Subject: Proposed Parking Fine, Penalty, On-Street Metered and Off-Street Facility Rate Increases

Key Points:

 The effectiveness of the City’s downtown parking program to provide a balance of patron and monthly parking relies on an active and consistent enforcement program.

 The metered enforcement area was recently expanded (Government District and Uptown Village), yet the number of parking enforcement officers has remained static.

 Current penalties are too low to incentivize program compliance with the cost to pay all day at a metered spot ($12.50) only $2.50 less than an expired meter fine ($15.00).

 The lack of enforcement presence and low fine amounts combine to form a belief by drivers that there is no need to pay to park resulting in lost revenue to the City’s parking program.

 Maximum rates established in the VMC for metered on-street and off-street parking facilities do not provide administrative latitude to optimize revenue within a quickly maturing parking market.

 The current parking and penalty rates are too low to support development of additional public and private parking facilities over the long term.

Objective: To improve parking compliance to better meet patron and monthly user needs through more consistent enforcement with updated parking fines, penalties, on-street metered and off-street facility parking rates, and recover administrative costs and support increased enforcement in the downtown. This action supports Goal 8, Objective 8.1 of the City’s Strategic Plan: Make downtown Vancouver a vibrant destination for the community and region.

Present Situation: The City has made progress in expanding and improving parking services downtown. The addition of the Government District and Uptown Village meter areas in recent years allows for more active comprehensive management of the on- and off-street parking system throughout the downtown to meet patron and monthly permit parker needs. In addition, the conversion of meters to pay stations in the downtown and introduction of meters in the Uptown Village area allows more payment options for patrons (cash, card and in the future mobile payment) and reduces the operating costs through improved use of technology.

With these changes in place or underway, the City hired Dixon Resources Unlimited at the beginning of 2017 to complete an independent operational assessment for its public parking services program and functions. The focus of the study is to complete an analysis on the costs of

As part of the study, the consultant visited the City in mid-March and completed an initial on-site assessment of the City’s parking operations. While on-site, they had more than 20 meetings with internal and external stakeholders that included: parking enforcement, maintenance and administrative services; the City’s Police, Engineering, Planning, and Finance departments; and the City Management Leadership Team. Also included in the process were two Stakeholder meetings, which consisted of local business owners, developers, employees, and members of the community.

One of the primary findings of the study is the lack of adequate downtown enforcement.

Currently, officers alternate areas of enforcement each day rather than following set schedules, so proactive enforcement of the time limit zones is lacking. There are only three full-time and one part-time officers enforcing the downtown and recently included uptown area. In addition, a combination of scheduling, enforcement strategies and priorities, lack of enforcement technology, and labor intensive processes has created a less than ideal working environment for the existing officers and subsequently less effective enforcement.

Over time, drivers have become familiar with enforcement’s lack of presence throughout the downtown, feeling there is not a need to consistently pay to park because the chance of receiving a citation is minimal. To further the issue, the City’s current expired meter fine is $15.00, only

$2.50 more than the cost of parking all day at metered spaces. The effect on the City is ongoing losses in parking revenue and a reduction in consistent vehicle turnover commonly desired in a commercial downtown. The proposed ordinance changes would increase parking fines and penalties.

The VMC has established maximum rate for on-street metered parking and off-street facility daily, monthly, and event rates. The rates may be increased or reduced by the City Manager or his designee based on a set of guidelines defined in VMC Section 19.11.040. The current rate maximums for on-street metered parking of $1.25 per hour and off-street facilities of $9.00 daily,

$100.00 monthly, and $10.00 for events have all been met. Any future increases to reflect changes to on-street metered and off-street facility rates are prevented due to the limitations set in the code. The proposed ordinance changes would increase the authorized maximums for on- street metered parking and off-street daily, monthly, and event rates, but no increases in the current posted rates would be imposed immediately.

Proposed Increases:

1. Raise current parking fines by $10.00, except for an Overtime Violation which would be increased by $12.00 (increases would not apply to ADA violations).

2. Included parking penalties that would be $25.00 on top of the base fine.

3. Raise the off-street maximum rates for City-owned facilities to a $25.00 daily rate, $200.00 monthly rate, and $25.00 event rate.

1. The proposed increase in parking fines and penalties would improve driver compliance of paying at meters.

2. The proposed increase in maximum on-street metered parking and off-street facility rates would provide the ability to increase rates in the future based on the guidelines established in VMC Section 19.11.040.

3. The proposed increases in parking fines, penalties, on-street metered and off-street facility parking rates would support additional enforcement staff in the downtown and uptown areas.

Disadvantage(s): The proposed increases to parking fines and penalties could result in more drivers appealing their citations.

Budget Impact: The changes in parking fines, penalties, on-street metered and off-street facility rates would result in increased revenue for the parking program.

Prior Council Review: Public workshop on August 7, 2017.

Action Requested:

1. On Monday, August 14, 2017, approve ordinance on first reading, setting date of second reading and public hearing for Monday, August 21, 2017.

2. On Monday, August 21, 2017 subject to second reading and public hearing, approve the proposed parking fine, penalty, on-street metered and off-street facility rate increase ordinance.

AN ORDINANCE relating to the Parking Code for the City of Vancouver under Vancouver Municipal Code (VMC) Title 19; amending VMC sections 19.06.030 relating to rates in the municipal lot at Evergreen and Broadway; section 19.06.090 relating to penalties and violations in the municipal lot at Evergreen and Broadway; section 19.10.050 relating to long- term permit parking violations; section 19.11.030 relating to parking meter fees designated;

section 19.11.040 relating to rates in public off-street facilities; section 19.11.060 relating to Zone – 3 parking meter fees; section 19.13.050 relating to parking fines and penalties; and section 19.13.060 relating to the Table of Common Parking Fines and Penalties; repealing sections VMC 19.07.060 and 19.13.040; providing for severability; and providing for an effective date.

WHEREAS, the City of Vancouver downtown parking ordinances date back to 1948; and WHEREAS, between 1948 and 2014, the City of Vancouver has adopted more than 60 ordinances related to parking regulation; and

WHEREAS, the City of Vancouver adopted the Washington State Model Traffic Ordinance (MTO) Chapter 308-330 Washington Administrative Code (WAC) as authorized in Revised Code of Washington (RCW) Chapter 46.90 by Ordinance M-3276 in 1996; and

WHEREAS, WAC 308-330-710 provides that unless another penalty is expressly provided by law, any person found to have committed a traffic infraction under the Model

WHEREAS, RCW 46.63.110 provides that in addition to that penalty not exceeding more than two hundred fifty dollars, the Supreme Court shall prescribe by rule a schedule of monetary penalties for designated traffic infractions; and

WHEREAS, the Supreme Court has prescribed a schedule of monetary penalties under Infraction Rules for Courts of Limited Jurisdiction (IRLJ) 6.2; and

WHEREAS, IRLJ 6.2(c) provides that the schedule of monetary penalties does not apply to penalties for parking, standing, stopping, or pedestrian infractions by municipal “statutes”.

Penalties for parking infractions established by municipal statute are established by statute and shall be consistent with the philosophy of IRLJ 6.2; and

WHEREAS, RCW 46.63.110(4) sets forth that a local legislative body may set a monetary penalty not to exceed twenty-five dollars for failure to respond to a notice of traffic infraction relating to parking as defined by local law, ordinance, regulation, or resolution; and

WHEREAS, the last time improper, prohibited, expired meter, overtime, moving to evade, pay station violation, and incorrect display of a pay station receipt parking fines and penalties were adjusted was in 2007; and

WHEREAS, the City of Vancouver parking program initiated a Total Cost of Ownership study in 2017 for its public parking programs and services; and

WHEREAS, a community stakeholder process was included in the Total Cost of Ownership process;

WHEREAS, it was recommended to increase parking fines and penalties for common infractions to improve compliance and cover administrative costs; and

WHEREAS, it was also recommended that that the City hire at least one (1) additional full-time (FTE) parking staff member for immediate support of the Downtown parking operations; and

WHEREAS, increasing parking fines and penalties and rates in off-street facilities will help to support a new limited term position in parking enforcement; and

WHEREAS, The Vancouver Parking Advisory Committee has reviewed the proposed changes provided for in this Ordinance and concurs.

NOW, THEREFORE,

BE IT ORDAINED BY THE CITY OF VANCOUVER:

SECTION 1. Legislative Findings. The recitals set forth above are adopted as the

legislative findings of the City Council of the City of Vancouver in support of adoption of this ordinance.

SECTION 2. Section 1 of Ordinance M-4088, as codified by VMC 19.06.030 is hereby

amended to read as follows:

Section 19.06.030 Rates

Use of seventeen spaces shall be limited to one hour of use and thirty-five spaces shall be limited to two hours of use; provided, not to exceed eleven spaces shall be available for long term permit use under the criteria herein provided and upon payment of the monthly fee of a maximum rate of onetwo hundred dollars ($100.00$200.00), which may be reduced administratively by the city manager or his/her designee pursuant to the guidelines set forth in section 19.11.040. The city manager, or his/her designee, shall report to the city council from time to time as requested by

the city council, but in any event, shall report at least once every year regarding these parking rates.

SECTION 3. Section 1 of Ordinance M-4088, as codified by VMC 19.06.090 is hereby

amended to read as follows:

Section 19.06.090 Penalties and violations

All of the provisions, violations, and penalties contained in VMC 19.07.030, and VMC 19.07.050, and VMC 19.07.060 shall apply to chapter 19.06.

SECTION 4. Section 1 of Ordinance M-4088, as codified by VMC 19.10.050 is hereby

amended to read as follows:

Section 19.10.050 Long-term permit parking

A. Long-term permit parking is allowed in those parts of the city marked for permit parking. In those parts of the city which are marked for "permit parking" signs shall be installed to limit the parking to vehicles for which a parking permit has been issued under the provisions of this section and section 19.04.070, and it shall be a violation of this section for anyone to park in any such space unless a parking permit for such vehicle has been secured under the provisions of section 19.04.070 and unless such permit is properly displayed in or on such vehicle so that it is readily observable by parking control officers.

B. Any person who violates or fails to comply with the provisions of this section shall be subject to the penalties provided for in section 19.13.050.

SECTION 5. Section 1 of Ordinance M-4088, as codified by VMC 19.11.030 is hereby amended to read as follows:

Section 19.11.030 Parking meter fees designated

A. Between the hours of eight a.m. and six p.m. daily except Saturdays and Sundays, and also except days being celebrated as any of the following holidays: New Year's Day, Martin Luther King's Birthday, Presidents' Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans' Day, Thanksgiving Day, the day after Thanksgiving, and Christmas Day, the operator of a vehicle, upon entering any metered parking space, shall immediately deposit in the proper adjacent parking meter, coins totaling no more than onetwo dollar twenty-fivefifty cents ($1.25$2.50) per hour as shown on the meter, and shall put the meter in operation. (In some short-term meters a portion of the hour is available free by turning the dial of the meter.) If the vehicle remains parked in the parking space beyond the legal parking time which is designated by a sign or signal on the parking meter, such vehicle shall be considered as parked overtime. In zones where parking is limited to fifteen minutes or less per use, the meter fee shall be no more than thirty-fiveseventy cents ($0.35$0.70) per quarter hour. In zones where parking is limited to thirty minutes or less per use, the meter fee shall be no more than sixty-five centsone dollar thirty cents ($0.65$1.30) per half hour, in zones where parking is limited to two hours or less per use, the meter fee shall be no more than onetwo dollar twenty-fivefifty cents ($1.25$2.50). In zones where parking is permitted for longer than two hours per use, the meter fee shall be no more than onetwo dollar twenty-fivefifty cents ($1.25$2.50) per hour.

The parking meter fee may be reduced administratively by the city manager or his/her designee in accordance with the provisions of section 19.11.040. The city manager, or his/her designee, shall report to the city council from time to time as requested by the city council, but in any

event, shall report at least once every year regarding these parking rates.

B. The department of public works shall cause for there to be installed on each parking meter a suitable plate informing of the hours and days in which such metered parking regulations are enforced.

SECTION 6. Section 1 of Ordinance M-4088, as codified by VMC 19.11.040 is hereby

amended to read as follows:

Section 19.11.040 Rates in public off-street facilities

There is hereby established a maximum daily parking rate of nine twenty–five dollars ($9.00

$25.00), a maximum monthly parking rate of one two hundred dollars ($100.00$200.00), and a maximum event rate of ten twenty–five dollars ($10.00$25.00) per event stay. These rates may be reduced administratively by the city manager, or his/her designee, pursuant to the guidelines below:

A. Any citizen sixty-two years of age, or older, may receive a “senior citizen discount” in an amount to be determined by the city manager or his/her designee, but in no event should the discount exceed twenty (20) percent;

B. The parking rates may be changed to an amount to reach the desired occupancy rate in each municipal lot;

C. The parking rates may be changed to reflect the annual consumer price index (CPI) for inflation in the Portland-Vancouver area;

D. The parking rates may be changed to an amount to reach desired occupancy rates at parking meters;

E. The parking rates may be changed to reflect market conditions in the Portland-Vancouver area;

F. The parking rates may be changed to accommodate specific site characteristics and seasonal events;

G. The parking rates may be changed to reflect the parking conditions, including, but not limited to, covered vs. uncovered parking, and reserved vs. non-reserved.

The city manager, or his/her designee, is authorized to promulgate rules and regulations regarding the administrative reduction of the maximum parking rates. The city manager, or his/her designee, shall report to the city council from time to time as requested by the city council, but in any event, shall report at least once every year regarding these parking rates.

SECTION 7. Section 1 of Ordinance M-4088, as codified by VMC 19.11.060 is hereby

amended to read as follows:

Section 19.11.060 Zone 3 – Parking meter fees

Parking meter fees are established for the parking meters authorized by Section 19.11.050 as follows: no more than onetwo dollar twenty-fivefifty cents ($1.25$2.50) per hour of use for the one and two-hour meters; no more than onetwo dollar twenty-fivefifty cents ($1.25$2.50) per hour of use for the ten-hour meters. These parking meter fees may be reduced administratively by the city manager or his/her designee, pursuant to the guidelines referred to in section 19.11.040. The city manager, or his/her designee, shall report to the city council from time to time as requested by the city council, but in any event, shall report at least once every year regarding these parking rates.

SECTION 8. Section 1 of Ordinance M-4088, as codified by VMC 19.13.050 is hereby

amended to read as follows:

Section 19.13.050 Parking fines and penalties

Parking fines associated with parking violations related to meter violations, overtime violations, disabled parking violations, parking lot violations and other violations shall be as follows:

A. Expired Meter. Penalties for such expired meter violations shall be fifteentwenty-five dollars ($15$25) for each violation if paid or postmarked within fifteenthirty calendar days, and

thirtyfifty dollars ($30$50) for each violation if paid or postmarked after fifteenthirty calendar days.

B. Paystation Violation. Penalties for paystation violations shall be twenty-five dollars ($25) for each violation if paid or postmarked within thirty calendar days, and fifty dollars ($50) for each violation if paid or postmarked after thirty calendar days.

BC. Overtime Violation. Penalties for such overtime parking shall be eighteenthirty dollars ($18$30) for each violation if paid or postmarked within fifteenthirty calendar days, and thirty- six fifty-five dollars ($36$55) for each violation if paid or postmarked after fifteenthirty calendar days.

CD. Improper Parking. Penalties for such improper parking shall be twenty-fivethirty-five dollars ($25$35) for each violation if paid or postmarked within fifteenthirty calendar days, and fiftysixty dollars ($50$60) if paid or postmarked after fifteenthirty calendar days.

DE. Prohibited Parking. Penalties for such prohibited parking shall be thirtyforty dollars ($30$40) for each violation if paid or postmarked within fifteenthirty calendar days, and fifty-

five sixty-five dollars ($55$65) if paid or postmarked after fifteenthirty calendar days.

EF. Moving to Evade. Penalties for such moving to evade violations shall be twenty-five thirty- five dollars ($25$35) for each violation if paid or postmarked within fifteenthirty calendar days, and fifty sixty dollars ($50$60) if paid or postmarked after fifteenthirty calendar days.

F. Failure to Demonstrate Valid Proof of Payment from Parking Pay Station. Penalties for failing to demonstrate valid proof of payment from a parking pay station shall be fifteen dollars ($15) for each violation if paid or postmarked within fifteen calendar days, and thirty dollars ($30) for each violation if paid or postmarked after fifteen calendar days. Penalties for incorrectly

displaying a valid proof of payment from a parking pay station shall be eight dollars ($8) for each violation if paid or postmarked within fifteen calendar days, and sixteen dollars ($16) for each violation if paid or postmarked after fifteen calendar days.

G. Expired Proof of Payment from Parking Pay Station. Penalties for displaying expired proof of payment from a parking pay station shall be fifteen dollars ($15) for each violation if paid or postmarked within fifteen calendars days, and thirty dollars ($30) for each violation if paid or postmarked after fifteen calendar days.

HG. Disabled Parking Violations. Fines, penalties, and assessments for violations of the

Washington State statute RCW 46.19.050 regarding special parking for persons with disabilities are set forth shall be as provided in Section 46.16.381 RCW, until July 1, 2011. On July 1, 2011, Section 46.19.050 RCW sets forth the applicable fines, penalties, and assessments.

H. Expired Tabs. Penalties for expired tabs violations shall be fifty dollars ($50) for each

violation if paid or postmarked within thirty calendar days, and seventy-five dollars ($75) if paid

or postmarked after thirty calendar days.

I. Permit Parking Violation. Penalties for permit parking area violations on a highway, municipal parking lot, or public parking lot shall be twenty-five dollars ($25) for each violation if paid or postmarked within thirty calendar days, and fifty dollars ($50) if paid or postmarked after thirty days.

SECTION 9. Section 1 of Ordinance M-4088, as codified by VMC 19.13.060 is hereby

amended to read as follows:

Section 19.13.060 Table of parking fines and penalties

All parking fines and penalties as outlined in sections 19.13.050 through 19.13.070 are listed in the following table.

SECTION 10. Repealer. Section 1 of Ordinance M-4088 codified as VMC 19.07.060

and VMC 19.13.040 respectively are hereby repealed;

SECTION 11. Severability. If any section, sentence, clause or phrase of this ordinance

should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance.

SECTION 12. Effective Date and Notice. This ordinance shall become effective thirty (30) days after final passage by the City Council.

Proposal is to increase the cap  to give the City Manager the  flexibility to set the rates based  on code guidance – rates are  currently at their maximum

In zones where parking is limited to thirty minutes or less per use,  the meter fee shall be no more than sixty‐five cents ($0.65) per half  hour, in zones where parking is limited to two hours or less per use,  the meter fee shall be no more than one dollar twenty‐five cents  ($1.25) per hour. In zones where parking is permitted for longer than  two hours per use, the meter fee shall be no more than one dollar  twenty‐five cents ($1.25) per hour.

Proposal is to have a flat $10  increase for base fines and $25  for 15 day late penalty per RCW.
