___________________________________________________________________________________ The Corporation of the Township of Cramahe (herein after referred to as the Town or Corporation) is currently seeking quotations from experienced Landscape Architects for Design Fees for Victoria Square. Submissions for this quotation call will only be received by the Municipal Clerk at 1 Toronto Street, Colborne, Ontario K0K 1S0 before 3:00:00pm (local time) on June 6th, 2014. The Corporation will not be responsible for any lost documents or for those documents that are not delivered to the proper location.
Three (3) copies of the submissions should be signed and placed in a sealed envelope, clearly marked with “Request for Proposal for Landscape Architect RFP# 2014-08” (label attached).
Only the names of the respondents shall be made public by the Purchasing Agent.
All submissions submitted shall become the property of the Corporation of the Township of Cramahe. For further information please contact Keeley Biron, Manager of Parks and Recreation at (905) 355-2846 ext. 121.
SCOPE OF SERVICES:
Qualified bidders are to submit their fees for the following;
1. Site Analysis/Site Visit – includes a site meeting with municipal staff and sub-committee members for clarification of the project.
2. Concept Design Master Plan – the preparation of master plan documentation for approval and the preparation of the Landscape Concept Plan of the whole site including any feature areas. The preparation of proposed planting and material palette, and the opinion of probable costs is included. It includes the liaison and coordination with municipal staff and sub-committee members.
3. Developed Design 3D Visualization - preparation of development documentation in 3D format, to help finalize the overall concept plan for approval presented to Council by the Architect.
SUBMITTAL CONTENTS:
Proposals submitted in response to this RFP must meet the specifications set forth herein. Any major deviation from these specifications will be cause for rejection of the proposal at the Town’s discretion. The content and sequence of the Proposals are to be as follows:
All Proposals must outline the following details, 1. Name of Business
2. Name of Contact
3. Proof of Liability Insurance and WSIB Certificate of Clearance. 4. Other documentation as deemed appropriate.
5. Length of Time your company has been in business.
6. Provide 3 client references for whom you have provided similar services to.

RIGHTS RESERVED BY THE TOWNSHIP OF CRAMAHE:
The Corporation is not liable for any costs incurred by interested parties in the preparation of their response to this request or interviews/oral presentations/on site demonstrations, etc. Furthermore, the Corporation shall not be responsible for any liabilities, cost, expenses, loss or damage incurred,
sustained or suffered by any interested party, prior to subsequent to, or by reason of the acceptance, or non-acceptance by the Corporation of any response, or by reason of any delay in the acceptance of the response.
The lowest submission will not necessarily be accepted, and the Corporation reserves the right to accept or reject any or all responses and/or to reissue the RFP in its original or revised form.
The Corporation reserves the right to request proponents to: a) Provide additional information;
b) Modify submissions in areas considered to be deficient;
c) Address specific requirements not accurately covered in their initial submissions; d) Substitute components where the Corporation considers that an alternative may be
more suitable; e) references
The Corporation reserves the right to modify any and all requirements stated in the RFP prior to the possible awarding of a contract. In such an event, any and all changes will be forwarded to all parties in possession of a RFP package.
INDEMNIFICATION:
Without limiting any other obligation of the Proponent under this Contract or otherwise, the Proponent hereby agrees to Indemnify and Save Harmless the Corporation of the Township of Cramahe, its elected officials, officers, employees, servants, agents and others for whom the Corporation is in law
responsible, from and against any liability, loss, claims, demands, damages, fines and penalties, costs and expenses (including consulting fees), investigatory and legal expenses, and any other actions or causes of actions, suits, caused by or attributed to any willful or negligent act, omission, delay, or allegations thereof on the part of the Proponent, its officers, employees, subcontractors, agents, licensees, assignees, invitees or other persons engaged in the performance, non-performance or attempted performance of the Work pursuant to this Contract or anyone else for whom the Proponent is in law responsible.
Should the Corporation be made a party to any litigation commenced by or against the Proponent, then the Proponent will protect, indemnify and hold the Corporation harmless and will promptly pay all costs, expenses, and legal fees (on a solicitor and own client basis) incurred or paid by the Corporation in connection with such litigation upon demand. The Proponent will also promptly upon demand all costs, expenses and legal fees (on a solicitor and own client basis) that may be incurred or paid by the
Corporation in enforcing the terms, covenants and conditions in the Contract. The Proponent’s obligations under this indemnification section will survive the expiry or early termination of this Contract.
LIABILITY FOR ERRORS:
While the Corporation has used considerable efforts to ensure an accurate representation of information of the Request for Proposal, the information contained in this Request for Proposal is supplied solely as a guideline for proponents. The information is not guaranteed or warranted to be accurate by the Corporation, nor is it necessarily comprehensive or exhaustive. Nothing in this Request for Proposal is intended to relieve proponents from forming their own opinions and conclusions with respect to the matters addressed in the Request for Proposal.
STATUTES AND REGULATIONS:
The successful bidder shall comply with all Federal, Provincial and Municipal laws and regulations, including but not limited to the Workplace Safety and Insurance Act, Occupational Health and Safety Act and regulations including W.H.M.I.S. Any required permits or inspections shall be the complete
WORKPLACE SAFETY & INSURANCE COVERAGE:
The successful bidder must obtain and forward to the Corporation a letter of clearance from the Workplace Safety and Insurance Board stating that he is in good standing with the Board. This letter must be provided before any work start on the site.
Out-of-province contractors are not exempt from having to register and must comply with the
requirements of the Workplace Safety and Insurance Board. Prior to commencing work, out-of-province contractors not required to be registered in Ontario shall provide:
(a) written confirmation from the Workplace Safety and Insurance Board stating the contractor is not required to be registered in Ontario, and
(b) evidence of compliance with the requirements of the province or territory of the Place of Business with respect to workers compensation.
MUNICIPAL FREEDOM OF INFORMATION AND PROTECTION OF PRIVACY ACT (MFIPPA):
In accordance with the Municipal Freedom of Information and Protection of Privacy Act, this is to advise that the personal information Respondents provide is being collected under authority of the Municipal Act and will be used exclusively in the selection process. All proposals submitted become the property of the Corporation of the Township of Cramahe. Because of MFIPPA, Respondents are reminded to identify in their proposal material and specific scientific, technical, commercial, proprietary, or similar confidential information, the disclosure of which could cause them injury. Complete proposals are not to be identified as confidential. The Corporation of the Township of Cramahe reserves the right to discuss any and all proposals, to request additional information from proponents and to accept or reject any and all proposals.
