PRINCIPLES OF USING THE TABLE

1. All Bank’s organisational units and sections charge fees and commissions for ordered services on the basis of the rates specified in the Table. 2. For bank activities performed by the Bank on the basis of agreements with the Customer, commissions/fees other than those specifiedin the

Table may be charged on terms and of the value agreed mutually in such agreements.

3. At a Customer’s request, the Bank may perform activities other than those listed in the Table, however the Bank reserves the right to charge a bank commission or fee.

4. The Bank determines commissions and fees for ordered services in PLN. The Bank charges due commissions and fees in accordance with applicable laws in PLN or convertible currencies by converting PLN rates into a foreign currency at buying/selling rates of exchange applicable at Bank BPH. In the case of Customers of other foreign banks, fees may be determined in foreign currencies.

5. Commissions and fees charged are rounded to one grosz on general terms.

6. All bank fees and commissions are to be paid by the originator of the banking service/transaction unless the parties to a particular service/ transaction agreed otherwise. Commissions and fees not paid by the other party within three months will be charged to the originator of a bank transaction.

7. In the case of orders containing omissions or errors, consequences of delays and changes in foreign exchange rates are borne by the Customer.

8. Irrespective of commissions and fees listed in the accompanying Table, commissions and fees, if any, in favour of banks (domestic and foreign) intermediating in the execution of an instruction are also charged in accordance with separate tables or actually incurred costs.

9. Standard form - a standard form of a deposit receipt/transfer order compliant with the Polish Norm No. PN-F-01101 established by the Polish Committee for Standardisation.

10. Standard transfer - a domestic payment order placed in the form of a paper document using a standard form, booked in the Customer’s account and sent by the Bank for inter-bank clearing on the next business day following the day of placing the order.

11. Urgent transfer - a domestic payment order placed in the form of a paper document, booked in the Holder’s account on the same business day and sent by the Bank for inter-bank clearing not later than on the next business day.

12. In the case of granting a loan as part of a syndicate in which Bank BPH is an arranger or participant - all types and rates of fees and commission are determined by negotiations.

13. In the case of granting a foreign exchange loan from re-lent funds - additional fees resulting from other banks’ costs may arise.

14. The Bank does not purchase or sell, accept deposits into accounts or make withdrawals of a convertible currency in coins nor does it convert convertible currencies in coins into bank notes (and vice versa).

15. The Bank reserves the right to amend the amount of rates of commissions and fees. Such change may occur if at least one of the following conditions is satisfied:

a. change to generally applicable laws that may affect the amount of fees and commissions, b. change in the scope or the form of performing a specific activity,

c. change in fees and commissions applied by competitive banks,

d. change in the price of services used by the Bank at executing individual banking or non-banking activities,

e. change in prices of energy, telecommunications and postal tariffs, inter-bank settlements and other factors influencingthe level of Bank’s fixed costs,

f. change of the consumer price index specified by the Central Statistical Office (GUS), g. change in the foreign exchange rate of the National Bank of Poland (NBP).

16. The table of fees and commission is available in Bank’s branches and on the Bank’s website at: www.bph.pl.

17. The Bank charges fees and commission in the amount applicable on the date of executing a particular banking activity, unless the agreement provides otherwise.
