CALL TO ORDER

Fourth District Matt Flynn called the meeting to order at 9:00 AM.

PLEDGE OF ALLEGIANCE CONSENT AGENDA

Wright moved; Thein seconded, to approve the following items in the Consent Agenda:

Proclaim March as Social Work Month in Olmsted County.

Award a contract with AVM Construction in the amount of $529,500 for restoration of the exterior envelope of the 2122 building, contract #19101, and approve the Project Manager to have change order authority in the amount of $25,000, and approve supporting resolution as follows.

Resolution No. 19-42

WHEREAS, Building Operations and Purchasing solicited competitive bids for

constructions services to restore the exterior envelope of the 2122 building, Contract #19101;

and

WHEREAS, the apparent lowest responsive, responsible bid was $529,500.00.

NOW, THEREFORE, BE IT RESOLVED, that the County Board awards a contract to AVM Construction for a contract amount of $529,500.00.

Authorize the Chairperson and Deputy Clerk to enter into Cooperative Construction Agreement 1033040 with MNDOT and adopt supporting resolution as follows.

Resolution No. 19-43

WHEREAS, Minnesota Statute § 471.59, Subd 10, authorizes Olmsted County and the State of Minnesota to enter into agreements; and

WHEREAS, the Minnesota Department of Transportation (MNDOT) has developed plans and specifications for improvements to Trunk Highway (TH) 52 and County Roads (CR) 136 & 137; and

WHEREAS, the CR improvements are designated as C-19-136; and

WHEREAS, the County has agreed to reimburse the State for improvements to CR 136 & 137 including design, right of way acquisition, drainage improvements, bituminous paving construction and associated construction engineering as specified in Cooperative Construction Agreement 1033040; and

WHEREAS, the County’s cost is estimated at $93,937.72, with the final amount being determined at the completion of the project.

NOW, THEREFORE, BE IT RESOLVED, that the Olmsted County Board of

Commissioners hereby enters into Cooperative Construction Agreement No. 1033040 with the State of Minnesota, Department of Transportation.

BE IT FURTHER RESOLVED, that the Chairperson and Deputy Clerk are authorized to execute the Agreement and any amendments to the Agreement.

SIGNATURE OF PERSON TAKING ACKNOWLEDGMENT

Approve and sign the Purchase of Service Agreement with Rochester Area Foundation for calendar year 2019 in the amount of $88,860 and supporting resolution as follows.

Resolution No. 19-44

WHEREAS, The Olmsted County Children’s Collaborative (BRIDGE Collaborative) was formed in September, 2015; and

WHEREAS, This family services and children's mental health collaborative has been formed to allow comprehensive planning and coordination of services to children,

adolescents and families between the participating entities; and

WHEREAS, The Collaborative determined the need to support the Cradle to Career Initiative by funding one year of the Executive Director position. Cradle to Career’s goal is to improve educational outcomes in Rochester, MN with the option to expand county-wide; and

WHEREAS, Olmsted County is the Collaborative fiscal host and this item has been approved through the funding approval process with the Collaborative without fiscal impact to Olmsted County’s budget; and

NOW, THEREFORE, BE IT RESOLVED, that the Olmsted County Board of Commissioners does hereby Approve and sign the Purchase of Service Agreement with Rochester Area Foundation for calendar year 2019 in the amount of $88,860.

Approve and sign a State of Minnesota Joint Powers Agreement for MFIP Teen Parent Home Visits in the amount of $58,000.00 per year for the period of January 1, 2019 through December 31, 2023.

Resolution No. 19-45

WHEREAS, Olmsted County Family Support and Assistance has been receiving funding from the Department of Human Services to serve Minnesota Family Invest Program (MFIP) teen parents since January, 2014; and

WHEREAS, the funding targets Employment Counseling and Eligibility Services to serve teen parents who are receiving MFIP; and

WHEREAS, the Department of Human Services has approved grant funds for Olmsted County to continue these existing services with a new joint powers agreement for the time period of Jan. 2019 through Dec. 2023; and

WHEREAS, the amount of funding from DHS is no more than $58,000 per year for each of the five years listed above; and

WHEREAS, Olmsted County Family Support and Assistance contracts with Workforce Developoment Inc.(WDI) to provide Employment Counseling services; and

WHEREAS, Olmsted County compensates WDI for these serves at a rate of $20,800 annually.

NOW, THEREFORE BE IT RESOLVED that the Olmsted County Board of Commissioners does hereby approve this Resolution.

Authorize the Chairperson and Deputy Clerk to execute Maintenance Agreements with the Cities of Chatfield and Stewartville and adopt the supporting resolution as follows.

Resolution No. 19-46

WHEREAS, Olmsted County has historically entered into agreements with the Cities of Stewartville and Chatfield for the maintenance and removal of snow from county roads within their corporate limits; and

WHEREAS, the cities are reimbursed for this work at the rate of $4,142.95 per mile per year of maintenance performed.

NOW, THEREFORE, BE IT RESOLVED that the Olmsted County Board of

Commissioners approves this resolution whereby authorizing the Chairperson and Deputy Clerk to execute the Maintenance Agreements and any Amendments with the Cities of Chatfield and Stewartville.

Accept the donation of real property for use as public road right of way for project SAP 055- 605-016 (CSAH 5) and adopt supporting resolution as follows.

Resolution No. 19-47

WHEREAS, Minnesota Statutes Section 465.03 provides that counties may accept a grant or devise of real or personal property and must maintain such property for the benefit of its citizens in accordance with the terms prescribed by the donor. Nothing herein shall

authorize such acceptance or use for religious or sectarian purposes. Every such

acceptance shall be by resolution of the governing body adopted by a two-thirds majority of its members, expressing such terms in full; and

WHEREAS, the County has adopted a Donations and Contributions Policy to provide

guidance to county staff about the types of donations which will be accepted, and the manner in which they will be accounted for and distributed once they have been accepted; and

WHEREAS, through the right of way negotiation process for SAP 055-605-016, County State Aid Highway (CSAH) 5, located between 85th Avenue NW and County Road 131, a landowner requested to donate real property for public road right of way, without restriction; and

WHEREAS, SAP 055-605-016 (CSAH 5) was approved by the County Board in the 2014 Capital Improvement Program (CIP); and

WHEREAS, the donation consists of fee property totaling 2.09 acre, temporary construction easement of 0.12 acre, access control, and a pole shed; and

WHEREAS, the donation is legally described as Parcel 1 of Olmsted County Highway Right of Way Plat No. 214.

NOW, THEREFORE, BE IT RESOLVED, that, the Board of Commissioners does hereby accept the donated real property on behalf of Olmsted County for project SAP 055-605-016 (CSAH 5).

BE IT FURTHER RESOLVED, the County Finance Department shall account for the acceptance of these donations.

Approve final payment of contract CT18102 in the amount of $21,444.32 to Construction Collaborative, LLC for the Updates to Building 31 project and adopt the supporting resolution.

Resolution No. 19-48

WHEREAS, the Updates to Building 31 project at Graham Park, contract CT18102, is certified to by the contractor Construction Collaborative LLC; and

WHEREAS, the final work is accepted and certified complete by the Olmsted County Building Superintendent.

NOW, THEREFORE, BE IT RESOLVED, that the Olmsted County Board of Commissioners hereby accept change order 1 and completion of the contract with

Construction Collaborative, contract CT18102, and hereby authorize and direct final payment in the amount of $21,444.32.

Approve the Chairperson and Deputy Clerk to enter into Professional Services Agreement No. 2019007 with SRF Consulting Group, Inc and supporting resolution as follows.

Resolution No. 19-49

WHEREAS, the County, the State of Minnesota (MNDOT) and other local partners are working cooperatively for the corridor analysis/evaluation of US Highway 14 from Kasson to Rochester; and

WHEREAS, Olmsted County will administer the project, but each party will share in the cost; and

WHEREAS, the goal of the US Highway 14 corridor analysis/evaluation is to create a future vision for the corridor that improves safety, manages access, improves freight

movement, manages congestion into the future and encourages economic development; and WHEREAS, the County will retain the services of SRF Consulting Group, Inc. to provide professional and technical expertise for the analysis and design concept

development; and

WHEREAS, Agreement No. 2019007 between Olmsted County and SRF outlines each party's commitment.

NOW, THEREFORE, BE IT RESOLVED, that Olmsted County enters into

Professional Services Agreement No. 2019007 with SRF Consulting Group, Inc., to provide professional and technical expertise for the for the US Highway 14 Corridor

Analysis/Evaluation project.

BE IT FURTHER RESOLVED, that the Vice-Chairperson and Deputy Clerk are authorized to execute the Agreement and any amendments to the Agreement.

Approve the following CREST Purchase of Service Agreements and supporting resolution as follows.

WHEREAS, Olmsted County is fiscal host to the CREST Adult Mental Health Initiative (AMHI) Grant funds, and;

WHEREAS, a portion of these AMHI funds are used for Purchase of Service Agreements for services provided to clients in other counties, and;

WHEREAS, the Olmsted County Board of Commissioners is required to approve and sign the following Agreements effective for Calendar Years 2019 & 2020:

Authorize Public Works to make final payment to Shafer Contracting Company, Inc., to close out Project SAP 055-604-017 and adopt supporting resolutions as follows.

Resolution No. 19-51

WHEREAS, SAP 055-604-017, Grading, Aggregate Base, Storm Sewer, Watermain, Curb and Gutter, and Concrete and Bituminous Surfacing, located on County State Aid Highway (CSAH) 4 between 19th Street NW in Rochester and County Road (CR) 104; and

WHEREAS, the work is certified complete by Shafer Contracting Company, Inc.; and WHEREAS, the final work is accepted and certified complete by Kaye M Bieniek, Director of Public Works/County Engineer.

NOW THEREFORE BE IT RESOLVED, the Olmsted County Commissioners accept completion of SAP 055-604-017, by Shafer Contracting Company Inc., and hereby-direct final payment and contract closeout.

Olmsted County Board of Commissioners is asked to acknowledge the approved listing of 2018 payments from the Olmsted County Finance System as noted in the 2018 Listing of Abstract amounts.

WHEREAS, Olmsted County Finance requests approval of the acknowledgment of payments for 2018; and

WHEREAS, the listing of payments made from the Finance System were approved by the Administrative Committee during 2018; and

WHEREAS, pursuant to Minnesota Statute 375.18, Olmsted County Finance is required to have a record of the approval documented in the County Board Minutes.

NOW, THEREFORE, BE IT RESOLVED, the County Board hereby approves the acknowledgment of payments made from the Olmsted County Finance System and approved by the Administrative Committee in 2018.

Wright moved; Podulke seconded, to Approve the parcels of land described in the list of Tax- Forfeinted Land for public auction and supporting resolution as follows.

Resolution No. 19-52

WHEREAS, notice is hereby given, that the parcels of land listed is Tax-Forfeited Land that shall be sold to the highest bidder at public sale; and

WHEREAS, the sale will be governed by the provisions of Minn. Stat. Section 282.01, and by the resolution of the Olmsted County Board of Commissioners authorizing such sale; and

WHEREAS, these parcels have been appraised by the Olmsted County Assessor’s Office as required by the statute; and

WHEREAS, all parcels have been released by the cities and townships in which they are located for public sale; and

WHEREAS, all parcels of tax-forfeited land listed on the List of Tax Forfeited Land are hereby classified as non-conservation land; and

WHEREAS, the basic sale price of each parcel on the List of Tax Forfeited Land, that is on file with the Olmsted County Property Records Department, be approved and authorization for a public sale of this land be granted, pursuant to Minn. Stat. Section 282.01; and

WHEREAS, the sale will be held at 1:00 PM, Thursday, May 9, 2019 by the Olmsted County Director of Property Records and Licensing in the County Board Room at the Olmsted County Government Center; and

WHEREAS, the sale of any property listed will be sold for no less than the basic sale price, and that payment for all sales shall be consistent with the Payment Terms in the Terms for the Sale of Tax-Forfeited Land Policy; and

WHEREAS, notice of sale shall be published once a week for two consecutive weeks, with the last publication not less than 10 days before the sale of tax-forfeited land by public auction. In addition, notice of sale shall be mailed to all owners of land adjoining each parcel to be sold.

NOW BE IT RESOLVED, that the conditions and terms of the public sale shall be as described in the list contained herein and approved by the Olmsted County Board of Commissioners.
