Sweepstakes Period: The 2014 CMA Awards Chevy Sweepstakes (“Sweepstakes”) begins on 8/5/14 at 12:01 AM Eastern Time (“ET”) and ends on 9/30/14 at 11:59 PM ET (the “Sweepstakes Period”).
Who is Eligible: To enter, you must be a legal resident of the United States or the District of Columbia and be 18 years of age or older or of the age of majority in their state of residence, whichever is older. Employees, officers, directors and agents of Chevrolet Motor Division, General Motors LLC ("Sponsor"), American Hole 'n One ("Administrator"), Jack Morton Worldwide, Country Music Association, Inc. and each of their respective parents, affiliated companies, subsidiaries, distributors, participating dealers, retailers, printers, advertising and promotion agencies and any and all other companies associated with the design or execution of this Sweepstakes (collectively, the “Promotion Parties”), and the members of their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) or households, whether or not related, of any of the above, are not eligible to enter or win. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Instagram.
How to Enter: During the Sweepstakes Period, there are two (2) ways to enter: 1) Instagram Post: You must be a follower of the Official Instagram Accounts of Chevrolet (@Chevrolet) and Country Music Association (@CMA) to be eligible. Log-in to your Instagram account and post a photo on Instagram that best represents what the country music lifestyle means to you and include the hashtag #CHEVYCMASWEEPS (the “Instagram Hashtag”) in your post to receive one (1) entry. Your Instagram account must be set to public, and your Instagram post must include the Instagram Hashtag to be eligible. By using the Instagram Hashtag, you acknowledge and agree that the Sponsor has the right to stream the photo post through the Instagram API and/or stream it online at www.cmaawards.com/chevy.
Sponsor does not guarantee the photo post will be used for either circumstance and may remove a posted photo at any time. Photo entries will not be judged and the photo provided in your Instagram post will not increase or decrease your chances of winning a prize. If you do not have an Instagram account you may sign-up for free by visiting www.instagram.com or downloading the phone application, and following the enrollment instructions. Smartphone Data fees may apply when entering via Instagram. See your wireless service provider for phone capabilities and fees. Entries must be received by 9/30/14 at 11:59 PM ET to be eligible. OR, 2) Mail-In: to participate without using Instagram or posting a photo, hand-print your name, mailing address, email address, daytime and evening numbers (area code included), and date-of-birth, and mail in a stamped, standard #10 envelope, addressed to: 2014 CMA Awards Chevy Sweepstakes, PO Box 2227, Buford, GA 30518. Mail-in entries must be postmarked by 9/30/14 and received by 10/6/14 to be eligible. Limit one (1) entry per person, regardless of method of entry, throughout the Sweepstakes Period. Additional entries submitted from any person or email address in excess of the above stated limitation will be void. Entries generated by script, macro or other automated means and entries by any means which subvert the entry process will be void. Entries that are incomplete or corrupted are void and will not be accepted. Mechanical reproductions and entries generated by any means which subvert the entry process are void. Entries that are forged, tampered with, obtained through illegitimate channels or by any other means that are not compliant with the Official Rules will be void.
INSTAGRAM ENTRY REQUIREMENTS: Instagram entries must be (i) entrant’s original creation, (ii) cannot be previously published or submitted in connection with any other promotion, (iii) be in keeping with the
Sponsor’s image and (iv) may not contain any content that: is irrelevant to the purpose of the Sweepstakes, is sexually explicit or suggestive; violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane, pornographic, contain nudity, and not be offensive or inappropriate, as determined by the Administrator in its sole discretion, promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message; is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted entries; defames, misrepresents or contains disparaging remarks about other people or companies; contains trademarks, logos, or trade dress other than Chevrolet or Country Music Association (such as distinctive packaging or building exteriors/interiors) owned by others, without permission; contains any personal identification, such as personal names or email addresses; nor can it defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights, contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media); contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including without limitation, celebrities and/or other public or private figures, living or dead, without permission; contains look-alikes of celebrities or other public or private figures, living or dead; communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; image cannot depict illegal activity and cannot itself be in violation of any law. If photo is taken by a third party, entrant must have secured all rights and clearance to the photo from the photographer. Administrator reserves the right to void Sweepstakes entries that do not comply with the above entry requirements from Sweepstakes consideration. Noncompliant entries may be removed from the Sweepstakes at Administrator’s sole discretion.
By submitting an Entry, Entrant (or parent/legal guardian of Entrant if Entrant is deemed a minor in his/her state of residence) warrants and represents that: (a) Photo does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other legal or moral rights of any person or entity; (b) Entrant has obtained written permission from a third party whose photograph is being used in the Entry; (c) Entrant owns all rights to the Entry, including without limitation, copyrights, and has received prior written permission from a third party if any Photo was photographed by someone other than the Entrant him/herself; (d) publication of the Entry via various media, including posting on the Websites, will not infringe on any third-party rights; and (e) Entrant will indemnify and hold harmless the Sponsor, General Motors LLC, agents and assigns from any claims and damages (including reasonable attorneys' fees) arising from or relating to the breach or alleged breach of your representations and warranties herein, the Entry, or Entrants conduct in creating the Entry, the acceptance or use of any prize or otherwise in connection with this Sweepstakes.
By submitting an Entry, Entrant warrants and represents that he/she and any other persons appearing or who are otherwise identifiable in the Photo consents to the Entry and the use of the Entry. By
participating, Entrant grants Sponsor permission to use his/her name, hometown, photograph or image for future advertising and publicity purposes in any and all media without additional compensation, notification or permission. Sponsor reserves the right in their sole and absolute discretion to alter, change or modify any Entry. By submitting an Entry, Entrant warrants and represents that he/she and any other persons appearing or who are otherwise identifiable in the Photo consents the use of the Entry. Entries made by any other individual or entity that is not the person named on the submitted Entry or made in any manner inconsistent with these Official Rules will be declared invalid and disqualified from this Sweepstakes.
CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY APPLICATION OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL
AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Promotion Parties are not responsible for: (i) electronic transmissions or entries or Instagram posts that are lost, late, stolen, incomplete, inaccurate, damaged, garbled, misdirected, undelivered, delayed, or not received by the Promotion Parties or their respective agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries or Instagram posts, or for destruction of or unauthorized access to, or alteration of, entries, (iii) failed, interrupted or unavailable hardware, network, software, cable, satellite, Internet Service Provider (ISP), or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes, (iv) any other mechanical, technical, printing, typographical, human, or other errors or malfunctions or technical failure, jumbled, scrambled, delayed, or misdirected transmissions relating to or in connection with the Sweepstakes, including, without limitation, errors or malfunctions which may occur in connection with the administration of the Sweepstakes, the processing of entries or Instagram posts, the announcement of the prize, or in any Sweepstakes-related materials, or (v) any entries or Instagram posts submitted in a manner that is not expressly allowed under these Official Rules and all such entries will be void. Sponsor reserves the right to cancel, modify or terminate the Sweepstakes in the event that fraud, misconduct, technical failures or other causes destroy or threaten the integrity of the Sweepstakes, in the opinion of the Sponsor/Administrator, or if a computer virus, bug, worm, tampering, unauthorized intervention, or other technical problem or other cause corrupts the administration, security, or proper conduct of the Sweepstakes as determined by Sponsor/Administrator, in their sole discretion. In the event of early termination, the Sponsor reserves the right to conduct a random drawing for the Grand Prize from among all eligible, non-suspect entries received up to time of such impairment. In the event a dispute as to an entry submitted by multiple users having the same Instagram account, an entry will be deemed made by the authorized account holder of the Instagram account used to submit the applicable Sweepstakes post, and such person will be required to meet the eligibility requirements of these Official Rules. "Authorized account holder" means the natural person who was assigned the applicable Instagram account by Instagram. Potential winner may be requested to provide proof (to the Promotion Parties’ satisfaction) that they are the authorized account holder. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor.
Winner Selection & Notification: One (1) potential Grand Prize winner will be selected in a random drawing held on or about 10/7/14 from all eligible entries received and combined during the Sweepstakes Period. Odds of winning depend on the number of eligible entries received. Potential winner will be contacted by Administrator in one of the following ways: 1) Posting a comment on the potential winners’ Instagram post, which will include Sponsor’s or Administrator’s return contact details within the comment and will be required to respond as instructed within twenty-four (24) hours of issuance of notification and provide their contact information. 2) Via Instagram Direct Message and will be required to respond as instructed via Direct Message within twenty-four (24) hours of issuance of notification and provide their contact information, or 3) via phone call at the daytime phone number provided on such potential winners’ mail-in entry. Potential winner is subject to eligibility verification and compliance with these Official Rules. Potential winner will be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within five (5) days of date of issuance of initial notification. If any prize notification, direct message, post and/or letter is returned as undeliverable, the potential winner cannot be contacted within a reasonable time period, does not reply to correspondence within the required timeframe, fails to comply with verification process and/or eligibility requirements, documents are not returned within the specified time period, or potential winner is not in compliance with these Official Rules, he/she will be disqualified and an alternate winner may be selected at Administrator’s sole discretion. In the event of a dispute as to the identity of the entrant, entrant will be deemed the primary account holder with the Instagram account used to
enter. Proof to Sponsor satisfaction of being the primary account holder may be required by Sponsor or Administrator.
Grand Prize (1): A trip for four (4) (winner and up to three (3) guests) to the 2014 CMA Awards scheduled to take place on November 5, 2014 in Nashville, TN. Trip includes round-trip coach class air transportation for winner and up to three (3) guests from a major U.S. gateway airport nearest winner’s residence to Nashville, TN, two (2) nights’ hotel accommodations (two (2) rooms, double occupancy), and up to four (4) tickets to the 2014 CMA Awards. Approximate Retail Value (“ARV”) of Grand Prize trip: $6,400. Any difference between stated value and actual value will not be awarded. Travel must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Winner and guest(s) must travel together on the same itinerary, and must travel on the dates specified by Administrator or prize will be forfeited and Sponsor will have no further obligation to such winner. Guest(s) must be of legal age of majority in his/her jurisdiction of residence (and at least 18), unless the child or legal ward of winner and must sign a liability/publicity release prior to issuance of travel documents. If guests are child or legal ward of winner, winner must sign and return release on behalf of such child or legal ward.
General Prize Conditions: All costs and expenses related to prize acceptance and use not specified herein as being awarded, including, but not limited to income, federal, state and local taxes, any ground transportation, luggage fees, hotel incidentals, meals, beverages, souvenirs, and gratuities are the sole responsibility of the winner. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Administrator. Tickets are subject to terms and conditions specified thereon. Exact seat locations to be determined by Sponsor, in its sole discretion. If the event is postponed and rescheduled, prize will be rescheduled around the date of the rescheduled event. If the event is postponed and not rescheduled or otherwise cancelled, no compensation or substitution will be provided for such portion of prize and Sponsor will have no further obligation to such winner. Winner and guest(s) agree to comply with all event and venue rules and regulations and, in accordance therewith, agree not to act in an unsportsmanlike or disruptive manner, or with any intent to annoy, abuse, threaten or harass any other person at the event. Failure to do so may result in forfeiture of such portion of the prize and removal from event. Prize is non-transferable and no cash redemption or prize substitution allowed, except at Administrator’s sole discretion. Administrator reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion. Winner will be issued an IRS Form 1099 reflecting the actual value of the prize. All prize details are at Administrator’s discretion.
License/Use Of Instagram Entries: By participating via Instagram, and to the extent allowed by law, you grant the Released Parties a perpetual, worldwide, royalty-free, non-exclusive, sub licensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse your entry, name, post, photo, and biographical material including, but not limited to, all materials submitted in connection with the Sweepstakes in any and all media, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to entrant or any third party.
Additional Rules & Restrictions: By participating in this Sweepstakes, entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor and the Administrator, which shall be final and binding in all matters relating to this Sweepstakes. In the event winner is found to be in violation of any of these Official Rules, he/she will be required to forfeit the awarded prize or to reimburse the Sponsor for the stated value of such prize if such violation is found after the prize has been used by winner. Acceptance of a prize constitutes permission for Sponsor and its designees to use winner’s name, city and state of residence and/or likeness for purposes of advertising and trade in any and all media now or hereafter known worldwide in perpetuity, without limitation or further compensation, notification or permission, unless prohibited by law. By participating, each entrant further agrees to release and hold Promotion Parties harmless from and against any and all claims, damages and liability of any kind arising from or in connection with, in whole or in part, directly or indirectly, the acceptance, possession or
use/misuse of a prize (including any travel/activity related thereto), participation in the Sweepstakes or in any prize-related activities and entrants assume all liability in connection therewith.
Arbitration: Except where prohibited by law, as a condition of participating in this Sweepstakes, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Michigan, USA
