CROW WING COUNTY BOARD OF COMMISSIONERS REGULAR MEETING MINUTES

Historic Courthouse

Brainerd, Minnesota 01/22/2019 1. Call to Order and Pledge of Allegiance

Chair Franzen called the meeting to order at 9:00 AM and called for participation in reciting the Pledge of Allegiance followed by a moment of silence.

Present: Paul Koering, Bill Brekken, Steve Barrows, Rosemary Franzen, Doug Houge

Others Present: County Administrator Timothy Houle, County Sheriff Scott Goddard, Administrative Coordinator Therese Norwood, staff and citizens

2. Open Forum

Pete Mohs, Publisher of the Brainerd Dispatch, informed the Board that the new Crow Wing County 2019 Residential Resource Guide is ready for distribution.

3. GFOA Award for Excellence in Financial Reporting

Administrative Services Director Deborah Erickson reported to the Board that a Certificate of Achievement for Excellence in Financial Reporting has been awarded for the fifth year in a row to Crow Wing County by the Government Finance Officers Association of the United States and Canada for its comprehensive annual financial report. Former employees Jason Rausch and Alaina Bundy were acknowledged for their exemplary performance.

4. Review and Approve Minutes

Moved by Commissioner Barrows seconded by Commissioner Houge to approve the minutes of the January 8, 2019 statutory, organizational and regular County Board meeting. Motion Passed [Unanimous]

5. Review and Approve Agenda

Moved by Commissioner Koering seconded by Commissioner Brekken to approve the agenda of the January 22, 2019 regular County Board meeting. Motion Passed [Unanimous]

6. Consent Agenda

Moved by Commissioner Koering seconded by Commissioner Barrows to approve the following consent agenda. Motion Passed [Unanimous]

Approved the following expenditure listing for January 22, 2019, with the full listing available on file in the Office of the Administrative Services Director:

6.2. Personnel Actions

Approved the Human Resource Report for Personnel Actions dated January 22, 2019, as on file.

6.3. Northeast MN Regional Emergency Communications Board (ECB) Bylaws

Approved the Northeast MN Regional Emergency Communications Board (ECB) Bylaws, as on file, and the Chair and County Administrator are authorized to sign said document, subject to review as to form and execution by the County Attorney.

6.4. Resolution Approving Modifications to JPA Forming NE Emergency Communications Board

Approved Resolution #2019-6 (attached): A RESOLUTION APPROVING MODIFICATIONS TO THE JOINT POWERS AGREEMENT FORMING THE NORTHEAST EMERGENCY COMMUNICATIONS BOARD.

6.5. Donation to Dive Team

Accepted a $100 donation from Granite Electronics to the Crow Wing County Dive Team.

6.6. 2019 New Tobacco License

Approved the 2019 new Tobacco License application of Northland Off Sale Liquors, LLC DBA Northland Off Sale Liquors, LLC, City of Jenkins, as recommended by the County Attorney and County Sheriff, subject to any delinquent taxes being paid, and authorized the Administrative Services Director to issue said License.

6.7. Exempt Gambling Permit

Approved the Minnesota Lawful Gambling Application for an Exempt Permit for the Brainerd Chapter of Minnesota Deer Hunters Association to be held on the date of March 30, 2019, at the Green Lantern, Town of Nokay Lake, subject to all State Laws and upon approval of said date, the applicant submitting a copy of reports required by the State.

6.8. Interlocal Cooperative Agreement - Licensing Specialist Services Family Day Care Authorized entering into an Interlocal Cooperative Agreement with Sourcewell, Cass County, Crow Wing County, Morrison County, Todd County and Wadena County for Sourcewell to host a Regional Licensing Specialist (Day Care) position, effective January 1, 2019, and the Chair and County Administrator are authorized to sign said agreement, subject to review as to form and execution by the County Attorney.

6.9. Donation to Crow Wing Energized to Support Make It OK Campaign

Accepted a $10,000 donation from HealthPartners to Crow Wing Energized to launch and promote the Make It OK campaign and support the County's efforts to further educate and encourage awareness in the community about mental illness.

6.10. Application for Repurchase of Forfeited Lands, Andresen

Approved an Application for Repurchase of Forfeited Lands of Lula Andresen based on circumstances of undue hardship.

6.11. Withdraw Tract 35-17 on Tax Forfeit Available OTC List, Direct Sale to Adj. Landowner, Set Price

Authorized withdrawing Tract 35-17, described as South Half of Lot 10, Block 6, East Brainerd (09122006010B009), from the Tax Forfeit Available Over-the-Counter List; and further, authorized the direct sale of said tax forfeit parcel to an adjoining landowner, pursuant to Minnesota Statute 282.01, Subd. 7a., at the sale price of $4,300.

6.12. Potential Land Acquisition, Heno and Bowman Properties, Section 6 and 31, City of Cuyuna

Approved the acquisition of land described as Government Lot 1, Section 6, Township 46N, Range 28W (Bowman Property), and the NE1/4 of SE1/4, the SE1/4 of SE1/4, and the SW1/4 of SE1/4, Section 31, Township 47N, Range 28W (Heno Property).

6.13. Landfill - 501(c)(3) Non Profit $1,000 Credit on Account Policy

Approved the 501(c)(3) Non Profit Credit on Account Policy on a one-year trial basis to be reviewed in January 2020.

6.14. Release Stormwater Plan Bond for The Sanctuary

Approved the release of the stormwater plan surety bond in the amount of $2,500 for the plat of The Sanctuary, as recommended by the County Land Services Department.

6.15. Septic System Inspection Contract

Authorized entering into a contract between Crow Wing County and Tri-County Septic Inspections (Greg Kossan) to provide inspection services for new septic system installations at a contract amount of $165 per inspection, effective February 1, 2019 to January 31, 2021, and the Chair and County Administrator are authorized to sign said contract, subject to review as to form and execution by the County Attorney.

6.16. Public Land Survey Corner Remonumentation Contract

Authorized entering into a contract between Crow Wing County and Stonemark Land Surveying, Inc. for Public Land Survey Corner Remonumentation to complete section corner work in the City of Fifty Lakes, the City of Crosslake, and Ideal Township, in the amount of $42,840, and authorized the Environmental Services Supervisor to sign said contract on behalf of Crow Wing County.

7. Community Services

7.1. Letter of Reconsideration - Out Patient Services Contract - BCBS Contract with Acquire Mental Health

Moved by Commissioner Houge seconded by Commissioner Barrows to authorize the Chair to submit a letter of reconsideration to BlueCross BlueShield regarding their denial of a contract with Acquire Mental Health for Substance Use Disorder (SUD) Treatment Services. Motion Passed [Unanimous]

8. Land Services

8.1. Kimble Lake 5-year Lake Improvement District (LID) Report

Moved by Commissioner Koering seconded by Commissioner Brekken to authorize the continuation of the Kimble Lake Improvement District for another five-year period, pursuant to Crow Wing County LID Policies. Motion Passed [Unanimous]

8.2. Sibley Lake 5-year Lake Improvement District (LID) Report

Moved by Commissioner Barrows seconded by Commissioner Houge to authorize the continuation of the Sibley Lake Improvement District for another five-year period, pursuant to Crow Wing County LID Policies. Motion Passed [Unanimous]

9. County Administrator

9.1. Senior Management Team Report - No report

9.2. Committee Appointments

Moved by Commissioner Houge seconded by Commissioner Koering to appoint Mike Domin as the City of Deerwood representative on the Serpent Lake Sanitary Sewer District Board of Directors for a term expiring 12/31/22. Motion Passed [Unanimous]

Commissioner Brekken reaffirmed the appointment of Michael Dubay as the District 2 representative on the Transportation Advisory Committee for a term expiring 01/31/20.

The Chair appointed Ronald Roscoe to the Transportation Advisory Committee as the District 1 representative for a term expiring 01/31/21, Steven Voss to the Transportation Advisory Committee as the District 4 representative for a term expiring 01/31/21, Facilities Manager Reid Thiesse to the Historical Society Committee in lieu of a

Commissioner, Commissioner Koering as the alternate to the Central Minnesota Emergency Medical Services Joint Power Board, and Nathan Bertram to the Regional Transportation Coordination Council in lieu of a Commissioner.

The Board asked that reports by the County Sheriff and County Attorney be added as standard agenda items.

A RESOLUTION APPROVING MODIFICATIONS TO THE JOINT POWERS AGREEMENT FORMING THE NORTHEAST EMERGENCY COMMUNICATIONS BOARD

WHEREAS, Crow Wing County is a participating member of the Northeast Emergency Communications Board, a Joint Powers Entity formed pursuant to Minnesota Statutes 403.39 and 471.59; and

WHEREAS, a Joint Powers Agreement creating the Northeast Emergency Communications Board was approved by the eleven counties and four cities, and three tribes comprising the Board, including Crow Wing County; and

WHEREAS, the current Joint Powers Agreement provides for membership by counties and cities within HSEM Region 2; and

WHEREAS, the Minnesota Legislature has amended Minnesota Statute 471.59 to provide authority for federally recognized Indian tribes to participate in Joint Powers Agreements; and

WHEREAS, compliance with this amendment to Minnesota Statute requires modification of the existing Joint Powers Agreement; and

WHEREAS, the Northeast Emergency Communications Board recommends modification of the Joint Powers Agreement governing the Northeast Emergency Communications Board to provide for the authority for federally recognized Indian tribes meeting the same requirements as counties and cities within HSEM Region 2 to participate in the Northeast Emergency Communications Board; and

WHEREAS, the Northeast Emergency Communications Board further recommends modification of the Joint Powers Agreement to provide management and administration of regional Emergency Management functions by the Emergency Communications Board.

NOW THEREFORE, BE IT RESOLVED the Crow Wing County Board of Commissioners approves the modifications to the Joint Powers Agreement recommended by the Northeast Emergency

Communications Board and attached hereto.
