manner which may enable any third party to make use of the Card.

4.4 Once the Cardmember receives the PIN it is the responsibility of the Cardmember to ensure that the PIN is not made known to or easily discovered by any other person as AEON Credit shall not in any way be liable if the PIN is made known to or discovered by any third party. The Cardmember shall hold AEON Credit free from all claims and liabilities from all parties whomsoever arising from the use of the PIN whether authorised or otherwise.

5. DISCLOSURE OF PIN, OR LOSS, THEFT OR UNAUTHORISED USE OF CARD

5.1 It is a fundamental condition that the Cardmember shall use all reasonable precautions and diligence to prevent disclo sure of the PIN to any unauthorised person, or loss, theft or unauthorised use of the Card. This shall include but not be

limited to measures such as frequent changes of the PIN by the Cardmember and avoidance by the Cardmember to use values for the PIN number which may be easily guessed or discovered by others e.g. date of birth etc.

5.2 The disclosure of the PIN to any unauthorised person, or loss, theft or unauthorised use of the Card shall immediately be reported by phone call or fax to AEON Credit, followed by a written letter to AEON Credit. The Cardmember shall also immediately lodge a full and truthful police report upon the occurrence of such event and deliver a copy of the relevant police report to AEON Credit promptly and in any case no later than two (2) days from the happening of such event unless the Cardmember is overseas.

5.3 All charges arising from all transactions effected through the use of the Card whether authorised or otherwise including all cash withdrawals and advances shall be deemed to have been made by the Cardmember and the

Cardmember shall be liable for all such charges once the Card has been delivered to the Cardmember and for the purposes of this Clause, AEON Credit’s records of any transaction effected through the use of the Card shall be conclusive and binding upon the Cardmember.

5.4 Upon receipt by AEON Credit of a written notice of loss or theft of the Card from the Cardmember in accordance with Clause 5.2 thereof,

the Cardmember’s maximum liability for any unauthorized transactions undertaken by any third party with the lost or stolen Card shall be limited to a sum not exceeding RM250.

5.5 Without prejudice to the rights of AEON Credit herein and notwithstanding that the Cardmember may have exercised all reasonable precautions and diligence to prevent the loss or theft of the Card and reported the loss or theft in accordance with Clause 5.2 hereof, the Cardmember shall remain liable to pay to AEON Credit in the following circumstances: (a) the Cardmember has acted fraudulently in that he was involved in the procurement of goods or services supplied by any merchant or cash advances effected through the use of the Card by any person; or

(b) the Cardmember has failed to inform AEON Credit as soon as reasonably practicable upon discovering that the Card has been lost or stolen.

5.6 When a lost or stolen Card is found, the Cardmember shall not use the Card so retrieved but shall return the same, cut into half, to AEON Credit immediately upon the retrieval of the Card.

5.7 Although AEON Credit is under no obligation to issue a replacement card, AEON Credit may do so subject to payment of such fee as may be prescribed by AEON Credit.

6. CARD IS THE PROPERTY OF AEON CREDIT

6.1 The Card is and shall at all times remain the property of AEON Credit and shall be surrendered to AEON Credit immediately upon request by AEON Credit or its duly authorised agent.

6.2 Upon the expiry of the Card, the Cardmember shall immediately surrender the expired Card to AEON Credit and request for the issuance of a new Card which shall be entirely at the absolute discretion of AEON Credit whether to do so.

7. CARD SHALL NOT BE TRANSFERRED OR PLEDGED

7.1 The Card shall not be transferable and shall be used exclusively by the Cardmember. 7.2 The Card shall not be pledged by the Cardmember as security for any purpose whatsoever. 8. CARD SHALL NOT BE USED FOR UNLAWFUL ACTIVITIES

8.1 The Card shall not be used for any unlawful activities such as illegal online betting. 9. TRANSACTIONS WITH MERCHANTS

9.1 AEON Credit shall be entitled to disclose to any merchant to whom the Card may be presented or any member institution of VISA International and/or MasterCard International, the Cardmember’s Account number and any other information

which may be necessary to facilitate the use of the Card or the processing of any transaction effected or to be effected through the use of the Card.

9.2 Without prejudice to Clause 9.1 hereof, AEON Credit shall not be responsible for the refusal of any merchant or member institution of VISA International and/or MasterCard International to honor or accept the Card or for any defect or deficiency in the goods or services supplied to the Cardmember by any merchant. Any complaint by the Cardmember must be resolved directly with the merchant or member institution of VISA International and/or MasterCard International concerned and no claim against the merchant or member institution of VISA International and/or MasterCard

International shall entitle the Cardmember to set-off or counterclaim against AEON Credit or to withhold payment to AEON Credit on account of any such complaint or under any circumstances whatsoever.

10. USE OF ATM FACILITY

10.1 Any ATM deposits effected through the use of the Card on any ATM installed by AEON Credit, whether by cheques or by cash, shall be subject to verification by two senior officers whom AEON Credit may in its absolute discretion appoint and authorise. The amount so verified by the said two senior officers of AEON Credit shall be deemed to be the correct amount of the deposits so effected. Cheque deposits shall only be available for use after the cheques have been collected and cleared. The statement issued by the ATM at the time of the purported deposit shall only be confirmation that a deposit has been so made but shall not be proof of the amount purported to have been deposited.

10.2 The amount reflected on the ATM screen against the Card Account shall not for any purpose whatsoever be taken as a conclusive statement of the Card Account with AEON Credit as it may not include deposits made to account of the Card Account which have not been verified by AEON Credit.

10.3 The exchange rate for all inter-country transactions effected via the ATM shall be the prevailing exchange rate as deter mined by AEON Credit at its sole discretion as at the date of entry into the Card Account. All inter-country transactions by the Cardmember via ATM shall not violate the laws existing in the country where the transactions are done.

11. CASH ADVANCE FACILITY, FINANCE CHARGE AND CONVERSION FOR OVERSEAS TRANSACTION

11.1 The Cardmember may obtain cash advances in such amount as may be decided by AEON Credit from time to time at its absolute discretion, by the following means:

(a) presenting the Card at any office of AEON Credit or of any member institution of VISA International and/or MasterCard International together with evidence of his/her identity card and signing the necessary transaction record; or

(b) using the Card at any ATM of AEON Credit or any other bank or institution with whom AEON Credit has an

arrangement(s) for the use of the ATM of the said bank or institution (in which case the amount of each advance will be further subject to the applicable daily withdrawal limit imposed by such other bank or financial institution).

11.2 The use of the Card by the Cardmember to obtain a cash advance shall be deemed to constitute agreement of the

Cardmember to pay interest on each cash advance and a fixed cash advance fee as may be prescribed by AEON Credit from time to time in the manner set out in this Clause.

11.3 Finance Charge shall accrue on each cash advance from the date of the advance until repayment in full at the current rate of 1.5% per month (or 18% per annum) or such other rate as AEON Credit may prescribe from time to time.

11.4 A fee of 5% or such other rate as AEON Credit may prescribe from time to time shall be imposed on the amount of each cash advance (subject to a minimum of RM15.00) and charged to the Card Account.

11.5 Any transaction performed at casinos, betting outlets or similar outlets permitted by law shall be deemed to be cash advance and not as retail purchase.

11.6 The conversion rate as determined by VISA International/MasterCard International plus service charge 1.5%. 12. USE OF INTERNET TRANSACTIONS FACILITY

12.1 If Cardmember uses the Card to purchase good and/or services through the online internet sites or portals, Cardmember shall be solely responsible for the security of such use at all times. Cardmember agrees that the entry of the Card

information on the internet shall be sufficient proof or the authenticity of such instructions. AEON Credit shall not be under any obligation to verify the identity or the authority of the person entering the Cardmember’s Card information and AEON Credit shall not be liable for acting on such use of the Card information regardless of whether the person is authorized or unauthorized and regardless of the circumstances prevailing at the time of transaction. However, AEON Credit reserve the discretion to not carry out any such transaction over the internet if AEON Credit has any reason to doubt its authenticity or if in AEON Credit’s opinion it is unlawful or otherwise improper to do so for any other reason.

13. AEON CREDIT’S RIGHT TO CHARGE FEES AND/OR CHARGES

13.1 Immediately upon a demand being made by AEON Credit, the Cardmember shall pay AEON Credit the following: (a) an entrance fee as may be prescribed by AEON Credit for the issuance of the Card;

(b) an annual fee as may be prescribed by AEON Credit for each renewal of Card;

(c) a handling charge as may be prescribed by AEON Credit for the issuance of a replacement Card,

(d) a handling charge as may be prescribed by AEON Credit for the issuance of card conversion requested by Cardmember (e) a sales investigation fee as may be prescribed by AEON Credit for dispute raised but found to be invalid;

(f) an Early 0% Card Easy Payment settlement may be prescribed by AEON Credit as an early settlement penalty fee. (g) a credit balance refund fee may be prescribed by AEON Credit as a processing fee for balance refund;

(h) an over limit penalty fee may be prescribed by AEON Credit as penalty charge for utilizing credit above the limit awarded.

13.2 All fees paid pursuant to or in connection with the Card are non-refundable under any circumstances whatsoever. 14. SERVICE TAX

14.1 Service Tax fee of RM50 for Principal Card and RM25 for Supplementary Card will be charged on every anniversary month. 15. MINIMUM PAYMENT AND FINANCE CHARGE ON RETAIL TRANSACTIONS

15.1 The Cardmember may choose not to settle the Current Balance in full, in which case the Cardmember shall on or before the Payment Due Date, pay to AEON Credit the Specified Minimum Payment which is calculated as follows:

(a) if the Current Balance does not exceed the Credit Limit, 5% (rounded up to the nearest ringgit) of the Current Balance or RM50.00 whichever is greater; or

(b) subject to Clause 20.1 hereof, if the Current Balance exceeds the Credit Limit, the sum specified in Clause 15.1(a) hereof and the excess over the Credit Limit.

15.2 Subject to Clause 20.1 hereof, if the Specified Minimum Payment amount shall be unpaid or unpaid in full or is paid after the Payment Due Date, AEON Credit shall impose Late Payment charge(s) as stated for Clause 16 hereof, until the Specified Minimum Payment is paid in full and/or may allow the Cardmember to pay:

(a) if the Current Balance does not exceed the Credit Limit, the current Specified Minimum Payment and the unpaid previous Specified Minimum Payment amount; or

(b) if the Current Balance exceeds the Credit Limit, the current Specified Minimum Payment and the excess over the Credit Limit and the unpaid previous Specified Minimum Payment amount.

15.3 That all retail transactions (as opposed to cash advance transactions) charged to the Card Account shall be allowed an interest free period of 20 days from the posting date of such transaction if the statement from the previous month is fully settled by due date.

15.4 Subject to clause 15.3 hereof, then a finance charge at the prescribed rate calculated on the daily basis shall be charged on the Current Balance as from the date of the Statement until the first repayment is credited to the Card Account and thereafter on the reduced balance. For the purposes of this clause, “prescribed rate” for retail transactions shall be charged accordingly to the below ‘Tiered Interest Rate Structure” (Effective 11th April 2009) as set out below:

15.5 All finance charges on Retail Transaction before 11th April 2009 will be calculated based on the previous Tier Interest Rate released on 1st July 2008.

15.6 Where Cardmember opts to pay partial or minimum payment or fails to make any payment by the payment due date in respect of the previous statement, the finance charges as per the applicable Tier Rate Structure shall be calculated from

the day the new retail transactions are posted to the card account in the current statement period. 16. LATE PAYMENT CHARGE

16.1 A late payment charge of 1% of the current balance or RM5.00 whichever is higher, up to a maximum value of RM75 (or such other rate as AEON Credit may in its absolute discretion deem fit to impose from time to time) shall be imposed in the event the Cardmember fails to pay the Specified Minimum Payment by the Payment Due Date.

17. EVIDENCE OF INDEBTEDNESS 17.1 AEON Credit shall be entitled to rely:

(a) any sales draft, transaction record, credit voucher, cash disbursement draft and/or other charge record bearing the imprint or other reproduction of embossed information contained on the Card and duly completed, and/or

(b) any of AEON Credit’s records of cash advances or any other transactions effected by the use of the Card including but not limited to transactions effected via mail order or via telephone;

as conclusive evidence of a debt properly incurred by the Cardmember and shall be debited to the Card Account and reflected in the Statement.

17.2 Such debts if incurred in a currency other than the billing currency shall, before being debited to the Card Account, be converted into the billing currency at such rate of exchange as may be determined by AEON Credit in its absolute discretion as at the date of entry into the Card Account.

17.3 All payments for purchases of goods and/or services and cash advances effected by the use of the Card and all annual fees, handling charges, additional charges, finance charges, late payment charges and all other charges and interest shall be debited to the Card Account in the billing currency and shall be reflected in the Statement.

17.4 The Cardmember agrees that the records of AEON Credit of any transaction effected through the use of the Card shall be conclusive and binding on the Cardmember for all purposes unless otherwise provided.

18. EXCESS OF CREDIT LIMIT

18.1 The Cardmember shall and undertakes that he/she shall not utilise the Card such that the aggregate outstanding amount owing to AEON Credit in respect of the Card exceeds the Credit Limit unless the prior written approval of AEON Credit is obtained.

18.2 In the event the Credit Limit is exceeded, the Cardmember shall in addition to the amounts payable under Clause 15 hereof, forthwith pay to AEON Credit upon demand the excess amount in full failing which the use of the Card shall be deemed terminate and the provision relating to termination in Clause 21.1 shall henceforth apply.

19. PAYMENTS

19.1 All payments to AEON Credit shall be made in the billing currency.

19.2 Payments by the Cardmember to AEON Credit shall not be considered as having been made until the relevant funds have been received by AEON Credit and entered into AEON Credit’s computer generated records on the day following receipt of payment by AEON Credit. Subject to the discretion of AEON Credit to waive the foregoing provisions, the said provisions shall also for the purposes of determining the Cardmember’s available Credit Limit.

19.3 All payments made by the Cardmember to AEON Credit whether by direct debit to the Cardmember’s Card Account or otherwise shall be applied in the following order:

(a) in or towards payment of fees and charges (excluding (b) below); (b) in or towards payment of all outstanding interest or finance charges;

(c) in or towards payment of all outstanding cash advances and purchases from prior month(s) Statements; and finally (d) in or towards payment of cash advances and purchases stated in the Statement for the current month.

19.4 Where the Cardmember has executed instruction for any amounts due on the Card Account(s) to be paid through direct debit or auto debit facilities provided by any domestic bank in Malaysia, the Cardmember irrevocably authorises AEON Credit to submit billing data to the bank for deduction of the amount due on the Card Account from the Cardmember’s bank account on the Payment Due Date.

20. EVENTS OF DEFAULT

20.1 Upon the occurrence of any of the following events :

(a) if any sums shall be due from the Cardmember to AEON Credit at any time under the Card Account; (b) if the Cardmember’s payment due to AEON Credit shall be overdue on any other account(s); (c) if the Cardmember shall breach the terms and conditions herein or any part thereof;

(d) if the Cardmember shall use the Card for any unlawful activities such as illegal online betting; (e) leave Malaysia to take up residence elsewhere;

(f ) if the Cardmember shall die;

(g) if the Cardmember shall be adjudged bankrupt;

(h) if the Cardmember shall be unable to pay his/her debts as they fall due or become insolvent; (i) if the Cardmember’s whereabouts shall be unknown to AEON Credit;

(j) if the Cardmember shall be desirous of terminating the use of the Card;

(k) if AEON Credit shall in its absolute discretion refuse to issue a replacement card or renew the Card; or (l) if AEON Credit shall in its absolute discretion decide to cancel or terminate the use of the Card;

then, the use of the Card shall be terminated forthwith and the whole outstanding balance on the Card Account shall become immediately due and payable to AEON Credit by the Cardmember and all further monies credited to the Card Account after the date of such termination including all interest, fees and charges shall become due and payable upon its entry into the Card Account. The Cardmember shall continue to be bound by the terms and conditions herein notwithstanding the termination of the card by AEON Credit for any reason.

20.2 In the event AEON Credit obtains judgment for any sum due hereunder, any interest, finance charge, late payment charge or any other charges payable in respect thereof shall continue to be payable from the date of judgment until the date of full payment of such sum of money so adjudged to be payable to AEON Credit.

20.3 Any breach or default by the Cardmember in respect of a Card Account, shall result in a breach or default by the Cardmember in respect of any other Card Account of the Cardmember. For the avoidance of doubt, in the event of a breach or default by the Cardmember in respect of a Card Account giving rise to remedies hereunder in favour of AEON Credit in respect of such Card Account, AEON Credit shall further be entitled to invoke such remedies in respect of any other Card Account of the Cardmember.

21. CONSOLIDATION OF ACCOUNTS FOR CREDIT FACILITIES & SET-OFF

21.1 In addition to any general right of set-off or other rights conferred by the law on AEON Credit, AEON Credit shall in its absolute discretion at any time and without notice be entitled to combine or consolidate all or any accounts of the Cardmember for credit facilities with AEON Credit of whatever description and wheresoever located and whether in Ringgit Malaysia or in any other currency or set-off or transfer any sums standing to the credit of any such account(s) including a joint account with a Supplementary Cardmember in or towards discharge of all sums due to AEON Credit under any account(s) of the Cardmember with AEON Credit of whatever description and wheresoever located and whether in Ringgit Malaysia or in any other currency, and may do so notwithstanding that the balances on such account(s) and the sums due may not be expressed in the same currency, and the Cardmember hereby authorises AEON Credit to effect any such combination consolidation set-off or transfer with the necessary conversions at AEON Credit’s prevailing exchange rates which shall be determined by AEON Credit at its sole discretion.

22. SUSPENSE ACCOUNT

22.1 For the purposes of enabling AEON Credit to preserve intact the liability of any party including the Cardmember once a writ or summons has been issued or to prove in AEON Credit bankcruptcy or insolvency of the Cardmember or for such other reasons as AEON Credit deems fit AEON Credit may at any time place and keep for such time as AEON Credit may think prudent any monies received, recovered or realised hereunder or under any other security or guarantee to the credit of the Cardmember as AEON Credit shall think fit without any intermediate obligation on the part of AEON Credit to apply the same or any part thereof in or towards the discharge of the sums due and owing to AEON Credit.

23. CARD TERMINATION BY CARDMEMBER

23.1 The Cardmember may at any time after acceptance and/or usage of the Card, terminate the use of the Card by a written notice to AEON Credit and returning the Card into half to AEON Credit. Upon AEON Credit’s receipt of the Card shall be deemed terminated and the provision relating to termination in Clause 20.1 shall henceforth apply.

24. VARIATION REVISION OR CHANGE OF TERMS AND CONDITIONS

24.1 AEON Credit may from time to time by giving written notice to the Cardmember vary, revise or change the terms and conditions herein including but not limited to the terms of payment, rates and/or method of calculation of annual fee, handling charge, the additional charges, finance charge, the specified minimum payment and late payment charge. Such variation, revision or change shall apply on the effective date specified by AEON Credit and shall apply to all outstanding balance in the Card Account.

24.2 Retention or use of the Card after the effective date of any variation, revision or change of terms and conditions pursuant to Clause 24.1 hereof shall be deemed to constitute acceptance of such variation, revision or change without reservation by the Cardmember.

24.3 If the Cardmember does not accept the proposed variation, revision or change, the Cardmember must terminate the use of the Card by giving prior written notice to AEON Credit and return the Card cut into half to AEON Credit prior to the effective date and the use of the Card thereafter shall be deemed terminated upon AEON Credit’s receipt of the Card cut into half and the provision relating to termination in Clause 20 hereof shall henceforth apply.

25. AEON CREDIT’S RIGHT TO WITHDRAW ANY FACILITIES OR TERMINATE USE OF CARD

25.1 AEON Credit reserves the right to withdraw, at its absolute discretion, all or any of the Facilities at any time with or without notice and without assigning any reasons for it, and in such circumstances if it so deems fit to terminate use of the Card notwithstanding that AEON Credit may have waived its rights on some previous occasions.

26. AEON CREDIT’S RIGHT TO RESTRICT OR REFUSE CREDIT

26.1 AEON Credit reserves the right at any time (in its absolute discretion and without giving notice thereof to the Cardmember or assigning any reason thereon) to restrict or limit the Cardmember’s credit or refuse and otherwise withhold credit. 26.2 AEON Credit shall not be liable for any loss, injury or damage howsoever arising, including any consequential and economic loss suffered by the Cardmember, as a result of card transactions being rejected due to a “Card Referral”, “Card Block”, “Card Declined” or “Pick Up Card” status being placed on the Card by AEON Credit as a security measure.

AEON Credit shall further not be liable for any loss, injury or damage whatsoever, including consequential and economic loss, howsoever caused and/or arising by/from mechanical defect or malfunction of AEON Credit’s ATMs or other

MasterCard/Visa/Cirrus/Plus ATM network or equipment failure or failure of the Card (primary or Supplementary) or by any circumstances beyond AEON Credit’s control or by strikes or other labour disputes.

27. AEON CREDIT’S RIGHT TO CHECK CREDIT STANDING

27.1 AEON Credit shall have the absolute right to check the credit standing of the Cardmember at any time as and when AEON Credit deems fit without reference to him/her.

28. AEON CREDIT’S RIGHT TO DISCLOSE

28.1 The Cardmember consents to the disclosure of the last known address of the Cardmember to any bank or VISA International and/or MasterCard International or its successors and the disclosure of the Card numbers of any new, ‘ renewed or replaced Card to merchants or other interested persons.

28.2 AEON Credit shall be entitled to disclose and the Cardmember irrevocably consents to the disclosure by AEON Credit of any information pertaining to the Cardmember and/or the Card Account to such extent as AEON Credit may at its sole and absolute discretion deem fit to the Central Credit Reference Information System under Bank Negara Malaysia, credit information organisations and/or other authority or body established by Bank Negara, Malaysia, any other authority having jurisdiction over AEON Credit, AEON Credit’s branches, related corporations, associates, subsidiaries, affiliates, assignees, proposed assignees, agents and/or any other parties engaged by AEON Credit to enable or assist AEON Credit to exercise or enforce AEON Credit’s rights hereunder and/or any other party whomsoever as AEON Credit may, at its sole and absolute discretion deem fit. No further permission or consent from the Cardmember is necessary or required in relation thereto and this shall constitute the consent required pursuant to any other contractual consent for such disclosures. 28.3 Any disclosure by AEON Credit of the information referred to in this Clause will not render AEON Credit liable to the Cardmember for any claim, loss, damage (including direct or indirect damages or loss of profits or savings) or liability howsoever arising whether in contract, negligence, or any other basis arising from or in relation to:

(i) the release or disclosure of the information by AEON Credit; and/or (ii) the information being incorrect, erroneous or misstated; and/or

(iii) reliance on the information, whether caused by AEON Credit or other third party’s omission, misstatement, negligence or default or by technical, hardware or software failures of any kind, interruption, error, omission, viruses, delay in updating or notifying any changes in the information or otherwise howsoever.

29. AEON CREDIT’S RIGHT TO APPOINT AGENT

29.1 AEON Credit shall be entitled to appoint an agent (hereinafter called “the Agent”) to collect all sums due to AEON

Credit from the Cardmember hereunder and AEON Credit shall be entitled in its absolute discretion to disclose to the Agent (without giving any notice to the Cardmember or assigning any reason therefor) the Card Account and any other

relevant information pertaining to the Card Account to facilitate the collection of all sums due and owing to AEON Credit by the Cardmember.

30. CONCLUSIVE EVIDENCE

30.1 Any admission or acknowledgement in writing by the Cardmember or any person authorised by the Cardmember of the amount of indebtedness of the Cardmember to AEON Credit and any judgment recovered by AEON Credit against the Cardmember in respect of such indebtedness shall be binding and conclusive in all courts of law in Malaysia and elsewhere.

30.2 The Cardmember expressly and irrevocably agrees that a certificate of indebtedness issued by an officer of AEON Credit shall be conclusive and binding evidence as to the amount for the time being due and owing under the Card Account to AEON Credit and it shall be conclusive evidence against the Cardmember in any legal proceedings.

31. DISPUTES

31.1 All disputes arising from the Cardmember’s Statement shall be made or notified to AEON Credit within fourteen (14) days from the date of the Statement. Notwithstanding anything herein to the contrary, the Cardmember shall be deemed to have conclusively accepted all charges on the Statement if the same are not disputed within the said period of fourteen (14) days.

31.2 In the event that the Cardmember disputes any transactions pursuant to Clause 31.1 hereof, AEON Credit may in its absolute discretion deem fit conduct any investigation(s) regarding the disputed transaction(s) wherein the following shall apply:

(a) If AEON Credit’s investigation(s) reveal or indicate that the Cardmember is liable for any of the disputed transaction(s), AEON Credit shall be entitled to levy the following charges:

(i) investigation(s) charge(s) of RM15.00 or any other amount, which AEON Credit may in its absolute discretion deem fit to do so; and

(ii) finance charge(s) from the date of the disputed transaction(s) until the finalisation of the investigation( s) by AEON Credit.

(b) No finance charge(s) and/or investigation charge(s) shall be levied in the event that the investigation(s) reveal that the Cardmember is not liable for any of the disputed transaction(s).

31.3 AEON Credit’s findings in any investigation conducted in relation to the Card Account shall be conclusive, final and binding on the Cardmember and shall not be opened for questioning in any event.

32. COSTS AND EXPENSES

32.1 The Cardmember shall be liable to pay to AEON Credit all legal costs (including costs on a solicitor and client basis), charges and expenses which AEON Credit may incur in enforcing or seeking to enforce any of the provisions herein or in obtaining or seeking to obtain payment of all or any part of the monies owing by the Cardmember.

33. INDEMNITY

33.1 The Cardmember shall hold AEON Credit harmless and indemnify AEON Credit against any liability for loss, damage, costs and expenses (legal or otherwise including costs on a solicitor and client basis) which AEON Credit may incur by reason of the provisions herein or in the enforcement of its rights hereunder.

34. SERVICE AND/OR NOTIFICATION

34.1 The Cardmember hereby irrevocably consents to the service of any notice or statement hereunder by prepaid ordinary post to the last known address of the Cardmember in AEON Credit’s records and such service shall be deemed effective on the fifth day after posting.

34.2 The Cardmember hereby agrees that in the event that any action is begun in the Malaysian Courts in respect of this Agreement, the legal process and other documents may be served by posting the documents to the Cardmember at the last known address of the Cardmember in AEON Credit’s records and such service shall on the fifth day after posting, be deemed to be good and sufficient service of such process or documents.

34.3 The Cardmember hereby irrevocably consents to the mailing of the Card by prepaid ordinary post to the last known address of the Cardmember in AEON Credit’s records and the Card shall be deemed delivered on the fifth day after posting.

35. WAIVER

35.1 AEON Credit’s acceptance of late payments or partial payments or cheques or money orders marked as constituting

payment in full or any waiver by AEON Credit of its rights indulgence granted to the Cardmember shall not operate to prevent AEON Credit from enforcing any of its rights hereunder to collect the amounts due hereunder nor shall such

acceptance operate as consent to the modification of any of the terms herein in any respect. 36. TIME OF ESSENCE

36.1 Time shall be of the essence hereof.

36.2 No failure to exercise and no delay in exercising on the part of AEON Credit of any right, power or privilege hereunder shall operate as waiver thereof, nor shall any single or partial exercise of any right, power or privilege preclude any other or further exercise thereof or the exercise of any other right, power or privilege.

36.3 The rights and remedies herein provided are cumulative and not exclusive of any rights or remedies provided by law. 37. ASSIGNMENT

37.1 AEON Credit shall be entitled at any time without the consent of the Cardmember to assign the whole or any part of its rights or obligations hereunder with or without notice to the Cardmember.

38. SUCCESSORS BOUND

38.1 This Agreement shall be binding upon and enure to the benefit of the respective successors in title and assigns of the Cardmember and AEON Credit provided that the Cardmember may not assign its rights and obligations hereunder. 39. SEVERABILITY OF PROVISIONS

39.1 If any of the provisions herein becomes invalid, illegal or unenforceable in any respect under any law the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired.

40. GOVERNING LAW AND JURISDICTION

40.1 This Agreement shall be deemed to be a contract made under the laws of Malaysia and shall for all purposes be governed by and construed in accordance with the laws of Malaysia and the parties hereby agree to submit to the non-exclusive jurisdiction of the Courts of Malaysia or the courts of such other competent jurisdiction as AEON Credit may in its sole discretion elect.

41. EXECUTION OF FURTHER DOCUMENTS

41.1 The Cardmember undertakes to sign such further documents as may be requested by AEON Credit from time to time. 42. NOTIFICATION OF CHANGE

42.1 The Cardmember shall promptly notify AEON Credit in writing of any change in his employment or business, address (office or residential) or telephone number(s) or if the Cardmember intends to be absent from Malaysia for more than thirty (30) days.

43. CARDMEMBER’S DEPARTURE FROM MALAYSIA

43.1 In the event the Cardmember shall be absent from Malaysia for more than one (1) month, the Cardmember shall at least seven (7) days prior to his/her departure, settle the amount outstanding under the Card Account.

43.2 In the event the Cardmember shall leave Malaysia to take up residence elsewhere, the Card and all Supplementary Card (if any) shall be returned to AEON Credit at least fourteen (14) days prior to the Cardmember’s departure and the use of the Card and the Supplementary Card (if any) shall be deemed terminated and the provision relating to termination in Clause 20.1 shall henceforth apply.

44. FEATURES AND BENEFITS RENEWABLE

44.1 In line with AEON Credit’s commitment to upgrade the Card’s services and benefits, AEON Credit may review and revise any of the features and benefits listed in the Directory from time to time.

45. CONFLICT BETWEEN ENGLISH TEXT AND OTHERS

45.1 In the event of any conflict or discrepancy between the English text of terms and conditions herein and any translation thereof, the English text shall prevail.

APPENDIX 1

TERMS AND CONDITIONS – CARD SERVICES VIA PHONE

In addition to the foregoing terms and conditions, in the event the Cardmember requests for the use of AEON Credit’s services via telephone (the “Services”) and has been issued a personal identifying code or number (“T-PIN”), the following terms and conditions shall also apply:

1. Notwithstanding the terms of any present or future mandate or other agreement between AEON Credit and the Cardmember, AEON Credit is authorised to act on and to treat and consider as valid and binding on the Cardmember any telephone instructions given by any person quoting or keying in the title or number of the Card Account and the valid and current T-PIN for the Card Account or any personal information in relation to the Cardmember which was previously furnished by the Cardmember to AEON Credit. The Cardmember agrees that the quoting and keying in of such

information shall be sufficient proof of the authencity of such instructions. AEON Credit shall not be under any obligation to verify the identity or the authority of the person giving the telephone instructions in or purportedly in the

Cardmember’s name and AEON Credit shall not be liable for acting on the telephone instructions which are given by the person regardless of whether the person is authorised or unauthorised and regardless of the circumstances prevailing at the time of such instructions. However, AEON Credit reserves the discretion not to carry out any such instructions if AEON Credit has any reason to doubt its authencity or if in AEON Credit’s opinion it is unlawful or otherwise improper to do so or for any other reason.

2. The Cardmember agrees to keep the T-PIN strictly confidential at all times and shall not disclose or permit it to be disclosed to any unauthorised person. The Cardmember shall report to AEON Credit immediately if the T-PIN has become known to any unauthorised person. The Cardmember shall bear all consequences arising out of the Cardmember’s failure to comply with the Cardmember’s obligations under this Clause.

3. AEON Credit may at its sole and absolute discretion require the Cardmember to:

(i)confirm in writing the instructions within the period stipulated by AEON Credit and/or call AEON Credit to confirm the instructions and/or to provide such other information and/or execute such other documents which AEON Credit may deem necessary, failing which AEON Credit may treat such instructions as having lapsed; or

(ii)refute in writing the instructions within the period stipulated by AEON Credit, failing which AEON Credit may treat such instructions as having been confirmed by the Cardmember.

APPENDIX 3

ADDITIONAL TERMS AND CONDITIONS APPLICABLE TO CO-BRAND CARD / AFFINITY CARD

1. A Co-brand and/or Affinity Card is a Card issued by AEON Credit in conjuction with a Co-brand and/or affinity establish ment whereby the Card may not carry the mark and/or logo of AEON Credit.

2. A Co-brand and/or Affinity establishment is any body(ies) or corporation(s) as the case may be with whom AEON Credit has a joint agreement, scheme or programme for the issuance of a Card solely or jointly by AEON Credit and the said body(ies) business(es) or corporation(s) as the case may be.

APPENDIX 2

TERMS AND CONDITIONS – THE USE OF AEON CREDIT AUTO-PAYMENT SERVICE 1. AEON Credit Auto-Payment Enrolment

(i)AEON Credit shall at its absolute discretion, and without assigning any reason thereto, accept or reject Cardmember’s

enrolment for AEON Credit Auto-Payment or the Bill payment advice presented by the Service Provider to AEON Credit relating to any outstanding amount due by the Cardmember to the Service Provider.

(ii)Cardmember shall be notified of the acceptance and commencement date of this AEON Credit Auto-Payment

enrolment. Any amount outstanding due to the Service Provider prior to the Cardmember’s AEON Credit Auto-Payment commencement date shall be settled by Cardmember directly with the Service Provider.

2. Debit into Card Account

(i)AEON Credit shall debit into Cardmember’s Card account the transaction amount of the Bill payment advice presented by the Service Provider to AEON Credit. Such an arrangement shall continue at the absolute discretion of AEON Credit

unless Cardmember advises AEON Credit to terminate such an arrangement for any or all of the Bill enrolled by Cardmember in AEON Credit Auto-Payment. For such a termination request, AEON Credit shall endeavour to effect the termination as soon as possible but AEON Credit shall not be held responsible for any delay in effecting such

terminations. 3. Authorisation Request

(i)For each Bill payment advice, the Service Provider will seek an authorisation request of the transaction from AEON Credit as and when the transaction falls due and in the event that such authorisation request is rejected by AEON Credit, Cardmember shall be fully responsible for settling that particular transaction amount directly with the Service Provider. 4. Claims And Disputes

(i)In respect of the Cardmember’s enrolment in AEON Credit Auto-Payment, Cardmember hereby agrees and acknowl edges that if any claim or dispute whatsoever relating to the Bill payment advice presented by the Service Provider to AEON Credit, the claim or dispute shall be forwarded by Cardmember to the Service Provider directly and Cardmember shall not hold AEON Credit responsible in any way.

5. Non-crediting Of Payment By Service Provider

(i)If payment is not received or is rejected by any Service Provider for whatever reason, the Cardmember shall have no claims whatsoever against AEON Credit.

6. Indemnity

(i)Cardmember hereby indemnify fully and keep AEON Credit fully indemnified from and against all losses, damages, expenses (including legal costs, fees and expenses on a full indemnity basis), claims and demands, however arising, which AEON Credit may incur or sustain by reason of AEON Credit offering or rendering this AEON Credit Auto-Payment facility under these Terms and Conditions.

4. Any information given by AEON Credit under the Services is for reference only. AEON Credit shall not be liable or respon sible for the sufficiency or accuracy of the information so given and AEON Credit reserves the right to update and vary

such information from time to time and at any time.

5. AEON Credit shall not be liable for any loss whatsoever arising out of or in connection with the carrying out or failure or delay in carrying out the Cardmember’s instructions.

6. AEON Credit may (but shall not be obliged to) record the telephone instructions by tape recording and such recording of instructions shall be conclusive and binding the Cardmember.

7. All faxed documents sent by the Cardmember and received by AEON Credit and all taped recordings of the Cardmember’s instructions shall be admissible as primary evidence in any civil proceedings between AEON Credit and the Cardmember. 8. AEON Credit reserves the right to add to or vary any of the Services available through telephone or any of the terms and conditions herein by giving due notice to the Cardmember.

9. AEON Credit reserves the right to cancel or suspend any of Services without any notice or reference to the Cardmember. 10. The Cardmember shall pay to AEON Credit all fees and charges which AEON Credit may impose from time to time in connection with the Services.

11. The terms and conditions herein are in addition to and not in substitution for any other agreements, mandates, terms and/or conditions relating to the Card Account.

APPENDIX 4

TERMS AND CONDITIONS – AEON REWARD POINTS PROGRAMME

Terms and Conditions stated in Appendix 4 are applicable for all AEON Credit Cards, except JUSCO Credit Cards (Terms and Condi-tions for JUSCO Credit Card Reward Points Programme (J CARD Gift Redemption Programme) is available at AEON Co. Berhad, website www.jusco.com.my)

Definitions

1. AEON Reward Points Programme (ARPP) is a programme for principal credit cardmembers of VISA and/or MasterCard issued by AEON Credit Service (M) Berhad (AEON Credit).

2. Reward Point (RP) means the points awarded to the cardmember under the ARPP in accordance with these terms and conditions.

3. Gifts are defined as goods, services, holiday packages and any other privileges contained in this catalogue. 4. “Express Lane” is a redemption option using a combination of RP and RM value portion fixed under the ARPP. Validity Of Reward Points (RP)

1. All RP earned is valid for up to 3 years period (based on statement date).

Example: RP earned between Statement dates from 10th January 2005 to 10th December 2005 is considered as RP earned in year 2005 and will therefore expire on 31st December 2007.

2. All RP must be redeemed prior to the expiry date.

3. The applicable expiry dates for RP earned will be shown in the cardmember’s credit card statement and any RP earned but not redeemed will be forfeited on the expiry dates.

Earning Of Reward Points (RP)

1. Every RM1.00 of transaction posted to the cardmember’s credit card account will generate one (1) RP. This rate is subject to Validity Of Reward Points (RP) change without prior notice to cardmembers.

2. RP are awarded to the cardmember based on the total posted Ringgit Malaysia (RM) amount of retail purchases within and outside Malaysia charged to the credit cards, including supplementary credit card(s), cash advance and balance transfer (on promotional basis only) and the value portion of “Express Lane” redemption charged to the card(s).

3. Charges for cash advance and balance transfer (if any), annual fees for the credit cards, interest and/or finance charges, disputed transactions and any other kind of charges and penalties will not be included in the calculation of RP. AEON Credit will not be liable for any delay in actual posting of the transactions and/or RP earned during the ARPP. 4. Adjustments will be made to the RP accrued in the cardmember’s account if there is any credit(s) transaction posted including those due to returned goods or service or billing disputes.

5. RP earned during ARPP have no cash or monetary value and are not convertible to cash.

6. RP are accrued in the principal account of the cardmember only and will be reflected in the monthly statement of account issued by AEON Credit to cardmember. Redemption can ONLY be done by the principal cardmember. 7. If a cardmember who is good standing (not overdue in payment or exceeded limit) has more than 1 credit card and closes 1 account during the ARPP, the existing RP acquired must be redeemed prior to the date the credit card account is closed. Thereafter, all unredeemed RP will be automatically cancelled.

8. The redemption of RP is subject to the sole discretion of AEON Credit to cancel or suspend, without assigning any reasons thereof. RP earned on any credit card accounts believed by AEON Credit to be operated fraudulently or any account closed by AEON Credit will be cancelled.

9. No RP shall be awarded for:

(a) Any purchase of petrol and/or diesel at petrol stations. (b) Any transaction(s) made for utlity bills payment. Gifts Redemption

1. Redemption orders once acceptance by AEON Credit CANNOT be revoked, cancelled or exchanged. Once RP have been redeemed, such RP shall be deemed extinguished and STRICTLY cannot be reinstated.

2. Redemption of Gift(s) with insufficient RP will be rejected.

3. Cardmembers are allowed to combine the RP earned in their AEON VISA and MasterCard accounts for Gift Redemption. However, cardmember cannot combine the RP earned from AEON Co-brand and/or Affinity cards (unless specified) for redemption purposes.

3. If you are a Co-brand and/or Affinity Cardmember, besides the terms and conditions herein, you will also be subject to the following items:

(i)AEON Credit may (but is not obliged) at any time and its absolute discretion convert any Co-brand and/or Affinity Card(s) issued by AEON Credit to the Cardmember into any other credit card(s) as the case may be.

(ii)You agree that AEON Credit shall not be responsible for any obligations of and/or promises, inducements made by the respective Co-brand and/or Affinity establishment.

(iii)You hereby consent to and authorize AEON Credit to disclose to any Co-brand and/or Affinity establishment any information in respect of the Credit Card Account and/or Cardmember which may be necessary to aid and assist the Co-brand and/or Affinity establishment/s directly or indirectly in fulfilling its obligations to the Cardmember under the joint agreement, sheme or programs with AEON Credit.

4. Cardmembers may redeem their RP by sending the redemption order by fax or mail directly to AEON Credit Service (M) Berhad.

5. AEON Credit does not accept any liability whatsoever (including negligence) with respect to Gifts supplied or in connection with any supplier’s refusal to accept certificates/ vouchers issued by AEON Credit. Any dispute arising from this is solely between the cardmember and the supplier.

6. AEON Credit does not accept any liability with the respect to death, injury, consequential loss or damages of whatever nature suffered by the cardmember and if applicable, his accompanying persons arising from the redemption of Gifts, including but not limited to any injury or loss suffered pursuant to the holiday packages, cancellation of the holiday packages, extra charge, delay and resulting from any advice, pointers, tips and directions as may be contained in this catalogue or from the loss, theft, destruction of a Gift.

7. AEON Credit gives no representation or warranty with respect to the quality of the Gift(s) or their suitability for any purpose under ARPP. Any dispute in relation to the Gift(s) shall be settled between the cardmember and the supplier. AEON Credit will bear no responsibility for resolving such disputes and cardmember is to liaise directly with the manufac turer for such warranty information.

8. Gifts that consist of certificates/vouchers issued by suppliers cannot be encashed and are valid for use until the dates specified and subject to Terms and Conditions therein. If they remain unused after the specified date, the

certificates/vouchers will lapse and will not be replaced.

9. If the certificates/vouchers are used for a value less than the amount mentioned, the difference cannot be encashed. If the value of the certificates/vouchers is less than the values of the item(s) purchased, cardmember is to pay the difference. 10. Issuance of hotel accommodation and other service certificates / vouchers do not constitute a reservation or subscription. Cardmember is responsible for making such reservation upon receiving the certificates/vouchers to be entitled for the Gift(s).

11. Cardmember who opt for a “Express Lane” redemption option hereby authorizes AEON Credit to debit his/her credit card account to pay the said RM value portion of the redemption. No cash, cheque or any other mode of payment will be accepted for the “Express Lane”.

12. In the event that the cardmember’s choice of Gift(s) is unavailable. AEON shall notify the cardmember accordingly and the cardmember shall select another gift for redemption. All Gift(s) are available while stocks last and AEON Credit reserves the right, without giving any prior notice nor assigning any reason whatsoever to the cardmember to discontinue and/or replace the Gift(s) featured herein with different products, colour, model or services.

Delivery Of Gifts

1. For delivery of Gift(s), cardmember must provide an address in Malaysia to AEON Credit. All deliveries and/or facsimile charges shall be borne by the cardmember whereupon such charges shall be debited into the cardmember’s account. AEON Credit reserves the right to increase delivery charges without prior notice.

2. AEON Credit does not deliver Gift(s) to address outside Malaysia (overseas countries) notwithstanding that the cardmember agrees to pay for the delivery charges.

3. Delivery of any Gift(s) and/or document e.g. gift vouchers/certificates/application forms will be sent via courier service. In the event cardmember is not available to receive at the delivery address, cardmember has to liaise directly with courier service at the specified time frame stated in the “attempt card” (dropped by courier service) to collect the Gifts.

4. The Gifts will be delivered within 21 working days from the date of the redemption order subject to availability of the gift. A redirection fee of RM10.00 will be debited to cardmember’s credit card account for any change in delivery address. Change of delivery address will only be allowed if Gifts have not been sent out to cardmember.

5. AEON Credit shall notify the cardmember through any channel at the discretion of AEON Credit, on unavailability or late delivery of any gift order within 21 working days of receiving the redeem order.

6. Cardmember or recipient of Gifts is obliged to present IC to the delivery staff, failing which the delivery staff has the right to refuse delivery and will return the Gifts to AEON Credit as unclaimed.

7. Proof of delivery of Gift(s) is by way of written acknowledgement of receipt of the Gift(s) by occupants at the delivery address, and where is an office, receipt by any office staff shall be deemed to be the acknowledgement of the cardmember. 8. If a cardmember does not receive the Gift(s) upon expiry of 21 days from the date of the redemption order, it is

cardmember’s responsibility to inform AEON Credit not later than 2 months from the expiry of the 21 days whereupon AEON Credit will arrange for the delivery of the Gift(s) to the cardmember upon receipt of the proof of the non-delivery of the said 2 months and cardmember shall be deemed to have had received and accepted the Gift(s).

9. Cardmember or his/her authorized representative is advised to examine all packages of the Gift(s) upon delivery. Should a Gift(s) arrive damaged or faulty, the Gift(s) should be returned within 3 days from receipt date to AEON Credit.

A replacement Gift(s) shall be delivered within 14 days of the return of the Gift(s) and the delivery charges incurred for the replacement Gift(s) shall be borne by the cardmember. The right for replacement of Gift(s) will be extinguished if a cardmember fails to return the Gift(s) within 3 days.

10. All Gift(s) and services supplied will be covered by manufacturers’ or suppliers’ normal terms and conditions of business. AEON Credit will not be responsible for any delay of delivery.

11. The cardmember hereby consents and authorizes AEON Credit to disclose or reveal to all the participating merchants or third party operators, service providers or suppliers of any information relating to the cardmember and the cardmember hereby confirms that no further consent from the cardmember is necessary and AEON Credit shall be under no liability for disclosing such information.

General Information

1. All accessories or equipments featured together with the Gift(s) in the photographs contained herein are for decorative purposes only and do not form part of the Gift(s) to be redeemed by cardmember.

2. The Gift(s) set out in this catalogue are valid for stipulated period redemption and while stocks last.

3. A cardmember’s beneficiary or successor-in-title shall have no claim on the RP accumulated by the cardmember. 4. AEON Credit’s decision on all matters relating to the ARPP shall be final and binding on cardmembers and no correspon dences, complaints, claims by the cardmember will be entertained.

5. All Terms and Conditions and Gift(s) in the ARPP may be changed or varied at any time by AEON Credit without giving any prior notice nor assigning any reason whatsoever to cardmember.

Atas pertimbangan AEON Credit Service (M) Berhad (No.Syarikat 412767-v), Kuala Lumpur (dengan ini bernama “AEON Credit”) bersetuju memberikan kad kepada Ahli Kad (seperti didefinasikan di sini) atas permintaan Ahli Kad untuk kemudahan berikut (secara kolektif, “Kemudahan”) ditawarkan berhubung dengan penggunaan Kad VISA AEON dan/atau MasterCard AEON (di sini dirujuk sebagai “Kad”):

i. sebarang pembayaran untuk pembelian barangan dan/atau perkhidmatan yang pembayaran akan dicaj ke Akaun Kad (seperti didefinasikan di sini);

ii. sebarang pendahuluan tunai yang akan didebitkan ke Akaun Kad;

iii. sebarang kemudahan lain yang mungkin ditawarkan oleh AEON Credit dari masa ke masa, tertakluk pada perancangan sebelumnya dengan AEON Credit

Ahli Kad dengan ini bersetuju dengan terma dan syarat berikut: 1. DEFINISI

1.1 Dalam perjanjian ini yang mana konteks menerima ekspresi berikut harus mempunyai makna berikut kecuali disediakan sebaliknya.

1.1.1. ekspresi “caj tambahan” harus bermakna caj tambahan yang dirujuk pada Klausa 13.1 tersebut;

1.1.2 ekspresi “AEON Credit” bermakna AEON Credit Service (M) Berhad, Peti Surat 12754, 50788 Kuala Lumpur dan termasuk penggantinya dalam hak milik dan serah hak;

1.1.3 ekspresi “Bayaran Automatik AEON Credit” bermakna perkhidmatan pembayaran yang disediakan oleh AEON Credit yang mana Ahli Kad memberi kuasa kepada AEON Credit untuk menyelesaikan Bil yang dikeluarkan oleh Pembekal Perkhid matan kepada AEON Credit dengan mendebitkan Akaun Kad Ahli Kad. Perkaedahan perkhidmatan ini dijelaskan dengan nyata dalam Terma dan Syarat yang mengawal penggunaan Perkhidmatan Bayaran Automatik AEON Credit, dilampirkan di sini sebagai Lampiran 2.

1.1.4 ekspresi “ATM” bermakna mesin juruwang automatic termasuk mesin deposit tunai;

1.1.5 ekspresi “Bil” bermakna Bil Berkala yang dikeluarkan oleh Pembekal Perkhidmatan kepada orang (biasa atau sebaliknya) yang telah melanggan untuk peruntukan utiliti atau perkhidmatan dari Pembekal Perkhidmatan.

1.1.6 ekspresi “Kad” bermakna Kad VISA dan/atau MasterCard atau kedua-duanya sekali yang dikeluarkan oleh AEON Credit kepada Ahli Kad dan harus termasuk Kad Jenama Bersama yang dikeluarkan dengan penggabungan atau persatuan dengan mana-mana pihak ketiga dan/atau bawah mana-mana produk atau nama terpilih atau rujukan dan juga termasuk Kad Tambahan;

1.1.7 ekspresi “Akaun Kad” bermakna akaun Kad VISA Ahli Kad dan/atau akaun MasterCard Ahli Kad, mengikut keadaannya, yang mana AEON Credit akan mengenakan caj semua jumlah yang ditanggung oleh Ahli Kad kerana menggunakan Kemudahan termasuk semua faedah, yuran dan caj yang kena bayar berhubung dengan perkara tersebut;

1.1.8 ekspresi “Ahli Kad” bermakna nama individu yang tertera pada Kad termasuk wakil peribadinya;

1.1.9 ekspresi “Kad Jenama Bersama” bermakna mana-mana Kad VISA atau MasterCard yang hanya dikeluarkan oleh AEON Credit atau dikeluarkan bersama oleh AEON Credit dan mana-mana badan atau perbadanan mengikut keadaan yang mana AEON Credit mempunyai perjanjian, skim atau program bersama atas pengeluaran Kad Jenama Bersama tersebut. Terma dan syarat yang mengawal penggunaan Kad Jenama Bersama diterangkan di sini dalam Lampiran 3.

1.1.10 ekspresi “Had Kredit” bermakna had kredit yang diberi oleh AEON Credit kepada Ahli Kad;

1.1.11 ekspresi “Baki Semasa” bermakna jumlah penuh yang ditunjukkan sebagai perlu dibayar di dalam Penyata atau mana notis bertulis lain yang diserah kepada Ahli Kad oleh AEON Credit;

1.1.12 eskpresi “Direktori” bermakna pek alu-aluan Kad yang akan diterima oleh Ahli Kad apabila Kad dikeluarkan kepada Ahli Kad. 1.1.13 ekspresi “Caj Kewangan” bermakna caj kewangan yang dirujuk kepada Klausa 14 di sini;

1.1.14 ekspresi “Caj Pengendalian” dan “caj tambahan” bermakna caj pengendalian yang dirujuk kepada Klausa 13.1 ( c ) di sini; 1.1.15 ekspresi “Caj Pembayaran Lewat” bermakna caj pembayaran lewat yang dirujuk kepada Klausa 15 di sini;

1.1.16 ekspresi “MasterCard International” bermakna MasterCard International Incorporated , syarikat yang didaftar mengikut undang-undang Delaware, Amerika Syarikat yang mana pejabatnya terletak di 2000 Purchase Street, Purchase NY

2509 dan termasuk Pengganti Dalam Hakmilik (successors in title) dan serah hak;

1.1.17 ekspresi “Pedagang” bermakna mana-mana pedagang yang membekalkan barangan dan perkhidmatan;

1.1.18 ekspresi “Tarikh Perlu Dibayar Pembayaran” bermakna tarikh yang mana Ahli Kad perlu menyelesaikan Pembayaran Minimum yang Ditetapkan atau Baki Semasa dan seperti ditetapkan dalam Penyata;

1.1.19 ekspresi “PIN” bermakna nombor pengenalan diri Ahli Kad yang merupakan kod nombor yang mana perkhidmatan boleh didapati dari Mesin Juruwang AEON Credit, atau mana-mana bank atau institusi yang mana AEON Credit telah membuat perjanjian untuk menggunakan Mesin Juruwang bank tersebut atau institusi yang boleh diakses dengan menggunakan Kad;

1.1.20 ekspresi “Mata Ganjaran” bermakna mata ganjaran yang diberikan kepada Ahli Kad bawah Program Mata Ganjaran AEON. Terma dan syarat yang mengawal penggunaan Mata Ganjaran dijelaskan di sini dalam Lampiran 4.
