I conducted a special investigation because the child care licensing division received a complaint against your facility that related to licensing rules or law. The allegations were related to the following:

MCL 722.115p Child care center, group child care home, or family child care home; potential or current child care staff member convicted of crime.

R400.1903(1)(a) Licensee responsibilities. R400.1903(1)(d) Licensee responsibilities. R400.1903(4)(c) Licensee responsibilities. R400.1907(3) Child’s record.

The details of the allegations are in the attached report. To investigate the allegations:  I interviewed: licensee, child care staff members and parents.

 I completed on-site inspections on the following dates: 02/13/2020. As a result of this investigation, I found the following violation(s):

I recommend no change to the current license status.

Due to the violations, you must send us a corrective action plan by 04/10/2020. You can use our corrective action plan form or create your own.

If you need help writing the corrective action plan, please contact me. If you do not send a corrective action plan, you may face disciplinary action. The corrective action plan must include the following:

 How compliance with each rule will be achieved.

 Who is directly responsible for implementing the corrective action for each violation.

 Specific time frames for each violation as to when the correction will be completed or implemented.

 How continuing compliance will be maintained once compliance is achieved.

 The signature of the responsible party and a date.

Arrived approx. 10:45am and departed approx. 11:15am. Interviewed Ms. Crystal Haynes, Mr. Travis Haynes, and Ms. Brittany Kibble-Hasenbank.

ALLEGATION: Ms. Haynes is never at the child care home.

INVESTIGATION: Ms. Haynes indicated that she is at her home daily unless she is

away on vacation. She stated that sometimes she runs errands or may have doctor’s appointment, but other than that she is at her home.

Ms. Hasenback explained that Ms. Haynes is in the child care home working

everyday unless she goes out to complete errands. Ms. Hasenback stated that this only occurs on the days she works with Ms. Taylor.

I interviewed Ms. Haynes’ husband Mr. Travis Haynes and he stated that Ms. Haynes is in the home unless she is out running errands.

Child A and B’s Mother stated that Ms. Haynes is present in the home when her children are dropped off.

Child C’s Mother stated that Ms. Haynes is present when she drops off and picks up her child.

Child D and E’s Mother stated that when she drops her children off Ms. Brittany Hasenbank will come to the door while Ms. Haynes is feeding the other children or

APPLICABLE RULE

R 400.1903 Licensee responsibilities.Responsibilities.

(1) A licensee shall be responsible for all of the following:

(a) When the child care home is in operation, the licensee shall be present in the home on a daily basis and provide direct care and supervision for the majority of time children are in care, except for any of the following circumstances:

(i) Vacation or personal leave, which must not exceed 20 days within a calendar year. The 20 days of vacation or personal leave means the licensee is absent the entire day or at least 51% of the day when the child care home is operating. A licensee may have a short periodic absence from the home.

(ii) Medical treatment and subsequent recovery.

ANALYSIS: Ms. Haynes is in her home on a daily basis and provides direct care and supervision for the majority of the time children are in care.

CONCLUSION: VIOLATION NOT ESTABLISHED

ALLEGATION: Ms. Crystal Haynes does not notify parents she will

not be present at the child care home.

INVESTIGATION: Ms. Haynes explained that when she will be gone on vacation

and her child care staff members will be caring for the children she will notify the parents. She stated that when she is absent from the home for errands or

appointments, she does not notify parents.

Ms. Hasenback stated that she believes Ms. Haynes informs parents when she will be away from the home.

Child A and B’s Mother stated that Ms. Haynes will notify parents when she will be away from the home for long periods of time. She doesn’t inform if she must leave the home for appointments.

Child C’s Mother stated that parents are notified if she will be gone on vacation. They are not typically notified if she is gone on daily appointments or errands. Child D and E’s Mother indicated that Ms. Haynes will notify parents if she will be away on vacation but not for doctors’ appointments or errands.

APPLICABLE RULE

R 400.1903 Licensee responsibilities.Responsibilities.

(1) A licensee shall be responsible for all of the following provisions:

(d) Inform parents when a child care staff member is providing care in the absence of the licensee.

ANALYSIS: Ms. Haynes does not always notify parents when she will be absent and a child care staff member will be providing care in her absence.

CONCLUSION: VIOLATION ESTABLISHED

ALLEGATION: Ms. Crystal Haynes does not keep a sign in and out

log for the child care children.

INVESTIGATION: Ms. Haynes provided me with documentation of her attendance

records of her child care children’s attendance. The records contained dates, first and last name as well as time in and time out.

APPLICABLE RULE

R 400.1907 Child's records.

(3) Dated daily attendance records of children in care must be maintained and include the child's first and last name and the time of arrival and departure. Electronic records may be

used. If electronic records are used, they must be available to the department at the time of the inspection. If electronic attendance records are not available during an on-site inspection, the child care home is in violation of this rule.

ANALYSIS: Ms. Haynes was able to provide daily documentation of child care children attendance.

CONCLUSION: VIOLATION NOT ESTABLISHED

ALLEGATION: The individual that works in the home isn’t allowed

to be watching children and she will falsify paperwork.

INVESTIGATION: On 02/11/2020 I received a complaint regarding the licensed

child care home of Ms. Crystal Haynes. I conducted an unannounced on-site inspection on 02/13/2020. I explained to Ms. Haynes why I was there and read her the allegations in the complaint. Ms. Haynes indicated that both of her child care

staff members completed the comprehensive background check process and deemed eligible to provide for the care and supervision of children prior to them working with her.

I was able to confirm that Ms. Emaleigh Taylor and Ms. Brittany Hasenback both completed the comprehensive background check process and were determined eligible by the department. Ms. Haynes’ Husband also completed the

comprehensive background check process and was determined to be eligible by the department.

Ms. Haynes, her husband Mr. Haynes and child care staff member Ms. Emaleigh Taylor all indicated that they are not aware of any documents that have been falsified. Ms. Taylor explained that Ms. Haynes has never asked her to falsify any records. Mr. Haynes indicated that he is not aware of the documents his wife has to use and wouldn’t know how to falsify them.

APPLICABLE RULE

MCL 722.115p Child care center, group child care home, or family child care home; potential or current child care staff member convicted of crime.

(1) Except as provided in section 5n(14) and (15), a child care center, group child care home, or family child care home shall not allow an individual to be a child care staff member without requesting a criminal history check as required by section 5n. (2) If a criminal history check performed under section 5n or information obtained as a result of notification from the department of state police under section 5k reveals that a potential or current child care staff member has been convicted of a crime as described in section 5r, the department shall notify the child care center, group child care home, or family child care home. The child care center, group child care home, or family child care home shall not allow the individual to be a child care staff member.

ANALYSIS: Ms. Haynes ensured that all adult household members and child care staff members were fingerprinted and determined to be eligible.

APPLICABLE RULE

R 400.1903 Licensee responsibilities.

(4) The licensee shall cooperate with the department in connection with an inspection or investigation, as required in section 10(1) of the act, MCL 722.120(1). Cooperation includes, but is not limited to, all of the following:

(c) Provide accurate and truthful information to the

department, and encourage witnesses to provide accurate and truthful information to the department.

ANALYSIS: There was no evidence found during the interviews that would indicate that Ms. Haynes has not provided accurate and truthful information to the department.

CONCLUSION: VIOLATION NOT ESTABLISHED

IV. RECOMMENDATION

I recommend no change in the current status of the license.
