Citation: TX CIV PRAC & REM § 87.001 - 005 Citation: V. T. C. A., Civil

Practice & Remedies Code § 87.001

Summary:

This Texas section provides that any person, including an equine activity sponsor,

equine professional, livestock show participant, or livestock show sponsor, is not liable for

property damage or damages arising from the personal injury or death of a participant in an

equine activity or livestock show if the property damage, injury, or death results from the

dangers or conditions that are an inherent risk of an equine activity or the showing of an animal

on a competitive basis in a livestock show. Liability is not limited by this statute where the

equine professional knowingly provided faulty tack or equipment, failed to make reasonable and

prudent efforts to determine the ability of the participant to engage safely in the equine activity,

owns or otherwise is in lawful possession of the land or facilities upon which the participant

sustained injuries because of a known, dangerous latent condition, or if he or she commits an act

or omission that constitutes willful or wanton disregard for the safety of the participant or

intentionally injures the participant. The statute also requires the visible displaying of "clearly

readable" warning signs that alert participants to the limitation of liability by law

1. RV Hook-Up & Golf Cart Rental needs to be made Directly through the Texas Rose Horse Park Web Site:

2. ALL SHAVINGS MUST be purchased through the Texas Rose Horse Park. Shavings are $8 per bag, 3 bag minimum required per Horse Stall. The initial 3 bags of shavings are to be paid on show entry. Additional shavings may be ordered and paid for by contacting the Horse Park directly at email danne@texasrosehorsepark.com any additional questions, please call 903-882-8696 Monday-Friday 8:00-5:00. No outside shavings allowed.

4. Show management reserved the Right to Cancel or Combine any Classes as deemed Necessary.

5. Decision of the Judge is Final. Respect to Show Officials & Management is expected or Permanent REMOVAL from ALL SHOWS can happen.

6. You are Responsible for knowing the Show Rules – Rules available on Show Web Site – Download & Print PDF File. 7. Exhibitors are responsible for their own errors and those of their Agents in preparation of entry form.

10. OPEN CHECK REQUIRED when ADDING Classes at Show – No Exceptions. All Add Slips for the Day end at 12 Noon.

11. No Refunds for Stalls, Classes, Shavings, Office Fee, Vendor Space, Catering, Advertising, and No Refunds for cancellations due to hazardous weather, Pandemic, Acts of God, human or equine accidents, illness, or emergencies.

13. Post Entry Fee will be Added for added Classes & Stalls after Deadline – no exceptions.

14. Only one Amateur (Age 18 & over and not a paid professional) can use the Same Back # & Same Horse – if another Amateur is showing Horse a New back # will be assigned. Same for Youth (Age 17 and under) exhibitors. But both CAN NOT enter Showmanship, Trail In-hand – Trail Under saddle - any class where it is an INDIVIDUAL GO.

A. All OPEN pointed Classes Roll-up to “All Around Champion” WJ/WT & WJL/WTC B. YOUTH and AMATEUR Classes do NOT Roll Up to All Around Champion.

15. When Entering Horse in by age Classes… Use the JAN 1st Date to determine horses correct Show Date of Birth… See Rule Book! i.e., Horse Born June 2018 - as of Jan 1, 2020 this horse is a 2 year old. Not a Yearling.

16. LIST your Music for Liberty on the ENTRY Form - Show Mgmt will download all Music – Song & Artist.

17. All People at the Show MUST Follow all CDC Guidelines that are Outlined by the Facility, to include but not limited to, Signing a Waiver Form, Temp Check, Wearing a Mask, and Social Distancing.

18. ALL NSF CHECKS will be REQUIRED to Pay the $35 Check Charge - No Exhibitor/Owner will enter or attend a FHC Event with an Outstanding Balance to Show Management. GVHS is notified, and ALL POINTS May be removed from your yearly record.
