Cash shall not be left in unattended vehicles. Journeys in excess of 1KM must be undertaken in a Motor Vehicle and for the duration of such transits, the cash must be contained within the locked boot of such vehicle. Business Hours shall mean ‘The working hours which the authorised employees/volunteers/club members entrusted with the money are on the premises for the purposes of the Business’. All negotiable Instruments e.g. cheques are deemed to be cash unless crossed and recorded.

DEFINITION OF FLOOD AND WINDSTORM

Ø Flood shall mean the escape of water from its normal, natural or artificial confines (other than tanks, apparatus or pipes), tidal wave, tsunami or any other inundation from the sea, whether or not driven by wind.

Ø Windstorm shall mean rainstorm, windstorm, hailstorm, hurricane, tempest, typhoon, tornado or cyclone, including ensuing Damage caused by water that backs up from a sewer or drain as a direct result thereof but excluding Flood.

Ø 72 Hour Provision

All Damage:

Ø caused by Earthquake arising out of a single seismic disturbance

Ø caused by Windstorm arising out of a single atmospheric disturbance

Ø caused by Flood

occurring within a period of 72 consecutive hours shall be one Occurrence

PRINCIPAL CONDITIONS

Ø Drain pipes and isolate water when closed during winter

Ø Lag all external pipes (Oil Feeds and Water Feeds) to prevent freezing in extreme conditions

Ø Regularly check premises when closed over winter

PRINCIPAL EXCLUSIONS

Damage or consequential loss caused by:

Ø Faulty or defective design, materials or workmanship, inherent vice, latent defect, gradual deterioration, wear and tear or frost.

Ø Collapse or cracking of buildings

Ø Corrosion, rust, change in temperature, dampness, dryness, wet or dry rot, shrinkage, evaporation, loss of weight, contamination, change in colour or flavour or texture or finish, vermin, insects, marring or scratching

Ø Theft other than theft involving entry to or exit from the buildings at the insured’s premises by forcible and violent means or any attempt threat.

Ø Cracking, fracturing, collapse or overheating of boilers, economisers, vessels, tubes or pipes, nipple leakage and/or failure of welds of boilers.

Ø Mechanical or electrical breakdown and/or derangement of machinery or equipment.

Ø Damage to vehicles licensed for road use

RISK MANAGEMENT

To ensure the continued success of the Programme the following Risk Management guidelines should be complied with where applicable.

Ø All walls, ceilings, linings and roofs should be composed of non-combustible materials and all contents, carpets, and soft furnishings should be composed of fire retardant materials.

Ø Ensure that all employees and members have been instructed and trained in the procedures to be followed in the event of a fire or a similar emergency.

Ø Fire Detection and Alarm systems including Intruder Alarms, should be inspected daily to ensure they are functioning properly and faults should be rectified at once. These systems should also be fully tested on a regular basis.

Ø All fire exit doors and escape routes should be checked daily to ensure they are not obstructed and are functioning properly.

Ø Ensure that full evacuation drills are carried out at least once every six months.

Ø Fire blankets should be provided in kitchen areas and employees and members should be trained in their proper use.

Ø Fire extinguishing appliances should be regularly checked and maintained to ensure that they are in proper working order. Employees and members should be trained in the correct use of fire extinguishers.

Ø Burst Pipes Prevention Checklist:

1. Are your pipes and tank properly lagged? 2. Are all your taps closing tightly?

3. Do you know where the main water stop valve/stopcock is? 4. Are you sure your main water stop valve/stopcock is working? 5. Do you have a light in your attic?

6. Do you open your attic door during the winter? 7. Do you set your heating to come on at night?

8. Do you leave your heating on when the house is unoccupied?

9. Cash must be kept in an approved locked safe outside of business hours. If you answer ‘no’ to any of the above you will need to take action.

BALL STOP NETS

It is a condition precedent to Liability under the Property Insurance Policy that all retractable ball nets are pulled over after a match and cover in respect of same only applies once the club has adhered to this condition.

TOOLS, IMPLEMENTS & MACHINERY

The policy extends to cover loss of or damage to tools, implements, mowing machines, ride-on mowers, tractors, rollers and the like, the property of the Insured, whilst anywhere upon the Insured's premises. In respect of this extension the policy deductible as stated in the schedule, each and every loss, will apply.

Engineering Cover

Domestic heating boilers are covered under the GAA Property policy for defined perils only. Steam Explosion is however excluded.

If motorised tractors/lawnmowers are used on car parks or public roads they will require a minimum of third party motor cover which needs to be arranged separately. Willis can provide a quotation for this cover once the following information has been obtained:

GAA LIABILITY PROGRAMME

The guide remains an overview of the Terms, Conditions, limitations and Exclusions under the Association’s Public and Employers Liability Insurance arrangements.

There are changes which affect all units covered under the

GAA LIABILITY PROGRAMME

, in which participation remains mandatory.

GENERAL

Liability risks arise under a variety of circumstances, most frequently from the attendance of the public at GAA grounds and premises.

The

Code of Practice for Safety at Sports Grounds

, published by the Department of education in 1996, remains the authoritative guide in the 26 Counties on the liabilities that may typically arise for the majority of GAA facilities. The equivalent in the six Counties is the recently published ‘red guide’ (The safety at sports Grounds Legislation).

The

SAFETY, HEALTH and WELFARE at WORK ACT 2005

, enacted on September 1, 2005, imposes statutory obligations on many GAA units.

The 2005 Act

is of particular importance where Association officers are responsible for any form of

EMPLOYMENT

– which can include full and part-time staff, FAS scheme participants, causal and voluntary workers, building contractors, or anyone working under the direction of club officials. Other legislation which may impose particular duties on Association units include the

Fire Services Act, 1981

, the

Criminal

Justice (Public Order Act), 1994

or

the Occupiers Liability Act 1995

.

A Liability claim

can usually only succeed where negligence can be proven. Negligence is a failure to exercise the proper and prudent care appropriate to the circumstances.

In Civil Law, the measures of negligence make reference to

FORESEEABILITY

(ignorance is no defence), and

REASONABLENESS

(common sense would normally indicate the duties of care expected).

For example

, a greater measure of responsibility is expected towards children in cases where they may be guilty of trespass.

LOSS CONTROL

1. ACCIDENT PREVENTION

It is absolutely essential that Clubs and other units

“shall take all reasonable precautions to prevent

accident, injury, loss or damage and shall take all reasonable steps to observe and comply

with all statutory or local authority laws obligations and requirements”

.

Each club or unit must have a safety Statement and carry out

Risk Assessments

, the extent of which will be determined by the activities undertaken at the facility. This will include match day as well as non-match day exposures.

A system of

continuous safety inspection

at the facility is necessary to ensure it is maintained in a healthy and safe condition for both visitors (‘Third Parties’, ‘Outside Bodies’, ‘Hirers’) and, of course, members.

A safety review should cover

Ø Regular Maintenance

Ø Utilities: Electrical (wiring/lighting), Gas, Oil and Water Supplies

Ø Dangerous refuse and litter – constituting fore and toxic risks

Ø Walls, Gates and fencing

Ø Stands, Roofs, terracing, Seating

Ø Car Parking

Ø Stewarding and crowd control

Ø Medical facilities, including access for ambulances

Ø Safe access and exits (external and internal)

Ø Clearance of glass and sharp stones from playing areas

Ø Shops, Kiosks, Canteens

Ø Co-operation with An Garda Síochána and Fire Officers

Ø Cleaning operations including toilets

There should be regular briefing on Accident Procedures (‘drills’) and Incident Reporting for anyone likely to come into contact with the public such as Officials, Stewards, Gatemen, Stilesmen, Barmen and Caterers.

Ground Safety Rules

For Match Days the Association has published Rules which replace the previously issued FÓGRAÍ and are available from County Boards.

LOSS CONTROL

2. INCIDENT REPORTING

Equally important are the actual costs incurred in defending ourselves against the many and varied claims against the Association, whether they are valid claims or not.

In recent times it has become prudent, on a country-wide basis, to retain the services of a panel of defence solicitors who have proven collective experience in legal matters involving the Association. Loss Control, in human terms as well as financial, still remains a core management responsibility at all levels within the Association. The early recognition of potential losses (‘incidents’), their recording and reporting is crucial to any successful programme of Risk Management.

Any incident likely to give rise to a claim must be reported without delay.

Early referral to County Boards will ensure a uniform defence strategy, including the appointment of designated defence solicitors, as well as meeting basic Insurance Policy reporting requirements.

GAA PUBLIC LIABILITY INSURANCE

Cover has been arranged with Lloyd’s and other Market Insurers and comprises:

Annual Policies which provide for cover up to €6.5 million in respect of any one occurrence subject to an Annual Aggregate Excess of €1.5 million.

This means that all compensation cost and expenses payable in respect of injury, loss and damage up to this Excess during the year are the responsibility of the GAA and must be met from the GAA Liability Fund.

The Policies provide indemnity against all sums which the Association shall be come legally liable to pay compensation, together with claimant’s costs and expenses, in respect of:

Ø Accidental bodily injury to Third party

Ø Accidental loss of or damage to their material property

In addition, approved legal costs and expenses incurred in defence of any claim will be paid.

Internal Excess

It is a condition of the Public Liability Programme that an excess of €1000 shall apply to each and every claim.

EXCLUSIONS

INCLUDING BUT NOT LIMITED TO:

A. DANGEROUS ACTIVITIES

In addition to the standard Policy Exclusions, the following list of activities will be deemed excluded unless agreed in advance on a case-by-case basis with the GAA Headquarters / Willis Insurance Brokers.

Ø Mechanical Rides and/or Amusement Device/Fairground/Machinery/Circuses/Motorised Vehicles

Ø Bouncing Castles/Inflatable’s and/or Trampolines

Ø Motorised Sports/Racing/Aircraft or other Aerial Devices

Ø Show jumping

B. CONTINGENCIES – THE SUBJECT OF OTHER INSURANCES

Ø Liability assumed under Contract

Ø Liability in respect of the engagement of full time professional entertainers

Ø Liability in respect of injury caused by or arising from engagement in sports (participatory injuries)

Ø Liability in respect of injury to any employee in the course of employment/engagement by the insured

Ø Liability arising from the ownership/use of mechanically propelled vehicles or craft designed to travel through air or water

Ø Advice or Examination given for a fee

Ø Liability in respect of Injury or Damage caused by Bouncers

Ø Assault.

C. BUILDING WORKS

The current liability policy can be extended to cover contract works that are being carried out by volunteers of the club up to a certain limit .The club will need to meet certain GAA requirements in order for Insurers to confirm cover for example: adequate safety statement, security details for the site, nature of work, duration & value of works etc.

The policy can include liability arising out of:

Ø the maintenance of existing buildings or structures belonging, leased, rented or hired to the Insured

Ø any work of construction or reconstruction of any building or structures belonging, leased, rented or hired to the Insured

PROVIDED THAT

The club will need to meet certain GAA requirements in order for Insurers to confirm cover for example: adequate safety statement, security details for the site, nature of work, duration & value of works etc.

GAA EMPLOYERS LIABILITY INSURANCE

Cover has been arranged with Lloyd’s and other Market Insurers and comprises:

Annual Policies which provide for cover up to €13 million in respect of any one occurrence subject to an Annual aggregate Excess of €1.5 million.

Participation in the GAA Employers Liability Programme is compulsory for all units. The scheme cover Cumann Lúthchleas Gael Central and Provincial Councils, County Boards and other units, including Clubs, as a Sports and Cultural organisation also involved in fund-raising, social and recreational activities, as well a property owners.

The Policies provide indemnity against all sums which the Association shall become legally liable to pay as compensation and for claimants’ costs and expenses in respect of accidental bodily injury to any Employee arising out of and in the course of employment by the Association.

Safety, Health and Welfare at Work Act 2005

The GAA may incur liability for injuries to employees, be they full or part-time, casual, voluntary or sub-contracted, due to negligence in failing to use reasonable care in:

a. providing a safe place of work

b. providing a safe system of work

c. providing suitable and safe equipment

d. providing adequate training on a continuous basis

e. engaging suitable and competent employees.

The following are the GAA requirements for all third parties who use the

GAA facilities on a commercial basis:

WAIVER AND RELEASE OF LIABILITY

In consideration of my involvement and participation in INSERT EVENT I fully understand and

acknowledge

that:-(a) risks and dangers exist in my involvement and participation in INSERT EVENT

(b) my participation in such activity may result in my injury or illness including but not

limited to bodily injury, fractures, partial and/or total paralysis, eye injury, blindness,

dismemberment or other ailments that could cause serious disability or death;

(c) by my participation in these activities and/or use of equipment, I hereby assume all

risks and dangers and all responsibility for any losses and/ or damages, whether

caused in whole or in part by the negligence or other conduct of the agents, officers,

employees of INSERT NAME OF CLUB and COUNTY BOARD or other third parties;

I, on behalf of myself, my personal representative and my heirs, herby agree to release,

waive, discharge, hold harmless, defend and indemnify INSERT NAME OF CLUB and

COUNTY BOARD and its agents, officers and employees form any and all claims, actions

or losses for bodily injury, property damage, wrongful death or otherwise which may

arise out of my involvement and participation in INSERT EVENT.

As the excess on the property policy have increased for 2012, new procedures have been implemented in relation to dealing with claims as follows:

Ø Clubs should notify new claims to Willis Insurance Brokers immediately after a loss occurs.

Ø Where notifications are under wither the flood or escape of water (EOW) headings, the clubs will need to indicate into which, in their view, of the following bands the notification is likely to fall:

§ € 1 - € 4,000 § € 4,001– 15,000 § € 15,001 - € 25,000 § € 25,001 +

Ø Where the notified flood or EOW incident Is believed to fall into the bands € 4,001 - € 15,000 & € 15,001 - € 25,000, clubs will be required to submit the following:

§ A brief description of the cause and extend of the damage § Details of the rooms / areas affected

§ Where possible, approximate measurements (length, width, height etc.) of the affected rooms/areas

§ Digital photographs of the rooms/areas affected

§ Clubs estimate of the maximum potential value of damage

This information should ideally be provided at the time of notification but if this is not possible, then within 14 days of the notification of the claim.

Ø Where the notified remainder of claims fall above the standard policy excesses on the policy, Willis will notify insurers of these claims and a loss adjuster will be appointed accordingly to assess the claim on behalf of the GAA club.

1. Third Party Using Facilities

If there is a third party who wishes to use the GAA facilities for a commercial basis then the following are the GAA requirements in relation to their insurances:

Ø Evidence of EL (€13m) if applicable

Ø Evidence of PL (€6.5m)

Ø Specific indemnity to Club & Cumann Lúthchleas Gael For example: Aerobics Instructor, Badminton Club,

If a group of individuals wish to use the GAA facilities or if a member wishes to have a birthday party in the facilities, this is covered under the current GAA Hirers policy. This is a contingency policy which is in place for members who would not have their own insurances in place. All GAA Clubs should update their safety statement to reflect this usage and have adequate controls in place.

2. Bank Interest

Ø All Requests should come from the Club by email/fax to gaageneral@willis.ie. / Fax number: 01 676 6906.

3. Broker Declaration

Ø These can be issued by Willis. Clubs can request a copy of these by email to gaageneral@willis.ie Ø Liability & Property declarations available.

Clubs would require these if they are hiring out third party premises and are asked to provide evidence of the GAA’s insurances.

4. Building Works

No Contractor

Ø The current liability policy can be extended to cover contract works that are being carried out by volunteers of the club up to a certain limit .The club will need to meet certain GAA requirements in order for Insurers to confirm cover for example: adequate safety statement, Statutory health & safety reports, security details, nature of work, duration & value of works etc.

Ø If the project does not meet certain requirements a separate CAR and Liability policy will need to be taken out by the club.

Contractor

If there is a contractor involved the following guidelines should be adhered to:

Ø The club and Cumann Lúthchleas Gael must be specifically indemnified on the contractor’s liability policies, by endorsement, and we must see a copy of the actual endorsement.

Ø The limit of insurance on the Contractors All Risks policy must equal or greater to that of the contract /project.

Ø It is the recommendation of Croke Park that outside contractors should be used to reduce our potential liability from construction projects. If there are exceptions to this approach please refer to the Insurance Department at Croke Park"

5. Completed Forms for Grants/funding etc.

Ø Willis Insurance Brokers can complete these forms on behalf of the GAA and send them back to the clubs. Forms can be sent by email to gaageneral@willis.ie.

6. Concerts

Ø If a concert is being organised by the GAA club they should discuss this with Sinead Quinn in Croke Park or Aisling Mc Laughlin in Willis.Aisling.mclaughlin@willis.ie

7. Gym Usage

The GAA have guidelines in relation to the gym usage for club members ONLY as per details outlined below.

Ø An induction evening should be organized and overseen by a qualified PE Instructor who would give individual programmes to members and monitor their progress on a weekly basis.

Ø It would be a recommendation, if possible, that a fully qualified instructor be present at all times when the equipment is in use.

Ø ALL users must be trained in the use of the equipment

8. Lawnmowers/Tractors

Ø If a club requires RTA cover for a lawnmower or tractor a quotation can be provided by Willis Insurance Brokers.

Ø Details required: Club name & Address, make/model, value, year, who will be using/driving vehicle.

9. Specific Indemnities

Ø Need to be requested by email togaageneral@willis.ie

10. Exclusions Hirers/Liability Policy

Ø List of current exclusions attached.

11. Travel

Ø Clubs may request a travel quotation – this can be sent to Aisling Mc Laughlin in Willis – aisling.mclaughlin@willis.ie.

Ø Details required: Location, Period of cover (how long they are going to be travelling for), and how many people travelling, if Personal Accident cover is required for the players only.

12. Fundraising events

Ø Clubs should advise Croke Park or Willis Insurance Brokers of any fundraisers being organised as approval is required.

Pitch or Other Grounds of

Insert GAA Club

As a condition of you and the group which you represent being permitted to hire out the Astroturf pitch or other grounds of the Insert GAA Club, you, the undersigned:

1. Acknowledge that you and all members of your group are over the age of 18 years and free of any physical or mental infirmity that would affect any ability to participate in your sporting activity.

2. Acknowledge that there is an inherent risk of personal injury in your sporting activity.

3. Agree to obey all rules and regulations of the club and to follow any directions as may be given to you and your group by a representative of the club.

4. Agree that if any member of your group injures himself or herself while on the grounds of the club that you will inform the club immediately after such injury occurs.

5. Agree that if you or any member of your group sustains any personal injury, material loss, or other damage while on the grounds of the club – regardless of the manner in which it is caused – you or any other member of your group will not hold the club, any member, officer, or committee of the club liable for the injury, loss, or damage or initiate legal proceedings of any nature or kind arising from such injury, loss, or damage.

6. Agree to bring to the attention of the club any risk to the health or safety of yourself or your group as soon as you become aware of such risk.
